(3) May 2, 2016 prevent light from unnecessarily falling outside the boundaries of the property on which a light fixture is installed; and WHEREAS, dark sky compliant outdoor lighting practices will conserve energy and resources; and WHEREAS, proclaiming the Municipality of West Grey a “Dark Sky Friendly Community” will protect our night-time environment and promote our community identity; and WHEREAS, the Municipality is prepared to lead by example and is committed to improving where possible by retrofitting or replacement, municipal lighting to ensure safety, security, effective and efficient use of energy; and WHEREAS, the Municipality, through the review of future exterior lighting within Site Plans and Subdivision Agreements and by the education of property owners to the benefits, shall encourage the use of dark sky compliant practices for exterior lighting. NOW THEREFORE, BE IT RESOLVED THAT the Corporation of the Municipality of West Grey hereby proclaims this Municipality as being a “Dark Sky Friendly Community”; and AND FURTHER THAT West Grey formally request that the County of Grey include a Dark Sky Friendly policy within their Official Plan to ensure compliance by all future developments and also encourage all other Grey County municipalities to consider adopting similar proclamations; and THAT this proclamation be forwarded to the Provincial and Federal Governments for their information and future support and recognition of this position. … #162-16 Carried. p.m., West Grey Municipal Office Part II - Regular Agenda Communications from the Mayor and Council Mayor Eccles, and Councillors Lawrence, Thompson, and Hutchinson, reported on past activities and events since the last regular meeting of Council, and on upcoming events and activities. Delegations Dale & Mary McKean Dale & Mary McKean, property owners at 323069 Durham Road East, came before Council to express concerns with the Durham water/sewer rates, as the rates have increased since 2013 from approximately $109/year to $152/year. Mr. McKean also expressed some concerns with the lack of water pressure to their property.

(5) May 2, 2016 Mayor Eccles indicated the Municipality installed a booster pump for upper Durham in 2011/12 to address water pressure issues, and noted he has not heard of water pressure problems since this project was completed. Mayor Eccles cited reasons for the increased cost of water/sewer services, noting there are further upgrades required to the Durham water/sewer system that users will be responsible to pay for in the future as well. Mayor Eccles indicated a reserve fund is being built up for future upgrades, and grants will be sought for the proposed upgrades. The Clerk cited some other water/sewer municipal costs of nearby towns/cities that were provided by the Director of Finance/Treasurer, noting the Durham water/sewer rates are quite reasonable compared to the others. The Director of Finance/Treasurer indicated Council approved increasing the water/sewer rates over a 2-year span, and Council is also looking to increase water/sewer rates in line with the annual cost of living adjustment. Mr. McKean asked if a West Grey employee can check the water pressure. Mayor Eccles responded that a West Grey Public Works employee will check the water pressure. Dr. Hazel Lynn, Medical Officer of Health, and Sarah Ellis, Manager, Grey Bruce Health Unit Dr. Hazel Lynn, Medical Officer of Health, and Sarah Ellis, Manager, Grey Bruce Health Unit, came before Council to provide an update respecting Grey Bruce Health Unit activities, and to discuss the proposed Ontario Health Study that will as part of the Study, investigate the health related concerns of individuals residing in the vicinity of industrial wind turbines. Dr. Lynn noted the Health Unit has undertaken a lot of work into improving water quality, and lessening the level of diseases associated with poor water quality as a result. One of the big achievements of the Health Unit during Dr. Lynn’s tenure is the passing of a no smoking by-law in Grey & Bruce Counties, resulting in a decrease in smoking related visits to health care facilities, and a decrease in smoking related deaths.

