Talking Points for the Keynote Address

National Conference of State Social Security Administrators (NCSSSA)

It is my pleasure to welcome you to Bozeman, MT, which is part of Social Security’s Denver Region.

Thank you for inviting me and allowing me to speak at your 66TH Annual Conference.

The NCSSSA has been a great partner in helping us get the word out about our programs, online services, and initiatives that our agency promotes to the states.

This Spring, NCSSSA leadership visited SSA headquarters and met with our colleagues to discuss important issues raised by NCSSSA membership, such as:

o Policy and Legislation;

o Assessing the possibility of data exchanges with State and Local Government entities and NCSSSA’s role; and

o Agency engagement to assist with section 218 technical support and communications with every state, recognizing the importance of the State Social Security Administrator and their role with section 218 of the Social Security Act. As an example, I know that the SSSA in Montana – who is hosting

this year’s conference – has worked closely with my Regional Office over the years.

When people need help, organizations like the NCSSSA and government agencies like Social Security/IRS have important roles to play. In my work at Social Security, I see firsthand up how our programs provide an important safety net to individuals and families.

Of course, Social Security is unique because it’s an EARNED benefit. People who pay into the system over a long enough period can get something back out later in life. That’s true whether you make $200,000 a year or $20,000.

This is equally true for many individuals who work for state and local governments, both in this Region and across the country. As you know, the collaboration between SSA, the IRS, and you as State Social Security Administrators is what allows this safety net to be available to many people at the state and local government level.

Many people may not be aware that there are a number of state and local government employees who enjoy Social Security coverage that has been extended to them under Section 218 of the Social Security Act. But, as you all know, this Section of the Act provides a way for some of these employees to get coverage.

The FY2017 President’s Budget includes a provision that SSA establish data exchanges with State and local entities to obtain pension information for wages not covered by Social Security.

SSA is pursing the feasibility of a data exchange with Colorado Dept. of Labor and Employment. The purpose is to find a solution to agency issues we encounter involving Title II Windfall Elimination Provision (WEP) and Government Pension Offset (GPO). These

provisions rely on self-reporting of receipt of pensions based on earnings NOT subject to the OASDI payroll tax. Self-reporting is a major cause of SSA’s improper payments to Social Security beneficiaries. The Colorado Department of Labor and Employment (CDLE) is the principal department of the Colorado state government responsible for local government assistance, property taxation, property assessment appeals, affordable housing, and housing construction regulation. If all goes well, this will be pursued nationally with other states as well.

We recognize just how important your role as State Social Security Administrator is, because you provide the link between the state (and its various state and local government entities) and our federal agency.

At our Regional Office, we’re focused on the day-to-day operations at the agency. One operational aspect that I’d like to discuss in a bit more detail is the amount of information that is submitted by SSSAs when seeking guidance and approval by SSA of a particular modification to their state’s 218 agreement.

One thing that would foster even greater collaboration between the members of the NCSSSA and SSA in the upcoming year is to encourage each of you to compile as much information – whether through documentary evidence, written descriptions, or something else – on the front end before guidance is sought from SSA.

Compiling as much information as possible with your submission then allows us at the Regional Office to have a full perspective of the situation and to put us in the best possible position to provide you with the guidance and approval you need to move forward.

As you know, SSA provides benefits to millions of beneficiaries in the U.S. every year.

Baby boomers retiring • The 2016 Trustees Report projects that the number of retired

workers will grow rapidly, as members of the post–World War II baby boom continue to retire in increasing numbers. The number of retired workers is projected to double in about 50 years. People are also living longer, and the birth rate is low. As a result, the Trustees project that the ratio of 2.8 workers paying Social Security taxes to each person collecting benefits in 2015 will fall to 2.1 to 1 in 2037.

Given the scale of our agency’s operations, you can appreciate that we are faced with an ever-increasing workload. We also want to be able to provide you with the best service that we can. Your efforts to compile comprehensive information about the guidance that you seek from our agency about a 218 matter will go a long way towards achieving that goal.

Thank you for keeping this in mind in the upcoming year.

Because of your hard work as State Social Security Administrators, we are able to provide everything that our agency can offer to employees at the state and local level across the country.

Today I’d like to talk a little about how the system works and give you some facts and tools that can help state and local employees who may be considering voting for Social Security coverage to make an informed decision about their possible future Social Security benefits. The decision to vote for Social Security coverage is an important one that some state and local employees may be faced with in the future.

Additionally, I wanted to highlight the benefits of what SSA has to offer to remind everyone of just what is at stake with the important work that we do every day in the 218 realm. It is also a good reminder for those state and local employees who already pay into Social Security of the full range of benefits available to them.

