AN ACT TO APPROPRIATE TWO HUNDRED SIXTY TIIOUSAND DOLLARS ($260,000) FOR IMPROVELIENTS TO THE RECREATION FACILITIES AT THE AFLLEJE AND NIMITZ BEACHES AT AGAT.

BE I T ENACTED BY THE PEOPLE OF THE TERRITORY O F GUAM:

Section 1. Ninety-Five Thousand Dollars ($95,000) are hereby

appropriated from the General F u n d t o the Department of Public 'Works (the

"Departmentn) to provide sidewalks, a u t o barriers, picnic fad l i t i e s , showers , pavi l ions and shelters, demolish the old restroom, and to

landscape and otherwise beau t i fy Nirnit z Beach, Aga t . Section 2 . Ninety-Five Thousand Dollars ($95 ,000 ) are appropriated

from the Genera l Fund to the Department to improve the shelters and picnic

fadlitlea at ~ f l l e j e Beach, Aga t and to landscape the same.

Section 3. Fifty Thousand Dollars ($50,000) are appropriated from the

General Fund to the Department to improve the basketball court at Nimitz

Beach, Agat.

Section 4. Twenty Thousand Dollars ($20,000) are appropriated from

the General Fund to the Department to improve the Agat Basketball Court.

Section 5. The Agat Municipal Planning Council shall coordinate the

projects authorized by this Act with the Department of Parks and

Recreation and the Department. The contracting officer for the projects

shall be the Mrector of the Department.

Dear Senator Gutierrez:

I want to thank the Legislature for their support on the Governor's Capitol Imprwement Project as rec-ended in the FY 1990 Budget submissions.

I am testifying on Bill No. 802, an act to appropriate the sum of tvo hundred sixty thousand dollars for imprweaante to the recreational facilities in Agat and at Ninitz Beach.

Of the three areas proposed for imprweaent funding, two - Nimitz Beach t and Rizal Beach, known as Aflleje Memorial Beach Park, are under the jurisdiction of the Department of Parks and Recreation. Regarding the Nimitz Beach, we recomnend that the scope of work listed in Section 1 of Bill No, 802 be expanded to include denolition of the old restroom and storage facility and to construct picnic facilities that are needed.

Section 2 appropriates $95,000 for itlrprwements for the shelters at Rizal Beach, We would recmend that the scope be expanded to state picnic facilities including shelters.

Section 3 is to conetruct a basketball court at Nidtz Beach to serve the youths fror that area of Nidtz that has no recreational facilities.

We support Section 5 to renwate improving the lighting at the existing Agat Multipurpose Court which is highly used by the people of &at, The facility plays a major role in successful recreational program8 for Agat.

Therefore, with these changes, we r e c m n d enactment of Bill lo. 802.

BACKGROUND

A public hearing on Bill No. 802 was conducted by the Committee on Ways and Means on Wednesday, July 19, 1989 at the Legislative Session Hall.

Bill No. 802 would appropriate Two Hundred Sixty Thousand Dollars ($260,000) from the General Fund to the Department of Parks and Recreation for improvements to the recreational facilities in Agat and at Nimitz Beach.

TESTIMONY

Director of Parks and Recreation, Anthony C. Mariano, submitted written testimony in support of Bill No. 802. Mr. Mariano recommends that Section 1 of Bill 802 be expanded to include the demolition of the old restroom and storage facility. He recommends that the projects at the Rizal Beach include building picnic facilities as well as picnic shelters.

The Committee on Ways and Means recommends that Bill No. 802, as substituted, be passed by the Twentieth Guam Legislature.
