STEAMER dEFINITIoNS

STYLE & TYPE dEFINITIoNS

BATCH Batch or production cooking is filling the steam cavity with product and allowing the cooking cycle to run its course without the introduction of new product in the cavity. (example: schools particularly K-12 need to produce large volumes of re-thermed food in a fast timeline as they are not cooking to order but serving in bulk a batch steamer is appropriate.)

VERSATILE Primarily batch cooking with the flexibility of a la carte cooking when required. (example: on occasion this full service restaurant receives orders for spaghetti, an item on their menu for which the noodles are cooked in the morning via batch style but are re-thermed per order a la carte style during the lunch and dinner times. Therefore, this restaurant requires a unit with the flexibility of operating efficiently in both batch and a la carte cooking.)

A LA CARTE A la carte or cook to order is the ability to introduce new product in the steam cavity as required by order. (example: high end restaurants often prepare each dish as its ordered and require a steamer that can be interrupted in its cooking cycle by placing additional product within the steam cavity with little to no recovery time.)

RE-THERM Re-therm is the process of bringing refrigerated or frozen precooked product back to serving temperature. (example: an Italian restaurant prepares full pans of lasagna each night for service the next day. As orders come in, individual pieces are steamed to fill the order.)

BoILERLESS Boilerless is producing steam without the use of a boiler or a typical steam generator by use of a water reservoir, eliminating the maintenance required of those units as well as reducing water use.

STEAM GENERAToR A steam generator is typically a stainless steel box with independent heat source that produces steam under minimal pressure (.25lb or less) for a steam cavity, introduced as an alternate to the more expensive boiler units.

BoILER A mild steel pressure vessel typically rated for 12-15psi operated by gas or electric power and used to give steam on demand to a steam cavity.

CoNNECTIoNLESS Connectionless steamers are units that require manual water fill and drain and do not require a water or drain connection.

FREiGHT CLAiM POLiCY AND PROCESSUnified Brands ships products F.O.B (Free On Board) Origin.- FOBisa legaltermusedtogovernpassageofTitlewhengoodsareshipped. Regardlessof freightterms,orwhichpartyisresponsibleforthefreightcharges,FOBOriginmeansthatTitlepassestothebuyerwhenthefreightisloadedontothecarrier.When the carrier signs for the shipment, they are acknowledging that the productis properlypackagedand free fromdamageat the time theproduct is loadedon totheirtruck.Thecarrierassumesresponsibilitytodelivertheshipmenttothespecifieddestinationinthesameconditionitwaspickedupfromthefactory.

When thecarriermakesdelivery it is very important that the receiver INSPECTTHESHIPMENT IMMEDIATELY BEFORE SIGNING THE DELIVERY RECEIPT. In the eventthe shipment is being drop shipped to a third party, you will need to advise themof this responsibility. Acceptance of the shipment without any notations on thedelivery receiptacknowledgesthat theproducthasbeendeliveredcompleteand inundamagedcondition.

Process to follow when receiving shipment:• Inspecttheentireshipmentforvisibledamageandcorrectnumberofpieces.Ifyou

receivea shipmentwithobvious freightdamage, youhave the right to refuse theentireshipment,oranypartoftheshipmentthathasbeendamaged,andcontactUnifiedBrandsimmediatelyforareplacement.UnifiedBrandswillrepair,re-shiporsupplyareplacementattheoriginalprice,andprovideacreditfortherefuseditemuponreceiptfromthecarrier.

• Unpack cartons immediately to check their contents for possible damage in thepresenceofthedeliverydriver.Ifdamageappearsminorandcanbecorrectedviafieldrepair,youmayelecttosignfortheshipmentasdamaged,contactaUnifiedBrandsAuthorizedServiceAgenttoorderandinstallreplacementpartsandtofileaclaimwiththecarrierforthecostofpartsandrepairs.Makenotationofshortageordamageonallcopiesofthefreightbill-beasspecificaspossiblewhenmakingyour

damageorshortagenotationonthedeliveryreceipt.(IfyouwishUnifiedBrandstoassistyouwithfilingfreightclaimmakesureyouhaveavailablealldocumentationasmentionedaboveandcontactyourCustomerServiceRepresentativeforassistance.)