Everyone’s situation is different. Whatever your unique set of circumstances happens to be, having good information at your fingertips is key to developing a sound financial plan that makes the most sense for you and your family.

As Acting Deputy Regional Commissioner for the Denver Region, I have the privilege of partnering with State and Local government agencies, Tribal Governments and organizations to hear their constituents concerns and help the public understand our programs and services.

Social Security is there:

o On Day One, with a Social Security card and number that will stay with you throughout your life.

o As you grow, protecting your family in case of death or disability.

o When you get your first job, helping your employer secure your identity and report your earnings accurately.

o If you become severely disabled, to help you cope by replacing a portion of your lost income.

o When you marry, to protect your NEW family and change your name if you wish.

o And, of course, at your retirement, to provide an extra measure of financial security or help put a grandchild through college.

Social Security Basics

Before I get to retirement planning, let me say a few words about your Social Security protections.

When you work and pay Social Security and Medicare taxes, you earn Social Security credits. Credits can count toward your retirement benefits and can qualify you and your family for disability and survivors insurance. In addition, you’re earning Medicare

protection that can be available to you when you reach age 65, or sooner if you become disabled.1

Although we usually don’t like to think about it, Americans need to be financially prepared not only for a distant tomorrow, but also for what could happen to any of us TODAY.

The unfortunate reality is that we expect one in eight of today’s 20-year-olds who are covered under Social Security to die before reaching age 67, and one in four to become disabled.2

Retirement Eligibility

I mentioned Social Security credits. For 2016, you have to make a little under $1,300 to earn one credit. You can earn up to four credits a year. Most of today’s workers need at least 40 credits to apply for retirement benefits. That’s ten years of work. Of course, you need to be old enough to retire, too!

You can start receiving retirement benefits as early as age 62. However, we’ll reduce the amount of your monthly benefit if you begin receiving benefits before your full retirement age.

You can find out your full retirement age and get estimates of your benefit amount for various retirement scenarios by going to SocialSecurity.Gov and selecting “Retirement Estimator.”

I’ll mention our Retirement Estimator page throughout this presentation. This is a tremendous resource that can help you set your retirement goals and answer just about any question you’re likely to have about Social Security retirement benefits.

Claiming retirement benefits before your full retirement age can permanently reduce your monthly benefit payment by about half a percent for every month that you retire early.

The reduction is greater if you retire more than 3 years before your full retirement age. In that case, we reduce your monthly payment by about 1 percent.3

You can also DELAY retirement benefits.

If you delay benefits past your full retirement age, your monthly benefit will increase by about half to two-thirds of a percent for each month you delay, up to age 70. The exact percentage depends on when you were born. Past age 70, there’s no additional advantage to waiting.4

Claiming Considerations

People frequently ask us when they should start taking retirement benefits. That’s a natural question. The truth is, there’s no one-size-fits-all ‘best age.’ It depends on your individual circumstances, priorities, and how long you expect to live.

If you live to the average life expectancy for someone your age, you’ll receive about the same amount in lifetime payments NO MATTER WHEN you start receiving retirement benefits.5

You can get a rough estimate of how long you or your spouse may live by using the life expectancy calculator off of our Retirement Estimator web page.

If your spouse or children will qualify for benefits with you, you might decide that taking retirement benefits EARLY is the best decision for your family. On the other hand, starting early could reduce the survivors benefit for your spouse if you die before your full retirement age.6

If you start retirement benefits early while continuing to work, we’ll reduce your monthly payment by one dollar for every two dollars you earn over a certain limit — until you reach full retirement age. For 2016, the limit is a little under $16,000 a year.7

Keep in mind that your additional earnings during this period and checks we withhold could increase your monthly benefit after full retirement age.

If you expect to live long, you might decide that DELAYING retirement benefits makes the most sense for you. More than one in three of today’s 65-year-olds will live to age 90, and more than one in seven will live to 95.8

And, of course, women tend to live longer than men. In the United States, a man reaching age 65 today can expect to live until age 84 on average. For women, it’s 86.9

Those figures are considerably under the national average I just quoted.

These are just a few points to consider when deciding when to start your retirement benefits. On our Retirement Estimator web page, you’ll find a number of useful calculators and an informative fact sheet titled “When To Start Receiving Retirement Benefits.”

These resources can help you make an informed decision about the best time to retire.

