AND IN THE MATTER OF the Premises known as Municipal number 848 Upper WentworthStreet, in the City of Hamilton and in a "C/S-1652-H" (Urban Protected Residential, etc.)district;

AND fN THE MATTER OF AN APPLICATION by the owner Colin Scott, for relief from theprovisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O.1990, c. P. 13, so as to permit the existing building to be altered to contain a hair dressingestablishment with one (1) accessory dwelling unit only in order to facilitate Site PlanApplication File # MDA-15-088 notwithstanding that:

1. The boundary of the parking area shall be 0.0m from the northerly lot line and 0.0mfrom the easterly lot line for a 4.2m portion extending south from the northerly side lot lineinstead of the requirement that the boundary of every parking area on a lot containing five ormore parking spaces located on the surface of a lot adjoining a residential district shall befixed not less than 1.5 metres from the adjoining residential district boundary;

2. A minimum 1.5m planting strip shall be provided and maintained along the rear lot line,with the exception of 4.2m section extending from the northerly side lot line which shall be0.0m for vehicle manoeuvring instead of the requirement that a 1.5m planting strip shall beprovided along the rear lot line with the exception of a 4.1m section extending from thenortherly side lot line; and,

3. A sign shall be permitted within a landscaped area instead of the requirement that alandscaped area shall be fully and completely open and exposed to natural light and air andunobstructed above the surface.

NOTE:

i) The variances are necessary tofacilitate Site Plan Control Application MDA-15-088.

ii) The applicant shall confirm that there is either a formerly established right-of-way ormutual driveway between the subject lands and the lands to the north known municipally as844 Upper Wentworth Street. If a right-of-way or mutual driveway is not or cannot beestablished, additional variances shall be necessary.

iii) The"'4"ÿ (Holding) provision shall be removed prior to development of the building for ahair dressing establishment.

3. No onsite manoeuvring shall be provided for the required parking space instead of therequirement that a manoeuvring space abutting and accessory to each required parkingspace shall be provided and maintained on the lot;

4. A minimum parking space length of 5.5m shall be permitted instead of the minimum6.0m parking space length required;

5. An access driveway (specifically the door width opening into the private garage) havinga minimum width of 2.1m shall be permitted instead of the minimum 2.8m wide accessdriveway width required; and,

6. The existing rear yard shed shall be permitted to be located as close 0.5m to thesoutherly side lot line instead of the minimum 6.0m setback required.

Notes:

i) The zoning By-law requires a minimum 50.0% of the gross area of the front yard and aminimum 50.0% of the gross area of the side yard to be maintained as landscaping. Nodetails were provided to confirm compliance.

ii) The parking area shall not occupy more than 50.0% of the gross area of the side yard.No details were provided to confirm compliance.

4. Visitor parking required for the semi-detached dwellings, landscaped area and sidewalksshall be permitted within the common element lands instead of being provided on the lot on whichthe principal use is located.

The maximum eave and gutter projection permitted is 0.6m into any required yard. Insufficientinformation was provided to confirm compliance.

Please note where a driveway is provided in the front yard all portions of the front yard shall bemaintained as landscaped areas. In addition, no parking spaces shall be permitted within arequired front yard.

AND ÿN THE MATTER OF the Premises known as Municipal number 114 Emerson Street, in theCity of Hamilton and in a "G" (Neighbourhood Shopping Centre, etc.) district;

AND IN THE MATTER OF AN APPLICATION by the owners Changbao Shen & Doudou Liu, forrelief from the provisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act,R.S.O. 1990, c. P. 13, so as to permit the establishment of a two (2) family dwelling within theexisting building and recognize existing site conditions notwithstanding that;

1. A minimum northerly and southerly side yard width of 0.9m shall be permitted instead ofthe minimum 1.2m side yard width required;

2. A minimum rear yard depth of 7.2m shall be permitted instead of the minimum 7.5m rearyard depth required;

3. A minimum lot width of 7.6m shall be permitted instead of the minimum 12.0m lot widthrequired;

4. A minimum lot area of approximately 220.0m2 shall be permitted instead of the minimum360.0m2 lot area required;

5. No onsite manoeuvring shall be provided for the two (2) required parking spaces insteadof the requirement that a manoeuvring space abutting and accessory to each required parkingspace shall be provided and maintained on the lot;

6. The accessibility to the rear parking space may be obstructed by another vehicle whereasthe By-law requires an unobstructed access driveway to the parking space;

7. A minimum parking space size of 2.6m x 5.5m shall be permitted instead of the minimum2.7m x 6.0m parking space size required; and,

8. Required parking and parking areas may be permitted in the required front yard whereasthe By-law states that no part of the required parking area shall be located in a required front yard.

Notes: An eave or gutter may project into a required side yard not more than one-half of it width or1.0m whichever is the lesser. Therefore, if the requested 0.9m side yard is approved, a maximum0.45m eave or gutter projection shall be permitted. Insufficient details were provided to determinecompliance.

The Zoning By-law requires a minimum 50.0% of the gross area of the front yard to be maintainedas a landscaped area. Insufficient information was provided to confirm compliance.

A minimum of two (2) parking spaces are required for the proposed two (2) family dwelling.