(7) May 2, 2016 Dr. Lynn reported the Health Unit is also working on a rabies protection program through the Ministry of Natural Resources and Forestry (MNRF), and the MNRF will be conducting a baiting program again this Fall. Dr. Lynn stated the Health Unit has worked hard on addressing alcohol abuse issues, and encouraging municipalities to have municipal alcohol policies for their facilities. Dr. Lynn indicated the Health Unit wants to work with communities on priorities for health, and encouraged individuals to enroll in the Ontario Health Study. The Ontario Health Study will, as part of the Study, conduct tests on individuals living in West Grey and Grey Highlands that reside in the vicinity of industrial wind turbines, in an attempt to assess any correlation between health impacts and industrial wind turbines. Council questioned why the Province does not ban individuals under the age of 19 years old from smoking. Dr. Lynn noted it is illegal for people under 19 to smoke on school grounds, and it is illegal for individuals to provide cigarettes to individuals under 19. Dr. Lynn noted smoking rates for individuals under the age of 19 living in Bruce-Grey have decreased, and the smoking rates are less than the Provincial average. Dr. Lynn also mentioned the Health Unit will need to address the issue of the de-criminalization of marijuana. Council asked Dr. Lynn how individuals can enroll in the Ontario Health Study. Dr. Lynn indicated individuals can enroll online, and the Ontario Health Study will arrange to come to a West Grey facility to take blood samples, and obtain other pertinent information. Dr. Lynn noted the Health Unit/Ontario Health Study is in contact with municipal staff to arrange a suitable venue. Council thanked Dr. Lynn for taking a stance on industrial wind turbines, and questioned if the Ontario Health Study could be skewed to the Provincial viewpoint respecting industrial wind turbines. Council also asked how many people will be included in the Ontario Health Study. Dr. Lynn stated the Ontario Health Study is a much better system, and they want large numbers of people to be assessed, particularly in areas such as Kingston, with a large number of industrial wind turbines. Dr. Lynn stated large groups of people are required for statistical analysis purposes.

(8) May 2, 2016 Council asked why the Health Unit is not considering other studies already completed regarding health related impacts due to industrial wind turbines. Dr. Lynn responded that the Ontario Health Study is not specifically for industrial wind turbine related issues, as a huge population base is needed to address other health issues such as cancer, and other diseases, however, the Ontario Health Study does want to assess possible health problems relating to industrial wind turbines. Mayor Eccles indicated the Ontario Health Study is a long term study, and won’t be only six months in duration. Council questioned if the Health Unit is considering the impact of neonics on bees. Dr. Lynn indicated the Health Unit did some research on cosmetic pesticides, but it is not one of their priority items. Council thanked Dr. Lynn for her presentation and congratulated Dr. Lynn on her pending retirement. Jackie Robertson Jackie Robertson came before Council to provide some community enhancement ideas for West Grey. Ms. Robertson requested more communication be made available for newcomers to the West Grey community and noted she was pleased to see that environmental concerns were identified as a priority item in the West Grey 2020 Action Plan. Ms. Robertson suggested West Grey implement a “Welcome Wagon” program, and farm animal care network. Ms. Robertson also suggested more household hazardous waste (HHW) days be made available, as well as more services be provided for children in local libraries. Business Arising from the Previous Meeting - None Staff Reports The CAO/Deputy Clerk introduced Brent Glasier, the new Director of Infrastructure and Public Works. Mr. Glasier thanked Council for his appointment as the Director of Infrastructure and Public Works, noting he looks forward to finding ways to create savings for ratepayers, and to work with the senior management team and Council. Mayor Eccles cited Mr. Glasier’s 27 years of past experience with Bruce County.

Cutting-Lawrence, Whereas, The Independent Electrical System Operator has requested input on the RFP process used to award renewable energy contracts; and, Whereas, the government indicated that new contracts would be directed to willing host communities with the Minister of Energy indicating on March 7 that it would be ‘almost impossible’ for a contract to be granted under the current process without municipal agreement; and, Whereas, three of the five contracts announced on March 10 did not have municipal support for the project; and, Whereas, the current process does not meet the government’s standards for openness and transparency because municipal Councils are asked to support power projects based on little or no detail and further, the recipient municipalities are unable to determine the basis on which individual contracts were awarded; and, Whereas, the Province has not demonstrated that renewable energy projects are of sufficient strategic importance in meeting Ontario’s electricity generation requirements and/or carbon emission reduction targets to warrant the Province taking action to override municipal decisions; Therefore, be it resolved that, the Municipality of West Grey requests:

1. That the Municipal Support Resolution become a mandatory requirement in the IESO process;

2. That the rules be amended to require that the resolution related to this support must be considered in an open Council meeting held after the community meeting organized by the proponent;