Medicare

Whatever you end up deciding, be sure to sign up for Medicare at age 65. The sign-up period for Medicare begins 3 months BEFORE the month you turn 65 and ends 3 months AFTER that month. If you don’t sign up during this period, your Medicare coverage could be delayed and cost you more.10

You can apply for both retirement benefits and Medicare at SocialSecurity.Gov, or for just Medicare if you aren't ready to receive retirement benefits yet.

Family Benefits

When you start receiving Social Security retirement benefits, certain family members may also qualify to receive benefits on your record.

Your spouse, divorced spouse, and minor children may qualify to receive up to half of your full-retirement benefit amount, even if you retired early. Children under 20 who are full time-students may also qualify, as well as grown children living with a disability that started before age 22.

Your benefit amount won’t change because one or more family members also receive benefits on your record. However, there is a limit on the monthly amount one family can receive. This computation doesn’t count divorced spouses.

If you qualify for benefits on your own record, we’ll pay that amount first. If the benefit on your spouse’s record is higher, you’ll get an additional amount on your spouse’s record so that the combination of benefits equals the higher amount.

The same rules I mentioned a moment ago for retiring early also apply when claiming benefits as a spouse or divorced spouse.

Whether you’re applying for retirement benefits on your own record, your spouse’s record, or both, you can apply online at SocialSecurity.Gov in as little as 15 minutes.

The earliest you can apply for retirement benefits is 3 months before you turn 62. To keep from receiving benefits sooner than you want, wait to apply until no more than 4 months before you’re ready for your benefits to begin.

Benefit Amount

I’ve talked a lot so far about WHEN you choose to begin receiving retirement benefits. But exactly how MUCH can you expect from Social Security in retirement?

I hope you’ll all take advantage of our Retirement Estimator to get benefit estimates for retirement scenarios you are considering. Since the Retirement Estimator uses your actual Social Security record, this is an excellent tool for picking out a target retirement date that suits your individual circumstances.

We base your retirement benefit on your average earnings over your working years, up to a certain maximum. For 2016, the maximum monthly benefit at full retirement age is a little over $2,600. For those retiring early at age 62, that amount DROPS by over $500 a month. For people who wait until age 70 to claim retirement benefits, it INCREASES by over $900 a month.11

Those are substantial differences!

When you’re ready to retire, we calculate your benefit amount based on the 35 years in which you earned the most.12 To receive the maximum benefit, you need to have made the maximum taxable earnings during 35 or more years.13

For workers who retire at their full retirement age, Social Security replaces about 55 percent of taxed pre-retirement monthly earnings for low earners, about 34 percent for higher earners, and about 27 percent for those who made the maximum taxable earnings throughout their working life.14

September 12, 2016 Session Title: Legislative Update Speaker: Sue Bussman, SSA, Tony Roda, ESQ Moderator: Gwynne James

This presentation was divided into two parts. Part one by Sue Bussman, discusses H.R. 711. This bill would replace the current WEP law with an added provision to add a formula that represents the work history of people in non-covered jobs. This will allow everyone to be treated fairly. This bill also would have provided a monthly rebate to those subject to current law WEP.NCSSSA supported the bill. The bill would have been cost neutral. In March 2016, the Ways and Means Social Security Subcommittee held a hearing on the bill. Changes were made to the bill, support weakened and it was pulled from the mark-up, was not considered and was not voted on. Chairman Brady and Congressman Neal are committed to solving the WEP issue. H.R. 711 will likely be reintroduced in the 115th Congress. Tony Roda’s presentation focused on PEPTA, the Annuity Accumulation plan and Normal Pension Costs. PEPTA is the Public Employee Pension Transparency Act. PEPTA provides annual reports to the Treasury Department which include the current assumed rate of return and a supplemental report based on FMV of assets and U.S. Treasury obligation yield curve. The Annuity Accumulation Plan is a proposed plan that is being positioned as a replacement for DB plans. Only employer contributions are allowed in the individual, deferred, fixed-rate annuities. Normal Pension Cost was attempted in 2015 on the Every Student Succeeds Act but was stopped because of unintended consequences. This legislation would affect the use of ESEA dollars by states. Normal cost would not equal unfunded liabilities.

