OVERVIEW: This application proposes to construct a new house on a subdivided section of the property at 6625 Lincoln Drive. The new property with the new house would be known as 6627 Lincoln Drive. The Historical Commission designated the Nichols-Goehring House property at 6625 Lincoln Drive on 11 January 2019. The designated parcel is shown on a site plan from the nomination in Figure 1. The property owner subdivided the property that was known as 6625 Lincoln Drive into five parcels known as 6619, 6621, 6623, 6625, and 6627 Lincoln Drive with a deed that is dated 9 January 2019 and recorded on 11 January 2019, the day that the property was designated. A zoning permit for the subdivision had been issued in 17 September 2018. The Historical Commission notified the property owner that it would consider designating the property at 6625 Lincoln Drive on 12 November 2018, thereby initiating its jurisdiction over the entirety of the property originally known as 6625 Lincoln Drive, which was later subdivided into five properties. In May 2020, the Historical Commission was notified that three houses were under construction at 6625 Lincoln Drive, presumably without permits. The staff visited the site and photographed the three houses under construction as well as one foundation being excavated. The staff contacted the Department of Licenses & Inspections about the construction that was underway without the Historical Commission’s review or approval. The Department responded that the houses had been permitted under the addresses 6619, 6621, and 6623 Lincoln Drive. The permits had been applied for on 26 April 2019 and issued on 10 September 2019. A Google Streetview photograph shows that site work and the construction of the foundations was underway in November 2019. The Department of Licenses & Inspections did not refer the new construction permit applications to the Historical Commission because they had been issued under 6619, 6621, and 6623 Lincoln Drive, addresses that did not exist at the time of designation; only 6625 Lincoln Drive was identified as historic. The permit referral system was designed to catch subdivisions and carry the historic designation marker from the parent to the child property, but it did not in this case. The Department of Licenses & Inspections declined to revoke the permits because the mistake had been made within the City system and revoking the permits would open the City to liability. The fourth house contemplated for the site was not permitted with the other three in 2019. Despite not having any permits for construction at 6627 Lincoln Drive, the developer began excavating for a foundation in the spring of 2020. The staff photographed the unpermitted work underway on 11 May 2020 and requested a violation for work without a permit on 12 May 2020 through the City’s 311 system. That violation was apparently never issued. This application proposes the new house for the new parcel at 6627 Lincoln Drive. While the first three houses were located off to the side of the historic house, the fourth house would be situated directly in front of the historic house. The excavation for the foundation has been completed. The proposed house would be three stories tall and clad in Wissahickon schist at the front and stucco at the sides and rear. A one-story garage wing would be entered from a drive at the rear.

SCOPE OF WORK:
Construct house STANDARDS FOR REVIEW: The Secretary of the Interior’s Standards for the Treatment of Historic Properties and Guidelines include:
Standard 9: New additions, exterior alterations, or related new construction shall not destroy historic materials, features, and spatial relationships that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment.
o While the design of the proposed house is compatible with the historic house and site, its location in the front yard of the historic house is not. The construction of a house in the front yard of the historic house would destroy historic spatial relationships. The new work would not protect the historic integrity of the property.
Guidelines for New Exterior Additions to Historic Buildings and Related New Construction:
o Recommended: Locating new construction far enough away from the historic building, when possible, where it will be minimally visible and will not negatively affect the building’s character, the site, or setting.
o Not Recommended: Placing new construction too close to the historic building so that it negatively impacts the building’s character, the site, or setting.
o Recommended: Considering the design for related new construction in terms of its relationship to the historic building as well as the historic district and setting.
o Not Recommended: Adding new construction that results in the diminution or loss of the historic character of the building, including its design, materials, location, or setting.
o The proposed house will be highly visible and will negatively impact the historic building’s character, site, and setting. The new construction will result in the diminution or loss of the historic character of the older building and its setting. The yard directly in front of the historic house should be left open to maintain the historic space and views.
STAFF RECOMMENDATION: Denial, pursuant to Standard 9 and Guidelines for New Exterior Additions to Historic Buildings and Related New Construction.

INSTALL CONSTRUCTION FENCING AROUND SUBSURFACE INFILTRATION AREAS. IFAREAS ARE COMPACTED DURING CONSTRUCTION, ADDITIONAL INFILTRATION TESTING AND POTENTIAL REDESIGN EFFORTS MAY BE REQUIRED.