3. That full details of the project, including siting of project elements and site consideration reports, are required to be made available at the community meeting and to the Council before the resolution is considered;

4. That the terms of any municipal government related to the project also need to be discussed in open Council and that such agreements cannot contain terms that limit the municipality’s ability to exercise Municipal Act powers relative to the project;

New Business Rockwood Terrace (Council discussed the Grey County Consultants Report considering long-term care that contains an option to close Rockwood Terrace. Mayor Eccles stated he will do everything in his power to keep the beds at Rockwood Terrace. Council asked who will be discussing the long-term housing issue at the County level. Mayor Eccles indicated Health and Social Services and long-term care representatives will be considering this matter. Mayor Eccles suggested West Grey ratepayers email all Grey County Council members to provide their thoughts regarding the future of Rockwood Terrace. The CAO of the Local Health Integration Network (LHIN) is meeting with Grey County Council staff and the Grey County Warden on this matter, and will discuss what the LHIN is proposing. Mayor Eccles noted the Grey County Warden wants a decision on this issue made by the end of the year.)

Closed Session – Incomplete Items Only – n/a Matters Arising from Closed Session – Incomplete Items Only – n/a Question Period Christine Robinson asked why the Rockwood Terrace was not listed on the Council Agenda, while acknowledging her appreciation for the discussion that did take place earlier in the Council meeting. Christine Robinson noted Rockwood Terrace is a cultural, social, and economic institution of West Grey, and its closure would have a significant impact on West Grey. Mrs. Robinson opined that the Grey County consultants’ report is a flawed report, as for instance, it doesn’t include an option for improving Rockwood Terrace. Mrs. Robinson implored Council to do everything they can to retain Rockwood Terrace in West Grey. Council reiterated that citizens should contact all of Grey Council members to make their view known. Mayor Eccles indicated the issue of Rockwood Terrace was not on today’s agenda as Council/staff have not formulated a strategy to address this matter at this time. Council noted this issue was brought up during the Annual General meeting for the Durham Health Care Foundation, and the Council representative on the West Grey Chamber has requested the Chamber to draft a letter to the County of Grey to note their concerns. Paul Gutzke asked if West Grey can utilize similar resources for the east side of property at the Shoppers Drug Mart, similar to that being proposed for the May 14 Clean Sweep Program. Mayor Eccles noted Shoppers Drug Mart is located in the Town of Hanover, however, he will address this issue with the Town of Hanover.

(16) May 2, 2016 John S. Black noted his endorsement of Council’s comments respecting Rockwood Terrace. Mr. Black noted West Grey has identified upgrading fibre optic/high speed internet as a main priority item, and mused how things have changed since his 50 year term as Clerk of the former Township of Glenelg, and his father’s 52 years as Clerk of the former Township of Glenelg, and indicated his desire to come to a future Council meeting to note some of these changes. Council was asked if the West Grey Parks Committee has permission to use the wood chipper along a trail area in Durham. (Council indicated approval for the West Grey Parks Committee. The Director of Infrastructure and Public Works cited possible health and safety issues respecting the use of municipal equipment such as a chipper by volunteers. Other 1) Bruce Fulcher Bruce Fulcher, acting on behalf of Steven Lantz and Kim Lantz (Estate of Alice Lantz), owners of 518 Jacob Street, Neustadt, came before the Committee seeking guidance and direction in terms of changing the Future Development Zoning and Official Plan designation of the subject property to facilitate the building of a dwelling on the subject property. The current West Grey Comprehensive Zoning By-law and Official Plan requires municipal water and sewer services in Durham and Neustadt. Mr. Fulcher indicated the County of Grey Official Plan requires municipal water and sewer services if servicing is feasible. Mr. Fulcher noted if municipal water and sewer services were required for the subject property, a pumping station would be needed, and the cost would not make the extension of water and sewer service economically feasible.