September 12, 2016 Session Title: IRS Future State for Outreach & Education Speakers: Dwayne Jacobs and Rhonda Kingsley Moderator: Mark Shelhammer, WV Dwayne began the program discussing a slide that represented some of the major initiatives being undertaken by the IRS. He then discussed the IRS’ previous outreach and service paradigm. He described new technology upgrades being utilized by IRS personnel to increase efficiency. He explained that the new electronic based model was justified based on both diminishing resources and the shift toward meeting the needs of you taxpayers. The resulting new model is designed to be both effective and efficient. Dwayne discussed various improvements to educational/outreach resources available through the web relative to voluntary compliance within government entities. Dwayne reminded the group that while the IRS cannot commit to every invitation to speak, it is often possible that a personal address can be made to large audiences. Future state needs through digital opportunities was discussed as a “what’s next” scenario and listed several action items to empower IRS customers through educations and tools to help everyone be more effective. Rhonda discussed the FSLG webpage and the resources and webinars available there and informed the group that two more webinars will be coming out in the near future. She then answered questions regarding new the new Jan. 31, 2017, deadline for filing W-2s, W-3s and 1099-MISC (Box 7). Rhonda encourage us, and to recommend to our “customers”, to sign up for the FSLG Distribution list in order to get timely access to information that will benefit us all.

September 12, 2016 Session Title: Information Sharing & Enhancing Partnerships with IRS & SSA Speakers: Maryann Motza, PhD, and TJ Reardon, JD Moderator: Maryann Motza, PhD This session included Maryann Motza (Colorado) providing a summary of the issues and concerns that were discussed during the May 2016 NCSSSA leadership team meetings with various federal agencies, departments, and Congressional staff members. The leadership team consisted of Maryann Motza (President), James Sawyer (Vice President), Meghann Spring (Vice President Designate), and TJ Reardon (NCSSSA Section 218 Council member). One of the principal issues discussed during the leadership team meetings with NCSSSA’ s federal partners, i.e., Social Security Administration (SSA), Internal Revenue Service (IRS), and Treasury Counsel, was how to better use the Section 218 Council which was jointly formed by the three groups in September 2011.1 Dr. Motza also provided a historical overview of the original purpose and reasons the Section 218 Council was created in September 2011. The Council was formed in response to issues and concerns that were raised by Congress asking the Government Accountability Office (GAO) to examine how Social Security coverage and taxes are being managed nationwide due to concerns that arose out of a Missouri Task Force Report issued in 2009.2

TJ Reardon (Maryland), one of two current representatives on the Section 218 Council (Angie Dowdy, Louisiana, is the other member), provided information on plans for the Council to be more effectively used by all parties in the future. Among the ideas to be explored are: generally how to improve the use of the Council by all parties (i.e., SSA, IRS, and NCSSSA) , establish and maintain a 360º input and feedback loop among NCSSSA members and our Council representatives so our issues are identified and feedback is provided as to what the Council is considering to address our concerns (which will include the Council members asking for suggested topics to discuss and sharing the agenda of topics to be discussed with all NCSSSA members), and ensuring a regular meeting/conference call schedule is adhered to by the Council. Attached are: the PowerPoint slides used during the session, the final Section 218 Council Charter, the letter that was sent to our federal partners in April 2016, and the final summary notes from the May 2016 NCSSSA Leadership Team meeting.

• School “teacher” positions • Police & fire positions • Pension plan contributions following changes made to qualifying FICA

replacement plans • Government entity restructuring due to consolidations and annexations • Charter schools • Mandatory Medicare coverage • Part time positions and part time exclusions • Appropriate application of student exclusions

It was noted that the definition of a government entity is primarily driven by who can be in the government pension plan. The statistical results of IRS examinations for entities under a Section 218 modification were shared. Categories included: worker reclassifications; adjustment of FICA wages; Medicare only coverage; unreported compensation; and employee usage of employer owned vehicles. Audience response found this presentation informative and beneficial.

Session Title: Exclusion from Coverage (Mandatory vs Voluntary) Speaker: Mr. John Fox, SSA, OGC, Kansas City Moderator: Mr. Madison Davis (AR) Mr. Fox provided the attendees with a detailed explanation on exclusions from coverage when a state elects to extend Section 218 coverage to a coverage group, it has the option of excluding or covering certain services and positions. Mr. Fox explained each of the following Voluntary Social Security Coverage Required Exclusions:

• Services performed by individuals hired to be relieved from unemployment. (This does not include many programs financed from Federal funds where the primary purpose is to give the employee work experience or training.)

• Services performed in a hospital, home or other institution by a patient or inmate thereof as an employee of a state or local government employer;

• Services performed by an employee on a temporary basis in case of fire, storm, snow, earthquake, flood or other similar emergency;

• Transportation services covered under Section 210(k) of the Act. • Services that would be excluded if performed for a private employer because the

work is not defined as employment under Section 210(a) of the Act (e.g., non-resident aliens with F-1, J-1, M-1, and Q-1 visas).

During his explanation of Required Exclusions he pointed out that these exclusions apply to voluntary Social Security coverage situations (coverage via a Section 218 Agreement) and should not be confused with the different set of exclusions that applies to required Social Security and required Medicare situations.

