1.2 EARNEST MONEY :

1.2.1 Earnest money of Rs. 3,81,000/- to be deposited along with the tender in

favour of Commissioner, Ahmednagar Municipal Corporation.

1.2.2 Tender of those who do not deposit earnest money as above acceptable

forms shall be summarily rejected.

1.3 THE AMOUNT OF EARNEST MONEY :

The amount of earnest money will be refunded to the unsuccessfully tenderer on

deciding about the acceptance of otherwise of the tender or on expiry of the validity

period whichever is earlier. In case of the successful tenderer, it will be refunded on his

paying the initial security deposit and completing the tender documents or will be

transferred toward a part of security deposit to be paid after awarding of the work, if

successful tenderer does not pay the security deposit in the prescribed time limit and

complete the agreement bond, his earnest money deposit will be forfeited to The

Ahmednagar Municipal Corporation.

While submitting the tender, the tenderer shall submit the documents in three

sealed envelopes as below:

1.4 ENVELOPE NO.1 :

The first Envelope marked as Envelope No.1 shall contain the following

documents:

i) A list of documents accompanying in Envelope No.1.

ii) Cash receipt of EMD Ahmednagar Municipal Corporation or Demand

Draft of any Nationalize or Schedule Bank for the amount of earnest

money.

iii) Certificate Valid on the date of submission of tender as a Registered

Contractor with the Government of Maharashtra PWD Department in

appropriate category.

iv) List of Machinery and plant immediately available with the tenderer for

use on this work.

v) List of Technical & Non-Technical Persons employed by contractor with

their Name & Designation & Qualification.

vi) Statement of works in hand with cost of remaining part of each work.

1.5 ENVELOPE NO.2 :

i) The second envelope clearly marked as Envelope No.2 shall contain only

the main tender documents mentioning the cost of offer of the tender.

ii) Covering letter for the offer for the rates quoted above / below.

iii) The Contractor should note this procedure carefully. He should quote his

percentage in words and figure on Page No.11 of the printed tender form.

Tender document to be submitted only in Envelope No.2. He should not

quote this basic cost offer anywhere directly or indirectly on Envelope

No.1 or 3, if any such mention is made, the tender will become invalid and

will not be considered, the contractor shall quote for the work as per

department design only.

1.5.1 Content of Bidding Documents :

The set of bidding documents comprises the documents listed as the below

and Agendum issued in accordance with Clause 8.

i) Invitation for Bids.

ii) Instruction to Bidders.

iii) Forms of Bid and Qualification Information.

iv) Specifications.

v) Drawings.

vi) Bill of Quantities.

1.5.2 Amendment of Bidding Documents.

Before the deadline for submission of bids, the Employer may modify the

bidding documents by issuing agenda.

1.5.3 Any agendum thus issued shall be part of the bidding documents and shall

be communicated in writing or by cable to all the purchasers of the bidding

documents. Prospective bidders shall acknowledge receipt of each

agendum by cable to the Employer.

1.5.4 All duties, taxes & other levies payable by the contractor under the contract,

or for any other cause shall be included in the rates, prices and total Bid

Price submitted by the Bidder.

1.5.5 Bid Validity

Bids shall remain valid for a period not less than one twenty days after the

deadline date for bid submission.

1.5.6 In exceptional circumstances, prior to expirty of the bid validity time limit, the

Employer may request that the bidders may extend the period of validity for

a specified additional period. The request and the bidders’ responses shall

be made in writing or by cable. A bidder may refuse the request without

forfeiting his bid security. A bidder agreeing to the request will not be

required or permitted to modify his bid, but will be required to extend the

validity of his bid security for a period of the extension, and in compliance

with Clause 14 in all respects.

1.5.7 The tender documents shall be signed by a person duly authorized (who can

produce the authority letter anytime when demanded) to sign on behalf of

the Bidder. All pages of the bid where entries or amendments have been

made shall be initiated by the person or persons signing the bid.

1.6 OPENING OF TENDERS :

On the date specified in the tender notice following procedure will be adopted for

opening of the tenders.

ENVELOPE NO.1 : (Technical Bid)

First of all Envelope No.1 of all the tenders will be opened to verify its content as

per requirements. If the various documents contained in this envelope do not meet the

requirements of the Department, a note will be recorded accordingly by the tendering

opening authority and the said tender’s Envelope No.2 will not be considered for

opening.

ENVELOPE NO.2 : (Commercial Bid)

This Envelope shall be opened after opening Envelope No.1 only, if the contents

of Envelope No.1 are found to be acceptable to the department, and there are not

assumptions, presumption or any conditions from any of the contractor.

In case the various assumptions, conditions, deviations and additional

stipulations incorporated by the completions tenders in Envelope No.1 will be scrutinized

by the Department and a common set of deviations from the original conditions

incorporated in the tender and the additional stipulations as may be considered as

acceptable to the department will be formulated and all the concerning renderers will be

informed accordingly. The effect of this change in terms of money shall be submitted by

the tenders in terms of percentage above or below.

Note : The Contractor should quote his percentage below or above both in words and in

figure in printed B – 1 form only. No alteration in the form of quotation and in the

schedule of quantities and no change in special stipulated time will be permitted.

Tenderers which do not fulfill all or any of the above conditions or incomplete in any

respect are liable to summary rejections.

1.7 Instruction to bidder

Validity & Rejection

It will be obligatory for the tenders to keep the offer of their quotation valid for the period

of 120 days from the last date assigned for submission of tender.

1.7.1 A Competent Authority however reserves the right to reject any or all the

tenders without assigning any reasons what so ever.

1.7.2 Canvassing in connection with tender in any form tenders, the tender liable

for rejection.

1.7.3 The tenderers are invited on the Department design only.

1.7.4 The tenderers if firm or company shall in their forwarding letter mention the

names of the partners of the firms of the company (as the case may be and

the name of the partner who holds the power of attorney if any authorizing

him to conduct transaction on behalf of the body).

1.8 The tenderer whose tender is accepted will have to pay the labours engaged on

the work the wages as per minimum wages Act 1948 applied to the Zone in

which the work lies and act accordingly.

1.9 The contractor shall comply with the provisions of the payment of wages Act

1936, minimum wages Act 1948, Employees liability Act 1947 and the maternity

benefit Act 1961, the Contract labour (resolution and Abolition) Act 1970 are any

modification there of or any or low relation there to the rules made there under

from time to time.

1.10 The contractor whose tender is accepted is required to note that no foreign

exchange will be released by the Department.

1.11 INSPECTION OF WORKS :

The contractor shall himself supervise the execution of the works and shall

appoint the competent Civil Engineer, approved by the PMC & Engineer-in-

charge to Act on his behalf.

Resident Engineer

The Contractor shall keep on the work at all times during its progress a

competent Resident Engineer to the satisfaction of AMC & PMC, who shall not

be replaced without Thirty (30) days written notice to the Engineer except under

extra ordinary circumstances. The Resident Engineer shall be the Contractor’s

representative site and shall have authority to act on behalf of the contractor. All

communications, instructions and directions given to the agent shall be bindings

as if given Contractor by the Engineer not otherwise required to be in writing will

be given or confirmed in writing upon request of the Contractor. The age of the

resident engineer should be less than 40 years. Order given to the contractor’s

agent, shall be considered to have the force as if these had been given to the

contractor himself, if the contractor fails to appoint a suitable agent as directed

by the Engineer-in-charge, shall have full powers to suspend the execution of

the work until such date a suitable agent is appointed and the contractor shall be

responsible for the so caused to the works and contractor shall not be entitled

for any compensation on his behalf.

1.12 The tender notice form is a part of the contract agreement.

1.13 The contractor will have to sign the original copy of tender papers and the

drawings. The work is to be carried out according to Working Drawings release

at the time of Construction. The contractor shall also have to give declarations to

the effect that he has full studied the plans, specifications, local conditions,

availability of labour and materials and that he has quoted his rated with

considerations of all these factors.

1.14 Right is reserved to revise of demand the contract documents period to the date

notified or the receipt of tender or extend the date. Such deviations,

amendments or extensions, if any shall be communicated in the form of

corrigendum of by a letter as may be considered suitable.

1.15 SECURITY DEPOSIT :

1.15.1 There shall be no liability on the Department to pay any interest on the

Security deposited by or recovered from the contractor.

1.15.2 All compensation or other some payable by the contractor under the

terms of this contract or any other contracts or account may be

deducted from his Security Deposit or from any sums which may be

due to him or may become due to him by the Ahmednagar Municipal

Corporation on any account and in the event of the Security being

reduced by reason of any such above noted deductions the contractor

shall within ten days of receipt of notice of demand from the Municipal

Engineer make good the deficit.

1.16 RETURNS OF SECURITY DEPOSITS :

The security deposit will be refunded after completion of the defect liability

period prescribed for this contract & as per the provision of Municipal account

code.

The Bid Security may be forfeited :

a) if the Bidder withdraws the Bid after Bid opening during the period of Bid

validity.

b) if the Bidder does not accept the correction of the Bid Price or

c) In the case of a successful Bidder, if the Bidder fails within the specified

time limit to

• Sign the Agreement; or

• Furnish the required Performance Security.

1.17 SITE VISIT

The Bidder, the Bidder’s own responsibility and risk is encouraged to visit and

examine the Site of Works and its surroundings and obtain all information that

may be necessary for preparing the Bid and entering into a contract for

construction of the Works. The costs of visiting the Site shall be at the Bidder’s

own expense.

(2) I / We agree that the offer shall remain open for acceptance for a minimum period of

period mentioned above or (2) sign and complete the contract documents and furnish

the security deposit as specified in item (d) of the Memorandum contained in paragraph

1 above within the time limit laid down in clause (i) of annexed General condition of

as the same may extend in terms of the said bond and in the event of the deficiency out

Security Deposit :

Clause 1 : The security deposit lodged by a contractor shall be refunded after the expiry

of six months from the date on which the final bill is paid, or after expiry of the date up to

which the contractor has agreed to maintain the work in good order whichever is later.

Compensation for Delay :

Clause 2 : The time allowed for carrying out the work as entered the tender shall be

strictly observed by the contractor and shall be reckoned from the date on which the

order to commence work is given to the contractor.

The work shall through the stipulated period of the contract be proceeds within with all

due diligence (time being deemed to be the essence of the contract on the part of the

contractor) and the contractor shall pay as compensation an amount equal to one

percent or such smaller amount as the Executive Engineer (Whose decision in writing

shall be final) may decide, of the amount of the estimated cost of the whole work as

shown by the tender for every day that the work remain uncommenced or unfinished

after the proper dates. And further to ensure good progress during execution of the work

the contractor shall be bound in all cases in which the time allowed for any work exceeds

one month to complete.

estimated cost of the whole work for everyday that due quantity of work remains

incomplete provided always that the amount compensation to be paid under the

provisions of this clause shall not exceed 10 percent of the estimated cost of the work as

shown in tender.