• If youhaveany concerns regarding the integrityof thepackagingor its contents,markthedeliveryreceiptassuch.Example:“Cartontornopenorcreased–possibledamagetocontents, subject to further inspection.”or,“boardsoncratebrokeoff,possibleinternaldamage,subjecttofurtherinspection.”Iftheequipmentislaterfound to be damaged, contact the carrier immediately and request that a formalinspectionbeperformed.

• Ifhiddenorconcealeddamageisdiscoveredafterthecarrierhasleftthereceiver’sfacility, the receiver should save the original packing material, and contact thecarrier immediately to report the concealed damage, and request an inspectionbeperformed.Concealeddamagemustbereportedwithin5daysoftheoriginaldelivery,andtheequipmentshouldremainattheoriginaldeliverylocation.Movingthe damaged unit to a new location will greatly reduce your chances of beingreimbursedbythecarrieronyourfreightclaim.

Unified Brands AssistanceYour Customer Service Representative can be contacted at any time for additionalassistanceorinformation.ThoughUnifiedBrandsisnotliablefordamagescausedbyfreight,wecanassistwithclaimsprocessingasneeded.

FreightdamageisnotcoveredunderUnifiedBrandsproductwarranty.

Do not return any product back to the factory without a valid return materialauthorization number (RMA). Without a valid return authorization number returnedshipmentswillberefused.

CustomersFollowing are the terms and conditions which apply to all your purchases from UNiFiED BRANDS, iNC (UNiFiED BRANDS) . Placement of any purchase order constitutes your acceptance of these Terms and Conditions (as in effect now and as they may be changed by us from time to time in the future) .

1 . Purchase Price and Payment Obligations(a) Purchase Price The purchase price for and specifications relating to allorders are subject to change without notice to conform to the prices and speci-fications in effecton thedateof shipmentof yourorder. All pricesare F.O.B. themanufacturing plant (currentlyWeidman,Michiganor Jackson,Mississippi,U.S.A.)unlessotherwiseapprovedinwritingbyUnifiedBrandsandincludeonlycratingfordomestic shipping. Extra charges will be added for special or export crating. Allshippingweightsdescribedinourcatalogsandelsewhereareapproximateandship-pingchargesmayvary.Ourbasepricesdonotincludeanysalesexciseuseorothertaxesapplicabletoyourpurchases,whethernoworhereafterineffect-andyouareresponsibleforpayingallsuchtaxes.Allshipmentwillbemadeatyourexpenseonacollectbasisunlessweotherwiseagreeinourwrittenacceptanceofyourorder.

Wealso reserve the right tostop, limitordiscontinue fillinganyorallofyourordersor making any or all shipments of equipment and/or parts to you (whether or notorderswith respect theretohavebeenacceptedbyus) if anyof the followingoccur:(i) Youfailtopayanyinvoicewhendue;or(ii) youbecomeorareinsolvent,admityourinabilitytopayyourbillswhendue,begin

anybankruptcyproceedingsoranybankruptcyproceedingisbegunagainstyou;or(iii) any proceeding or action which could materially affect your business is begun

againstyou;or(iv) UNIFIEDBRANDSforanyreason,initssolejudgment,decidesthatitisunwilling

oruncomfortableaboutextendingyoucreditandyouareunabletopayforyourordersinadvanceorprovidesufficientsecurityforsuchorders.

(c) Collection, Repossession and Costs of Collection Ifanyof theevents listed inParagraph1(b)aboveoccur,UNIFIEDBRANDSmay,at itsoption, takeanylegalactionagainstyouitdeemsnecessaryorappropriatetocollecttheamountsofanyinvoicesthenoutstandingandunpaidandtheamountsyouoweforwhichinvoiceshavenotyetbeensent.Inaddition,byvirtueofplacingapurchaseorderwithUNIFIEDBRANDSyoualsotherebygranttoUNIFIEDBRANDS,apurchasemoneysecurityinter-estinandtotheequipment,partsand/orothergoodscoveredbysuchpurchaseorder,andUNIFIEDBRANDSmayforeclosesuchsecurityinterestandmayalsotakeanystepsnecessaryorappropriate to repossessanyequipment,partsand/orothergoodswhichhavebeenshippedtoyoubyUNIFIEDBRANDS,andUNIFIEDBRANDSmayexerciseallother available rights and remedies under the Mississippi Uniform Commercial Codeandotherapplicablelaw.Youareresponsibleforthefullcostsofanysuchcollectionorrepossessionefforts,includinglegalfees,thirdpartycollectionfeesandotherexpensesinconnectiontherewith. YouagreethatyoumustpayUNIFIEDBRANDSallsuchfees