Mr. Fulcher indicated the Lantz’ could provide an Undertaking if they were allowed to build a dwelling, requiring them to hookup to municipal water and sewer services when they become available. Steven Lantz recounted the history of the subject property and indicated they only wish to build one dwelling. The Clerk provided background to the requirement for full municipal services in Neustadt and Durham, noting that Council approved this provision to be included in the West Grey Comprehensive Zoning By-law, and the purpose being to ensure the efficient and effective use of lands and provision of services in the urban areas of Durham and Neustadt. The Committee asked how far municipal water and sewer services are from the subject property. Steven Lantz estimated municipal services are approximately ¼ mile away. Mr. Fulcher noted the assumptions to maximize the efficient use of the subject property is the landowner would want to sell the land for a plan of subdivision, which is not the case. The Municipal Planner noted the lands are zoned and designated Future Development. The Planner stressed that the Municipality has to consider the full development potential of the land, if these lands can be developed, and to what extent. The Municipal Planner noted when trying to expand urban boundaries, the County and Province makes it difficult to expand without sufficient justification, and the Province and County looks at how the lands can be developed efficiently and effectively. The Municipal Planner noted lengthy discussions were held in 2012 during the development of the West Grey Official Plan regarding the requirement for full water and sewer services, and Council approved this policy. The Municipal Planner also noted that a similar Official Plan application (OPA #1) was not approved by Council, as the subject property was proposed to be serviced by a private well and private septic system. The Committee asked the Municipal Planner about the question of feasibility of developing the subject lands without full municipal water and sewer services. Mr. Fulcher recited the applicable County of Grey Official Plan policy regarding the requirement for full services if feasible. The Municipal Planner noted you would have to look at the cost of developing these lands to the maximum potential with full municipal water and sewer services being available. Steven Lantz noted they are just looking at one dwelling. The Municipal Planner noted the lands have to be looked at in terms of maximizing the potential development of lands in the urban area of Neustadt.

Kim Lantz, noting it might cost $1.2 million to provide full services to the subject property, asked if an Undertaking could be entered into between the Municipality and the property owners that there would be agreement to hookup to municipal water and sewer services when they become available. The Committee indicated a willingness to consider a zoning by-law amendment and official plan amendment to permit a dwelling without full municipal services, subject to an Undertaking, and for the property owners to verify with the West Grey Public Works Department the feasibility of extending municipal water to the property. The Clerk indicated a zoning by-law amendment and official plan amendment would be required to facilitate the request from the property owners, and that the Committee cannot provide direction on whether or not such a proposal may be supported as the Committee needs to be open-minded with respect to any comments received during the Public Meeting. The Municipal Planner strongly suggested that the subject lands not be designated Residential, but be zoned/designated as an Exception to the Future Development Zone or Future Development designation, with the exception permitting a single detached dwelling without full municipal water and sewer services. The zoning by-law amendment should identify a specific building envelope through the SVCA, and to limit the area on the property that can be built on to mitigate the impact of the proposed detached dwelling on the maximum potential development of the subject property. The Municipal Planner indicated a Planning Justification Report by a qualified Planner will be required to justify that there is sufficient area for further development upon full water/sewer services being available to the subject property, and that a report from an engineer should indicate whether or not extending municipal water and sewer services is financially feasible. 5. Written comments were received from the Grey County Planning & Development Department, Saugeen Valley Conservation Authority, and Historic Saugeen. The Grey County Planning & Development Department indicated in a letter dated April 7, 2016 that County planning staff have no concerns with the subject application. The Saugeen Valley Conservation Authority indicated in a letter dated May 4, 2016 that the Authority is of the opinion that the proposed amendment appears to conform to the relevant policies of the Grey County Official Plan, the Local Official Plan, and Provincial Policies referred to in the Agreement.

The Committee requested section 6.14 c) be amended to permit up to a 20% retail component for home industries. Background & Analysis

The purpose of this staff report is to inform Council of the building activities that

were conducted within the Municipality for the month of April 2016.

Construction within the municipality is steady with 4 new home permits issued this

month. A total of 16 permits were issued with a total construction value of $1,203,500.00

Attached to this report is Appendix “A” Monthly Report for April.

Approval of Voucher No. 9-2016 in the amount of $329,724.08.

FTR#1 Recommendation: That Council approves Voucher No. 9-

2016.

Approval of the 2015 Financial Statements Consideration of the 2015 draft Financial Statements for Council approval.

FTR#2 Recommendation: That Council hereby accepts and approves

the Municipality of West Grey Consolidated Financial Statements for

the year ended December 31, 2015 as prepared by BDO Canada LLP.

