• Alternative Dispute Resolution/Corporate Practice Th

(Joint Meeting) Resolving IP Related Disputes - There Is More Than Just One Way to Skin A Cat: Cost Effective Alternatives to Litigating IP Disputes

Corporate counsel is constantly confronted with handling disputes about intellectual property. Disputes may range from oral exchanges, to written exchanges, to formal papers filed with adjudicatory tribunals. Although each dispute deserves attention and requires resources to resolve, not all can receive the same level of attention and resources, particularly in these economically stressed times. Through generalized examples the presenters will provide practical ideas for using and customizing ADR for creatively resolving domestic and international IP disputes in comparison to litigated alternatives.

• American Intellectual Property Law Education Foundation (AIPLEF) (Committee Members Only) W

• Amicus (Committee Members Only) W

• Anti-Counterfeiting & Anti-Piracy WThe committee addresses legislative, judicial, and enforcement issues relating to the counterfeiting of trademarks and piracy of copyrighted works. The committee coordinates its efforts with other organizations to strengthen the IP communities’ voice in strengthening US laws and regulations in an effort to combat counterfeiting and piracy. The following four Sub-Committees work toward these goals: (1) Enforcement: headed by Sherri Schornstein this group will, inter alia, coordinate AIPLA’s anti-counterfeiting efforts with those of other entities and organizations such as the US Department of Justice, the International Anti-Counterfeiting Coalition, and the United States Chambers of Commerce and will also establish a “toolkit” for corporate members to assist companies in developing comprehensive programs to counter counterfeiting and piracy. (2) Programming and Education: Kieran Doyle heads this Sub-Committee which will work with the programming committees to develop content for upcoming meetings and online programming on various topics relating to anti-counterfeiting and anti-piracy. (3) Legislation and Treaties: Jeffrey Kaufman heads this Sub-Committee which will continue to monitor and report on legislative and Executive Branch activity including the Anti-Counterfeiting Trade Agreement (ACTA). It is anticipated that the Administration, through the office of the Trade Representative, will continue to work with other countries to ACTA. (4) Decisional Law: headed by Brett August, this Sub-Committee will track relevant anti-counterfeiting and anti-piracy case law and regularly update our members on these cases and their holdings.

At the beginning of 2009, Amy Cahill was appointed as the Committee’s liaison to the Amicus Committee. The Committee invites your participation as we pursue our goals and develop additional programming and materials.

• Antitrust Law/Electronic & Computer Law/Licensing & Management of IP Assets/Patent Litigation (Joint Committee Educational Session) WFor the Committee Educational Session description, please see pages 11-12.

• Biotechnology/Chemical Practice (Joint Meeting)Th

Role of Scientific Evidence and Scientific Experts in Litigation &Optimizing Patent Term versus Patent Claim Scope

One half of the meeting will discuss the ins and outs of reconstructing prior art examples and the use of reconstructed example as evidence in litigation. This will include discussion from a seasoned scientist, Dr. Leonard J. Chyall of Aptuit Consulting, who has previously acted as a scientific expert reproducing examples and testifying in numerous litigations. Strategy and other issues that arise during litigation and interferences will also be discussed from the perspective of a life sciences patent litigator.

The other half of the meeting will focus on optimizing patent term given

patent term adjustment, patent term extension, terminal disclaimers, and how to best avoid causes for delay in the US and abroad. Strategies and metrics for maximizing term extension will be discussed. Patent scope will be considered in view of the total effective patent term and speakers will discuss how large pharma assesses value to broad claim scope versus narrow claim scope when coming in as a purchaser of technology and where small biopharma could make their portfolios more attractive for purchase.

• Copyright Law/Trademark Internet/Trademark Law/Trademark Litigation/Trademark-Relations with the USPTO/Trademark Treaties & International Law (Joint Meeting)Th

This will be a working committee meeting where we will review and discuss several of our current initiatives in the area of trademark and copyright law, including internet-related issues. The above-referenced committees will lead short discussions in the following areas: (1) Proposed Legislation; (2) The Madrid Protocol - Is it Working?; (3) An Update on ICANN; (4) Trademarks in Asia; (5) Pending Copyright Legislation and the Reed Elsevier Case; (6) Trademark Public Education Initiative; (7) Future Trademark Program Planning and the Trademark Bootcamp. If you are interested in any of the above programs or would simply like to become more involved in any of these committees, please join us.

Attend Wednesday afternoon’s concurrent track one to learn about best practices in taking and defending depositions and then attend our joint meeting for an opportunity to practice your skills. Participants will have an opportunity to take and defend mock depositions and to obtain valuable feedback from experienced litigators.

• Emerging Technologies/International & Foreign Law Th

(Joint Meeting) We will address emerging technologies across the world. Speakers from China, Europe, India, Japan, Latin America and the US will discuss emerging technologies and the laws governing them, particularly as the technologies and the laws evolve. The speakers individually and in panel format will discuss these and other topics in this fast-developing area. A technologist in emerging technologies is also expected to address the committee members on recent technological advances.