andexpensesimmediatelyuponUNIFIEDBRANDS’demandtherefore.IntheeventthatlegalactionistakenforcollectionofanydebtowedbyyoutoUNIFIEDBRANDS,placeofvenueshallbeHINDSCOUNTY,MISSISSIPPI,andallordersandpurchasesfromUNIFIEDBRANDSshallbegovernedbyMISSISSIPPIlawandsuchvenueandgoverninglawareagreedtoaspartofUNIFIEDBRANDS’extensionofcredittoyouoryourplacementofanorderwithUNIFIEDBRANDS(unlessotherwiseapprovedinwritingbyUNIFIEDBRANDS).

2 . Placement, Acceptance and Cancellation of Orders(a) Placing an Order Allequipmentordersmustcontainall informationneces-sary for our processing. Full details about equipment orders, and other informationaboutorderingcanbeobtainedfromourfactory.Pleasepaycarefulattentiontotheserequirements when ordering as you are responsible for any omissions or errors. AllordersaresubjecttowrittenacceptanceandcreditapprovalbyusatUNIFIEDBRANDSheadquarters,andwhensoacceptedshallresultinabindingcontractbetweenusonthetermssetforthinouracceptanceandsubjecttotheseTermsandConditions.Onceanorderhasbeenaccepted,neitheryounorwemaycancelthatorderexceptasspecificallyprovidedforinouracceptanceorintheseTermsandConditions.

(b) Optional Devices; Customer’s Design or Specifications Thecus-tomer isresponsibleforpurchasingand/or installingalloptionalorothersafetydevicesappropriatetoanyitemyoupurchase.Whereaunit ismanufacturedtothecustomer’sdesignorspecifications,oursoleresponsibilityislimitedtothemanufactureanddeliveryofsuchunitinaccordancewiththecustomer’sapproveddrawingsandspecifications.Anyrecommendationswemaymakeforuseofequipmentprocessesormaterialsarebasedontestsandevaluationsbelievedreliable,butwearenotresponsibleinanywayforthecorrectnessorreasonablenessofsuchrecommendations.ShouldanyclaimbebroughtbyanyoneagainstUNIFIEDBRANDSarisingoutofacustomer’sdesignandspecificationsoracustomer’sfailuretoorderand/orinstalloptionalorothersafetydevices,youagreetodefendandindemnifyUNIFIEDBRANDStothefullestextentlegallypossible,includingfordamages,expenses,andcostsofcounsel

(c) Return items or Cancellation of Orders Written authorization isrequired for the returnofanypartorallofanyorderofstandardequipmentalreadyshipped. Returnsmustbe labeledwith theapplicableReturnMaterialAuthorizationNumber, you must include all RMA forms and the equipment must be shipped toUNIFIEDBRANDSpre-paidwithin30daysofauthorization.Returnswithoutpriorwrit-tenauthorizationwillberefusedandyouwillremainliableforthefullamountofthepurchaseprice(andotherchargesapplicablethereto).Therewillbearestockingchargeappliedtoallreturneditems,asdeterminedappropriatebyUNIFIEDBRANDS.Noitemsmaybereturnedmorethan90daysafterthedateoftheapplicableinvoice.Longleaditems or special order equipment built to your specifications may NOT be returned.All orders for standard items may be cancelled with the written consent of UNIFIEDBRANDSatanytimeuptoseven(7)daysprior toshipment;butyouare responsiblefortheappropriatecancellationcharges,andouragreementtocancellationissubjecttoyourpaying thosecancellationcharges. Long-leadandcustomorderswhichhavebeenacceptedmaybecancelledwithourwrittenconsent,butyouarestillresponsibleforthefullamountoftheapplicablepurchasepricereducedbytheappropriatecancel-lationadjustment.


