Wicker said he didn't go out and get official prices, that he relied more on what Porter provided.

"I don't feel comfortable with the labor·equipmbllt costs," he said.

Wicker said he didn't think the tie-on to Carrizo Lodge would be any problem as far as water was concerned. He said the work load of his crews would be impacted.

He said he presented the council with a work plan that outlined projects to be accomplished for the rest of the year.

"If we commit to this, the council has to reali2e adjustments in that whole process," Wicker said. He said to install the water line would mean other projects, previously ap· proved by the council, would have to be rescheduled.

James asked Vie if 100 percent of the homeowners had been con· tacted and approved of the annexa· tion.

Vie said he had sent letters. He said homeowners that responded were most favorable of the water line .installation. He said water was the top concern with the homeowners contacted.

"To answer your question, Mr. James, I do not have in writing, 100 percent," Vie said.

Vie said the homeowners associ­ation has 28 of the 93 condo units.

'The rest are owned by C-Net or Pioneer Savings," Vie said.

Wicker said when the committee to negotiate with Porter was formed, a councilor was supposed to be appointed to that committee. Ap· parently, Mayor Victor Alonso dl d not make that appointment.

"Hopefully, in the future, if we get back into this posture, someone from the council will volunteer to meet with us." Wicker said. He said he thought Porter or someone from Carrizo Lodge should ask for anoth­er meeting.

To annex Carri20 Lodge into the village, Wicker said Carrizo Lodge ownet'S would apply by petition for their property. He said the private property along Carrizo Road to the Lodge would be annexed by the vii· !age through another method re­quiring public hearings.

Planner Cleatus Richards said that method would be by a municipal boundary commission.

The municipal boundary com· mission consits of three menbers appointed by the governor. Each member is a resident of a separate county of New Mexico. One member shall be a practicing attorney and no more than two of the members shall be of the same political party.

The municpal boundary commis­sion shall publish a notice, of a pub· lie hearing, once each week for four consecutive weeks.

The squad also picked up two awardB for f'xcellence. The awards for excellence are earned when a team receives a score of 85-100 from two of the three judges, and only about eight teams won these this year.

Last year the squad picked up fourth place and one award for ex­cellence.

Sponsors Rebecca Durham and Karen Reeder said they were very proud of how well the girls did in only their second year, and they heard many good comments on their excellent behavior. The school and community should a1so be proud of them, she said.

Durham said it is unusual for a team to be able to earn such an out­standing finish after just two years of perfonning at the state level. Bernalillo and Silver City have also been the top contenders for the past 10 years. she said.

The squad will be losing four seniors, Molly Long, Ashley Fryer, Brie DeBusk and Katie Graham, who have added valuable leader· ship to this~· group.

Lawyers exchange opinions during unscheduled hearing by CHARLES STALLINGS Ruidoso News Staff Writer

A lengthy and vigorous debate left two attorneys redfaced Tues­day, when it was discovered the vil­lage council 'agenda item argued, had not yet been legally scheduled.

For over an hour, State Repre· sentative H. John Underwood (D· Ruidoso), acting as attorney for de­veloper Jeffery Smith, bantered with village attorney Patricia Ortiz who wa<> defending a planning and zoning commissiun action.

Smith wa.'> asking the council to overturn a planning commission denial for a zoning change from commercial, C-2, to multifamily, R· 3, in order to obtain financing to build apartment houses in Ruidoso. Smith has built other successful apartment houses in the area.

Members of the planning com­mission denied Smith's request for a zoning change at their last meet­ing. Their position was that the four·acre pi err of property in ques­tion, just off U.S. H1ghway 70 near Miner's Mountam Castle (t.he old Camelot theater), is one of the few flat prime pieces of commercial propErty left in the village.

Planning ~ director Cleatus Richards told the council that the planning commission is required to uphold th£' land use mnstrr plan and that the master plan desig­nates that property for community business developm(•nt.

Smith could han• applied for a

conditional use to bypass the C·2 zoning at the time, but Underwood said that Smith's financier, Hou.s~ ing and Urban Development (HUD), would not make the loan under C·2 zoning.

Underwood appealed to the vil­lage council to use common sense, assess the financial impact to the community and overturn the plan· ning commission's decision to allow Smith to build the apartments.

Underwood said that Smith was ready to build 40 units at the cost of about $1.5 million dollars. He said that Smith had a waiting list for renters. He said the property had not sold in six years, and that most of the surrounding property was residential.

Village attorney OrtiE said the planning commission had not erred in its deliberations, and therefore the council' should not hear argu­ments other than mistakes made by the commission. She said the intent to stay within the Master Plan and keep the area open for a oommer· cial venture was appropriate.

Underwood said thllt a muter plan was to' be Used as a gUide ana~· not carved in stone.

After much discussion, it was learned that the appeal had not been officially scheduled and ad· vertised.

The attorneys, better versed on each other's arguments, will butt heads again at the public hearing scheduled for April 27.

The council beard complaints from Ken-Hosmel" who lives near a small village parl< just up the road from Two Rivers Park.

Hosmer said he has repeatedly called for police help in cwtalling late night drinking and parties at the park. He said the police have been of little help and that to his knowledge, no citations had ever been issued.

Ruidoso Police Chief Richard Swenor acknowledged that the park and many other places · throughout the village are problem areas that a thin police for"" could not adequately patrol.

On the recommendation of Swenor, the parking area will be blocked in a manner that automobiles will be unable to drive on the park grounds.

Swenor said he is hopeful the new ~udget will help with his en· forcement by adding several officers to the department.

with west wind humming down the valley. And then for the rest of the month there was really very little wind, and it looked as though March had come in like a lion and was on the way out like a lamb - bearing out the old saying about the month of the wind.

