    Editorial Shipping has, for a long time, been considered as one of the strong catalysts for socio-economic development. A business enterprise working in a country without links to outside world can never achieve high level of efficiency, profitability and geographical outreach.. Ship management is an important part of maritime traffic supervision of which security of ship is crucial. DGS as a part of its functions, has, inter-alia, recently issued maritime security advisory by which vessels should not enter into Gulf of Aden (on the coast of Somalia region) and keep themselves clear of this region. One must not ignore such security advisory. Seafarers remain the most important aspect of ship operation and should therefore be well looked after. The MLC, 2006 has safeguarded the rights and needs of the seafarers. Similarly, the MLC is also applicable to trainees and cadets. The GST, a new era of indirect tax regime, has come into force w.e.f 01.07.2017.The DGS has organized an awareness program on application of GST to shipping sector. The industry now needs to analyze the provisions of law in detail including the crucial concept of place of supply which is crucial for inter-state transaction. The e-newsletter publicizes maritime information. Please do give us feedback as we believe in improving the quality of our services

    Director General of Shipping & Special Secretary to the Government of India Speaks

    Recognizing the requirement of flag states to carry out periodical inspection, the DGS has reviewed its FSI/ PSC regime to ensure that the condition of the vessels is seaworthy and corresponds to the certificate the vessel is holding. The review has emphasized the need for concrete scheduled inspection as well as continuing surprise inspection on need basis. The Directorate has also decided to grant exemption from next FSI/ General Examination to those vessels which have satisfactorily undergone all PSC inspection by certain countries, without any detainable deficiency and the total number of deficiencies do not exceed five.

    The ability to pass an examination for the competency of a function under STCW is indeed a valuable quality. In order to ensure that the candidates perform better in the examination, the preparatory courses are intended.

    A non-technical (administrative) training was organized for new recruits/ officers of the Directorate with a view to enhancing professional skills, quality performance.

    Day of the Seafarer was celebrated on 25th June 2017. The program started with meditation and ended with an exhibition at Mantralaya, to highlight the importance of shipping and the unique contribution of seafarers.

    The Hon'ble Minister of State for Road Transport, Highways, Shipping, Chemicals and Fertilizers Shri Mansukh L Mandaviya, visited the office of DGS. Dr. Malini V. Shankar, IAS, DG Shipping & Special Secretary to the GoI and Shri Amitabh Kumar, IRS, Addl. DG Shipping welcomed him.

    The Hon'ble Minister had a meeting with the officers of DG Shipping and stakeholders of shipping industry on 11th May, 17 at 1100 hrs. The purpose of the meeting was to gather the views of stakeholders on how Indian shipping sector could be made more vibrant and resolving

    the issues of the industry, specifically to device methods for increasing employment prospects of Indian seafarers.

    Presentations were made on the role of DG Shipping, LRIT, seafarers statistics and the incident involving collision of ships at Kamrajar Port, Ennore were made. Honble Minister was also briefed on the major legal reforms initiated by the DGS. Presentations were followed by an interactive session in which the Honble Minister invited suggestions from the representatives of Shipping Industry.

    The Honble Minister appreciated the efforts of DG Shipping in introducing new regulations like Admiralty Bill and M.S. Bill. The recommendations made by the Task Force were also appreciated and the need for a public- private partnership to create awareness about maritime profession was discussed. Honble Minister announced that development of Indian shipping industry is his priority project. For this, he stressed on developing a performance oriented work culture. He emphasized that the seafarers are our brand ambassadors and if they acquire skills proactively, they will be in great demand in the world market and make the country proud by their achievements.

    DR. MALINI V. SHANKAR, IAS, SPECIAL SECRETARY TO THE GOVERNMENT OF INDIA

    The Appointments Committee of the Cabinet, has approved in-situ upgradation of Dr Malini V. Shankar, IAS to the level of Special Secretary. Presently, Dr Malini V. Shankar, IAS is holding the charge of the Director General of Shipping & ex-officio Additional Secretary to the Government of India, Mumbai (Indian Maritime Administrator).

    The Appointments Committee of the Cabinet has already approved the empanelment of Dr Malini V. Shankar, IAS, (MH : 1984) for appointment to the post of Secretary/ Secretary equivalent at the Centre.

