PROGRAMME HIGHLIGHTThis two-day workshop aims to provide participants with practical insights of the broader policy issues in dealing with Contractors’ All Risks (CAR) claims relating to Material Damage and Third Party Liability sections of the policy.

The workshop is facilitated and delivered by highly experienced AICLA qualified loss adjusters who have many years of experience in handling CAR claims. They will share their combined knowledge and expertise with participants on this interactive workshop program that will provide participants the opportunity to work in groups to examine and discuss practical case studies to reinforce the learning experience.

WHO SHOULD ATTENDSenior Claims Officers and Managers from insurance/reinsurance companies and broking firms and Loss Adjusters. Also suitable for Underwriters Business Development and Marketing Executives from insurance/reinsurance companies; Client and Account Executives and Managers of insurance/reinsurance broking firms; and Risk Managers.

DAY 1MATERIAL DAMAGE (SECTION I)

DAY 1 PROGRAMME OUTLINE

The program will commence with setting the scene with an overview of the current and mega projects in Malaysia and the region, and a review of the typical issues arising out of CAR Section I (material damage) claims. It will continue with the examination of the general principles in dealing with these types of claims ranging from who is an insured under the policy, operation of the usual design/workmanship exclusions, typical endorsements, treatment of betterment and improvements etc.

Day 1 will look at the application of the issues via practical examples and case studies to illustrate the principles of Section I.

DAY 2THIRD PARTY LIABILITY (SECTION II)

PROGRAMME OUTLINE DAY 2

The second day will commence with a review of the general principles in principles of the CAR Section II (liability) policy wording, the range of third parties which participants can expect to encounter, typical damage to third party property arising out of contract works, who is identified as the insured under the policy and who is protected by the policy, typical exclusions, endorsements treatment of quantum and typical difficulties encountered with claimants and contractors.

Day 2 will examine a number of case studies with mini sessions to discuss in greater detail, providing a workshop environment to enable learning outcomes of issues highlighted in the previous day’s sessions.

WORKSHOP LEADERS

Jaye Kumar was born in Malaysia, completed his high school and tertiary education in England and has worked extensively in South East Asia, UK and for the last 30 years, in Australia. Jaye is a Chartered Loss Adjuster (Fellow), Chartered Mechanical Engineer

and has a Masters in Business Administration. He has been a practicing loss adjuster for 35 years and specialises in engineering claims.

In 2000, Jaye formed a national loss adjusting company with over 40 independent adjusting companies across Australia as service partners and heads this Company as the Managing Director. Jaye has been actively involved with the Australasian Institute of Chartered Loss Adjusters (AICLA) and has served on the AICLA Board since 1999. As the International Development Director of AICLA since 2003, he has been responsible for expanding AICLA’s membership base across the region and internationally. AICLA has international membership chapters in Malaysia, Singapore, Hong Kong, Indonesia, Thailand and Vietnam and is further expanding this to the Middle East and Europe.

Ian McWalter has worked as a loss adjuster for 35 years, and for the past 25 years, he has specialised in Construction and Engineering claims. He graduated in law from the London School of Economics in 1977 and

entered loss adjusting in the UK in 1978, where he worked for a period of 11 years. His experience in the UK was mainly in the area of building related claims.

In 1989, he returned to Australia where he worked in a major loss adjusting company for 20 years before leaving in 2011 to set up his own loss adjusting practice specialising in Construction and Engineering claims. The company currently employs 7 adjusters, 4 of whom are civil engineers.

The majority of his work during his time in Australia is related to professional indemnity, product and public liability and contract work claims. His work in respect of Public Liability and Professional Indemnity claims ranges from claims against building inspectors, architects and engineers, to claims involving project managers, large construction companies and specialist sub-contractors. This covers the gamut from damage to residential and commercial property to large civil infrastructure projects to power stations and mining interests.

Ian has been actively involved with AICLA for over 15 years, having previously held the position of Education Director, International Development Director and President. He has also been a member of the Academic Council for ANZIIF, AICLA’s educational service provider.

I r . P o o b a M a h a l i n g a m is a professional engineer with over 25 years of experience in cons t ruc t ion , insurance and loss adjusting. He has

dealt with construction, engineering, liability and property claims for various insurance companies and reinsurers. He was with a global claims management company in Singapore and a member of their C.I.A team that serves Asia. He was also based in Christchurch, New Zealand as a member of the CAT loss team handling the 2011 earthquake claims.

Pooba has previous experience working with an international loss adjusting firm in Kuala Lumpur where he was responsible for mega projects risk management and claims handling. This included the following large construction risks -KLIA, KLCC, KL Tower, LRT I & II, Sprint Highway and Smart Tunnel. He also gained further regional engineering exposure when he handled assignments in Brunei, Indonesia, Myanmar, Vietnam and Hong Kong.

Pooba has handled some high profile engineering/ construction cases in the past and is a well known presenter on project risks and claims handling procedures in Singapore and Malaysia. Pooba is also a Claims Management lecturer for SCI. He is actively involved in industry activities and is the current President of the Insurance Law Association of Singapore (ILAS).