2. PROVIDE EROSION AND SEDIMENTATION CONTROL PROTECTION ON THE SITE SUCH THAT CONSTRUCTION RUNOFF IS DIRECTED AWAY FROM THE PROPOSEDSUBSURFACE INFILTRATION SMP. SEDIMENT DEPOSITED IN A SUBSURFACE INFILTRATION SMP DURING CONSTRUCTION, PARTICULARLY A STONE BED, CANSIGNIFICANTLY REDUCE SMP PERFORMANCE. THE DESIGNER IS REFERRED TO THE LATEST EDITION OF THE PENNSYLVANIA DEPARTMENT OF ENVIRONMENTALPROTECTION (PA DEP) EROSION AND SEDIMENT POLLUTION CONTROL PROGRAM MANUAL FOR INFORMATION ON DESIGN STANDARDS FOR EROSION ANDSEDIMENTATION CONTROL PRACTICES.
3. INFILTRATION AREAS MAY NOT BE USED AS SEDIMENT TRAPS DURING CONSTRUCTION, UNLESS AT LEAST TWO FEET OF SOIL ARE LEFT IN PLACE WHILE THE AREA ISSERVING AS A SEDIMENT TRAP AND SUBSEQUENTLY REMOVED DURING CONSTRUCTION AFTER THE CONTRIBUTING DRAINAGE AREAS HAVE BEEN STABILIZED.
4. COMPLETE SITE ELEVATION GRADING AND STABILIZE ALL DISTURBED SOIL. STABILIZATION OF DISTURBED AREAS MUST BE IMPLEMENTED BEFORE FINALIZING THESUBSURFACE INFILTRATION SMP’S EXCAVATION AND CONSTRUCTION.
5. EXCAVATE SUBSURFACE INFILTRATION AREA TO PROPOSED DEPTH AND MANUALLY GRADE AND SCARIFY THE EXISTING SOIL SURFACE. THE BOTTOM OF THEINFILTRATION BED MUST BE AT A LEVEL GRADE.
6. EXISTING SUBGRADE MUST NOT BE COMPACTED OR SUBJECT TO EXCESSIVE CONSTRUCTION EQUIPMENT PRIOR TO PLACEMENT OF GEOTEXTILE AND STONE BED. THEUSE OF MACHINERY TO LOAD STONE FROM OUTSIDE OF THE INFILTRATION BED FOOTPRINT IS RECOMMENDED. STONE SHOULD BE CAREFULLY PLACED, NOT DUMPED, INTHE INFILTRATION BED. IF IT IS ESSENTIAL THAT EQUIPMENT BE USED IN THE EXCAVATED AREA, ALL EQUIPMENT MUST BE LOW GROUND PRESSURE EQUIPMENT ANDAPPROVED BY PWD. USE OF EQUIPMENT WITH NARROW TRACKS OR TIRES, RUBBER TIRES WITH LARGE LUGS, OR HIGH PRESSURE TIRES WILL CAUSE EXCESSIVECOMPACTION AND MUST NOT BE USED. SHOULD THE SUBGRADE BE COMPACTED DURING CONSTRUCTION, ADDITIONAL TESTING OF SOIL INFILTRATION RATES AND SMPREDESIGN MAY BE REQUIRED. ROCK CONSTRUCTION ENTRANCES MUST NOT BE LOCATED ON TOP OF AREAS PROPOSED FOR INFILTRATION PRACTICES.
7. PLACE GEOTEXTILE AND STONE AGGREGATE IMMEDIATELY AFTER APPROVAL OF SUBGRADE PREPARATION TO PREVENT ACCUMULATION OF DEBRIS OR SEDIMENT.PREVENT RUNOFF AND SEDIMENT FROM ENTERING THE INFILTRATION BED DURING THE PLACEMENT OF THE GEOTEXTILE AND AGGREGATE BED.

1. TEMPORARY SEEDING FOR CRITICAL AREAS:
1. DURING THE LIFE OF THE PROJECT, ALL EROSIONAND SEDIMENT CONTROL DEVICES MUST BEPROPERLY MAINTAINED. MAINTENANCE MUSTINCLUDE INSPECTION OF ALL EROSION ANDSEDIMENT CONTROL ON A WEEKLY BASIS ANDBEFORE ANY ANTICIPATED PRECIPITATIONEVENTS, AND AFTER ALL PRECIPITATION EVENTS,IMMEDIATELY PERFORM CLEANOUT, REPAIRS,AND REPLACEMENT OF THE FACILITIES ASNEEDED.