    The editorial team extends its greetings and congratulations to Dr Malini V. Shankar, on her promotion to the post of Special Secretary to the Government of India, on behalf of the Directorate General of Shipping, GoI, and the entire shipping fraternity.

    The DGS vide NT branch Circular No. 1 of 2017 piracy dated 06.04.2017 has advised/ cautioned all the owners, operators and masters of all Indian ships including sailing vessels and fishing vessels not to enter into this region and

    keep their vessels well clear of this region and preferably keep a safe distance of at least more than 200 nautical miles from the coast. Those who violate the instructions and decide to operate their vessels in these waters would be doing so at their own risk.     Shipping and Logistics industry is poised for growth, generating excellent career & job opportunities. Shipping has always been a major contributor to global prosperity. With a view to preparing, a road-map and strategic plan to increase the employment of Indian seafarers in the world, discussions were held with stakeholders on 31.03.2017[INSA, MASSA, FOSMA, ICCSA, NUSI, MUI, MSC etc]. Based on the discussions, the Directorate decided to constitute a Task Force Committee under the Chairmanship of the DGS for examining the issues.

    During the quarter ending June 2017, two meetings were held on 06.04.17 and 20.04.17. The Committee discussed inter-alia, the following issues: (1) enhancement of quality of training imparted, including workshop training and communication skills; (2) E-migrant program implementation for Indian seafarers at Seaports and Airports; (3) improvement in examination system in view of shortage of Indian officers; (4) enabling Indian seafarers to join in Europe, NZ, Australia, S. America, Russia etc on OK to board rather than obtain visa; The committee also deliberated on the means of raising awareness regarding the competence of Indian seafarers.

    The committee is likely to submit its report shortly.

    The DGS has directed the Mercantile Marine Departments vide NT/ENGG. Circular No.01 of 2017 dated 24.04.2017 that CoCs revalidated or upgraded to 2010 amendments to STCW 1978 Convention with containing note of Regulation I/2, Paragraph 9 of the Convention on the front pastedown endpaper page, shall be endorsed with a stamp that The original of this certificate must be kept available in accordance with Regulation I/2, paragraph 11 of the Convention while serving on a ship in the additional pages of CoC booklet.

    Seafarers in possession of CoCs upgraded to 2010 amendments may approach the nearest MMD as per their convenience to get their CoCs stamped accordingly.

    In order to prevent issues relating to Indian CoCs complying with 2010 amendments to STCW during Port State Control inspections, the notes on the front pastedown endpaper page of the CoC is to be now read as following:

    The Competent Authority has reiterated emphasized the need for carrying out written and oral assessment of the candidates prior to issuing preparatory course completion certificates. The maritime institutes have also been advised vide ENGG Circular No.138 of 2017 dated 02.05.2017 to keep records of all these examinations for a period of two years. This shall be verified during periodic inspections. (Feedback from the industry and available data of results of MEO Class-1 and MEO Class-II examinations reveal that the pass percentage of candidates is not satisfactory).

    The course is intended to prepare the candidate for the examination to ensure that the candidates perform better in the examination.

    MMD HALDIA the new office building was inaugurated by Dr. Malini V. Shankar, IAS, Director General of Shipping on 08th May 2017 in the presence of Shri, G. Senthilvel, Dy. Chairman, Kolkata Port Trust, Shri S.K. Sinha, PO, MMD Kolkata and his team.

    DGS had opened a subordinate office of Principal Officer, MMD, Kolkata in Haldia on 07.07.2003 for extending services to the shipping sector and other allied industries. It has been operating since then from a room given by the Kolkata Port trust- Haldia Dock Complex in its operations building.

    The office building has been constructed on a plot of land measuring 2000 sq. metres at Chiranjibpur, Haldia, leased to DGS by the KoPT, HDC for a period of 30 years. CPWD started the construction work in 2010 and finally after completion of civil and electrical works, the building was taken over by MMD, Haldia on 02.01.2017. The Principal Officer, MMD, Kolkata and his team initiated the plantation drive on the land adjacent to the building of MMD, Haldia. The drive was launched in the presence of the DGS. The DGS appreciated the eco-friendly initiative and appealed to all to join the campaign by planting more tree saplings.