Action when whole of security deposits forfeited

Clause 3 : In any case in which under any clause or clauses of this contractor shall have

rendered himself liable to pay compensation amounting to the whole of his security

deposit (whether paid in sone sum of deducted by installments) or in the case of

abandonment of the owing to serious illness or any other cause, the Commissioner on

behalf of the Ahmednagar Municipal Corporation, shall have power to adopt any of the

following courses as he may deem best suited to the interest of Ahmednagar Municipal

Corporation.

(a) To rescind the contract (for which rescission notice in writing to the contractor

under the hand of Executive Engineer, Ahmednagar Municipal Corporation shall

be conclusive evidence) and in the case the security deposit of the contractor

shall stand forfeited and be absolutely at the disposal of Ahmednagar Municipal

Corporation.

(b) To carry out work or any part of the work departmentally debiting the contractor

with the cost of the work expenditure incurred on tools and plant and charges on

additional supervisory staff including the cost of work charged establishment

employed for getting unexecuted part of the work completed and crediting him

with the value of the work departmentally in all respects in the same manner & at

the same rates as if it had been carried out by the contractor under the terms of

his contract. The certificate of the Executive Engineer as to the costs and other

allied expenses so incurred and as to the work so departmentally shall be final

and conclusive against.

(c) To order that the work of the contractor be measured up the to take such part

there of as shall be unexecuted, out of his hands to give it to another contractor

to complete, in which case all expenses incurred on advertisement for fixing a

new contracting agency additional supervisory staff including the cost of work –

charged and the cost of work executed by the new contract agency will be

debited to the contractor and the work done or executed through the new

contractor shall be credited to the contractor in all respects and in the same

manner and at the same rates as if it had been carried on by the contractor under

the terms of his contract. The certificate of the Executive Engineer Ahmednagar

Municipal Corporation all cost of the work and other expenses incurred as afore –

said for or in getting the unexecuted work done shall be final and the conclusive

against the contractor.

In case contract shall be rescinded under clause (a) above the contractor shall

not be entitled to recover or be paid, any sum for any work therefore actually

performed by him under this contract unless and until the Executive Engineer

shall have certified in writing the performance of such work and the amount

payable to him in respect there of the her shall only be entitled to be paid the

amount so certified in the event of either of the courses referred to in clause (b)

or (c) being adopted and the cost of the work executed departmentally or through

a new contractor and other allied expenses exceeding the value of such work

credited to the contractors the amount of excess shall be deducted from and

money due to the contractor by Ahmednagar Municipal Corporation under the

contract or otherwise howsoever or form his security deposit or the sale proceeds

there of provided however that the contract shall have on claim against

Ahmednagar Municipal Corporation even if the certified valued of work done

departmentally of through a new contract exceeds the certified value of work

done departmentally of through a new contract exceeds the certified cost of such

work and allied expenses provided always that whichever or the three courses

mentioned in clauses (a) (b) or (c) is adopted by the Dy. Engineer the contractor

shall no claim to compensation for any loss sustained by him by reason of his

having purchased, or purchased any material or procured in to any engagements

or made any advances on account of or with a view of the execution of the work

or the performance of the contract.

Action when progress of any particular portion of the work is unsatisfactory.

Clause 4 : If the progress of any particular portion of the work unsatisfactory the Dy.

Engineer shall not with standing that the general progress of the work is in accordance

with the condition mentioned in clause 2 be entitled to take action under clause 3 (b)

after giving the contractor 10 day’s notice in writing. The contractor will have no claim for

compensation for any loss sustained by him owing to such action.

Contractor remains liable to pay compensation if action not taken under Clauses 3

and 4

Clause 5 : In any case in which any of the powers conferred upon the Ahmednagar

Municipal Corporation Executive Engineer by clauses 3 and 4 there of shall become

exercisable and the same shall not have been exercised the non-exercise their of shall

not constitute a waving of any of the conditions hereof and such powers shall not – with

standing be exercisable in the event of any future case of default by the contractor for

which under any clause or clauses hereof he is declared liable to pay compensation an

mounting to the whole of his security deposit and and the liability of contract or for past

and future compensation shall remain unaffected in the event of the City Engineer

Ahmednagar Municipal Corporation taking action under sub clause (a) or (c) of clause 3,

he may if he so desire take possession of all or any too plant, materials and stores in or

upon the works or site there of or belonging to the contractor or procured.

Power to take possession of or require removal of or sell contractors plant.

by him and intended to by used for the execution of the work or any part there of paying

or allowing for the same in account at the contract rates or in the case of contract rate

not being applicable to current market rates to be certified by the Dy. Engineer whose

certificate their of shall be final in the alternative the Dy. Engineer may after giving notice

in writing to the contractor or his clerk of the work foremen or other authorise agent

require him to remove such tools, plant materials or stores from the premises within a

time to be specified in such notice and in the event of contractor failing to comply with

any such requision the Dy. Engineer may remove them at the contractor’s expense of

sell them by auction or private sale on account of the contractor and at his risk in all

respect and the certificate of the Dy. Engineer as to the expense of any such removal

and the amount of the proceeds and expense of any such sale be final and conclusive

against the contractor.

Extension of time

Clause 6 : If the contractor shall desire an extension of the time for completion of work

on the ground of his having been unavoidably hindered in its execution or on any other

ground, he shall apply in writing to the Dy.Engineer before the expiry of the period

stipulated in the tender or before the expiration of 30 days from the date on which was

hindered as aforesaid or on which the cause for asking for extension occurred,

whichever is earlier and the Commissioners if in his opinion there were reasonable

ground for granting in extension for work such extension as he thinks necessary or

proper. The decision of the Commissioner Ahmednagar Municipal Corporation in this

matter shall be final.

Clause 6 (a) : In case of delay in handing over the land required for the work due to

unforseen case the contractor shall not be entitled or any compensation whatsoever

form Ahmednagar Municipal Corporation on the ground that the machinery or labour was

for certain period retained idle, contractor may however apply for extension for time limit

which way be guarantee on the merit of the same.

The contractor will not have any claim in case of delay be the Department of removal of

trees or / shifting raising removing of telegraph or electrical lines (over head or under

ground) or other structure if any which may come in the way of work. However suitable

extension can be granted to cover such delay.

Final Certificate

Clause 7 : On the completion of the work the contractor furnished with certificate by

Executive Engineer Ahmednagar Municipal Corporation (hereinafter called the Engineer

in Charge) of such completion but no such certificate shall be given not shall the work be

considered to be complete until the contractor shall have removed from the premises on

which the work shall have been executed, all scaffolding surplus materials and rubbish,

and shall have cleaned off, the dirt form all woodwork, doors, windows, walls, floor or

other parts of any building in or upon which the work has been executed, or of which he

may have had possession for the purpose of execution the work not until the work shall

have been measured by the Engineer in charge or where the measurements have been

taken by his subordinates until they have received approval of the Engineer in charge

the said measurements being binding and conclusive against the contractor. If the

contractor shall fail to comply with the requirements of this clause is to the removal of

scaffolding, surplus materials and rubbish and cleaning of dirt on or before the date fixed

for the completion of the work the Engineer in charge may at the expenses of the

contractor remove such scaffolding surplus materials and rubbish, dispose of the same

as he thinks fit and clean of such dirt as aforesaid and the contractor shall forthwith pay

the amount of all expenses so incurred, but shall have no claim in respect of any such

scaffolding or surplus materials as aforesaid except for any sum actually realized by the

sale thereof.

Payment on Intermediate certificate to be regarded as advances

Clause 8 : No payment shall be made for any work, estimated to cost less than rupees

one thousand till after the whole of work shall have been completed and a certificate of

completion given but in the case of work estimated to cost more than rupees one

thousand the contractor shall on submitting a monthly bill therefore, be entitled to receive

payment proportionate to the part of the work that approved and passed by the

Engineer-in-charge whose certificate of such approval and passing of the sum so

payable shall be final and conclusive against the contractor all such intermediate

payments shall be regarded as actually done and completed and shall not preclude the

Engineer in charge from requiring and bad unbound, imperfect or unskillful work to be

removed or taken away any and reconstructed or recreated not any such payment be

considered as an admission of the due performance of the contract or any part thereof in

any respect or the accruing of any claim nor shall it conclude, determine or effect in any

other way the powers of the Engineer in Charge as to the final setttlement and

adjustment of accounts or otherwise, in any other way very or affect the contract.

The final bill shall be submitted by the work, otherwise the Engineer-in-charge’s

certificate of the measurements and of the total amount payable for the work shall be

final and binding on all parties. Payment at reduced rates on account of items of work

not accepted as completed to be at the discretion of the Engineer in charge.

Clause 9 : The rates for several items of works estimated to cost more than Rs. 1000

agreed to within shall be valid only when the item concerned is accepted as having been

complete full in accordance with the sanctioned specifications. In case where the items

of work are not accepted as so completed the Engineer-in-charge may make payment

on account of such items at such reduced rates as he may consider reasonable in the

preparation of final or an account bills.

Bills to be submitted monthly

Clause 10 : A bill shall be submitted by the contractor each month on or before the date

fixed by the Engineer-in-charge / PMC for all work executed in the previous month and

the Engineer-in-charge shall take or cause to be taken the requites measurements for

the purpose of having the same verified and the claim, so far as it is admissible, shall be

adjusted, if possible, with in ten days from the presentation of the bill. If the contractor

does not submit the bill within the time fixed as aforesaid, the Engineer-in-charge may

bill within the time fixed as aforesaid, the engineer-in-charge may depute a subordinate

to measure up the site work in the presence of the contractor or his duly authorised

agent whose countersignature to the measurements list shall be sufficient and the

Engineer-in-charge may prepare a bill from such list which shall be binding on the

contractor in all respects.

Stores supplied by Municipal Corporation (if required)

Clause 12 : If the specification or estimate of the work provides for the use of any

special description of materials on be suplied from the store of the Dept. store or if it is

required that the contractor shall use certain stores to be provided by the Engineer-in-

charge (such materials and stores and the prices to be charged therefore as herein after

mentioned being so far as practicable for the convenience of the contractor but not as so

in any to control the meaning or effect specified in the schedule or Memorandum hereto

annexed) the contractor shall be supplied with such materials and stores as may be

required from time to time to be used by him for the purposes of the contract only and

the value of the full quantity of the materials and stores so supplied shall be set off of

deducted from any sums then due, or thereafter to overcome due to the contractor under

the contractor, or otherwise or from the security deposits or the proceeds of sale thereof

if the security deposit is held in the Ahmednagar Municipal Corporation the same or a

sufficient portion therefore shall at all lives be open to inspection by the Engineer in

charge. Any such materials unused and in perfectly good condition at the time of

completion or determination of the contract shall be returned to the Ahmednagar

Municipal Corporation stores, if the Engineer in charge so requires by a notice in writing

given under his hand, but the contractor shall not be entitled to return any such material

except with consent of the Engineer in charge and he shall have no claim for

compensation account of any such material supplied to him as aforesaid but remaining

unused by him for any wastage in or damage to any such materials.