3 . Delivery and Delays in DeliveryAllrequestsforspecifictimeofshipmentmustbeacceptedbyusinwriting.Intheeventofanyconflictbetweentheshipmenttimerequestedinanorderandtheshipmenttimespecified in theacceptancewesent to you, the timespecified inouracceptancewillgovern.Youmaychangeashipmentdateonlyifwereceivenoticeofsuchchangeatleastsevendaysbeforetheshipmentdatetobechanged.Allagreementsastotimeandmethodofshipmentaresubjecttostrikesorotherlabordifficulties,laborshortages,fire,flood,orotherActsofGod,war,breakdowns,failureofplantmachineryorequipment,governmentalprioritiesorallocations,delaysofsuppliersoranyothercausebeyondourcontrol. InnoeventwillUNIFIEDBRANDSbe liable foranyconsequential,specialorcontingentdamagesonaccountofdelay inshipment,whetherornotwehaveactualorimpliedknowledgeoftheimportanceorsignificanceofthetimingofsuchshipmentandwhetherornotanyemployeeoragentofUNIFIEDBRANDShasgivenanyassur-anceswithrespecttosuchshipment.Ifyourequestashipmentmethodotherthanournormalshipmentforthatequipment,weareinnowayresponsiblefortheconditionoftheequipmentsoshippedorthetimelinessofitsdelivery.

4 . Warranties, Limitations on Warranties, and Limitation of RemediesUNIFIEDBRANDSwarrantsitsproductsagainstdefectsinmaterialsandworkmanshipundernormaluseandservicesforwhichsuchproductsweredesigned.Thiswarrantyrunsonlytotheoriginalenduserandis in lieuofanyother liabilityfordefects. THEWARRANTIESEXPRESSEDINTHESETERMSANDCONDITIONSAREINPLACEOFANYAND ALL OTHER EXPRESS WARRANTIES (UNLESS SEPARATELY STATED IN PRINTEDMATERIAL PREPARED BY US DESCRIBING OUR EQUIPMENT) AND EXCLUDE ALLIMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY ORMERCHANTABILITYORFITNESSFORANYPARTICULARPURPOSE;NORARETHEREANYOTHERWARRANTIES,EXPRESSORIMPLIED,BYOPERATIONOFLAWOROTHERWISE.InnoeventshallUNIFIEDBRANDSbeliablefordamagesordelayorforanyconsequen-tial,specialorcontingentdamagesarisingoutofanybreachofourwarranty,whetherornotwehaveknowledgeofspecificneedsorouremployeesoragentshavegivenanyspecificassurances.AnyoneclaimingthattherehasbeenabreachofanywarrantybyUNIFIEDBRANDSmustgiveuswrittennoticewithinTHIRTY(30)daysafterdiscoveryoftherelevantdefectortherighttoassertsuchclaimwillhavebeenwaivedconclusivelyandprovidedfurtherthatanysuchclaimmustalsobeassertedwithinthegeneralwar-rantyperiodforsuchequipmentand/orparts.UNIFIEDBRANDSwillnotbeliableforanyexpense incurredwithoutourpriorwrittenauthorization foralterationsmadeoutsideofourfactoryorforrepairswhicharenotperformedbyUNIFIEDBRANDSauthorizedservicedepartmentsusingUNIFIEDBRANDSfactoryparts.Norshallweberesponsiblefortheperformanceofequipmentastowhichanyrepairs,revisionsoralterationshavebeenmadebyothers.

THEEXCLUSIVEREMEDYOFTHEUSERORBUYER,ANDTHEEXCLUSIVELIABILITYOFUNIFIEDBRANDSORANYSELLEROFUNIFIEDBRANDS’PRODUCTS,FORANYANDALLCLAIMS, LOSSES, INJURIES, OR DAMAGES (INCLUDING CLAIMS BASED ON BREACHOF WARRANTY, CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHERWISE)RESULTING FROM ORARISING OUT OFTHE USE OR HANDLING OFTHIS PRODUCT,SHALL BE THE RETURN OF THE PURCHASE PRICE OF THE PRODUCT OR, AT THEELECTIONOFUNIFIEDBRANDSORTHESELLER,THEREPLACEMENTOFTHEPRODUCT.