    The Director General of Shipping is pleased to relax the minimum educational qualification requirement to VIII standard passed for admission to 6 months pre-sea training for GP rating course and certificate Course in Maritime Catering (CCMC) and for obtaining CDCs, to the candidates who are natives of Minicoy Island belonging to Schedule Tribe in Union Territory of Lakshadweep.

    COMPREHENSIVE INSPECTION PROGRAMME (CIP)

    (1) In order to improve the quality of training in the Institutes approved by the DG Shipping, DGS Order No.23/2014 was issued for CIP guidelines. Till date, many institutes have not undergone CIP. The Indian Maritime Administration has taken a serious view of the laxity of the training institute who have not undergone CIP and directed that if the training institute conducting post-sea courses do not comply with the guidelines latest by 31st July,2017, then intake capacity of the courses will be reduced by 10% from August, 2017 onwards.

    (2) In accordance with the directions of the Honble High Court of Madras vide order dated 17.11.2016 and to maintain the quality of education imparted in the DGS approved Maritime Training Institutes, the training institutes have been directed vide DGS Order No.03 of 2017 dated 30.5.2017 to undergo the CIP through the concerned MMDs of their respective region. They may also do the same through the RO, if they so desire. The CIP should be carried out within a period of two months of issuance of the order. The Institutes not complying with these directions may face action which may include withdrawal of approvals/ reduction of intake or denial of approval of new courses.

    An immersion suit or survival suit is a special type of waterproof dry suit that protects the wearer. No doubt, this necessitates adequate maintenance.

    The DG Shipping has issued Circular No. NT/LSA/01/2017 dated 31.05.2017 that each suit should be subject to an air pressure test at interval not exceeding three years and suits over ten years of age at alternate year in order to ensure that suits are of adequate strength and seams are tight.

    The air pressure test shall be carried out at (a) DGS approved life raft service station having adequate facilities in India or (b) any IACS class approved service station outside India or (c) ship board personnel as detailed in the said circular.

    IMMERSION SUIT AND ANTI-EXPOSURE SUITS NECESSITY OF PERIODIC TESTING

    The requirement of 100% PSC/ Flag State implementation inspection of all vessels loading cargo of iron ore fines/ concentrates and similar cargo has been dispensed with vide NT/ENG Circular No. 2 of 2017 dated 01.06.2017. However, PSC/ FSI may be conducted as part of regular PSC/FSI regime implemented by D.G. Shipping.

    Further, the requirement of obtaining clearance/approval from concerned Mercantile Marine Department prior to loading/sailing out after loading category A cargoes as per MS Notice 9 of 2010 has also been dispensed with.

    The DGS has clarified vide MS Notice No. 4 of 2017 dated 02.06.2017 that with respect to the trainees and cadets employed/ working on the vessels, the provisions of Maritime Labour Convention, 2006 as enshrined in the Merchant Shipping (Maritime Labour) Rules, 2016 shall be applicable as for other seafarers. In this regard, representations were received from Indian ship-owners requesting for exemption of the provisions of Maritime Labour Convention 2006.

    The Directorate General of Shipping, Govt. of India had held extensive discussions with the stakeholders on the subject matter and also referred to the provisions in related Acts of Maritime Nations. However, the same was not found viable.

    The Directorate General of Shipping organised a workshop on International Oil Pollution Compensation [IOPC] Regime at Vivanta by Taj Panaji, Goa on 08th & 09th June 2017, under the guidance of Dr Malini V. Shankar, IAS, Director General of Shipping & Special Secretary to the Govt. of India.

    An oil spill can cause financial losses as it may cause damage to property and economic losses, mainly affecting local fishing & tourism industry. Despite best efforts, clean-up can be challenging and costly. Those that are victims as a result of an oil spill may be eligible for compensation. However, payment of compensation for damage caused by a ship-source oil spill is dependent upon the applicable legal regime. The workshop provided an opportunity for the participants to get an overview of the international oil pollution compensation regime and how it operates for the benefit of potential victims including the claim process.

