Introduction

1.1 Purpose of Document

1.1.1 This Land Acquisition and Temporary Possession Negotiations Schedule (“this Schedule”) relates to the A303 Amesbury to Berwick Down scheme (“the Scheme”) and has been submitted by Highways England (“the Applicant”) to the Planning Inspectorate acting on behalf of the Secretary of State for Transport. It relates to an application for a Development Consent Order (“DCO”) to permit and enable implementation of the Scheme made under section 37 of the Planning Act 2008 (as amended) (“PA 2008”).

1.1.2 The Application for the Scheme was made on 19 October 2018 and was accepted for Examination by the Planning Inspectorate on 16 November 2018. Following Acceptance of the scheme, advice from the Planning Inspectorate under section 51 of PA 2008 suggested that information on the progress of land negotiations (detailed in Annex B of the Statement of Reasons (Application Document 4.1 (APP-023) was provided in a standalone document. This would then allow only this shorter document to be updated as negotiations progressed during the examination. The information in the tabulated schedule of negotiations detailed below has addressed this advice with this initial issue duplicating the information in the Statement of Reasons (Application Document 4.1 (APP-023).

1.1.3 This document should be read alongside, and is informed by the other application documents; in particular the Statement of Reasons (Application Document 4.1 (APP-023), Book of Reference (Application Document 4.3 (APP-025) and Land Plans Application Document 2.2 (APP-005).

Land Acquisition and Temporary Possession Negotiations Schedule

2.1 Introduction

2.1.1 The Schedule provided in section 2.3 provides a breakdown of the record of negotiations with each Category 1 (owners, lessees, tenants and occupiers) land interest affected by the scheme land interest and the Applicant up to the point of application. It details the land held by each interest through reference to the Book of Reference plot number (Application Document 4.3 (APP-025). Where multiple interests represent the same land holdings they have been grouped together where appropriate.

2.1.2 The Applicant has engaged with all landowners and occupiers with a view to acquiring their land interest by agreement by writing to them to inform them of the Applicant's willingness to negotiate to acquire the Land by agreement, and to invite dialogue on this point. As a result, the Applicant is in the process of engaging with all landowners with regard to the acquisition of land by agreement; and negotiations with this objective will be ongoing throughout the DCO process. The current status of such negotiations is set out in the Schedule within paragraph 2.3.

2.1.3 Whilst negotiations are ongoing, the Applicant is mindful that it is under a duty to acquire land at best value and that it is required to deliver the Scheme within a specified timescale. It has concluded that it may not be possible to acquire by agreement all land interests necessary to deliver the Scheme within this timescale.

2.2 Acquisition by agreement

2.2.1 The Applicant recognises that the power to acquire land compulsorily should only be sought if attempts to acquire by agreement fail. However, the Applicant notes that the CA Guidance recognises that, in some cases, it may not always be practicable to acquire each plot of land by agreement. Where this is the case, the CA Guidance confirms that it is reasonable to include provision authorising compulsory acquisition covering all the land required at the outset. It also recognises that in some cases it may be preferable, or necessary, to acquire land compulsorily rather than by agreement.

Suggested design change from consultation has been approved and now incorporated the proposed change means the new layout is located on the east of the A360 rather than west. While the change means the junction, location will be just inside the north west corner of the WHS, the area has been surveyed and found to be free of archaeological remains.
