In the atter of Order No. 33/2019-20 ·dated 24.03.2020 regard ing Econo ic Regu ation of Aeronautical Se..", ices provided by the independent Service providers of Cargo facility, Grouna Handling and Supp y of Fue l to the airc raft -Interi arrangement to conti ue the levy of existing tariffs for the Firs t Contro Period.

This is regarding interim arrangement of levy of tariff for the period mentioned below for the First Control Periodiri 'respeOt of Independent Service Provider(s) mentioned in the table below:

2, The Authority noted that the Airport Operator viz, Airports Authority o f India (AAI) has issued notice of termination of the license for ground handling services to Mis Bhadra International (I) Private Limited for Mangalore and Trichy Airpo rt and to Mis Indo Thai Airport Management Services Private Limited for Amritsar a nd Varanasi Airports and AAI has also initiated tender action to appoint new ground handling agencies in terms of new Ground Handling Regulations. The Authority also noted that AAI has granted extension of notice period to Mis Bhadra up to 25 .10.2020 for Mangalore and Trichy airports and to MJs :ltlPO Thai up to 31,12 .2020 as their tender action is under process and ne~ "i:!.g~i:\c.ie.?: 'wur )be appointed after finalization of the tender action ,

The Authority further noted 'that t h~ AAI has given extension of time as a temporary arrangement till new ag~neies' q,[e"'clRPointed as per new Ground Handling Regulations, Hence the Authority is ',of t ri~ view"that the existing tariff(s) as proposed by Mis Bhadra and Mis Indo Thai for provtdir:lg 9lq~,.Jnd handling services at above airports, may be allowed to continue till the cj ~te Qf'extension as given by AAI as an interim arrangement to avoid any regula tory -vacuum' or till determination of ta riffs by the Authority whichever is earlier. The order will be effective from the date of issue of order and the prior period will stand regularized .

ORDER

In view of the above , to avoid any regulatory vacuum in respect of the tariffs being levied by the regulated entities, the Authority, in 'exercise of powers conferred by Section 13(1) of the Airport Economic Regulatory Authority of India Act, 2008 hereby orders that:­

(i) Mis Bhadra International (I) Private Lirrilteo is allowed to continue the levy of the existing tar lffs :up to 25.10.'2:020 61' till d$t~hliination of tariffs by the Authority"whichever is earlier' for providing,grbutld , handling services at Mangalore and Trichy Airports as per Annexu re A.

(ii) Mis Indo Thai Airport MaQagelJlent' Services Private Limited is allowed to continue the levy,of the existing tariffs,Up to 31.12.2020 or till determination of tariffs by the Authority which'ev'er is earlier for providing gro und handling services at Amritsar and Varanasi Airports as per Annexure B.

(iii) The ta riff as mentioned above will be maximum tariff to be charged.

(iv) Mis Bhadra International (I) Private Limited and Mis Indo Thai Airport Management Se rvices Private Limited should not exceed the tar iffs for its Non-Scheduled Operations as approved by AERA for its Scheduled Operat ions for similar category of aircrafts.

(v) The order will be effective from the date of issue of this order an d the existing tariff with effect from these airports become Major Airport will also stand regularized .

(vi) The Airport Operators may ensure compliance of the Order .
