The holidays are here, and time to celebrate another good
year in shipping. If you're not celebrating, you must be
under 30.
There was, to be sure, some reallignment. After many
years in the shadow of a more glamorous cousin, the dry
bulk market stepped forward as the new darling at the ship-
ping ball. It is a fascinating development, to hear the econ-
omists who make a living analyzing the markets describe it,
and it goes to the heart of the past, present and future of
the global economy. I encourage you to attend the market
session of the CMA Shipping Conference 2008, on March
18. You won’t regret it.
On the other hand, some things have remained the same.

“Tis the season to be jolly. (Forget the tra la la!). By any
metric you have all earned the right to enjoy the fruits of
your labors this year. Santa will be good to you all.With the
cost of coal skyrocketing, even the naughty will do okay.
You will read this missive before our Holiday Party so the
only recent Association event was the Nov 29th luncheon
featuring John Veson, President of Veson Nautical. John
gave an excellent presentation on using e-commerce appli-
cations to communicate and manage. His comments
sparked some spirited exchanges with the audience.
In my closing comments last month I noted that there would
be a series of “scoping” (citizen input) hearings on the pro-

posed Long Island Sound Dredged Material Management
Plan (DMMP), one of which was at the Westin Hotel the
evening of November 28, 2007. Since my office is so close
to theWESTIN I attended – the only shipping person. I even
testified, urging far quicker action than the agency and envi-
ronmentally sensitive people present apparently felt was
needed.
I feel that a sense of urgency is missing and to make that
point I cited the TURBANA banana ship pull out from
Bridgeport and the consequences to our region including
New York State. As a reminder of what that is all about I
have included my testimony for your interest elsewhere in
this issue. I did not speak as a representative of CMA nor
of the shipping industry, fearing that would establish me as
having an agenda. I simply described myself as “citizen”.
There were representatives from three or more US Army
Corps of Engineers offices, a similar number of EPA offices,
NOAA fisheries people, a representative from
Congressman’s Shays office, two representatives each
from the states of New York and Connecticut, and untold
minions from an alphabet of other agencies and special
interests.
During the Q & A the Norwalk (CT) harbor master asked
how long ago the Corps of Engineers approved the central
and western Long Island Sound disposal sites. The answer
was over 50 years ago. For the record, the US EPA was
only established in July 1970. The next question was how
many years have those sites been monitored by anyone for
possible ecological damage. Answer: About thirty years.
Question: Has there been any ecological damage of any
kind. Answer: None that we can measure. QUESTION -
Why are we here if the dredging done before anyone knew
about the environment did nothing to hurt the environment?
The resulting pregnant silence was followed by heroic
efforts to explain that the DMMP was designed to make effi-
cient USE of the dredged material. I left about this time.
I re-learned something.We have to stay engaged and keep
trying to connect commerce, ships and shipping in order to
get any recognition for our virtually invisible industry.

useful to review these laws of nature and of men.These are

NORTH AMERICAN MARINEENVIRONMENT PROTECTION
ASSOCIATIONOn the 25th anniversary of the Helenic Marine
Environment Protection Association (HELMEPA), a pas-
sion of George P. Livanos, CMA’s 1992 Commodore, North
America joined the movement. The Charter was signed on
October 25, 2007 as part of theWorld Maritime Day events
in NewYork City. Among the Charter’s signatories are CMA
president, Peter Drakos, IMS’s founder James Lawrence
and IRI’s Clay Maitland.
“COGNITIVE DISSONANCE”

I first heard this phrase on a Bill Moyers’s TV program last
month. I think it was meant to describe the polarization of
voters and the inability of government to move any agenda
due to the “noise” (dissonance). On further consideration, it
seemed to have applications in the world of shipping regu-
lations today. I must emphasize “today” because as much
as we might like to ignore the steady drone of new regula-
tions, enforcement of old regulations and proposals for still
more regulation, shipping has caught up with other indus-
tries and society in general. Shipping has become what we
have always feared and tried to avoid.
There is a medical/psychological definition of the term, but
for my purposes lets look at the Random House
Unabridged Dictionary of the English Language definition
of each word.
• “Cognitive” – adjective – The act or process of knowing.
• “Dissonance” – noun – The music definition: A simulta-
neous combination of tones conventionally accepted as
being in a state of unrest and needing completion. For
you musicians think “atonal”.
All of my examples start with smart people (the COGNI-
TIVE). They have the best of intentions, but very narrow
agendas that do not: (a) accept that there are other valid
view points; (b) allow for compromise; (c) consider possible
consequences of their agenda beyond their well meaning
but narrow goal(s) (the DISSONANCE). All too often alter-
native views are seen as a personal attack, rather than a
discussion of their ideas thus further polarizing otherwise
logical people.
If people of different views do not listen to each other, nei-
ther is likely to learn anything and even less likely to create
change for the better. To be sure, the political dictum that
CHANGE is only hammered out on the anvil of emergency
seems to be truer today than at any time in the world’s his-
tory, but this method of change brings along the highest
percentage of unintentional consequences.