Clause 12 (A) : All stores of controlled materials such as cement, steel etc. supplied to

the contractor by Ahmednagar Municipal Corporation should be kept by the contractor

under lock and key and will be accessible for inspection by the Municipal Engineer or his

agent at all the times.

Work to be executed in accordance with specifications drawings orders etc.

Clause 13 : The Contractor shall execute whole and every part of the work in the most

substantial and workman like manner, and both as regards materials, and every other

respect in strict accordance with specifications. The contractor shall also confirm exactly

fully and faithfully to the designs, drawings and instructions in writing relating to the work

signed by the Engineer-in-charge and lodged in his office and to which the contractor

shall be entitled to have access for the purpose of inspection at such office, or on the

site of the work during office hours. The contractor will as well as one certified copy of

the accepted tender along with the work order free of cost. Further copies of the

contract, drawing and working drawing if required by him shall be supplied at the rate of

Rs. 500/- pe set of contract drawings and Rs.50/- per drawing working except where

otherwise specified.

Alteration in specification and designs not to invalid at contracts

Clause 14 : The Engineer in charge shall have power to make any alterations in or

additions to the original specifications, designs and instructions that may appear to him

be necessary or advisable during the progress or the work and the contractor shall be

bound to carry out the work in accordance with any instructions in this connection which

may be given to him in writing signed by the Engineer in charge and such alteration shall

not invalidate the contract any additional work which the contractor may be directed to

do in he manner above specified as part of work shall be carried out by the contractor on

the same conditions in all respects on which he agreed to do the main work, and at the

same rates as are specified in the tender for the main work and if the additional and

altered work includes any class of work for which no rate is specified in this contract,

then such class of work shall be carried out at the rates entered in the Schedule of Rates

of the P.W. Division or at the rates mutually agreed upon between the Engineer in

charge & the contractor, which ever are lower. If the additional or altered work for which

no rate is entered in the schedule of rates of the Division as ordered to be carried out

before the rates are agreed upon then the contractor shall within seven days of the date

of receipt by him of the order to carry out the work, inform the Engineer-in-charge of the

rate which it is his intention to charge for such class of work & if the Engineer in charge

does not agreed to this rate he shall by notice in writing be at liberty to cancel his order

to carry out such class of work & arrange to carry out such class of work and arrange to

carry out in such manner as her may consider advisable, provided always that if the

contractor shall commence work or insure any expenditure in regard there to before the

rates shall have been determined as lastly herein before mentioned than in such case he

shall only be entitled to be paid in respect of the carried out or expenditure incurred by

him prior to the determination of the rate as aforesaid according to such rate or rates as

shall be fixed by the Engineer in charge. In the event of a dispute, the decision of the

Ahmednagar Municipal Corporation will be final.

AHMEDNAGAR MUNICIPAL CORPORATION

Where, however, the work is to be executed according to the designs, drawing and

specification recommended by the contractor and accepted by the competent authority

the alterations above referred to shall be within the scope of such designs, drawings and

specifications appended to the tender.

Extensions of time in consequence of additions or alterations.

The time limit for the completion of the work shall extended in the proportions that

theincrease in it’s cost occasioned by alterations or additions bears to the cost of original

contract work, and the certificate of the Engineer-in-charge as the such proportion shall

be conclusive.

No. claim to and payment or compensation for alteration in or restriction of work.

Clause 15 : (1) If at any time after the execution of the contract documents the Engineer

shall for any reason whatsoever (other than default on the part of the contractor for

which the Ahmednagar Municipal Corporation is entitled to rescind the contract) desires

that the whole or part of the work should not be carried out at all he shall give to the

contractor a notice in writing of such desire and upon the receipt of such notice the

contractor shall forth with suspend or stop the work wholly of in part required, should be

stopped or suspended so as not cause any damage or injury to the work already done or

endanger the safety there of provided that the decision of the Engineer as to the stage at

which the work or any part of it could be or could have been safely stopped or

suspended shall be final and conclusive against the contractor. The contractor shall

have no claim to any payment or compensation whatsoever by reason of or in presence

of any notice as aforesaid, on account of any suspension, stoppage or curtailment

except to the extent specified herein after.

2)Where the total suspension of the work ordered as aforesaid continued for a continues

period exceeding 90 days the contractor shall be at liberty to withdraw from the

contractual obligations under the contract so for as it pertains to the unexecuted part to

the work by giving a 10 day’s prior notice in writing to the Commissioner within 30 days

of the expiry of the said period of 90 days of such intention and requiring the Engineer to

record the final measurements of the work already come and to pay final bill upon giving

such notice the contractor shall be deemed to have been discharged from his obligation

to complete the remaining unexecuted work under his contract on receipt of such notice

the Engineer shall proceed to complete the measurement and make such payment as

may by finally due to the contractor with in a period of 90 days from the receipt of such

notice in respect of the work already done by the contractor such payment shall not in

any manner prejudiced the right the contractor to any further compensation under the

remaining provisions of this clause.

3) Where the Engineer required the contractor to suspend the work for period in excess

of 30 days at any time or 60 days in the aggregate the contractor shall be entitled to

apply the Commissioner within 30 days of the resumption of work after such suspension

for payment of compensation to the extent of pecuniary loss suffered by him in respect –

of working machinery rendered idle on the site or on the account of his having and to

pay the salary or wages of labour engaged the contractor shall not be entitled to any

claim in respect of any such working machinery, salary or wages for the first 30 days

whether consecutive or in the aggregatge of such suspension or in respect of any

suspension whatsoever occasioned by unsatisfactorywork or any other defaulting his

part. The decision of the Engineer in this regard shal be final and conclusive against the

contractor.

No claim to compensation on account of loss due to delay in supply of materials

by the Ahmednagar Municipal Corporation.

4) In the event of :

i) Any total stoppage of work on notice from the Engineer under Sub clause (1) in that

behalf.

ii) Withdrawal by the Contractor from the contractual obligation to complete the

remaining unexecuted work under sub clause (2) en account of contined suspension of

work for a period exceeding days.

iii) Curtailment in the quality of item or items originally tendered on account of any

alteration omission or substitutions in the specifications, drawings, designs or

instructions under 14(1) where such curtailment exceeds 25% in quantity and the value

of the quantity curtailed beyond 25 percent at the rates for the item specified in the

tender is more than Rs. 5000/- It shall be open to the contractor, within 90 days from the

service of (i) the notice of stoppage of work or (ii) the notice if withdrawal form the

contractual obligation under the contract on account of the continued suspension of work

on (iii) notice under clause 14(1) resulting in such curtailment to produce to the Engineer

satisfactory documentary evidences that he had purchased or agreed to purchase

material for use in the contracted work before receipt by him of the notice of stoppage

suspension or curtailment and require the Ahmednagar Municipal Corporation to take

over on payment such material at the rates determined by the Engineer, provided.

However such rates shall in no ease exceed the rates at which the same was acquired

by the contractor. The Ahmednagar Municipal Corporation shall there after take over the

material so offered, provided the quantities offered, are not in excess of the

requirements of the unexecuted work as specified in the accepted tender and are of

quantity and specifications approved by the Engineer.

Time Limit for unforseen claim

Clause 16 : Under no circumstances. Whatever shall the contractor be entitled to and

compensation from the Ahmednagar Municipal Corporation on any account unless the

contractor shall have submitted a claim in writing to the Engineer in charge within one

month of the cause of such claim occuring.

Action and compensation payable in case of bad work.

Clause 17 : If at any time before the security deposit is refunded to the contractgor it

shall appear to the Engineer-in-charge or is subordinate in charge of the work, that may

work has been executed with unsound imperfect or unskillful workmanship or with

materials of inferior quality or than any materials or articles provided by him for the

execution of the work are unsound, or of a quality inferior to that contracted form or are

otherwise not in accordance with the contract it shall be lawful for the Engineer-in-charge

to intimate this fact in writing to the contractor and then not with standing the fact that the

work, materials or articles complained of may have been inadvertently passed, certified

and paid for the contractor shall be bound forthwith to rectify remove and reconstruct the

work so shall remove the materials or articles at his own charge and cost and in the

event of his failing to do so within a period to be specified by the Engineer-in-charge in

the written intimation aforesaid, the contractor shall be liable to pay compensation at the

rate of one percent on the amount of the estimate for everyday not exceeding the days

during which the failure 50 continues and and in the case of any such failure the

Engineer in charge may remove and Execute the work or remove and replace the

materials or articles complained of as the case may be at the risk and expense in all

respects of the contractor should the Engineer in charge consider that any such interior

work or materials as described above may be accepted or may use of it shall be within

his discretion to accept the same as such reduced rates as he may fix therefore.

Work to be open to Inspection

Clause 18 : All works under or in course of execution or executed in pursuance of the

contract shall at all times be open for inspection and supervision of the Engineer-in-

charge and his subordinate, and the contractor shall at all times during the usual working

hours, and at all other times at which reasonable notice of the intention or the Engineer

in charge and his subordinate to visit the work shall have been given to the contractor

either.

Contractor or responsible agent to be present.

Himself be present to receive orders and instruction or have responsible agent duly

accredited in writing present for that purpose. Orders given to the contractor’s dully

authorised agent shall be considered to have the some force and effect as if they had

been given to the contractor himself.

Notice to be given Before

Clause 19 : The contractor shall give not less than five days notice in writing to the

Engineer in charge or his subordinate in charge of the work before covering up or

otherwise placing beyond the reach the measurement.

Work is convered up any work in order that the same may be measured and correct

dimensions thereof taken before the same is so covered up or placed beyond the reach

or measurement and shall not cover up or place beyond the reach of measurement any

work without the consent in writing of the Engineer in charge or his subordinate in

charge of the work and if any work shall be covered up or placed beyond the reach of

measurement without such notice having been or consent obtained the same shall be

uncovered at the contractor’s expense, and in default thereof no payment or allowance

shall be made for such work or for the material with the same was executed.

Contractor liable for damage done and form part action for three months after

certificate

Clause 20 : If during the period of 6 (six) months from the date of completion as censed

by the Engineer in charge pursuant to clause 7 of the contract or 10 (ten) months after

commissioning the work, whichever is earlier in the opinion of the Executive Engineer,

the said work is defective in any manner whatsoever, the contractor shall forthwith on

receipt of notice in the behalf from the Executive Engineer dully commence execution

and completely vao out a this cost every respect all the work that may be necessary for

rectifying and setting right the defects specified there in strictly in accordance with and in

the manner prescribed and under the supervision of the Executive Engineer, in the event

of the contractor failing or neglecting to commence execution of the said rectification

work withing the period prescribed therefore in the said rectification work within the

period prescribed therefore in the said notice and / or to complete the same as aforesaid

as aforesaid as required by the said notice, the Executive Engineer get the same

executed and carried out departmentally or by any other agency at the risk on account

and the cost of contractor. The contractor shall forthwith on demand paid to Ahmednagar

Municipal Corporation the amount of such costs charges and expenses sustained or

incurred by Ahmednagar Municipal Corporation of which the certificate of the Executive

Engineer shall be final and binding on the contractor failing or neglecting to pay the

same on demand as aforesaid without prejudice to any other rights and remedies of

Ahmednagar Municipal Corporation the may be recovered from the contractor which

may then be payable or which may, thereafter become payable by Ahmednagar

Municipal Corporation to the contractor either in respect of the said work or any other

work whatsoever or from the amount of the security deposit.