2. INLET PROTECTION SHOULD BE PROVIDED FOR ALL INLETS OWNED BY PWDTHAT ARE LOCATED WITHIN ONE BLOCK OF THE PROJECT SITE.
3. PWD IS NOT RESPONSIBLE FOR ANY CLEANING OR REPAIRS NEEDED ONCITY-OWNED INFRASTRUCTURE DUE TO FAILURE OF ANY EROSION ANDSEDIMENT CONTROL PRACTICES. 6625 LINCOLN DR., LLC TO BE RESPONSIBLEFOR CLEANING AND REPAIRING OF CITY-OWNED INFRASTRUCTURE DUE TOFAILURE OF EROSION AND SEDIMENT CONTROL PRACTICES.
4. INSPECTION AND MAINTENANCE OF ALL EROSION AND SEDIMENT CONTROL BESTMANAGEMENT PRACTICES SHALL OCCUR ON A WEEKLY BASIS, BEFORE ANYANTICIPATED PRECIPITATION EVENTS, AND AFTER ALL PRECIPITATION EVENTS.
5. THE MAXIMUM HEIGHT FOR STOCKPILE AREAS SHALL BE 20 FEET. THE MAXIMUMSIDE SLOPE FOR STOCKPILE AREAS SHALL NOT EXCEED 2:1.
6. THE ROCK CONSTRUCTION ENTRANCE THICKNESS SHALL BE CONSTANTLYMAINTAINED ON-SITE. A STOCKPILE SHALL BE MAINTAINED ON-SITE FOR THISPURPOSE. AT THE END OF EACH CONSTRUCTION DAY, ALL SEDIMENT DEPOSITEDON PAVED ROADWAYS SHALL BE REMOVED AND RETURNED TO THECONSTRUCTION SITE. IN NO CASE SHALL THE SEDIMENT BE WASHED, SHOVELED,OR SWEPT INTO ANY ROADSIDE DITCH, STORM SEWER, OR SURFACE WATER.
7. FILTER FABRIC FENCE SHOULD BE INSTALLED AT LEVEL GRADE. BOTH ENDS OFEACH FENCE SECTION SHOULD BE EXTENDED AT LEAST 8 FEET. SEDIMENT MUSTBE REMOVED WHEN ACCUMULATIONS REACH 12 THE ABOVE GROUND HEIGHT OFTHE FILTER FENCE.
8. ANY FENCE SECTION WHICH HAS BEEN UNDERMINED OR TOPPED MUST BEIMMEDIATELY REPLACED WITH A ROCK FILTER OUTLET. SEDIMENT MUST BEREMOVED WHEN ACCUMULATIONS REACH 13 THE HEIGHT OF THE OUTLET.
9. EROSION CONTROL BLANKETING SHALL BE INSTALLED ON ALL SLOPES 3H:1V ORSTEEPER WITHIN 50 FEET OF A SURFACE WATER AND ON ALL OTHER DISTURBEDAREAS SPECIFIED ON THE PLAN MAPS AND/OR DETAIL SHEETS.
10. IMMEDIATELY UPON DISCOVERING UNFORESEEN CIRCUMSTANCES POSING THEPOTENTIAL FOR ACCELERATED EROSION AND/OR SEDIMENT POLLUTION, THEOPERATOR SHALL IMPLEMENT APPROPRIATE BEST MANAGEMENT PRACTICES TOMINIMIZE THE POTENTIAL FOR EROSION AND SEDIMENT POLLUTION AND NOTIFYPWD AND PA DEP.
11. UNTIL THE SITE IS STABILIZED, ALL E&S BMPs SHALL BE MAINTAINED PROPERLY.MAINTENANCE SHALL INCLUDE INSPECTIONS OF ALL E&S BMPs PRIOR TO ANYANTICIPATED STORM EVENT, AFTER EACH RUNOFF EVENT AND ON A WEEKLYBASIS. ALL PREVENTATIVE AND REMEDIAL MAINTENANCE WORK, INCLUDINGCLEAN OUT, REPAIR, REPLACEMENT, REGARDING RESEEDING, REMULCHING,AND RENETTING, MUST BE PERFORMED IMMEDIATELY. IF THE E&S BMPs FAIL TOPERFORM AS EXPECTED, REPLACEMENT BMPs, OR MODIFICATIONS OF THOSEINSTALLED, WILL BE REQUIRED.