    This workshop was organised in association with the IOPC Funds, the International Group of P&I Associations and the International Tanker Owners Pollution Federation (ITOPF).

    A half day session was specially arranged on 08th June for the officers from the Ministry of Shipping, Directorate General of Shipping and the Mercantile Marine Departments. This offered a forum for active interaction with delegates from the IOPC Funds, the International Group of P&I Associations and the International Tanker Owners Pollution Federation (ITOPF).

    The full day workshop on 09th June was attended by over 160 participants from a wide spectrum of stakeholders including officials from Major Ports, Non-Major Ports, State Maritime Boards, Department of Fisheries, State Pollution Control Boards, private and public Oil Companies and Insurance Companies. The workshop was highly appreciated for its informative value.

    The Directorate General of Shipping has organized a Training program for new recruits in non technical (Administrative) matters in two batches ; (i) from 12th to 24th June, 2017 and (ii) from 27th June to 09th July, 2017 at Yashwant Rao Chavan Academy of Development Administration (YASHDA) at Pune. The aim of the training is to enhance professional skills, quality performance & satisfaction towards the job and also for organizational development and success in its vision.

    The Merchant Shipping Bill, 2016 which was introduced in Lok Sabha on 16.12.16, is under examination and consideration of the Department Related Parliamentary Standing Committee on Transport, Tourism and Culture. The Committee under the chairmanship of Shri Mukul Roy, Honble Member of Parliament has heard the views of Secretary (Shipping), GoI, and DGS, GoI, on 12.05.17. Various questions asked and observations made by the Committee have also been responded by the DGS.

    Further, the Committee has held three more meetings at Ahmadabad, Mumbai and Cochin in the month of June17, for hearing the views of stakeholders and the Ministry of Shipping, GoI, on the said Bill.

    The Committee will submit its report to the Parliament in due course.

    The Director General of Shipping has reviewed its Flag State Inspection (FSI) regime after nearly 4 years vide Merchant Shipping Notice No.4 of 2017 dated 18.06.2017.

    The background of the review is due to the fact that the statistics of FSI and Port State Inspection for the Calendar year 2015 & 2016 revealed a high number of detentions of ships less than 25 years of age and particularly less than 15 years of age. These findings have raised concern about safety and environmental performance of Indian flag vessels less than 25 years of age. Some of the features of the Notice:

    applicable to all vessels including River Sea vessels and Indian Coastal vessels, from the date of issue of this notice;

    Every calendar year, after 3 months of Passenger Ship Safety Certificate survey, but before 3 months of the date of expiry of the same.

    3 Cargo Ship (5-15 years of age)

    Unscheduled Flag State Inspections: The present regime of carrying out

    FSI by surprise inspection and reporting thereto shall continue as it is. Flag State Computerized Information System (FSCIS):

    a) The DGS is maintaining web-based centralized computer information system for all the ships under the Indian registry for the benefit of stakeholders;

    b) Shipping Companies, Recognised Organisations (ROs) and MMDs are required to upload all the inspection reports under the General examination and FSI, to this data base within 2 working days;

    c) It is the responsibility of the company to ensure that general examination initial and rectification reports are uploaded by the concerned ROs on the FSCIS within the stipulated period.

    Verification and monitoring: a) The compliance of this notice shall be verified during the annual DOC

    audit of the company; b) Non-Conformity to be completed within a period of one month; c) Procedure for application for FSI and SOP are available on DGS

    website.

    The National Maritime Day Celebrations (Central)) organized the Day of the Seafarer on 25th June, 2017 at Mumbai. A Heartfulness Masterclass meditation program was organized under the guidance of Shri Sanjay Bhatia, IAS, Chairman, Mumbai Port Trust at K.R. Cama Institute Building, Bombay Samachar Marg, Fort, Mumbai.

    The main function Award to seafarers & Cultural program was organized at Maritime Training Institute, Powai, Mumbai.

    Shri Amitabh Kumar, IRS, Addl. Director General of Shipping graced the occasion as Chief Guest. The day was established in a resolution adopted by the 2010 Conference in Manila on STCW Convention.