Mr. Fox continued with an explanation of the Optional Exclusions from Voluntary (Section 218) Social Security Coverage:

• Agricultural labor, but only those services that would be excluded if performed for a private employer;

• Elective positions; • Election workers and election officials whose pay in a calendar year is less than

the amount mandated by law, unless Section 218 agreement covers election workers;

• Positions compensated solely by fees that are subject to SECA (Self-Employment Contributions Act), unless Section 218 Agreement covers these services;

• Part-time positions; • Students enrolled and regularly attending classes at the school, college or

university where they are working. Mr. Fox noted that beginning July 2, 1991, services optionally excluded from coverage under a Section 218 Agreement may be mandatorily covered unless the employee is a member of a public retirement system or the services are excluded from mandatory coverage. John’s presentation was complete, well organized and brought simplicity and clarity to help us guide our “customers” in regards to Exclusions from Coverage (Mandatory vs Voluntary). 9/13/2016 Session Title: Rehired Annuitants (Made Simple…) Speaker: Jim Burgess – SSA; Kirk Jockell - SSA Moderator: Gene Janke Jr. – WI The purpose of the presentation was to try to simplify, if possible, the situations and main principles regarding rehired annuitants to assist in effective administration. The presentation included:

• A detailed explanation of what is an annuitant and rehired annuitant; • Laws and policy regarding rehired annuitants; • rehired annuitants and mandatory SS coverage; • Several examples of rehired annuitant situations; • Detailed explanation of relevant factors that determine coverage or exclusion; • Discussion of ineligibles, and; • Referendum votes and how they relate to rehired annuitants

When discussing rehired annuitants state administrators need to have a complete picture – IRS rules, SS rules/218 agreement. See presentation for key points and examples. Gets very complicated very quickly! Question 1: Retaining membership – what do you mean? A1: Rules of the retirement system say that they maintain their vote under a divided vote referendum. Question 2: Is it up to the individual retirement system to determine membership rules? A2: Yes.

September 13, 2016 Session Title: What Happens Next? Speakers: W. Grant Wright, Social Security Administrator, New Mexico

Melanie Piccin, Social Security Coordinator, Washington Moderator: There was no moderator for this session Melanie Piccin was the first presenter with procedures after a Majority Vote Referendum. She discussed her use of a check sheet that she uses for each referendum to ensure all steps are followed. Pertinent information from the check sheet is then entered into a database that she uses to prepare the Section 218 Modification. She also mentioned that the state of Washington assesses an annual charge to all entities with a Section 218 Modification for file maintenance and support of the Section 218 program, including her office staffing. W. Grant Wright was the second presenter with procedures after a Divided Vote Referendum. He went through all the actual documents that must be held by the Social Security Administrator in a Divided Vote Referendum. These include originals of the following: Resolution, Notice of Referendum, Referendum Roster, Referendum Certification, Certification Tally of “Yes” votes, Certification Tally of “No” votes, and all ballots. He also explained that New Mexico has about 100 charter schools, half of which have gone through the Section 218 Modification process. In addition to the mentioned documents, two additional documents are needed for charter schools: A letter from the Administrator stating the chartering authority and a copy of the school’s actual charter. Melanie and Grant both prepare 3 originals of the actual Modification, and forward it along with required documents to the respective SSA Regional Office for review and final approval/signature by the Regional Commissioner. After signature, the regional office retains 1 original, and 2 originals are returned to the Administrator. One of these goes to the entity and one is retained in the Administrator’s file. In the case of a Divided Vote Referendum, the entity is notified that it can apply for a refund of FICA contributions for its employees who voted “No” on Social Security coverage.

The high-functioning workgroup first began by developing the ground rules which set the expectations on the “process” of our meetings and the behaviors that would guide our efforts. After adoption we turned our attention to defining an Objective. The definition of creating SMART Objectives was agreed to by consensus. SMART Objectives demand that the objective follow this criteria: S –Specific M – Measureable A – Achievable R – Relevant T – Time Sensitive Once all of the process engineering was completed, we took each Vision Statement individually and took time to dwell on it individually, and provide an email to each member prior to the following meeting describing our thoughts (brainstorming). At each meeting ideas were vetted with the author being responsible to “defend” their position. Once consensus was achieved, and not until then, did we move to the next vision statement. James agreed to be our liaison to the Executive Committee as he was already attending all meetings. James was able to provide updates, answer questions and relay any