Then on the morning of the twenty-seventh the west w:ind turned on the power and began making up for lost time. All day long it did its work of awakening the trees from their winter slumber, pollinating the cedar trees and bring­ing out the fruit buds. "I was real. happy with the number of responses," he said. "The applieations came from all over the state, Espanola, Hobbs, Las Cruc~ Fort Sumner, Raton and Grants to Gadsden. A lot are princi­pals who want to move up or w~ were superintendents before in small systems, then went to larger areas as assistants and now want to :rD.ove back to the top spot. A few even are from Texas. They have retired and want to- come here.

"Most are· unfamiliar names, but the majority have a lot of f'.xperi­ence. A few have been in private busine89. One was a kindergarten teacher in Capitan for one semester in 1972." ·, The contract of current superintendent David Lock was not renewed by the board. . Governor signs mandatory spay and neutering bill into state law

Last week, Governor Bruce King signed into law a mandatory spay and neuter requirement for all animals adopted or reclaimed from shelters across New Mexico.

The action is a significant step toward controlling the population of unwanted pets. Sponsored by State Senator Ann Riley (D·Bernalillo), the legislation is an attempt to reduce the number of animals killed each year because of owners who fail or refuse to sterilize their pets.

Present at the signing ceremony with King and Riley were tho senator's legislative aides and Shir­ley Hendrixson, with the Animal Humane Association of Albuquer­que, who originally proposed the law to Riley and state Representa­tives Max Coli (I)-Santa Fe) and John Underwood (D-Ruidoso).

"I brought my BdBton terrier, Bobby, with me to watch it become law," Hendrixson said.

By the time tho bill had worked its way through the House side of the Legislature, a provision in­serted on the Senate side had been

removed. The provision would have watered dawn the law by allowing shelter managers to make excep­tions.

"They took out the part that gave shelter managers some lati­tude in applying the provision and it paeaed 53·1," Hendrixson said. "All reClaims and adopted animals must be sterilized. It"s state law and carries all of the penalties and fines.

"The great part about it is that we had nothing to do with tho removal of the provision. The repre­sentatives saw the need on their own."

Ruidoso is ahead of the state al­ready. Village councilors last. year passed a mandatory spay and neuter ordinance for all dogs and cats over the age of six months. However, enforcement since it was implemented in April has been con­fined primarily to animals pieked up running loose by animal control or who end up in the shelter by other routes. Owners also can pur­chaae breeder's permits and pay ~ore for their pets' annual licenses, if they choose not to sterilize tham.

Sure, reporters have a job to do in covering their beats, but there's absolutely no way to know about all-district, DECA state wins and such without teachers' and coaches' help.

At a recent meeting ot parents and others inter­ested In the youth of this area, at least one man bat­tered· away at the newspaper for not reporting enough good news about young people. Questioned after the meeting, the man was complaining that the Ruidoso High School band wasn't photographed when it marched in the Aspenfest parade last year. Well,

· tt:at's just the way it goes when covering E! para!l!il, but his .tll:tttlfl.llil!hts brought horne the faCt that ... reporters and the n11wspaper are blamed by and 'the commu'illty when schbol officials fail to pro­vide information on school events.

On the other other hand, some coaches and sponsors go that extra mile all the time. Golf coach Kent Beatty writes up every golf tourney with every kids' name and score, and Keeps the community well

· informed about' th11 golf team. Clle.erleader sponsor Rebecca Durham was so proud of her young people's second place win at state that she called The News as soon as they got home. It didn1 take a lot of time, and it surely showed that sha cared eno·ugh about her talented .crew to maKe sure the whole towp hears about their succesS.

There's oct some secret tom-torn that sends out such news to newspapers - lt's up to coaches and teachers to notify the media. Kent Beatty and Rebecca Durham are exceptions rather than the rule, but they could teach their colleagues a thing or two. We've tried having a student reporter, having a box for information to be left in at the high school. We pay a freelancet'to be our eyes and ears .at the mid­school, and she, too, has problems getting Informa­tion. .

We have been hearii;tg a lot about our fragile environment, the ozone hole and fluorocarbon (in spray cans) and endangered species. The snail darter versus Brantley Dam- eagles and coyotes versus the sheep rancher, etc.

Now comes the gay rights flap. If I may, I would like to P"-t it in per·

sp~\re, as I see it. l·be1ieve that any life form that

makes a positive contribution to the ecology of the area in which it resides, or the wbrld in general, should receive some protection; the amount of protection to be determined by the value of the con­tribution.

Now what is gay rights'! Is this a

right to practice an unnatural life­style, free of any _criticism?

Would it be a right to prosecute anyone under the law who would criticize or reject gays from another social order, say the church -or any Christian group?

If this were the law, I think the gay population would escalate, and progressively so.

If every one -on this earth was gay, Homosapiens would follow the dinosaur ·and the dodo bird into obscurity.

Now, will someone please ex­plain to me who· or what should have the right and what or who is the endangered species? ·

I am one resident that is defu)itoly against the extra fee put on people that have cess pools.

I bought a new bouse six years agq, and the cess pool was already in place. In all thaselilx years there has not been one drop of anything

from my house that has been put in the city sewer.

As long as I use the chemical I use, there's not much possibility that the cess pool will have to be pumped out. rve usedthia chemical i)l two former places during the past 25 years, and the cess pool

never did require pumping out. However, I will say if this one

ever requires to be pumped out and the contents dumped in the city sewer, I should- and would- un­derstand a fee charged to use the sewer.

I have not inquired about the

cost involved in having plumbers connect my home to the City sewer, but feel there are 1JlBilY in the Ruidoso and Ruidoso Downs city limits that could not alford it.

I believe in paying for the set­vices l get.