• Interference/Patent Law (Joint Meeting)WFor the first part of the meeting, we have invited a USPTO Official to provide a State of the Board of Patent Appeals and Interferences presentation. For the second half of the meeting, we will hold a town hall forum to discuss improving the inter partes re-examination process. This portion of the meeting will begin with Herb Hart of McAndrews Held & Malloy and Gene Rzucidlo of Hunton & Williams reporting on the discussion at the ABA-IPL Committee 104 – Patent Inter Partes Proceedings Roundtable. Members of the joint subcommittee on inter partes re-examination will also present some specific ideas and proposals for improving the inter partes re-examination process. Topics for discussion will include questions such as where should jurisdiction for re-examination lie, what level of decision-maker is appropriate to pre-order practice, what standard should be used for deciding whether to initiate a proceeding, what is the best time table for a proceeding, what are the best practices/rules for expediting proceedings, and how appeals can be stream-lined or expedited. With patent law reform back on the legislative agenda, there is a great deal of debate surrounding inter partes proceedings and the proposed post-grant review procedures. We expect this discussion will be lively and very relevant to all patent practitioners, and we welcome everyone’s participation.

• International Education - Will Not Meet

• International & Foreign Law/Emerging Technologies Th (Joint Meeting) For the Commitee Meeting description, please see Emerging Technologies.

• International Trade Commission WThe committee is hoping to make a presentation at the 2009 Annual Meeting that will include commentary from sitting and former ITC Administrative Law Judges. If the program is adopted, it will be subject to discussion at the Spring Meeting. The committee welcomes suggestions from members and from other committees on integrating this ITC content into a larger program.

The committee is in the process of developing draft legislation for Board consideration to amend Section 337 to undo the results of the Kyocera decision, and the committee will have concluded a vote on this issue before the Spring Meeting. As currently drafted, the proposed legislation would provide downstream authority to the Commission in limited exclusion order cases upon application of the EPROMs factors. The draft will be discussed at the Spring Meeting.

The committee will also discuss implementing regular updates to its website with the assistance of members from the Young Lawyers Committee, reporting on new investigations and decisions at the ITC.

The Committee’s Sub-Committee on Procedural Innovation will discuss the White Paper drafted by the Sub-Committee. In the White Paper, the committee proposes submitting comments to the ITC, for consideration by both the Commission and the Administrative Law Judges, in order to provide useful information and suggestions regarding possible new procedures and policies to assist with the Commission’s increasing caseload of Section 337 investigations. For instance, the committee might propose that the Commission consider providing the ALJs with additional legal support and providing a forum in which suggestions, such as those offered by the committee, can be considered. In addition, several US District Courts, including the Northern District of California and the Eastern District of Texas, have issued local rules specifically designed to manage patent cases more efficiently. The committee is considering proposing that the ALJs may wish to experiment with implementing some of these best practices from the District Courts.

The committee hopes to continue to attract participants for its activities and to provide useful materials and programs for the membership of AIPLA.

The committee’s main focus this year is the preparation and the distribution of the results of the 2009 AIPLA Report on the Economic Survey. The preliminary draft of the 2009 Report will have been forwarded to the LPMC and AIPLA for review prior to the Spring Meeting. We will discuss making survey data from the 2009 Report available online and more specifically, what data to make available and in what format. We will also discuss any other outstanding issues associated with the preparation of the final draft of the Report for 2009 before it is sent to the printers.

We also intend on holding presentations and panel discussions at future meetings. We will discuss potential topics, and will also explore joint programs with other AIPLA Committees.

• Law Students WThe committee will be having a discussion-based meeting with other student members of AIPLA. The committee will discuss ideas for getting a student mentor program off the ground, the effectiveness and efficiency of our Law School Rep program, and discussing plans for facilitating student attendance at the next Annual Meeting (carpooling for travel, hosting, and hotel room sharing).

• Licensing & Management of IP Assets/Antitrust Law/Electronic & Computer Law/Patent Litigation (Joint Committee Educational

Solo/Small Firm Practitioner Networking ReceptionSponsored by: Jamison IP Services

We will have a five-minute business meeting. Immediately following the business meeting we will have a one-hour reception.

• Mentoring WWe will focus on preparations for the Board-approved Mentor of the Year Award, which will be handed out at the 2009 Annual Meeting. These discussions will include work on an expanded evaluations process and a decision regarding participation timing cut-offs. We also will continue discussions regarding the improvement of the committee’s webpage and the ongoing recruitment of mentors.

• Online Programs WThe committee will be reporting the results of completed online programs as well as developing and finalizing online programs for 2009 through its vendor, KRM. Ways in which the committee can perform lower cost programs in conjunction with other committees throughout vendor Citrix will be explored. The committee appreciates the recent volunteers for coordinating programs and is actively seeking additional program

• Patent Agents/Patent-Relations with the USPTO (Joint Meeting)WA USPTO Official has been invited to speak on Patent Operations, including updates on filings and fee revenues, and statistics on pre-appeal and appeal conferences. The joint session will discuss the Wyeth decision, current updates and statistics from the USPTO, including patent filings and revenues and statistics from the pre-appeal and appeal conferences and the new patent agent Sub-Committees.