pertinent information back to the team. The final document was vetted by all team members, revisions noted and submitted to the Executive Committee in February 2016. It was approved by the Executive Committee and now will serve as a guide to the 2017 officers. The final step in the process will be for the appropriate individuals (committee chairpersons, executive committee members, etc.) to develop the actual tactical plans to accomplish each of these objectives. Mark Shelhammer volunteered to hold a session to discuss a process that “owners” may want to consider and a tracking mechanism that will allow the Executive Committee to monitor the pace of our endeavors. I would like to thank Dr. Motza, the Executive Committee, and especially the GREAT people that served on this team for your input and support. Meghann Spring, Montana The purpose of the NCSSSA Legislative Committee is to: monitor, maintain, assess, and disseminate proposed legislative, policy, and regulatory changes affecting Social Security and employment tax programs at the federal and state levels of government. Provide analyses and proposed responses to NCSSSA leadership and other appropriate officials. The 2015-2016 Legislative Committee conducted an organizational conference call on September 15, 2015. The Committee was extremely active again this year, having accomplished the following: 1. Held multiple conference calls during the program year. During the first conference

call it was again decided that the most efficient way to approach Committee responsibilities was to divide the workload and assignments among all Committee members. An agenda was distributed prior to each meeting and summary notes, including action items, were provided after each conference call. Between conference calls numerous email exchanges occurred to ensure issues were addressed as quickly as possible.

2. Continued networking/liaison relationships with thirty-one (31 organizations or policy-

making bodies at the national level which included the addition of several new ones that have similar issues and concerns to NCSSSA. The organizations or policy-making bodies being monitored are:1

Each committee member selected one or more of the above organizations to monitor and highlight any significant information for other committee members so appropriate actions could be taken by the full committee, including any recommendations for actions by the NCSSSA Executive Committee. Between conference calls, informational emails and reports from the above organizations were shared with members of the Legislative Committee, which includes the current NCSSSA leadership team members thereby ensuring the NCSSSA leaders are kept apprised of significant national-level issues and developments and have direct input into establishing priorities for the Legislative Committee.

3. The Legislative Committee had four follow-up assignments that carried over into 2015-2016. Those items were:

A. Continued to monitor IRS’s plans to update the Federal-State Reference Guide (IRS Pub. 963). Due to other demands on IRS staff members’ time the IRS was unable to provide proposed changes to NCSSSA prior to the conclusion of the 2015-2016 program year. Based on feedback received from the IRS in September 2016, the proposed revisions will be provided to NCSSSA for review and comment during the early part of the 2016-2017 program year. The Legislative Committee will again coordinate feedback from NCSSSA’s members and consolidate that information so the IRS (and SSA) receive consistent and properly vetted suggestions for edits and improvements to the publication.

B. Continued to monitor and solicit feedback from the IRS on the risk areas they have identified. During the 2015-2016 program year no new updates were provided, but the IRS provided a summary of the risk areas during the 2016 Annual Conference in Bozeman, Montana. Information on that session can be found elsewhere in the 2016 NCSSSA Annual Conference Proceedings Book.

C. Identified issues and concerns with reports published by both the Center for Retirement Research at Boston College and the Brookings Institute that support expansion of Social Security (Old Age, Survivor, Disability Insurance, “OASDI”) to all newly hired state and local government employees. During the 2015-2016 program year the Legislative Committee members decided not to draw further attention to either study since neither one received much publicity or support. The information which had been accumulated that contradicts the assumptions and conclusions reached in those studies will be retained by the Legislative Committee, however, so it can easily be used in the future when similar proposals are presented, especially if any Congressional action seems possible.

D. Continued to monitor any developments related to the University of Colorado at Colorado Springs report entitled “An Analysis of SMART Options: Reinstatement of the Section 218 Option”, dated February 2014. No new developments occurred during NCSSSA program year 2015-2016.

4. Monitored legislative and regulatory activities and publications of interest to NCSSSA members, including:

A. Universal Social Security issues.

B. Windfall Elimination Provision (WEP) Proposal introduced by Representatives Brady and Neal, H.R. 711 (see https://waysandmeans.house.gov/hr711/ ). See, also, the NCSSSA 2016 Legislative Issues Statement (Appendix A) and Appendix B for H.R. 711 Fact Sheets and Chairman Brady’s opening statement at the mark-up on July 13, 2016 documenting developments related to H.R. 711 that put the measure on hold. The letter of support, dated March 14, 2016, that was submitted by Public Pension Network members, including NCSSSA, discussed below in 5.B. of this report prior to Chairman Brady pulling the measure from consideration during the House Ways and Means Committee hearing in July

C. Medicare Opt-in. No further action on this proposal is expected to be taken by Congress. The Legislative Committee will continue to monitor any developments that may occur in the future.