5 . Repairs, Claims and Limitations on ClaimsAllrepairsaretobemadebyfactoryauthorizedservicesusingUNIFIEDBRANDSfactorypartsonly.AlistofUNIFIEDBRANDSauthorizedservicingcentersisavailablefromthefactory.Allclaimsrelatingtothequality,quantityorconditionormerchandiseyouhavereceived(suchasshortages,equipmentdamagedinshipment,incorrectitems,etc.)mustbemadewithinfourteendaysafterreceiptoftherelevantshipmenteithertousortheshipper,asappropriate.

LiMiTED WARRANTY TO COMMERCiAL PURCHASEU .S . & Canadian Sales Only

Unified Brands warrants to original commercial purchaser/users that foodservice equip-mentmanufacturedbyUnifiedBrands(“UnifiedBrandsEquipment”)otherthanCapKoldfoodserviceequipment,shallbefreefromdefectsinmaterialandworkmanshipfor(i)2000actualoperatinghours(providedthatsuchequipmenthasadevicethathasrecordedactualoperatinghourssincetheinstallationofsuchequipment),(ii)twelve(12)monthsfromthedateofinstallationor(iii)fifteen(15)monthsfromdateofshipmentfromUnifiedBrands,whicheverfirstoccurs(the“WarrantyPeriod”),inaccordancewiththefollowingtermsandconditions:

I. ThiswarrantyislimitedtoreplacementpartsandrelatedlaborforUnifiedBrandsEquipmentlocatedatitsoriginalplaceofinstallationintheUnitedStatesandCanada.

II. DamagetoUnifiedBrandsEquipmentthatoccursduringshipmentmustbereportedtothecarrierandisnotcoveredunderthiswarranty.Thereportingofanydamageduringshipmentisthesoleresponsibilityofthecommercialpurchaser/userofsuchUnifiedBrandsEquipment.

III. ForUnifiedBrandsConvectionCombo™Steamer-Ovens,HyPerSteam™ConvectionSteamers and HyPlus™ Pressureless Steamers, Unified Brands further warrants to theoriginalcommercialpurchaser/usersofsuchUnifiedBrandsEquipmentthattheatmosphericsteam generators or boilers contained in such Unified Brands Equipment shall be freefromdefects inmaterialandworkmanshipfor (i)4000actualoperatinghours (providedthat such equipment has a device that has recorded actual operating hours since theinstallationofsuchequipment),(ii)twenty-four(24)monthsfromthedateofinstallationor (iii) twenty-seven (27)months fromdateofshipment fromUnifiedBrands,whicheverfirstoccurs,provided that: (a) theoriginalpurchaser/user shallhavealsopurchasedandinstalledaUnifiedBrandsPureSteem™WaterTreatmentSystemforuseinconnectionwithsuchUnifiedBrandsConvectionComboSteamer-Oven,HyPerSteamConvectionSteameror HyPlus Pressureless Steamer on or before the date such Unified Brands Equipmentwasinstalled,(b)theoriginalpurchaser/userhascontinuouslyusedsuchWaterTreatmentSystem inconnectionwithsuchUnifiedBrandsEquipment fromthedateof installation,and(c)thecommercialpurchaser/usershallhavemaintainedsuchWaterTreatmentSysteminaccordancewiththemaintenanceandfiltercartridgereplacementrecommendationsofUnifiedBrands,andotherwisemaintainedsuchOvenorSteamer inaccordancewithallotheroperationalandmaintenancerecommendationsofUnifiedBrands.