    The purpose is to recognize the unique contribution made by seafarers from all over the world to international seaborne trade, the world economy and civil society as a whole. The theme of the seafarers day was seafarer matters.

    Under the able guidance of Dr. Malini V. Shankar, IAS, Director General of Shipping, an Indian Shipping Expo was also organized on the occasion of the Day of the seafarer at Mantralaya, on 27th & 28th June, 2017. The Expo was inaugurated by Shri Sumeet Mallick, IAS, Chief Secretary, Govt. of Maharashtra.

    A NEW ERA IN INDIRECT TAXATION STRUCTURE AWARENESS PROGRAM BY DGS

    The Goods & Services Tax (GST) is the largest-ever tax reform in the fiscal history of India. It charts a new course for fiscal consolidation in India. GST is launching from 1 July 2017.

    To begin with, the DGS organized a lecture program on awareness of Goods and Services Tax (India), focusing on application of GST to the Shipping Sector on 27th June, 2017 in the conference hall of the DGS, Mumbai. The lecture was delivered by Shri Kamlesh Dave, CA, assisted by Shri R. S. Aiyar, CA. The program was attended by the officers of the DGS, representatives from the INSA, MASSA, FOSMA and other stakeholders from shipping industry. The lecture, inter-alia, included basic structure, salient features & important definition under CGST, SGST, IGST, taxable event, impact of industry, followed with questions and answers.

    Government of India is celebrating the Birth Centenary of Pandit Deendayal Upadhyay. Honble Minister of Shipping has desired that the following logo of Pandit Deendayal Upadhyay may be used in all advertisement of the Ministry and organizations during the centenary.

    I am very satisfied with the way assessment was done at Mumbai MMD for Class 2 examination. The officials involved gave very clear instructions and helped out candidates facing any issue for the assessment for Class 2 exams. I was surprised with the large number of people who came for the assessment and the officials worked so hard in finishing up all the paper work in just one day for everybody. The whole team worked efficiently. Online booking has made paying fees for examination very easy. As far as the examinations are concerned, the DG shipping building is very impressive and with very good infrastructure. Before giving my orals the waiting area I is comfortable with good amenities like Clean Toilets, Cold drinking water and Air Conditioned waiting area. And while giving my orals I was very comfortable. Overall I would say I am extremely happy with so much progress from 2012-2013 when I was giving my Class 4 exams. Things have changed drastically.     MERCANTILE MARINE DEPARTMENT (MMD), CHENNAI

    Under the Port State Control/Flag State Implementation, 10 inspections were carried out. Similarly, 17 vessels were surveyed during the quarter. Number of inspections carried out for approval to Training Institutes, during the quarter was 03. Number of candidates appeared for Engineering exams were 626 whereas for Nautical exams, 263 candidates appeared. Number of certificates issued during the quarter was 1447 which includes re-validation of CoC, CoC & DCE etc. The details of activities were as under :

    As part of 54th National Maritime Day Celebration, various programs such as press conferences, seminar, march past, felicitation of senior mariners, etc were held from 03.04.2017 to 05.04.2017 respectively;

    In connection with Swatch Bharat Abhiyan, all officers and staff of MMD, Chennai and SWO/SEO/SO, Chennai undertook the cleaning work of office premises on 03.04.17 and also attended the office on 08.04.17 (Saturday) to carryout various activities of cleaning of entire office premises such as corridors, stairs, work place, outside area of Anchor Gate Building including the parking area pathways, disposal of unused articles, furniture, equipment etc.

    Video conferencing on matters relating to PSC/FSI inspection was held on 19.04.17 by D.G. Shipping, Mumbai with MMD, Chennai Officers.

    The Workshop on the International Oil Pollution Compensation & Liability Regime held on 8th-9th June, 2017at Vivanta by Taj Panaji, Goa was attended by Shri S Barik, Principal Officer, MMD, Chennai and Capt Tapesh Ghosh, NS, MMD, Chennai.

    International Yoga day was observed on 21.06.17 in MMD, Chennai. Awareness program was also organized on the importance of yoga.

    Hindi workshop was conducted on 22.06.17. All officers/staff were

    encouraged to use Hindi as official language Hindi in their day-to-day official work.