Contractor supply plants ladders scaffolding etc.

Clause 21 : The contractor shall supply at his own cost all material (except such special

materials, if any as may, in accordance with the contract be supplied from the Municipal

Stores) plant tools, appliances implements, ladders cordage, tackle scaffolding and

temporary works requisite or proper for the proper execution of the work whether in the

original, altered of substituted form, and whether included in the specification or other

documents forming part of the contract or referred to in these conditions or not and

which may be necessary for the purpose of satisfying or complying with the

requirements of the Engineer in charge as so to any matter as to which under these

conditions, he is entitled to be satisfied or which ever is entitled to requisite together with

the carriage therefore to and from the work. The contractor shall also supply without

charge the requisite number of persons with the means and materials necessary for the

purpose of setting.

And is liable for damages arising form non-provisions of fights fencing etc. out works and

counting, weighting and assisting in the measurement or examination at any time and

from time to time of the work or the material failing which the same may be provided by

the Engineer in charge at the expense of the contractor and the expense may be

deducted from any money due to the contractor under the contract or from his security

deposit or the proceeds of sale thereof, or for a sufficient protion thereof. The contractor

shall provide all necessary fencing and lights required to protect the public from

accident, and shall also be bound to bear the expenses of defence of every suit action or

other legal proceeding that may be brought by any person for injury sustained owing to

neglect of the above precautions, and to pay any damages and costs which may be

awarded in any such suit action or proceedings to any such persons, or which may with

the consent of the contractor to paid for complementing any claim by such person.

Clause 21 (A) : The contractor shall provide suitale scaffolds and working platforms and

gangways and shall comply with the following regulations in connections there with.

(a) Suitable scaffolds shall be provided for works that cannot be safely done from a

ladder or by other means.

(b) A scaffold shall not be constructed, taken drawn or substantially altered except –

(i) under the supervision of competent and responsible person and

(ii) as far possible by competent workers possessing adequate experience in

this kind of work.

(c) All scaffolds and appliances connected there with and ladders shall –

(i) be of sound material.

(ii) be of adequate strength having regard to the leads and strains to which

they will be subjected and

(iii) be maintained proper condition.

(d) Scaffolds shall so constructed that no part there of can displaced in consequence

of normal use.

(e) Scaffolds shall not be over loaded and so far as practicable the load shall be

evently distributed.

(f) Before installing fitting gear on scaffolds special precautions shall be take to

ensure the strength and stability of the scaffolds.

(g) Scaffolds shall be periodically inspected by a competent person.

(h) Before allowing a scaffold to be used by his workman the contractor shall

whether the scaffolds has been erected by his workmen or not take stops to

ensure that it complies fully with the regulations herein specified.

(i) Working platform, gangway stairways shall.

(i) be so constructed that part thereof can sunduly or unequally.

(j) In the case of working platform, gangways, working places and stairway at a

height exceeding 3 meters (to be specified)

(i) every working platform and every gangway shall be closely boarded

unless other adequate measures are taken to ensure safety.

(ii) every working platform and gangway, shall have adequate with and.

(iii) every working platform gangway, working place and stairway shall be

suitable fenced.

(k) Every opening in the floor of a building or in a working platform shall, except for

the time and to the extent required to allow the excess of persons or the transport

or shifting of material, be provided with suitable means to prevent fall of persons

or material.

(l) When person are employed at a roof where there is a danger of falling from a

height exceeding 5 meter suitable precautions shall be taken to prevent the fall of

persons or material (to be prescribed).

(m) Suitable precautions shall be taken to prevent persons being struck by articles

which might fall from scaffolds or other working places.

(n) Safe means of access shall to make payment to labour as per Minimum Wages

Act amended from time to time.

Clause 21 B : The contractor shall with following as regards the Hoisting Appliances to

be used by him.

(a) Hoisting machines and tackle, including their attachments, anchorages and

supports shall.

(ii) be of good mechanical construction sound material and adequate

strength and free from patent defect and.

(ii) be kept in good repair and good working order.

(b) Every rope used in hoisting or lowering materials or as means of suspension

shall be of suitable quality and adequate strength and free patent defect.

(c) Hoisting machines and tackle shall be examined and adequately tested after

erection on the site and before use and be re – examined in position at intervals

to prescribed by Ahmednagar Municipal Corporation.

(d) Every chain, ring hook, shackle, swivel and pulley block used in hoisting or

lowering materials or as a means or suspension shall be periodically examined.

(e) Every crane driver or hoisting appliance operator shall be in properly qualified.

(f) No person who is below the age of 18 years shall in control of any hoisting

machine, including any scaffold which, or give signals to the operator.

(g) In the case of every hoisting machine and of every chain ring, hook, shackle,

swivel and pulley block used in hoisting or lowering or as a means of suspension,

the safe working load shall be ascertained by adequate means.

(h) Every hoisting machine and all gear referred to in preceding regulation shall be

plainly marked with the safe working load.

(i) In case of a hoisting machine having a variable safe working load each safe

working load the conditions under which it is applicable shall be early indicated.

(j) No part of any hoisting machine or of any gear referred to in regulation 7 above

shall be loaded the safe working load except for purpose of testing.

(k) Motors, gearing, transmissions electric wiring and other dangerous parts of

hoisting appliance shall be provided with efficient safeguard.

(l) Hoisting appliance shall be provided with such means as well reduce to a

minimum the risk of the accidential descent of the load.

(m) Adequate precaution shall be taken to reduce to minimum the risk of any part of

a suspended load becoming accidentally displaced.

Measures for Prevention of fire

Clause 22 : The contractor shall not set fire to any standing trees, brushwood or grass

without a written permit from the Executive Engineer when such permit is given and also

in all cases when destroying cut or dug up trees, brushwood, grass etc. by fire the

contractr shall take necessary measures to prevent such fire spreading to or otherwise

damaging surrounding property.

The contractor shall make his own arrangements for drinking water for the labour

employed by him and should provide sanitary and other arrangements.

Liability of contractor for any damage done in or outside work areas

Clause 23 : Compensation for all damages done intentionally or unintentionally by

contractors labour where in or beyond the limits of Ahmednagar Municipal Corporation

property including any damage caused by the spreading of fire mentioned in clause 22

shall be estimated by the Engineer in charge or such other officer as he may appoint and

the estimates of the Engineer in charge subject to decision of Executive Engineer on

appeal shall be final and the contractor shall be bound to pay the amount of the

assessed compensation on demand, failing which, the same will be recovered from the

contractor as damages in the manner prescribed in clause 1 or reduced by the Engineer

in charge from any sums that may be due or become due from Ahmednagar Municipal

Corporation to contractor under this contract or otherwise. The contractor shall bear the

expenses of defending any action or other legal proceeding that may be brought by any

persons for in fury sustained by him owing to neglect to precautions to prevent the fire

and shall pay any damages and cost that may be awarded by the court in consequence.

Employment of female labor

Clause 24 : The employment of female laborer on work in neighborhood or soldier’s

barracks should be avoided as for possible,

Work on Sunday,

Clause 25 : No work shall be done on Sunday without the sanction in writing of the

Engineer-in-charge.

Work not be sublet

Clause 26 : The contractor shall not be assigned or sublet without the written approval

of the Engineer-in-charge and if the contractor shall assign or sublet his contract or

attempt so to do or become insolvent or commence any proceeding to get himself

adjudicated and insolvent or make any composition with his creditors, or attempt so do

or if bribe.

Contract may be rejected and security deposit forfeited for subletting it without approval

oral bribing a public officer or if contract becomes insolvent.

Gratuity, first aid, loan, perquisite reward or advantage pecuniary or otherwise shall

either directly or indirectly be given, promised or offered by the contractor or any of his

servants or agents to any public offices or person in the employ of Ahmednagar

Municipal Corporation in any way reading to his office or employment, or if any such

officer or person shall become in any way directly or indirectly interested in the

contractor the Engineer in charge way thereupon by notice in writing rescind and the

contract, and the security deposit or Ahmednagar Municipal Corporation and the same

consequences shall ensure as if the contract had been rescinded under Clause 3 bere of

and in addition the contractor shall not be entitled to recover or be paid for any work

therefore actually performed under the contract.

Sum payable by way of compensation to be considered as reasonable

compensation – without reference to actual loss

Clause 27 : All sums payable & contractor by way of compensation under any of these

conditions; shall be considered as a reasonable compensation to applied to the use of

Ahmednagar Municipal Corporation without-refefefice to the actual loss or damage

sustained and whether any damage has or has-not been sustained.

Changes is, the constitution of firm to be notified

Clause 28 : In the case of tender by partners, any change in the constitution of a firm

shall be forth with notified by the contractor to the Engineer charge of his information

Direction.

Direction and control of Executive Engineer

Clause 29 : All works to be executed under the contract shall be executed under the

direction and subject to the approval in the respects of the Executive Engineer for the

time being who shall be entitled to direct at what point or points in what manner they are

to be commenced and from time to time carried on.

Clause 30 : (1) Except where otherwise specified in the contract and subject to the

powers delegated to him Ahmednagar Municipal Corporation under the Code rules there

in force, the decision of the Executive Engineer for the time being shall be final,

conclusive and binding on all parties of the contract upon all questions relating to the

meaning of the specifications, designs, drawings and instructions herein before

mentioned and as to the questions of workmanship or materials used on the work, or as

any other questions claim right, matter or thing whatsoever, in any way arising out of or

relating to the contract designs, designs, drawings, specifications, estimated instruction,

orders, or these conditions, or otherwise concerning the works or the execution or failure

to execute the some whether arising during the progress of the work, or after the

completion or abandonment thereof.

(2) The contractor may within thirty days of receipt by him of any order passed by the

Executive Engineer as afore said appeal against it to the Commissioner concerned with

the contract works of project.

(3) If the contractor is not satisfied with the order posted by the Commissioner as fore

said the contractor may within thirty days receipt by him of any such order, appeal

against it to the president who if convinced that prima facie the contractor’s claim

rejected by Executive Engineer is not previous and that there is some substance in the

claim of the contractor as would merit a detailed examination and decision by

Ahmednagar Municipal Corporation shall put to the Ahmednagar Municipal Corporation

for suitable decision.