E. Continued to monitor developments related to Senator Hatch’s proposal Secure Annuities for Employee (SAFE) Retirement Act of 2013). See the next section of this report (work with the Public Pension Network) for further information; see 5.A. of this report.

F. Reviewed, compared, and contrasted proposed rules related to the definition of political subdivisions that was issued by the IRS/Treasury Department on March 7, 2016 (https://www.irs.gov/irb/2016-10_IRB/ar17.html?_ga=1.46136612.1830561211.1476917779 ) for Tax Exempt Bonds (TEB) and Indian Tribal Governments (ITG) against what Employee Plans issued last year and the information FSLG provided during the Seattle Annual Conference. The Committee determined that the proposed rules only related to TEB and ITG, not to Internal Revenue Code Section 414 so it was unnecessary for NCSSSA to submit any comments on the proposed rules.

5. Continued active involvement in the Public Pension Network (PPN), which began during 2007-2008, after Ms. Barrie Tabin-Berger, Assistant Director, Federal Liaison Center, GFOA, sponsored NCSSSA’s membership. The PPN consists of a group of organizations that lobby Congress and Federal agencies regarding many issues with which NCSSSA members are also concerned. Among participating organizations in the Network, in addition to the GFOA, are: National Conference of Public Employees Retirement Systems (NCPERS), National Association of State Retirement Administrators (NASRA), the National Council on Teacher Retirement (NCTR), National Association of Government Defined Contribution Administrators (NAGDCA), and the National Conference of State Legislatures (NCSL). Involvement in the Public Pension Network has proven to be extremely valuable to NCSSSA in two major ways:

A. Ensures that NCSSSA is apprised immediately of any Federal-level developments (Presidential, Congressional, or regulatory) that impact any aspects of NCSSSA’s areas of interest, e.g., Social Security, Medicare, employment taxes, and public pension system requirement oversight.

B. Provides high-profile exposure for NCSSSA on significant national issues when NCSSSA signs on to letters expressing concern or support for proposed actions at the Federal level.

NCSSSA was a signatory on three (3) letters sent by the PPN during the 2015-2016 NCSSSA program year:

A. Letter dated December 11, 2015, sent to multiple members of Congress, opposing the public pension requirements that were contained in the Puerto Rico Assistance Act of 2015 (Senate Bill 2381). Those provisions were subsequently removed from the final bill, but attempts continued, especially by Senator Hatch (Utah) to link PEPTA and Puerto Rico aid. See Appendix D for both the letter and emails from members of the Public Pension Network that discussed those issues.

B. Support for H.R. 711 (WEP revision co-sponsored by Representatives Brady of Texas and Neal of Massachusetts). Copy of the final letter, dated March 14, 2016, is included as Appendix C (mentioned above in 4.B. of this report.

C. Letter dated March 14, 2016, sent to multiple members of Congress expressing opposition to the Public Employee Pension Transparency Act (PEPTA). See Appendix E for a copy of the letter.

NCSSSA’s Legislative Committee will continue to participate in PPN activities and provide the NCSSSA President with any draft letters so he/she can decide if NCSSSA should be a signatory.

6. Drafted legislative briefing materials for the NCSSSA leadership team (President Maryann Motza, First Vice-President James Sawyer, and Vice-President Designate Meghann Spring). The 2016 Legislative Issues Statement was used by the leadership team during the meetings with NCSSSA’s federal partners as well as with U.S. House Ways and Means Committee staff and with representatives from several of the NCSSSA Public Pension Network partners, while participating in the leadership meetings held in Washington, D.C. in May 2016 (see Appendix A for the final that was used during the meetings. Also see Appendix F for a copy of the April 28, 2016, letter and meeting agenda that was sent to the SSA and IRS for the May 23, 2016, joint meeting that was held by the NCSSSA leadership team members. Summary notes from all of the leadership team meetings that were held in May 2016 are included as Appendix G.

7. At the beginning of the 2015-2016 program year the NCSSSA Executive Committee asked the Legislative Committee to examine issues that arose in the State of Missouri associated with the U.S. Social Security Administration’s (SSA) requirement that an absolute coverage modification, rather than conduct a retirement system referendum election, to address an apparent erroneous payment by a Missouri political subdivision. This issue was brought forward due to the global effect on all states. The Legislative Committee formed a subcommittee to discuss the matter. The SSA subsequently (in late October 2015) issued an update to its Policy and Procedures Manual System (POMS) for SL 40001.465.B. Extensive research and numerous conference calls among members of the subcommittee and full Legislative Committee followed. In April 2016, a letter was sent to both SSA and IRS officials expressing concerns about the process that was followed in addressing the issue as well as concerns that the Section 218 Council was not used to discuss and properly consider the matter. See Appendix F for a copy of the April 28th letter,

including the attachments that further explain this matter (also discussed above in #6).