What I have described is most likely to be seen by you, the
shipping industry, as a commentary on environmental pro-
tection, but it also covers the paranoia of security and the
idea that punishment (incarceration and/or financial) is the
only way to change behavior. Of course that is not true.We
know that the exchange of ideas and a willingness to seek
the best path for all is far more effective than having the
party with the most power dictate a solution to a problem.
However, that is NOT what is happening.
We see evidence of this everyday during the presidential
political debates. Everyone is talking AT you and none are
listening to you. As we saw during the disgraceful Dubai
Ports World debacle, politically inspired back biting by
Congress was enabled and whipped into a senseless fury
by ignorant and irresponsible media. I likened it to the
Roman Forum where common sense was thrown to the
lions because to admit it was common sense would under-
mine the Nay Sayers’ self importance. In Aaron Sorkin’s
words “politicians are not at all interested in solving your
problems, only to make you afraid of them and create the
illusion that they, and only they, have a solution that they
will reveal at some time in the future (but never do).”
I am sorry to bring this negative vision to you in this season
of joy, but it is also a season when we must start to make
decisions as to who will lead this country in the future. The
future does not have to be so dark, but only if we as citi-
zens participate in the debates. Maybe one or more of you
will join me at the next public hearing on something ship-
ping related. “The price of freedom (ed. - personal as well
as commercial) is eternal vigilance.” (President Thomas
Jefferson).
DMMP TESTIMONYWEDNESDAY, NOV. 28, 2007
My name is Donald B. Frost. I live in Fairfield. I was a par-
ticipant in Governor Rell’s Cluster Competitiveness
Workshop in 2006 and the issue of dredging concerns me
as a citizen of Connecticut because, unless dredging
starts VERY soon, the leakage of jobs away from the State,
the rising cost of living, loss of population and the lessen-
ing quality of life in CT will significantly accelerate. The
URGENCY of this issue should not be underestimated. I
would like to give you one example.
For many years, Turbana Corp, an Ecuadorian banana grow-
er and shipping company has brought small, non-container,
refrigerated cargo ships into Bridgeport each week. The
boxes of bananas are discharged at the old CILCO terminal
(now owned by the ILA local) into refrigerated trailer trucks
for delivery to grocery stores from Westchester County to
southern Massachusetts and throughout Connecticut.
About a year ago, Turbana advised their Bridgeport termi-
nal managers, the Bridgeport Port Authority and, I assume,
the State of Connecticut, that they needed to use bigger
ships in order to expand the economic range of their oper-
ations in New England. Naturally, the larger ships would be
deeper drafted. Their contract in Bridgeport is up in 2008
and, as a condition for extending their contract, they want-
ed a realistic estimate of when dredging would take place
and they could start using bigger ships. No one could give
a realistic timetable, or even assure Turbana that
Bridgeport WOULD be dredged.
As a result, Turbana will pull out of Bridgeport in April 2008
and move their operations to Philadelphia. This will have
the following results:
1) JOB LOSS. 350-450 jobs in Connecticut counting the
terminal, longshoreman and truckers, and a reduction
of work by those who service the ships and the port.
2) INCREASED COST OF LIVING. The cost of bananas
in this region will rise due to the longer trip from
Philadelphia, and the bananas will not be as fresh.
3) REDUCED REGIONAL COMPETITIVENESS. The
further increase in road congestion and high cost of liv-
ing will discourage new industries from locating in the
region and encourage those still here to leave.
4) QUALITY OF LIFE ISSUES
a) INCREASED ROAD CONGESTION. More trucks will
traverse the region, beating up our roads and adding to
the congestion on our already choked highways.
b) INCREASED ENVIRONMENTAL DAMAGE.
Thousands of additional trucks will enter and leave our
region every year spewing global warming gases,
affecting our planet and our region’s health and the
prevailing winds from the west will bring us their pollu-
tion left in Pennsylvania, New Jersey and New York.