Action where on specifications

Clause 31 : In the case of any class of work for which there is no such specifications as

is mentioned in Rule 1 such work shall be carried out in accordance with the Divisional

specifications, and the event of there being no Divisional specification then in such case

the work shall be carried out in all respects in accordance with the Divisional

specifications, and that event of there being no Divisional specifications, then in such

case the work shall be carried out in all respects in accordance with all instructions and

requirements of the Engineer in charge.

Definition of work

Clause 32 : The expression work or work where used in these connections shall unless

there be something in the subject or context such construction; be construct to mean the

works contracted to be executed under or in virtue of the contract whether temporary or

permanent and original altered, substituted or additional

Contractor’s percentage whether applied to net or gross amount of bill

Clause 33 : The percentage referred to in the tender shall be deducted from added to

the gross amount of the bill before deduction the value of any stock issued.

Refund of quarried fees and royalties

Clause 34 : All quarry royalties and ground rent for stocking materials if any, should be

paid by the contractor.

Compensation under Workmen’s Compensation Act.

Clause 35 : The contractor shall be responsible for the and shall pay any compensation

to his workmen payable under the workmen’s compensation act 1923 (VII of 1923),

(hereinafter called the said Act) for injuries caused to the workmen, if such

compensation is payable paid by Ahmednagar Municipal Corporation as principal under

sub-section (1) of section 12 of the said Act of behalf of the Contractor is shall be

recoverable by Ahmednagar Municipal Corporation from the contractor under sub-

section (2) of the said section such compensation shall be recovered in the manner laid

down in Clause 1 Above.

Clause 35 (A) : The contractor shall be responsible for and shall pay the expenses of

providing medical aid to any workman who may suffer a bodily injury as a result to an

accident. If such expenses are incurred by Ahmednagar Municipal Corporation the same

shall be recoverable from the contractor forthwith and be deducted without prejudice to

any remedy to Ahmednagar Municipal Corporation from any amount due or that may

become due to the contractor.

Clause 35 (B) : The contractor shall provide all necessary personal safety equipment

and first aid apparatus available for the use of the person employed on the site and shall

maintain the same in condition suitable for immediate use at any time and shall comply

with the following regulation in connection therewith.

(a) The workers shall be required to use the equipment so provided by the contractor

and the contractor shall take adequate to ensure proper use of the equipment by

those concerned.

(b) When work is carried on in proximity to any place where there is a risk of drawing

all necessary steps shall be taken for the prompt rescue of any person in danger.

(c) Adequate provision shall be made for prompt first aid treatment of all injuries

likely to be sustained during the course of work.

Claim for quantities enter in the tender or estimates

Clause 36 : The contractor shall duly comply with the provisions of The Apprentices Act

1961 (III of 1961) the rules made there under the order that may be issued from time to

time under the said Act and the said Rules and his failure or neglect to do so he shall be

subject to all the liabilities and penalties provided by the said Act and said rules.

Clause 37 : Quantities shown in the tender are approximate and no claim shall be

entertained for quantities of work executed being either more of less than those entered

in the tender or estimate.

Quantities in respect of the several items shown in the tender are approximate and no

revision in the tendered rate shall be permitted contained in the specifications pre-

scribing different percentage of permissible variation the quantity of the does not exceed

the tender, is not more than Rs.5000/-. The contractor shall, if ordered in the writing

Engineer so to do, also carry out any quantities in case of the limit mentioned in sub-

clause (i) e…on the same conditions as the on accordance with the specification in the

tender and at the rate (i) derived from the rates entered in the current schedule of rates

and in the absence of such rates (ii) at the rate prevailing in the market, the said rates

being increased or decreased as the case may be by the percentage which the total

tendered amount bears to the estimated cost of work as per tender based upon the

schedule of rates applicable to the year in which the tenders were invited (for the

purpose of operation of this clause, this cost shall be taken to be Rs……….)

Claim arising out of reduction in the tendered quantity of any item beyond 25 percent will

be governed by the provision of clause 15 only when the amount of such reduction

beyond 25 percent at the rate of the item specified in the tender is more that s. 5000/-

Employment of famine labor

Clause 38 : The contractor shall employ any famine, convict or other labour of the

particular king or class if ordered in writing to do so by the Engineer in charge.

Claim for compensation for delay in starting the work

Clause 39 : No compensation shall be allowed for any delay caused in the starting of

the works on account of removal encroachment on case of clearance work on account of

any delay in according sanction to estimates.

Claim for compensation for delay execution of work

Clause 40 : No compensations shall be allowed for any delay in the execution of the

work on account of water, standing in borrow pits or compartments. The rate are

inclusive for hard or cracked soil, excavation sub in mud, soil, water standing in borrow

pits and no claim for an extra rate shall be entertained unless otherwise expressly

specified.

Entering upon or commencing any portion of work

Clause 41 : The contractor shall upon or commence any portion of work except with the

written authority and instruction of the Executive Engineer or of his subordinate in

change of work. Failing such authority the contractor shall have no claim to ask for

measurements of or payment forward.

Minimum age of persons employed the employment of donkey and or other

animals and the payment of fair wages.

Clause 42 :

(i) No contractor shall employ person who is under the age of 18

years.

(ii) No contractor shall employs or other animals with breeching of

string or thin rope. The breeching must be at least three inches

wide and should be of tape (Nawa).

(iii) No animal suffering from sores, lameness or emaciation or which

is immature shall be employed on the work.

(iv) The Engineer-in-charge is authorized to remove form the work any

person or animal found working which does not satisfy these

conditions and no responsibility shall be accepted by Ahmednagar

Municipal Corporation for any delay caused in the completion of

the work by such removal.

(v) The contractor shall pay fair and reasonable wages to the

workmen employed him in the event of any dispute arising

between the contractor and his workmen on the grounds that

wages paid are not fair and reasonable the dispute shall be

referred without delay of Executive Engineer who shall be

conclusive and binding on the contractor but such decision shall

not be any effect the conditions in the contract regarding the

payment to be made by Ahmednagar Municipal Corporation at the

sanctioned tender rates.

(vi) Contractor shall provide drinking water facilities of the workers.

Similar amenities shall be provide to the worker engaged on large

work in urban areas.

(vii) The contractors to take precautions against accidents which takes

place on account of labour using loose garments while working.

Method of payment acceptance of conditions compulsory before tendering of

work

Clause 43 : Payment to contractor shall be made cheque drawn on any schedule bank

at Ahmednagar.

Clause 44 : Any contractor who does not accept these condition shall not be allowed to

tender for works.

Employment of scarcity labour

Clause 45 : If Government declares a state of scarcity of famine to exist in any village

situated within 10 miles of the work, the contractor shall employ upon such parts of the

work, as are suitable for unskilled labour, any person certified to him by the Executive

Engineer or be any person to whom the Executive Engineer may have delegated this

duty in writing to be in need of relief and shall be bound to pay to such person wages not

below the minimum which government may have fixed in this behalf and dispute which

may arise in connection with the implementation of this clause shall be decide by the

Executive Engineer whose decision shall be final and binding on the contractor.

Clause 46 : The price quoted by the contractor shall not in any case exceed the control

price if any fixed Government or reasonable price which it is permissible for hum to

change a charge a private purchaser for the same class and description the controlled

price or the price permissible under Hoarding and profiting ordinance 1948 as amended

from time to time, if the price quoted exceeds the controlled price or the price

permissible under Hoarding and profiting prevention ordinance the contractor will

specifically mention this fact in his tender along with the reasons for quoting such higher

prices. The purchaser at his discretion will in such case exercise the right of raising the

price at any stage so as to confirm with the controlled price on the permissible under the

Hoarding and profiteering prevention ordinance. The discretion will be exercised without

prejudice to any other action that may be take against the contractor.

Clause 47 : The rates to be quoted by the contractor must be inclusive of Sales Tax. No

extra payment on this account will be made to the contractor.

Clause 48 : In case of materials that may remain surplus with the contractor from those

issued for the work contracted for, the date of ascertainment of the materials being

surplus will be taken as the date of sale for the purpose of sales tax and the sales tax

will be recovered on such sale.

Clause 49 : The contractor shall at least 80 percent of the total number of unskilled

labour to be employed by him on the said work from out of the persons residing in the

district in which site of the said work is located.

Provided however, that if the required number of unskilled labour form that district is not

available, the contractor shall in the first instance employ such number of person as is

available and thereafter may with the previous permission in writing of the Executive

Engineer in charge of said work obtain the rest of the requirement of unskilled labour

form out side district.

Clause 50 : Wages to the skilled and unskilled labours engaged by the contractors.

The contractors are bound to pay the labours as per the minimum wages act 1948

applicable to zone in accordance orders issued in Government P.W. circular No. NWA

10 dated 6-12-1958 Any change in the types of the Zones shall not entitle contractor any

claims.

Clause 51 : All amounts whatsoever which contractor is liable to pay it Ahmednagar

Municipal Corporation in connection with the execution of the work including the amount

payable in respect of (i) material and or stores supplied issued here under by the

Ahmednagar Municipal Corporation to the contractor (ii) hire charges in respect of heavy

plant. Machinery and equipment given on hire, by the Ahmednagar Municipal

Corporation to the contractor for execution by him of the work and / or on which advance

have been given by Ahmednagar Municipal Corporation to contract shall be deemed to

be arrear of House Tax and Ahmednagar Municipal Corporation may without prejudice

to any other rights and remedies of Ahmednagar Municipal Corporation recover the

same form the contractor arrears of House Tax.

Clause 52 : The contractor shal duly comply with all the provisions of the contract

Labour (Regulation and Abolition) Act, 1970 (27 of 1970) and the Maharashtra contract

labour (Regulation and Abolition) Rules 1071 as amended from time to time and all other

relevant status and statutory provisions concerning payment of wages particularly to

workmen employed by the contractor and working on the site of the work. In particular

the contractor shall pay wages to each worker employed by him on the site of the work

at the rates prescribed under the Maharashtra Contract Labour (Regulation and

Abolition) Rules 1971. If the contractor fails or neglects to pay wages at the said rates or

makes short payment and Ahmednagar Municipal Corporation makes such payment of

wages in full or part there of less paid by the contractor or deduct the same from the

amount payable by Ahmednagar Municipal Corporation to the contractor under or from

any other amounts (s) payable to him by Ahmednagar Municipal Corporation.

Clause 53 : The successful tenders will be required to produce to the satisfaction of the

specified concerned authority a valid and consequent licence issued in favour under the

provisions of the contract labour (Regulation & Abolition Act 1970) before starting the

work. On failure to do, the acceptance of the tender should be liable to be withdrawn &

also earnest money.

Clause 54 : In view of the difficult position regarding the availability of the Foreign

Exchange no foreign exchange will be released by the Department for the purchase of

the plant and machinery required for the execution for the work contracted for.