During 2016-2017, the Legislative Committee will need to review proposed changes to the Federal-State Reference Guide (IRS Pub. 963) both during 2016 and 2017. The IRS was delayed during 2016 in providing suggested edits for NCSSSA to review so the 2015-2016 Legislative Committee was unable to review and comment on suggested edits that will be included in the revised version of Pub. 963 later in calendar year 2016.

As chairperson of the Legislative Committee, I want to personally thank the other members (listed on page one of this report) for their contributions and continued support of the efforts of the Committee. Their work and dedication to the Committee was invaluable to ensuring NCSSSA members are kept informed in a timely manner of critical national level regulatory and legislative developments that are of importance to State Administrators and public employers/employees throughout the country and that NCSSSA’s voice is heard at the national level on important policy issues.

The Training and Succession Planning Committee conducted three regional training events during the program year: Providence, Rhode Island; Springfield, Illinois; and Portland, Oregon. Unfortunately, the attendance at these events was low due to on-going budgetary constraints within the states, with Portland being the most successful. Of particular concern, was the lack of federal officials’ participation. The Committee is looking at how we deliver training in this challenging fiscal environment. While we contend that “in-person” training is the most effective training method, the low attendance questions the continued expenditure of NCSSSA funds on providing regional training events. Changes to the training methods need to address these concerns: Will the use of technology increase participation? If so, which platform is best? How do we ensure federal officials participation? Proper analysis of these questions should be the basis for future plans. Respectfully Submitted,

Regional Activities for Year 2016

Region III did not encounter any major issues or concerns throughout calendar year 2016. However, the State of Mississippi conducted 2 referendums, 1 in June 2016 and 1 in July 2016 and both referendums were for a Planning and Development District. The 2 referendums were the first such action in several decades by the Mississippi SSSA. Both referendums were favorable.

Region III Caucus meeting convened September 11, 2016 at 2:00 p.m. in the Clark/Hyalite Room, Best Western Grantree Inn. States present for the meeting were:

SSA representative was not present due to flight scheduling.

State Administrators: The 2015- 2016 program year saw several changes in state administrators. Melanie Helmick has succeeded Kay Guyton in Alaska and a new team comprised of Irene Ho, Shay Jackson, Veronica Gill, Jennifer Rocca, and Robert Sharp, as the names administrator, is in place in California. The state of Nevada’s administrator position continued to remain vacant as it has since the retirement of Paul Brugger in 2014.

Referenda: With six states responding to a request for a year-end recap, 24 referenda were conducted in Region VII. Of these 20 (84 per cent) were favorable and four were unfavorable. Nine of the 24 referenda (38 percent) conducted were error modifications.

Challenges by State: Cited by states were the following challenges to their respective Section 218 program:

• Rehired annuitants working for mandatory employers with the same pensionsystems; one employer is working on a $2m refund of overpaid/collected FICAtaxes

• Staffing, funding, program strategies

• In the early stages of reviewing coverage obtained for traditional school districtsthat referenced an abolished retirement system in the modifications. Publiccharter schools, virtual schools, and local education agencies will be included inthe review

• Referenda for police officer positions• Multiple separate political subdivisions that have been withholding and paying

under the state’s agency EIN as directed in the code which created these entitieswith the assumption that the state’s Social Security modification covers them.This does not appear to be correct. The challenge is how to separate the sevenfrom the state’s EIN (with significant impact to their budgets) and SS coverageand change legislation which requires them to be treated as a state agency whilethat same statute clearly states they are not an agency.

• Meeting employer requests for training in a time of severely reduced budgets onthe part of our federal partners

Communication within Region VII: All communication within the region was conducted via e-mail including requests for feedback from the NCSSSA Executive Committee, updates on legislation (WEP/GPO), regional training opportunities, requested survey responses, dues requests, nominations and voting opportunities, as well as annual conference information.

NCSSSA Regional training: Regional training was hosted in Portland OR in May 2016. States participating included CA, ID, OR and WY. NCSSSA trainers were Angie Dowdy, LA and Rita Foltman, ID.

At the annual conference conducted September 10 – 14, 2016, Pamella Johnson was selected to serve as Regional Vice President for the 2016 – 2017 program year.