• Patent Cooperation Treaty Issues WWe will continue the planning of the Patent Cooperation Treaty Seminars scheduled for Washington, DC (July 16-17). Committee members will also share their experiences with the new Supplemental International Search capability of PCT, and their experiences with the various International Searching Authorities including Korea and Australia.

The committee will continue its efforts to improve speaker and content quality and further develop topic and speaker suggestion intake methodology. The committee will endeavor during the upcoming year to increase participation by committee members, and to involve new members.

The committee is meeting to continue developing and refining its mission of communicating a message to the public about the long term benefits of patents, trademarks, copyrights and other intellectual property. We have already started implementing initiatives in supporting and encouraging patent education by our members and others in primary and secondary schools, and in monitoring and positively influencing discussions of patents and IP on the internet. We are also gathering and developing stories and data to use in educating and responding to the press and to the public, in general, at all ages. These efforts are being supported through multiple channels, ranging from coordination within the AIPLA and its various committees, groups, and resources, to expanding interactions with PTO representatives, e.g., for the University Outreach program, the InventNow program for younger children, and the National Inventor’s Hall of Fame, as well as contacting the Copyright Society for insight into their anti-piracy message. We welcome anyone interested in actively participating in any way to one of these initiatives, or other areas, as we move forward. Lend a hand; be heard! We hope you will join us in this multi-faceted effort, and we look forward to seeing you at our committee meeting this Spring, or contact us whenever you have a moment.

Your adventure begins as you take a scenic drive through popular spots of San Diego. You will drive thru Coronado Island, learning fun facts of the locals and the history of the island. Then on to Balboa Park, which is considered one of the most beautiful, diversified, and culturally enriching parks in North America. Balboa Park is also home of the famous San Diego Zoo. You’ll travel through San Diego’s historic Gaslamp Quarter, a dining, entertainment and urban shopping district. Finally, the drive will end as you pass through the quaint Seaport Village. Next, you will enjoy an audio tour of the USS Midway aircraft carrier. The Midway has been converted into a multi-dimensional, interactive, educational and entertainment complex, attracting visitors and residents alike as one of the only museums of its kind on the west coast. Over the course of 27 years, she was the home to more than 200,000 Americans. She is making her final tour of duty in San Diego to pay tribute to the contributions of the armed services and as a beacon of education and entertainment. Highlights include carrier aircraft on display, a below-deck theater, interactive exhibits, touring and permanent exhibits, tours through selected portions of the ship and research/historical memorabilia centers and displays. Another popular attraction is the flight simulator exhibits which guests can enjoy for a small fee. Fly, spin, and shoot down enemies as you feel the G’s just like a real pilot! Today, you will explore the beauty of La Jolla – You will start the morning at the ‘Cave Store’; here you can purchase fun souvenirs that are unique to La Jolla and the caves. Then take a special walk down and thru the caves below. Over 100 years old, this is one of the most historic attractions to visit while in beautiful La Jolla and is the only La Jolla Sea Cave that is accessible by land. Following the cave walk, your seaside adventure will start at a scenic lookout point with a naturalist from the Scripps Institution of Oceanography. Breathe the healthy salt air and enjoy nature as our marine biology expert lovingly details the history of La Jolla, complete with anecdotes, and provides information on the many birds, plants, and geologic formations along the beach walk.

Along the way, you might also have a chance to view some of La Jolla’s furriest locals – seals! These endearing mammals are dotted along the coastline, especially near the Children’s Pool, a shallow tide-pool popular with the locals that the seals have claimed as their own.

After the tour, you will have the opportunity to visit some of Prospect Street’s famous art galleries. The galleries showcase various artists, both locally and worldwide. You will also have a chance to shop along the boutique filled streets, and admire the gorgeous cliff views. The town is an exquisite combination of a southern European resort atmosphere and Southern California fun, making it one of San Diego’s most popular places to visit!

1. HOTEL CUTOFF: The cutoff date for making reservations at the hotel is April 20, 2009! It is important to make your hotel reservations early. See page 18 for important rate and contact information.

2.EARLY BIRD REGISTRATION DISCOUNT: Registrations received by April 27, 2009 will receive a $100 early bird discount. All registrations must be accompanied by payment.

3.PARTICIPATION LIST: To be included on the participation list, registration must be received by May 4, 2009. Confirmation will be sent to all who register by May 4, 2009. If we do not receive your

registration form and fees by May 4, 2009, YOU RUN THE RISK OF HAVING TO REGISTER AGAIN ON-SITE.

4. REGISTERING ON-SITE: On-site registrations will be accepted, however, please be prepared to pay with a check, cash, or credit card. We DO NOT invoice for any fees.

5. PURCHASING EVENT TICKETS ON-SITE: Events sometimes sell out in advance of the meeting. Event tickets on-site are sold on an “as available” basis. Tickets will be collected at all food functions

and the spouse/guest tours.

6. Spouses or guests accompanying a registrant to social functions are not required to pay a registration fee. Spouses/guests do pay for event tickets and the tours.

7. Attendees must register for the meeting if they wish to register for or attend social events. Badges are required at all meetings and social events.