Clause 55 : The contractor are bound to pay the labours according to the wages Act

1943 applicable to zone in NWANC date 5-12-58 any differentiation in the types of zone

shall not entitled the contractor any claims.

Clause 56 : Those of the workers who are required to work under machinery and are

liable to any accident should not be allowed to wear loose clothes like Dhoti Zabba etc.

Advance against material / work done not measure

Clause 57 : Advance may from time to time if the Engineer in charge thinks fit be made

a contractor to the extent of 75% (Seventy Five percent) of the value of such materials

brought to the site of work & work done amount but not measure of work, such material

stack properly and carefully to the satisfaction of Engineer in charge, the Engineer shall

however the right to reject any or all such materials of which he may thereafter

disapprove & order to remove & in case of such rejection / disposal all loss resulting

there from shall be borne by the contractor.

Taxes

Clause 58 : All taxes shall be paid by the Contractor or if necessary will be deducted

from RA bill of contractor.

Dispute & Arbitration

Clause 59 : Dispute if any regarding any payment & work done, it will be decided by the

Commissioner, as an arbitrator, the decision of Commissioner will be binding to the

contractor.

Penalty

Clause 60 : If the work is delayed by the contractor penaly of Rs. 10,000/- per day will

be deducted from Contractors RA Bill but this amount should not be more than 1% of

tender amount.

Clause 61 : Price Escalation /Price Veriation : Price Esacaliation / Price veriation will

not be considerd.

Other clauses

Clause 62 : All the clauses in contract agreement (except clause 61) of PWD manual

will be binding on the contractor.

Clause 62 : All the guidelines of State Government, circular, amendment in the

6.1 The contractor shall no indent his requirement of cement as to assure utilization of

cement one later than 60 days after the receipt thereof cement older than the

the satisfactory passing tests that may specify. The testing charges will have to be

borne by the contractor.

9. The detail specification and drawing and Schedule B will be give to the contractor

before execution. The same will be given by the PMC and will be approved by

Executive Engineer.

10. If AMC plan to take this project in “Green Building Concept” & State Government

in principal approve the project the contractor shall depute the expert consultants

requires for this project at his own cost. Whereas the drawings estimate will be

as per green building concept and the process of Green Building concept will be

governed By Ministry of Non Conventional Energy GRIHA guidelines. For this

extra works payment will be paid as per revise estimate and drawings. But if the

sanction tender rate is above estimated cost this premium will not be paid to the

contractor.

11. As per labour welfare tax guidelines 1% of the work done amount will be

12. Mix design : If contractor requires for the mix concrete design, he should take the

written permission from the Executive Engineer & PMC. The Mix design should

be approve from the concern Government department before execution of the

work. Ready Mix Concrete with mix design will be allowed after the necessary

permission from the City Engineer & PMC.

13. Before Execution of the work the contractor should submit Bar Chart of the

Execution & cash flow data as per bar charge. Contractor shall also do the work

as per Sanction Bar Chart & in the month end submit the tracking of the mile

stone as per bar chart with the reasons.

14. AMC will not provide any material required for the work (it means Schedule A

quantity is nil)

15. Before execution of the work contractor shall inspect the site & do all require soil

test & water test at his own cost and should follow instruction as per test report.

16. Drawings attach to the tender documents are for tender reference and evaluation

only. Contractor shall execute the construction as per working drawing provided

by AMC.

GENERAL CONDITIONS AND INSTRUCTION TO BIDDER

1. Time Control

Program

1.1 Within the time stated in the Contract Data the Contractor shall submit to the

Engineer for approval a program showing the general methods, arrangements,

order, and timing for all activities in the works along with monthly cash flow

forecast. The programme shall indicate and give details of physical and financial

implication including men, materials and machinery requirements. In case the

progress is less than the stipulated progress, contractor shall increase the

resource i.e. machinery & labour to achieve the targeted progress at no extra

cost.

1.2 An update of the program shall be a program showing the actual progress

achieved on each activity and the effect of the progress achieved on the timing

of the remaining work including any changes to the sequence of the activities.

1.3 The contractor shall submit to the Engineer for approval an updated program at

intervals no longer than the period stated in the Contract Data. If the Contractor

does not submit an updated program within this period, the Engineer may

withhold the amount stated in the Contract Data from the next payment

certificate and continue to withhold this amount unitl the next payment after the

date on which the overdue program has been submitted.

1.4 The Engineer’s approval of the program shall not alter the Contractor’s

obligations. The Contractor may revise the program and submit it to the

Engineer again at any time. A revised program is to show the effect of variations

and compensation events.

2. Extension of the Intended Completion Date

2.1 The Engineer shall extend the Intended Completion Date if such event occurs or

a variation is issued which makes it impossible for completion to be achieved by

the Intended Completion Date without the Contractor taking steps to accelerate

the remaining work.

2.2 The Engineer shall decide whether and by how much to extend the Intended

Completion Date within 21 days of the contractor asking the Engineer for a

decision upon the effect of a Event or Variation and submitting full supporting

information. If the Contractor has failed to give early warning of a delay or has

failed to cooperate in dealing with a delay, the delay by this failure shall not be

considered in assessing the new Intended Completion Date.

3. Authority for Extension : The Executive Engineer, only on recommendation of

PMC and Engineer AMC shall extend the intended date of completion.

4. Management Meetings

4.1 Either the Engineer or the Contractor may requie the other to attend a

management meeting. The business of a management meeting shall be to

review the plans for remaining work and to deal with matters raised in

accordance with the early warning procedure.

4.2 The Engineer shall recor the business of management meetings and is to provide

copies of his record to those attending the meeting and the employer. The

responsibility of the parties for actions to be taken is to be decided by the

Engineer either at the management meeting or after the management meeting

and stated in writing to all who attended the meeting.

4.3 The management meeting will be under the head of Executive Engineer. The

member of which meeting are Engineer in charge of Site from AMC, Contractor,

PMC, Contractor or his authorise person and any other person related to project.

At least one meeting in a month shall be arrange to resolve the issues related to

The project.

5. Quality Control

Identifying Defects

5.1 The Engineer shall check the Contractor’s work and notify the Contractor of any

Defects that are found. Such checking shall not affect the Contractor’s

responsibilities. The Engineer may instruct the Contractor to search for a Defect

and to uncover and test any work that the Engineer considers may have a

Defect.

6. Tests

6.1 If the Engineer instructs the Contractor to carry out a test not specified in the

specification to check whether any work has a Defect and the test shows that it

does, the Contractor shall pay for the test and any samples. If there is no Defect

the test shall be a compensation event.

6.2 The Successful bidder will have to carry out the various tests on material and

construction process as indicated in QAP (Quality Assurance Plan) issued by

AMC.

6.3 Correction of Defects

The bidder should submit the maintenance manual to the employer before

commencement of lum sum work of first building for approval. After obtaining

approval, during contract period and defect liability period the bidder has to

follow the instructions given in approved maintenance manual. As per the

opinion of PMC, the Engineer shall give notice to the contractor of any Defects

before the end of the Defects Liability Period, which begins at date of virtual

completion and is defined in the Contract Data. The Defecs Liability Period shall

be extended for as long as Defects remain to be corrected.

6.4 Every time notice of a Defect is given, the Contractor shall correct the notified

Defect within the length of time specified by the Engineer’s notice.

7. Uncorrected Defects

If the Contractor has not corrected a Defect within the time-specified in the

Engineer’s notice, the Engineer will assess the cost of having the Defect

corrected & the Contractor shall pay this amount within 8 days after the last date

stated in such notice.

8. Events for Time Extension

The following are Events unless they are caused by the Contractor.

(a) The Employer does not give access to a part of the Site by the Site

Possession Date stated in the Contract Data.

(b) The Employer modifies the schedule of other contractors in a way, which

affects the work of the contractor under the contract.

(c) The Engineer / PMC order a delay.

(d) The Engineer instructs the Contractor to uncover or to carry out additional

tests upon work, which is then found to have no Defects.

(e) Ground conditions are susbtantially more adverse than could reasonable

have been assumed before issuance of Letter of Acceptance from the

information issued to Bidders (including the Site Investigation Reports), from

information available publicly and from a visual inspection of the Site.

(f) The Engineer gives an instruction for dealing with an unforeseen condition,

caused by the Employer, or additional work required for safety or other

reasons.

(g) Other contractors, public authorities, utilities or the Employer does not work

within the dates and other constraints stated in the Contract.

(h) The effect on the Contractor of any of the Employer’s Risks.

(i) Other Events listed in the Contract Data or mentioned in the Contract.

9. If a time extension event would cause additional time or would prevent the work

being completed before the Intended Completion Date, the Intended Completion

Date is extended. The Engineer shall decide whether and by how much the

Contract period shall be increased and whether and by how much the Intended

Completion Date shall be extended.

10. In case of any time extension, no price escalation will be allowed in any case and

at extension circumstances.

11. The Contractor shall not be entitled to time extension to the extent that the

Employer’s interests are adversely affected by the Contractor not having given

early warning nor not having cooperated with the Engineer / PMC.

12. Tax

The rates quoted by the Contractor shall be deemed to be inclusive of the sales

tax, VAT, Service Tax and other taxes that the Contractor will have to pay for the

performance of this Contract. The Employer will perform such duties in regard to

the deduction of such taxes at source as per applicable law.

13. Price Adjustment

No price adjustment will be made at any stage of the contract.

14. On completion of the whole of the Works, amount retained is not repaid to the

Contractor and total amount is released when the Defects Liability Period has

passed and the Engineer has certified that all Defects notified by the Engineer to

the Contractor before the end of this period have been corrected.

15. Liquidated Damages

15.1 The Contractor shall pay liquidated damages to the Employer at the rate per

day stated in the Contract Data for each day that the Completion Date is later

than the Intended Completion Date (for the whole of the works or the milestone

as stated in the contract data). The total amount of liquidated damages shall not

exceed the amount defined in the Contract Data. The Employer may deduct

liquidated damages from payments due to the Contractor. Payment of liquidated

damages does not affect the Contractor’s liabilities.

15.2 If the Intended Completion Date is extended after liquidated damages have

been paid, the Engineer shall correct any over payment of liquidated damages

by the Contractor by adjusting the next payment certificate.

16. Interest

No interest shall be payable on the amount refundable towards excess recovery

of liquidated damages.

17. Cost of Repairs

Loss or damage to the Works or Materials to be incorporated in the Works

between the Start Date and the ender of the Defects Correction periods shall be

remedied by the Contractor at the Contractor’s cost if the loss or damage arises

from the Contractor’s acts or omission. 55. Virtual Completion.

18. Termination

18.1 The Employer or the Contractor may terminate the Contract if the other party

causes a fundamental breach of the Contract.