AND iN THE MATTER OF AN APPLICATION by the agent Armstrong Planning & ProjectManagement on behalf of the owner Hughson Street Baptist Church, for relief from theprovisions of the Zoning By-Law No. 6593, under Section 45 of The Planning Act, R.S.O.1990, c. P. 13, so as to permit the redevelopment of the existing church thorough theconstruction of a one storey gymanatorium and well as the construction of a four storey forty-two (42) unit lodging house notwithstanding that;

1. A maximum of forty-two (42) lodgers shall be permitted instead of the maximum six (6)lodgers permitted;

2. The lodging rooms shall be permitted to have their own individual bathrooms and/or,kitchen facilities for the exclusive use of individual occupants whereas the By-law states thatthe lodging rooms do not have bathrooms and/or kitchens facilities for the exclusive use ofindividual occupants;

3. A maximum height of 4 storeys and 15.0m shall be permitted instead of the maximum2 storeys and 14.0m permitted;

4. A minimum front yard depth of 2.2m shall be permitted along James Street instead ofthe minimum 6.0m front yard depth required;

5. A minimum northerly side yard width of 0.0m shall be permitted instead of theminimum 1.2m side yard width required;

6. A minimum rear yard depth of 0.0m shall be permitted for the lodging house instead ofthe minimum 7.5m rear yard depth required;

7. A manoeuvring aisle having a minimum width 5.7m shall be permitted instead of theminimum 6.0m manoeuvring aisle width required;

8. A minimum parking space size of 2.6m wide x 5.5m long shall be permitted instead ofthe minimum 2.7m wide x 6.0m long parking space size required;

9. No planting strip shall be provided between the parking spaces and the adjacentnortherly residential "D" district whereas the By-law requires a minimum 1.5m wide plantingstrip to be provided;

10. No visual barrier shall be provided along the boundary of the lot abutting the northerlyresidential district whereas the By-law requires a minimum 1.2m high visual barrier;

11. A roofed-over unenclosed porch including the stairs shall be permitted to encroach intothe entire depth of the required front yard instead of the maximum 3.0m projection permittedand the minimum 3.0 setback required from the front lot line; and,

12. An uncovered porch shall be permitted to be located as close as 0.0m to the street lineand as close as 0.0m to the northerly side lot line instead of the minimum 1.5m setbackrequired from the street line and the minimum 0.5m setback required from the northerly sidelot line.

Note: Variances have been written exactly as requested by the applicant. This property issubject to Site Plan Control; to date, no formal site plan application has been submitted.Please note further variances may be required at such time that a formal site plan applicationis submitted and reviewed for zoning compliance on the proposed development.

The applicant requested a variance to reduce the required number of parking to 35 spaces.However, a minimum of twenty-one (21) parking spaces are required for the proposed lodginghouse (at a rate of 1 space for every 2 persons) and no parking is required for the place ofworship. Please note that if the place of worship functions as a community centre, additionalparking at a rate of 1 space per every six (6) persons shall be required. The applicant shallprovide further details respecting the use in order to accurately establish the use anddetermine overall on-site parking.

The applicant requested 'a variance to reduce the required number of loading spaces to 0.0spaces. However, no loading spaces are required for a lodging house and no loading spacesare required for a public use.

The applicant requested for a variance to reduce required visitor parking; however, no visitorparking is required for a lodging house.

Please note that the concrete curb shall not form part of the landscaped area. Therefore,further variances may be required to reduce the width of the landscaped area provided. Thisshall be verified by the applicant. '

6. No on-site manoeuvring space shall be provided instead of the minimummanoeuvring space width of 6.0 metres required to be provided abutting upon andaccessory to each provided parking space;

7. A minimum parking space size of 2.6 metres in width x 5.5 metres in length shallbe provided instead of the minimum required parking space size of 2.7 metres in width x6.0 metres in length; and,

8. Parking spaces shall be permitted to be located within the front yardnotwithstanding parking spaces are not permitted to be located within a front yard.

NOTES:

1. A further variance will be required if a basement, defined as having more than one-half of its clear height above grade, is provided and not a cellar, defined as having morethan one-ha!f of its clear height below grade.

Eaves and gutters for both existing sheds shall be permitted to project not more than0.5m into the southerly side yard so that they are as close as 0.1m to the southerly side lot lineinstead of the requirement that an eave or gutter may project into the required 0.6m side yardnot more than ½ of its required width (being 0.3m).

NOTE:

1. A minimum easterly side yard of 2.7m shall be permitted instead of the minimum5.0m side yard required; and,

2. An unenclosed roofed-over deck shall be permitted to be located as close as 2.1mfrom the easterly side lot line instead of the minimum required 2.7m side yard setback.

Notes:

i) The elevation drawings do not show the height dimension. Therefore, compliancecould not be determined for the maximum permitted height.

ii) A roofed-over unenclosed deck including eaves and gutter shall not encroach intoa minimum required side yard area. Therefore, if the requested 2.7m side yard isapproved, the porch including eaves/gutter shall maintain a minimum 2.7m setback fromthe easterly side lot line. The width of the eave and gutter has been assumed to be atleast 0.6m wide resulting in the porch to be as close as 2.1m to the side lot line. Pleasenote that this is only an approximation and shall be confirmed by the applicant.

iii) An eave or gutter for the principle building may project a maximum of 0.6m into thewestedy required side yard and a maximum of 1.0m into the easterly required side yard.While it appears that it may conform, insufficient details were provided on the site plan toconfirm compliance.
