The National Weather Service reports more snow was recorded in the south-central part of the Nebraska, with 9.2 inches reported in Cambridge and 8.5 inches in Lexington. In Iowa, the heaviest snow appeared to fall in the western and north-central parts of the state, which saw upward of 6 inches. No major highways or interstates were closed for an extended period during Saturday’s storm. At least one fatal crash was attrib- uted to the weather. The Nebraska State Patrols says a 2-year-old boy was killed when a semi crashed into the back of a car on Inter- state 80 near Waverly. Authorities Say Missing Hunter Found Dead SIOUX FALLS (AP) — Authorities in eastern South Dakota say a missing hunter from Sioux Falls was found dead on Sunday. KELO television reports that the 57-year-man was found dead in Island Lake, located just west of the McCook County-Minnehaha County line. He was duck hunting with his dog in the area on Saturday when he was reported missing by friends. Authorities found him just be- fore 10 a.m. Sunday. Searchers found the man’s vehicle near a slough in the Colton area. Authorities haven’t released the man’s name. Webinar Offers Info On Farm Flood Recovery LINCOLN, Neb. (AP) — A webinar offered to farmers in five states will explain what government resources are available to help them recover from Missouri River flooding. The Dec. 14 webinar will feature two producers who are repair- ing their farmland and representatives from the U.S. Department of Agriculture and U.S. Army Corps of Engineers. The Lincoln Journal Star reports that a Lancaster County district judge granted the state’s request to drop the case against Nebraska Diamond Dales Co. and president John Tavlin. A trial had been scheduled for this coming week. When the case was filed in 2009, authorities said Nebraska Dia- mond staff suggested to eight buyers that their merchandise could be delivered to them in Council Bluffs, Iowa, so they wouldn’t have to pay Nebraska sales tax. Lancaster County Attorney Joe Kelly told the newspaper Friday that research of tax law found no crime was committed. Lincoln Launches Its Own Health Channel LINCOLN, Neb. (AP) — The city of Lincoln is converting one of its cable-access channels to a 24-hour health and wellness channel. The Journal Star reports that the switch makes Lincoln one of the few U.S. cities to offer such programming. The channel switched to the new format two months ago but its official grand opening won’t be until Jan. 1. It now offers exercise programs and a presentation on childhood obesity but several new shows will be added in early 2012. The city has hired former History Channel producer Melissa Fuller as writer/producer. She’s already working on the new shows. BECK Associated Press OMAHA, Neb. — The Nebraska Supreme Court will determine whether an Omaha man gets a new trial in a fatal parking lot shooting. Rufus Freemont, 25, was convicted in January of second-degree murder and weapons counts for the June 2010 shooting death of 19-year-old Andrew Galligo. Freemont was sentenced in March to 55 to 60 years in prison for the murder count, 20 years for using a weapon and up to 10 years for being a felon in possession of a gun. All the sentences are to be served at the same time. According to witness testimony and police ac- counts, Freemont was in the back seat of a car when a friend who was driving spotted Galligo wearing the red and black colors of a gang to which she belonged. The woman pulled into the parking lot, got out of the car and began arguing loudly with Galligo. A few minutes into the argument, witnesses say someone in the back seat of the car stuck a gun out of the car’s window and shot Galligo sev- eral times. Police said the shooter was Freemont. Freemont argues that a Douglas County Dis- trict Court erred by, among other things, allow- ing evidence at his trial that he had a gun in the week before the shooting and that he jumped out of a second-story window to escape police trying to arrest him, and by allowing autopsy photos into evidence. Freemont also says his trial lawyer was inef- fective because the attorney failed to introduce evidence that the driver of the car shot Galligo, based on three witnesses who identified her as the shooter to police. “Although trial counsel had this information approximately two months prior to the com- mencement of trial, he — inexplicably — made no effort to adduce evidence regarding third-party guilt in order to defend Freemont,” Freemont’s ap- peal attorney, Peder Bartling of Omaha, wrote in his brief submitted to the state’s high court. The Nebraska Attorney General’s office coun- ters that all of Freemont’s arguments lack merit. “Since we do not know what information coun- sel had prior to trial, whether he considered it trustworthy, whether the witnesses who purport- edly could produce this testimony were available or willing to testify, and we frankly know nothing more about this issue than what is alleged, the record is plainly insufficient to resolve it on direct appeal,” assistant Attorney General Kimberly Klein wrote in her brief for the state. The high court will hear arguments in the ap- peal on Friday. Omaha Man Appeals Murder Conviction, Sentence South Dakota Tourism Dept. Spent $220K For Macy’s Float MITCHELL (AP) — While the state De- partment of Tourism spent about $220,000 on South Dakota’s float in the Macy’s Thanksgiving Day Parade, singer Neil Dia- mond — who rode on top of the float — was the cheapest part. The Daily Republic reports the depart- ment will pay up to $5,000 for Diamond’s travel and other expenses — a standard amount Macy’s requires for any group fea- turing a float performer. Department of Tourism spokeswoman Wanda Goodman says landing Diamond was a “happy coincidence.” She says the department can suggest the type of musi- cal artists it wants, but Macy’s talent staff is responsible for contacting and securing the talent. After going back and forth, Goodman says the department agreed at the last minute to have Diamond on the float.

A few minutes into the argument, witnessessay someone in the back seat of the car stuck agun out of the car’s window and shot Galligo sev-eral times. Police said the shooter was Freemont.

Freemont argues that a Douglas County Dis-trict Court erred by, among other things, allow-ing evidence at his trial that he had a gun in theweek before the shooting and that he jumped outof a second-story window to escape police tryingto arrest him, and by allowing autopsy photosinto evidence.

Freemont also says his trial lawyer was inef-fective because the attorney failed to introduceevidence that the driver of the car shot Galligo,based on three witnesses who identified her asthe shooter to police.

“Although trial counsel had this informationapproximately two months prior to the com-mencement of trial, he — inexplicably — made noeffort to adduce evidence regarding third-partyguilt in order to defend Freemont,” Freemont’s ap-peal attorney, Peder Bartling of Omaha, wrote inhis brief submitted to the state’s high court.

The Nebraska Attorney General’s office coun-ters that all of Freemont’s arguments lack merit.

“Since we do not know what information coun-sel had prior to trial, whether he considered ittrustworthy, whether the witnesses who purport-edly could produce this testimony were availableor willing to testify, and we frankly know nothingmore about this issue than what is alleged, therecord is plainly insufficient to resolve it on directappeal,” assistant Attorney General KimberlyKlein wrote in her brief for the state.

The high court will hear arguments in the ap-peal on Friday.

South DakotaTourism Dept.Spent $220K

For Macy’s FloatMITCHELL (AP) — While the state De-

partment of Tourism spent about $220,000on South Dakota’s float in the Macy’sThanksgiving Day Parade, singer Neil Dia-mond — who rode on top of the float —was the cheapest part.

The Daily Republic reports the depart-ment will pay up to $5,000 for Diamond’stravel and other expenses — a standardamount Macy’s requires for any group fea-turing a float performer.

Department of Tourism spokeswomanWanda Goodman says landing Diamondwas a “happy coincidence.” She says thedepartment can suggest the type of musi-cal artists it wants, but Macy’s talent staffis responsible for contacting and securingthe talent.

After going back and forth, Goodmansays the department agreed at the lastminute to have Diamond on the float.