18.2 Fundamental breaches of Contract include, but shall not be limited to the

following :

(a) The Contractor stops work for 28 days when no stoppage of work is shown

on the current Program and the stoppage has not been authorized by the

Engineer / PMC

(b) The Engineer / PMC instruct the Contractor to delay the progress of the

Works and the instruction is not withdrawn within 28 days.

(c) The Employer or the Contractor is made bankrupt or goes into liquidation

other than for a reconstruction or amalgamation;

(d) The Engineer gives Notice that failure to correct a particular Defect is a

fundamental breach of Contract and the Contractor fails to correct it within a

reasonable period of time determined by the Engineer / PMC;

(e) The Contractor does not maintain a security which is required.

(f) The Contractor has delayed the completion of works by the number of days

for which the maximum amount of liquidated damages can be paid as

defined in the Contract data and

(g) If the Contractor, in the judgement of the Employer has engaged in corrupt or

fraudulent practices in competing for or in the executing the Contract.

(h) For the purpose of this paragraph “corrupt practice” means the offering,

giving, receiving or soliciting of any thing of value to influence the action of a

public official in the procurement process or in contract execution.

“Fraudulent practice” means a misrepresentation of facts in order to influence

a procurement process or the execution of a contract to the detriment of the

Borrower, and includes collusive practice among Bidders (prior to or after bid

submission) designed to establish bid prices at artificial non-competitive

levels and to deprive the Borrower of the benefits of free and open

competition.”

18.3 When either party to the Contract gives ntoice of a breach of contract to the

Engineer / PMC for a cause other than those listed under Sub Clause 59.2

above, the Engineer / PMC shall decide whether the breach is fundamental or

not.

18.4 Notwithstanding the above, the Employer may terminate the Contract for

convenience.

18.5 If the Contract is terminated the Contractor shall stop work immediately, make

the Site safe and secure and leave the Site as soon as reasonably possible.

19. Payment upon Termination

19.1 If the Contract is terminated because of a fundamental breach of Contract by

the Contractor, the Engineer shall issue a certificate for the value of the work

done less advance payments received upto the date of the issue of the

certificate, less other recoveries due in terms of the contract, less taxes due to

be deducted at source as per applicable law and less the percentage to apply to

the work not completed as indicated in the Contract Data. Additional Liquidated

Damages shall not apply. If the total amount due to the Employer exceeds any

payment due to the Contractor the difference shall be a debt payable to the

Employer.

19.2 If the Contract is terminate at the Employer’s convenience or because of a

fundamental breach of Contract by the Employer, the Engineer shall issue a

certificate for the value of the work done, the reasonable cost of removal of

Equipment, repatriation of the Contractor’s personnel employed solely on the

Works, and the Contractor’s costs of protecting and securing the Works and less

advance payments received upto the date of the certificate, less other recoveries

due in terms of the contract and less taxes due to be deducted at source as per

applicable law.

20. Property

20.1 All materials on the Site, Plant, Equipment, Temporary Works Transit camp

structures and formwork for slabs, load bearing walls and aluminium supporting

systems and Works are deemed to be the property of the Employer, if the

Contract is terminated because of a Contractor’s default.

21. Labour

The successful tender will be required to produce to the satisfaction of the

specified concerned authority, valid and concurrent licence issued in his favour

under the provisions of the Contract Labour (Regular and Abolition) Act, 1970

before starting the work. Failure to do so, acceptance of the tender shall be

liable to be withdrawn and security deposit forfeited.

The Contractor shall, unless otherwise provided in the Contract, make his own

arrangements for the engagement of all staff and labour, local or other, and for

their payment, housing, feeding and transport. The Contractor shall, if required

by the Engineer, deliver to the Engineer a return in detail, in such from and at

such intervals as the Engineer may prescribe, showing the staff and the

number’s of the several classes of labour from time to time employed by the

Contractor on the Site and such other information as the Engineer may require.

22. Compliance with Labour Regulations :

During continuance of the contract, the Contractor and his sub contractors shall

abide at all times by all existing labour enactments and rules made ther under,

regulations, notifications and bye laws of the State or Central Government or

local authority and any other labour law (including rules), regulations, bye laws

that may be passed or notification that may be issued under any labour law in

future either by the State or the Central Government or the local authority. Salient

features of some of the major labour laws that are applicable to contruction

industry are given below. The Contractor shall keep the Employer indemnified in

case any action is taken against the Employer by the competent authority on

account of contravention of any of the provisions of any act or rules made there

under, regulations or notifications including amendments. If the Employer is

caused to pay or reimburse, such amounts as may be necessary to cause or

observe, or for non observance of the provisions stipulated in the notifications /

byelaws / Acts / Rules / regulations including amendments, if any, on the part of

the Contractor, the Engineer / Employer shall have the right to deduct any money

due to the Contractor including his amount of performance security. The

Employer / Engineer shall also have right to recover from the Contractor any sum

required or estimated to be required for making good the loss or damage

suffered by the Employer.

The employees of the Contractor and the Sub contractor in no case shall be

treated as the employees of the Employer at any point of time.

In the case of tender by partners, any changes in the constitution of a firm shall

be forthwith notified by the Contractor to the Engineer in charge for his

information.

23. The contractor shall be responsible for and shall pay any compensation to his

workmen payable under the Workmen’s Compensation Act 1923 (VIII of 1923)

act (hereinafter called the said Act) for injuries caused to the workmen. If such

compensation is payable paid by Council as principal under Subsections).

1) of Section 12 of the said Act on behalf of the contractor, it shall be

2) Recoverable by Council from the contractor under sub section (2) of the said

section. Such Compensation shall be recovered in the manner laid down in

clause 1 above.

24. The contractor shall be responsible for and shall pay the expenses of providing

medial aid to any workmen who may suffer a bodily injury as a result of an

accident. If such expenses are incurred by Council the same shall be recoverable

from the contractor forthwith and be deducted without prejudice to any other

remedy of Council from any amount due or that may become due to the

Contractor.

25. The contractor shall provide all necessary personal safety equipment and first aid

apparatus available for use of the persons employed on the site and shall

maintain the same in condition suitable for immediate use at any time and shall

comply with the following regulations in connection therewith.

a) The workers shall be required to use the equipment so provided by the

contractor and the contractor shall take adequate steps to ensure proper use

of the equipment by those concerned. When work is carried on in proximity to

any place where there is a risk or drawing all necessary equipment shall be

b) Provided and kept ready for use and all necessary steps shall be taken for

the prompt rescue of any person in danger.

c) Adequate provision shall be made for prompt first aid treatment of all injuries

likely to be sustained during the course of the work.

26. No compensation shall be allowed for any delay caused in the starting of the

work on account of acquisition of land or in the case of clearance works on

account of any delay in according to sanction of estimates.

27. No compensation shall be allowed for any delays in the execution of the work on

account of water, standing in borrow pits or compartments. The rates are of

inclusive for hard or cracked soil, excavation in mud, subsoil, water standing in

borrows pits and no claim for an extra rate shall be entertained, unless otherwise

expressely specified. Delays in shifting of slum dwellers mozani sheet by

authority handover of land from concern depth to M.C. or patta to beneficiary

shifting in electric pole or any after etc.

28. Contractor To Inform Himself Fully :

The Contractor shall be deemed to have carefully examined the work and site

conditions including labour, the general and the special conditions, specifications,

schedules and drawings and shall be deemed to have visited the site of the work

and to have fully informed himself regarding the local conditions and carried out

his own investigation to arrive at rates quoted in the tender. In this regard he will

be given necessary information to the best of knowledge of Department but

without any guarantee about it.

If he shall have any doubt as to the meaning of any portions of these general

conditions or the special conditions, or the scope of work of the specifications

and drawings or any other matter concerning the contract, he shall in good time,

before submitting his tender, set forth the particulars thereof and submit them to

the Engineer, Ahmednagar Municipal Corporation in writing in order that such

doubts may be clarified authoritatively before tendering. Once a tender is

submitted, the matter will be decided according to tender conditions in the

absence of such authentic pre clarification.

29. Initial Measurement For Record

Where, for proper measurement of the work, it is necessary to have an initial set

of levels or other measurements taken, the same as recorded in the authorised

field book or measurement book of Council by the Engineer or his authorised

representative willl he signed by the Contractor who will be entitled to have a true

copy of the same made at his cost. Any failure on the part of the contractor to get

such levels etc. recorded before starting the work will render him liable to accept

the decision of the Engineer as to the basis of taking measurements. Like wise

the contractor will not cover any work which will render its subsequent

measurements difficult or impossible without first getting the same jointly

measured by himself and the authorized representative of the Engineer. The

record of such measurements on the Council side will be signed by the

Contractor and he will be entitled to have a true copy of the same made at his

cost.

30. Co-ordination :

When several agencies for different sub work of the Project are to work

simultaneously on the timely completion of the whole project smoothly, the

schedule date for completion specified in each contract shall therefore be strictly

adhered to. Each contractor may make his independent arrangement for water ,

power, housing etc. if they so desire. On the other hand the contractors are at

liberty to mutual agreement in this behalf and make joint arrangements with the

approval of the Engineer. No single contractor shall take or cause to be taken

any steps or action that may cause disruption discontent, or disturbance of work

labour or arrangement etc. of other contractor in the Project localities. Any action

by any contractor, which the Engineer in his unquestioned discretion may

consider as infringement of the above code, would be considered as a breach of

the contract conditions and shall be dealt with as such.

In case of any dispute, disagreement between the contractors, the Engineer’s

decision regarding the coordination, cooperation and facilities to be provided by

any of the contractors shall be final and binding on the contractors concerned

and such a decision or decisions shall not vitiate any contract nor absolve the

contractor(s) of his / their obligations under the contract nor consider for the grant

for any claim or compensation.

31. Safety Measures And Amenities :

31.1 Safety Measures :

The Contractor shall take all necessary precautions for the safety of the workers

and preserving their health while working in such job as require special

protection and precautions. The following are some of the requirement listed,

though not exhausive. The contractor shall also comply with the directions

issued by the Engineer in this behalf from time to time and at all times.

1. Providing protective foot ware to workers, situtations like mixing and placing

of mortar of concrete in quarries and places where the work is done under

too much of wet conditions as also for movements over surfaces infected

with oyster growth etc.

2. Providing protective head wear to workers, working in sites or quarries etc. to

protect them against accidental fall of materials from above.

3. Taking such normal precautions like providing hand rails at the edges of the

floating platform or barges, not allowing nails or metal parts or useless timber

to spread around etc.

4. Supporting workmen with proper belts, ropes etc. when working on any

masters, cranes, grabs, hoist, dredges etc.

5. Taking necessary steps towards training the workers concerned in the use of

machinery before, they are allowed to handle it independently and taking all

necessary precautions in and around the ares where machines, hoists and

similar units are working.

6. Providing adequate number of boats (of at all required for plying water) to

prevent overload and overcrowding.

7. Providing life belts to all men working in such situation from where they may

accidentally fell into the water equipping the boats with adquate number of

life belts etc.

