If the tenant moves out according to this agreement and does not remove all their possessions, the tenant will have given up all right to these possessions and the landlord will be allowed to dispose of them. This agreement is void and the tenant does not have to move out if it was given to the landlord at the same time the tenant entered into the tenancy, or if the tenant had to sign it as a condition of the landlord granting the tenancy. Both the landlord and the tenant should keep a copy of this agreement for their records. Exceptions: Agreements to terminate a tenancy can be entered into at the same time the tenant enters into the tenancy if: the tenant is a student living in accommodation provided by a post-secondary institution or by a landlord who has an agreement with a post-secondary institution to provide the accommodation, or the tenant is occupying a rental unit in a care home for the purpose of receiving rehabilitative or therapeutic services, the period of occupancy agreed upon is not more than four years, and the tenancy agreement sets out that the tenant may be evicted when the objectives of the care services have been met or will not be met. (Note: this exception only applies where the housing is provided under an agreement between the landlord and a service manager under the Social Housing Reform Act, 2000.)