RealTerm Energy LED Streetlight Investment Grade Audit At the last Council meeting further questions were asked regarding the

Street Light proposal.

We have been advised that there is no salvage value in the old lights that will be removed from Elmwood.

The Municipality has assumed the Phase 1 portion of Marshall Heights. The

poles in the Marshall Heights subdivision cannot be retro-fitted with the cobra head fixture. If the six decorative lights in Phase 1 are not switched

to LED and the developer is required to use LED for the remaining Phases of the development then there will be a visible difference in the lighting. I have

requested an estimate from RealTerm Energy on the difference to the total

project cost if these six decorative lights are removed from the project and this information should be available for the meeting. The decorative lights

are not eligible for the grant.

The Municipality has not yet assumed MacDonald Crescent but will be in the near future. There is one decorative light fixture in this subdivision. I have

Topic: Work Summary – Informational Purposes

The following is a brief summary of the contracted work and the maintenance activities the staff has been working on as of May 2, 2016

Contracted Work

Winter Sand – Cedarwell has recently completed placing the sand in the Bentinck Shed and currently working placing sand in the Normanby Shed in

Ayton. The Glenelg Shed will be completed later this summer.

Owen King Limited will be commencing with the repairs to structures 57, 64

and 65 this week.

Maintenance Work Staff is currently working on the following maintenance projects:

Sweeping – completed in Bentinck and Normanby and commencing Glenelg.

Bridge washing Winter maintenance equipment washing, inspection and storage.

Catch basin cleaning. Trail Cleanup - from Douglas St. to Saugeen River completed with an

application of stone dust to follow in a few weeks to the first phase. Upgrades to Chlorine panels at Durham Well #1 and #2 completed.

Line painters are commencing work in Ayton followed by Neustadt,

Elmwood and Durham.

Half loads were lifted in early May

Dust Control – Application of Calcium Chloride is scheduled May 24th after the Victoria Day Holiday.

Delegations to the AMO Conference

MMAH has advised us that the window to apply for delegations at the upcoming AMO conference is open until June 29, 2016.

Should Council wish to direct me to make application please advise me the Ministry and issue we wish to discuss.

Seeking Council’s Direction

Discussions with Waste Management Proponent

As per Council’s instructions, I met with the proposed proponent to provide waste and recycling pick up as part of the three municipalities

RFP. At that meeting I presented the questions posed from the Council meeting.

They would be willing to work with West Grey to accommodate a

revised pick up schedule. They were advised that we will not consider the single pass collection in rural areas.

They would be willing to continue to work with us regarding the over flowing bins at the Durham Site on Monday`s.

They further commented that the quoted prices were for the three municipalities agreeing to the proposal.

I was just verbally advised that Grey Highlands will not be participating in the joint proposal.

2016 OMAA Spring AGM and Training Symposium I would like to thank Council for the opportunity to attend this session

May 11 – 13 in Alliston. It was a great opportunity to learn, network and discuss items of mutual interest and concern.

For Council’s Information

Grey County CAO’s Meeting Our quarterly meeting was hosted by Hanover on May 6th and we met

at the Launch Pad Youth Centre. Launch Pad is a very nice facility and moving forward with increasing youth participation and usage from

across the area.

A number of topics of mutual interest were discussed including Grey County presentations on corporate communications, the Official Plan

update and County Strategic Plan. There were several topics from the local CAO’s as well dealing with

Conservation Authority Rules, Distribution of 911 sign blades, health and safety updates and new legislative requirements, joint servicing

and other issues. This was a great local opportunity to meet and network with my peers

and further items of mutual interest.

For Council’s Information

Baseline Road update with the Town of Minto

Former Director Ken Gould notified Council that Minto had contacted him regarding updating the boundary road. Council approved the

matter and it was sent to tender which closed in late April. Minto has now processed the tender and approved it through their Council.

The scope of work was repaving and shouldering of Baseline Road. Our 2016 budget included a total of $300,000 for the project with the cost

being split at $150,000 each. The tender pricing was $259,626.80 plus HST.

I am subsequently requesting Council approve the works and instruct Mr. Glasier to notify Minto of this decision.