8. Avoiding bare livewires etc. as would electrocute workers.

9. Making all platforms, staging and temporaty structures sufficiently strong so

as not to cuase inconvenience and risk to the workmen and supervisory staff.

10. Providing sufficient first aid trained staff and equipment to be available

quickly at the work site to render immediate first aid treatment in case of

accidents due to suffocation, drowning and other injuries.

11. Take all necessary precautions with regard to use of divers.

12. Where the workers are required to work near machine are liable to accident

they should not be allowed to wear loose cloths like dhoti zabba etc.

31.2 Explosives :

Not Allowed.

31.3 Relation With Public Authorities :

The Contractor shall comply with all rules, regulations, byelaws and direction

given from time to time also by any local public authority in connection with this

work and shall himself pay fees or charges which are liveable on him without any

extra cost to the Department.

31.4 Indemnity :

The contractor shall indemnify the Council against all actions, suits, claims and

demands brought or made against him in respect of anything done or committed

to be done by the Contractor on execution of or in connection with the work of

this contract and against any loss or damage to the Council in consequence of

any action or suit being brought against the Contractor for anything done or

committed to be done in the execution of the works of this Contract.

31.5 Medical And Sanitary Arrangements To Be Provided For Labour Employed in

the Construction By the Contractor.

a) The contractor shall provide an adequate supply of potable for use of

labourers on work and in Camps.

b) The contractor shall construct trench or semi permanent latrines for the use

of the Labourers. Separate latrines shall be provided for men and women.

c) The contractor shall build sufficient number of huts on a suitable plot of land

for use of the Labourers according to the following specifications.

1) Huts of Bamboos and Grass may be constructed.

2) A good site not liable to submergence shall be selected on high ground remote

from jungle but well provided with trees, shall be chosen wherever it is available.

the neighbourhood of tank, jungle, grass or woods should be particularly avoided.

Campus should not be established close to large cuttings of earthwork.

3) The lines of huts shall have open spaces of at least ten meters between rows.

When a good natural site cannot procured, particular attention should be given to

the drainage.

4) There should be no over crowding. Floor space at the rate of 30 sq.ft. per head

shall be provided. Care should be taken to see that the huts are kept clean and in

good order.

5) The contractor must find his own land and if he wants Council land, he should for

it and pay assessment for it, if made available by Council.

6) The contractor shall construct a sufficient number of bathing places. Washing

places should also be provided for the purpose of washing clothes.

7) The Contractor shall make sufficient arrangements for draining away the surface

and silage water as well as water from the bathing and washing places and shall

dispose off this waste water in such way as 110 to cause any nuisance.

8) The contractor shall engage a Medical Officer with a travelling dispensary for a

Camp containing 500 or more persons if there is no Government or other private

dispensary situated within 8 kilometers from the camp. In case of emergency the

contractor shall arrange at his cost for transport for quick medical help to his sick

worker.

9) The contractor shall provide the necessary staff for effecting a satisfactory

drainage system and cleanliness of the camp to the satisfaction of the Engineer.

At least one seeper per 200 persons should be engaged.

10) The Assistant Director of Public Health shall be consulted before opening a

labour camp and his instruction on matters such as water supply, sanitary

conveniences, the camp site accommodation and food supply shall be followed

by the Contractor.

11) The contractor shall make arrangements for all anti malaria measures to be

provided for the labour employed on the work. The anit malaria meausre shall be

provided as directed by the Assistaant Director of Public Health.

32. Lining Out :

The Contractor shall provide free of charge all labour and material required for

lining out, surveying inspection decided by the Engineer as considered

necessary for the proper and systematic execution of the work. The department

will only show the changed points on the alignment of road and it will be the

responsibility of the contractor to correctly align the road straight between points

including setting out curves though the Department will render necessary

assistance. Likewise, only one Bench Mark with definite value or R.L. will be

shown to contractor who shall have to provide for a network of temporary bench

mark all along the road and near C.D. works for executing the work.

The contractor shall be responsible for the provision, accuracy and maintenance

of such temporary benckmark. He shall be responsible for the correctness of the

position, levels, dimensions and alignments of all parts of the works and

provision of necessary instruments and labour in connection with it, suitable

pointed bamboos or wooden stack shall be provided at his cost and firmly fixed at

every 50 meters on both sides of embankment to indicate final as well as

intermediate heights of the embankments. Any errors in position levels,

dimensions and alignment etc. shall be rectified by contractor at his expense. If

such error is due to incorrect data supplied in writing by the Engineer or his

authorised representative, the cost of rectification shall be borne by Council. the

checking or inspection of any setting out of any line or level or work by Engineer

or his representative shall not in any way relieve the contractor of his

responsibility or correctness thereof. The Contractor shall carefuly protect and

preserve all Bench Marks, Site Rails, Pegs and Stones etc. used in setting out

the works. Marking out the centre lines of C.D. works necessary approaches etc.

shall be done by the contractor at his own cost as directed by the Engineer.

33. Utilities And Sub-structures :

The contractor has to carry out work of utilities and services as per direction of

engineer. If any utility of service is found not covered under BOQ, the contractor

has to carry out the work as per direction of engineer including necessary co-

ordination with concerned services provider, payment for the same wil be made

as per provision in this contract. AMC will assist him in the matter. Some of the

utilities are included in the Schedule B some of utilities are unknown, with

permission of AMC & user department Contractor may be asked to remove the

services at accepted rate. The quantities of items pertain to suitability of various

utilities may increase or decrease. Contractor will not be paid any price variation

for variation in quantities. This is applicable to External Electrification, Water

Supply, drainage, street lights.

34. Fencing at construction site : The cost of the Fending at the construction site

in view to protect the material or goods stacks for construction activity and also

for the safety of people and workers from accidents and hazards required if any

shall be born by the contractor.

35. Site Officer, Laboratory & Facility to Field Staff (for each contract)

The Contractor shall provide a separate & independent site office of Semi

permanent type structure with attached toilet & bathroom arrangement for

consultants & AMC staff as well as laboratory for material testing, along with

furniture & electric fittings as required, during the contract duration as specified.

The Space for the same shall be provided by AMC.

Contractor shall maintain the structure during construction period inclusive of

payment of electric & telephone (Landline) bills, security & daily unkeep of the

premises. The designs and drawings shall be approved by Engineer in Charge /

Engineer. The area should be minium 75 sq.m. for site office of PMC etc. The list

of furniture & gadges is listed below. The contractor has to provide, maintain the

facilities in good condition. The cost of providing & maintaining these facilities is

incidentiaal to work and deemed to have included in the offer given by the

contractor, failing which non-refundable penalty of Rs. 1000/- (Rupees Thousand

Only) per day will be impose on contractor which he have to pay directly to the

PMC. After completion contractor should demolish site office and remove

furniture, fittings & etc. as per direction of Engineer. The contractor shall employ

2 civil engineers (B.E. Civil) with five years experience in construction with PMC

during contract period and their salaries are incidental to the work borne by the

contractor. If contractor fails to do this, then the payments on accounts of salary

of engineers Rs. 2000/- per day should be deducted from contractor’s payment

and diverted to PMC directly, till the ate of engagements of engineers.

The above facilities are to be provided and are incidental to work for each

contract executed with AMC separately. AMC shall not permit to use provided

facitlities in one contract to be used as common facilities in another contract.

36. Statutory Increase In Duties, Taxes etc.

All the taxes and duties levied by the State and Central Govt. and by Local

Bodies at the prevailing rates applicable on the date of receipt of tender shall be

fully borne by the Contractor and shall not be reimbursed to him on any account.

The tender shall be inclusive of all taxes levies, octroi etc. including the tax

liveable in respect of work contract under the provision of Maharashtra Sales Tax

as transfer of property in goods involved in the execution of Work Contract Act

1985 and its further amendments (Maharshtra ACT XIX of 1985) to be paid by

the Contractor. Further AMC shall not honour any claim arising out of any

increase in any of the prevailing statutory duties, taxes, levies, octroi etc. as the

same are inter-alias covered under the Price Variation Clause. At the time of

quoting / bidding contractor should bear the above fact in mind.

37. Site Test

The various works envisaged in the tender needs to be tested at site during /

after completion of the individual work. This testing is to be done as per the

standard procedure laid down in the relevant IRC MoRTH / I.S. and P.W.D.

specifications or any other standard being followed. The detailed specification

shall also be taken into consideration while carrying out the testing. The

frequency & type of test on various material & completed item shall be as per

PWD specifications. The sub work wise testing required is given in Note shall be

as below, which is only indicative :

Note : Course & Fine Aggregates should be tested for Aggregate _Alkali reactivity from

an approved laboratory. Contractor shall provide all facilities to conduct various test as

per IS & PWD specifications on site as specified at per his own cost & no extra payment

shall be made.

38. Mode of Measurement :

Mode of measurement shall be as per units mentioned in bill of quantities. In

case of discrepancy respective IS & PWD specifications shall be followed

(decision of Engineer / PMC shall be binding) except in case of excavation of

footings, trenches, block etc. the measurement shall be to the theoretical PCC

outer plumb line or actual line construction, whichever is less and shall be paid

for accordingly up to a depth of 4.5 m.

39. Extra Items

The contractor should not carry out any Work under Extra Items, unless the

approval for rates and execution is granted by the engineer in charge. The rates

of these items shall be decided by Executive Engineer & PMC and will be binding

on the contractor.

40. The contractor has to submit to AMC the safety plan indicating safety for workers

as well as citizens while carrying out the construction. After approval of AMC, the

contractor shall submit monthly report indicating the implementation and

experience recorded during the period. The contractor has to submit the work

area lighting plan to AMC while carrying out work in bad visibility condition.

The contractor has to get filled the test cubes for ready mix concrete when

reached at site only. The test shall be taken as per IS and failure of test would

attract removal of the respective concrete part i.e. beams, columns, slab,

footings, walls and other elements etc.

41. The Commissioner or his dully authorized Assistant shall open tenders in the

presence of contractors who have submitted tenders or their representative who

may be present at the time, and he will enter the amounts of the several tenders

in a comparative statement in a suitable form in the event of a tender being

accepted, the contractor shall for the purpose of identification sign copies of the

specifications and other documents mentioned in Rule. In the event of tender

being rejected. Commissioner shall authorize the Account Officer concerned to

refund the amount of the earnest money deposited to the contractor making the

tender on his giving a receipt for the return of the money.

42. All work shall be measured by standard measure and according to the rules and

customs of the Maharashtra Govt. Public Works Department and without

reference to any local custom.

43. The measurements of work will be takne according to the usual methods in use

is the Public Works Departments Govt. of Maharashtra and no proposals to

adopt alternative methods will be accepted. The Ahmednagar Municipal

Corporation of the Executive Engineer’s decision to what is “the usual method in

use in the Public Works Department will be final.

44. The contractor will have to make payment to the labour as per wages permitted

in minimum wages Act.