12. ALL EARTH DISTURBANCES, INCLUDING CLEARING AND GRUBBING, AS WELL ASCUTS AND FILLS, SHALL BE DONE IN ACCORDANCE WITH THE APPROVED E&SPLAN. A COPY OF THE APPROVED DRAWINGS MUST BE AVAILABLE AT THEPROJECT SITE AT ALL TIMES. PWD SHALL BE NOTIFIED OF ANY CHANGES TO THEAPPROVED PLAN PRIOR TO IMPLEMENTATION OF THOSE CHANGES. PWD MAYREQUIRE A WRITTEN SUBMITTAL OF THOSE CHANGES FOR REVIEW ANDAPPROVAL AT ITS DISCRETION.
13. AT LEAST THREE (3) DAYS PRIOR TO STARTING ANY EARTH DISTURBANCEACTIVITIES, OR EXPANDING INTO AN AREA PREVIOUSLY UNMARKED, THEPENNSYLVANIA ONE CALL SYSTEM INC. SHALL BE NOTIFIED AT 1-800-242-1776FOR THE LOCATION OF EXISTING UNDERGROUND UTILITIES.
14. ALL EARTH DISTURBANCE ACTIVITIES SHALL PROCEED IN ACCORDANCE WITHTHE SEQUENCE PROVIDED DEVIATION FROM THAT SEQUENCE MUST BEAPPROVED IN WRITING BY PWD AND THE PA DEP PRIOR TO IMPLEMENTATION.
15. AREAS TO BE FILLED ARE TO BE CLEARED, GRUBBED, AND STRIPPED OFTOPSOIL TO REMOVE TREES, VEGETATION, ROOTS, AND OTHER OBJECTIONABLEMATERIAL.
16. CLEARING, GRUBBING, AND TOPSOIL STRIPPING SHALL BE LIMITED TO THOSEAREAS DESCRIBED IN EACH STAGE OF THE CONSTRUCTION SEQUENCE.GENERAL SITE CLEARING, GRUBBING AND TOPSOIL STRIPPING MAY NOTCOMMENCE IN ANY STAGE OF THE PROJECT UNTIL THE E&S BMPs SPECIFIED BYTHE BMP SEQUENCE FOR THAT STAGE HAVE BEEN INSTALLED AND AREFUNCTIONING AS DESCRIBED IN THIS E&S PLAN.
17. AT NO TIME SHALL CONSTRUCTION VEHICLES BE ALLOWED TO ENTER AREASOUTSIDE THE LIMIT OF DISTURBANCE BOUNDARIES SHOWN ON THE PLAN MAPS.THESE AREAS MUST BE CLEARLY MARKED AND FENCED OFF BEFORE CLEARINGAND GRUBBING OPERATIONS BEGIN.
18. A LOG SHOWING DATES THAT E&S BMPS WERE INSPECTED AS WELL AS ANYDEFICIENCIES FOUND AND THE DATE THEY WERE CORRECTED SHALL BEMAINTAINED ON THE SITE AND BE MADE AVAILABLE TO PWD AT THE TIME OFINSPECTION.
19. ALL SEDIMENT REMOVED FROM BMPS SHALL BE DISPOSED OF IN THEFOLLOWING MANNER: SEDIMENT BUILDUP TO BE REDISTRIBUTED WITHIN THESITE LIMITS.
20. AREAS WHICH ARE TO BE TOPSOILED SHALL BE SACRIFIED TO A MINIMUM DEPTHOF THREE TO FIVE INCHES - SIX TO 12 INCHES ON COMPACED SOILS - PRIOR TOPLACEMENT OF TOPSOIL. AREAS TO BE VEGETATED SHALL HAVE A MINIMUMFOUR INCHES OF TOPSOIL IN PLACE PRIOR TO SEEDING AND MULCHING. FILLOUTSLOPES SHALL HAVE A MINIMUM OF TWO INCHES OF TOPSOIL.