IV. ForUnifiedBrandsSmartSteam100™BoilerlessSteamers,UnifiedBrands furtherwarrantstotheoriginalcommercialpurchaser/usersofSmartSteam100BoilerlessSteamersshallbefreefromdefectsinmaterialandworkmanshipfor(i)4000actualoperatinghours(providedthatsuchequipmenthasadevicethathasrecordedactualoperatinghourssincetheinstallationofsuchequipment),(ii)twenty-four(24)monthsfromthedateofinstallationor(iii)twenty-seven(27)monthsfromthedateofshipmentfromUnifiedBrands,whicheverfirstoccurs. ThiswarrantsUnifiedBrandsSmartSteam100BoilerlessSteamers thatwereshippedafterMay1,2003.

V. Unified Brands further warrants to the original commercial purchaser/users ofUnified Brands Convection Combo Steamer-Ovens that the electronic relay and controlboardcontainedinsuchUnifiedBrandsConvectionComboSteamer-Ovenshallbefreefromdefectsinmaterialandworkmanshipfor(i)4000actualoperatinghours(providedthatsuchequipmenthasadevicethathasrecordedactualoperatinghourssincetheinstallationofsuchequipment),(ii)twenty-four(24)monthsfromthedateofinstallationor(iii)twenty-seven(27)monthsfromdateofshipmentfromUnifiedBrands,whicheverfirstoccurs.

VI. DuringtheWarrantyPeriod,UnifiedBrands,directlyorthroughitsauthorizedservicerepresentative,willeither repairor replace,atUnifiedBrands’ssoleelection,anyUnifiedBrandsEquipmentdeterminedbyUnifiedBrandstohaveadefectinmaterialorworkman-ship.AstoanysuchwarrantyserviceduringtheWarrantyPeriod,UnifiedBrandswillberesponsibleforrelatedreasonablelaborandportaltoportaltransportationexpenses(time&mileage)incurredwithintheUnitedStatesandCanada.

VII.Thiswarrantydoesnotcoverboilermaintenance,calibration,periodicadjustmentsasspecifiedinoperatinginstructionsormanuals,consumableparts(suchasscraperblades,gaskets,packing,etc.),andlaborcostsincurredforremovalofadjacentequipmentorobjectstogainaccesstoUnifiedBrandsEquipment.Thiswarrantydoesnotcoverdefectscausedbyimproperinstallation,abuse,carelessoperation,orimpropermaintenanceofUnifiedBrandsEquipment.ThiswarrantydoesnotcoverdamagetoUnifiedBrandsEquipmentcausedbypoorwaterqualityorimproperboilermaintenance.ThiswarrantyshallbedeemedvoidiftheequipmentisworkedonotherthananAuthorizedServiceAgent.UnifiedBrandsisnotresponsibleforwarrantyclaimsfromnon-authorizedservicecompanies.

VIII. THIS WARRANTY IS EXCLUSIVE AND IS IN LIEU OF ALL OTHER WARRANTIES,EXPRESSEDOR IMPLIED, INCLUDINGANY IMPLIEDWARRANTYOFMERCHANTABILITYOR FITNESS FOR A PARTICULAR PURPOSE, EACH OF WHICH IS HEREBY EXPRESSLYDISCLAIMED. THE REMEDIES DESCRIBED ABOVE ARE EXCLUSIVE AND IN NO EVENTSHALL Unified Brands BE LIABLE FOR SPECIAL, CONSEQUENTIAL, OR INCIDENTALDAMAGESFORTHEBREACHORDELAYINPERFORMANCEOFTHISWARRANTY.

“I was not sure how much effect a braising pan would have for this high volume new concept. Every day, we have to prepare a wide variety of meats, sauces, beans and more. Before, we had used a stovetop with large pots and pans and I wondered if one device could cover such a range of products. Braising pans are for elementary schools right? To our surprise, it has covered most of our production needs at Big Star and our product quality has certainly improved. The pan’s heat is fast and very consistent, which has virtually eliminated hot spots and the waste due to scorching. The rounded corners make it easy to stir ingredients and the pan tilts, so we’re able to pour product from the braising pan directly into containers made for handling hot foods and liquids. This has virtually eliminated back strains and burns.

Our clean up has also become significantly easier. Start to finish, it’s all done in just one pan, which reduces labor, water and cleaning chemicals. And because the Groen braising pan features open leg construction, It’s easy to keep the surrounding area clean as well.”