21. ALL FILLS SHALL BE COMPACTED AS REQUIRED TO REDUCE EROSION, SLIPPAGE,SETTLEMENT, SUBSIDENCE, OR OTHER RELATED PROBLEMS. FILL INTENDED TOSUPPORT BUILDINGS, STRUCTURES, AND CONDUITS, ETC. SHALL BE COMPACTEDIN ACCORDANCE WITH LOCAL REQUIREMENTS OR CODES.
22. ALL EARTHEN FILLS SHALL BE PLACED IN COMPACTED LAYERS NOT TO EXCEEDNINE INCHES IN THICKNESS.
23. FILL MATERIALS SHALL BE FREE OF FROZEN PARTICLES, BRUSH, ROOTS, SOD,OR OTHER FOREIGN OR OBJECTIONABLE MATERIALS THAT WOULD INTERFEREWITH OR PREVENT CONSTRUCTION OF SATISFACTORY FILLS.
24. FROZEN MATERIALS OR SOFT, MUCKY, OR HIGHLY COMPRESSIBLE MATERIALSSHALL NOT BE INCORPORATED INTO FILLS.
25. FILL SHALL NOT BE PLACED ON SATURATED OR FROZEN SURFACES.
26. SEEPS OR SPRINGS ENCOUNTERED DURING CONSTRUCTION SHALL BE HANDLEDIN ACCORDANCE WITH THE STANDARD AND SPECIFICATION FOR SUBSURFACEDRAIN OR OTHER APPROVED METHOD.
27. ALL GRADED AREAS SHALL BE PERMANENTLY STABILIZED IMMEDIATELY UPONREACHING FINISHED GRADE.
28. IMMEDIATELY AFTER EARTH DISTURBANCE ACTIVITIES CEASE IN ANY AREA ORSUBAREA OF THE PROJECT, THE OPERATOR SHALL STABILIZE ALL DISTURBEDAREAS. DURING NON-GERMINATING MONTHS, MULCH OR PROTECTIVEBLANKETING SHALL BE APPLIED AS DESCRIBED IN THE PLAN. AREAS NOT ATFINISHED GRADE, WHICH WILL BE REACTIVATED WITHIN ONE YEAR, MAY BESTABILIZED IN ACCORDANCE WITH THE TEMPORARY STABILIZATIONSPECIFICATIONS. THOSE AREAS WHICH WILL NOT BE REACTIVATED WITHIN ONEYEAR SHALL BE STABILIZED IN ACCORDANCE WITH THE PERMANENTSTABILIZATION SPECIFICATIONS.
29. PERMANENT STABILIZATION IS DEFINED AS A MINIMUM UNIFORM, PERENNIAL 70%VEGETATIVE COVER OR OTHER PERMANENT NON-VEGETATIVE COVER WITH ADENSITY SUFFICIENT TO RESIST ACCELERATED EROSION. CUT AND FILL SLOPESSHALL BE CAPABLE OF RESISTING FAILURE DUE TO SLUMPING, SLIDING, OROTHER MOVEMENTS.
30. E&S BMPS SHALL REMAIN FUNCTIONAL AS SUCH UNTIL ALL AREAS TRIBUTARYTO THEM ARE PERMANENTLY STABILIZED OR UNTIL THEY ARE REPLACED BYANOTHER BMP APPROVED BY PWD AND PA DEP.
31. AFTER FINAL SITE STABILIZATION HAS BEEN ACHIEVED, TEMPORARY E&S BMPSMUST BE REMOVED OR CONVERTED TO PERMANENT POST-CONSTRUCTIONSTORMWATER MANAGEMENT PRACTICES. AREAS DISTURBED DURING REMOVALOR CONVERSION OF THE E&S BMPS SHALL BE STABILIZED IMMEDIATELY. INORDER TO ENSURE RAPID REVEGETATION OF DISTURBED AREAS, SUCHREMOVAL/CONVERSIONS ARE TO BE DONE ONLY DURING THE GERMINATINGSEASON.
32. DURING CONSTRUCTION, THE SELECTED CONTRACTOR IS EXPECTED TOFOLLOW THE PCSMP APPROVED BY PWD. NO CHANGE OR DEVIATION FROM THEAPPROVED PCSMP IS PERMITTED WITHOUT PRIOR APPROVAL FROM PWD.
