e. Allegation 5 :

Le cpl DUPONT a declare avoir ete temoin que des membres des FC ontlance des pierres pr~s d'adolescents afghans lors de certainsdeplacements ~ vehicule.

II est A noter, que lors des 44 entrevues preliminaires, quelquesmembres des FC ont rapportes avoir ete temoin de sevices a l'egardd'insurges et de la population locale de la part des membres de l'armeenationale afghane (ANA) ou de la police nationale afghane (PNA). Cesagissements ne sont pas du ressort de la police militaire mais bien duressort de la justice locale. Parce que 1 'ANA et la PNA n'etaient pasIe commandement et Ie contrOle des FC, elles n'etaient as assu'ettiescode de discipline militaire

6. Concernant l'allegation I, cette derniere est presentement sous enqu~tep~r Ie SNEFC RE, dossier d'evenement general (:EG) 2008-28019.7. L'allegation 2 comporte deux evenements distincts. Lors d'une~:fr~~~l~~ed~~~~~sl~o~;tunemenace ! !'e~~~oi~sd~~~s~~~~~~: ~:sf:~i~~Squia resulte au deces des trois afghans et de la captur~ deJ autres. Cetincident a ete enqu~te par Ie SNEFC FOI, ROTO 4, sous l' G 2007-26284.Cette enquete est terminee sans mise en accusation. Cependant, lesallegations que Ie cplcBUREAU aurait malmene lea detenus et aurait eteirrespectueux envers les depouilles afghanes font l'objet d'une enquete parIe SNEFC RE sous l'EG 2008-28019.

8. Concernant I 'allegation 3, Ie cpl MARCHAL reconnait que les conditionsde detention etaient acceptable quoi que peu confortable. Suite ~ uneverification de'l'EG 2007-26284, les detenus'en question ont eteinterviewes par Ie SNE~C FOI, ROTC 4, durant la journee du _ 2007 etHs ont declare avoir ete bien traites.

9. Pour ce qui est de l'allegation 4, cet evenement a deja fait l'objetd'une enquete par Ie SNFC FOI, ROTO 4, soua l'EG 2008-223, laquelle estterminee sana mise en accusation.

10. Finalement, l'allegation 5 a fait l'objet de la presente enquete. Le5 fey 2009, lors d'une entrevue, Ie cpl DUPONT a avoue avoir fait cesgestes. II a ajoute que ces gestes avaient pour but d'eloigner les jeunesafghans qui ne respectaient pas la zone de securite prescrite par leamembres de la force de securite des convois. A plusieurs reprises, desmembres des FC ont recus des projectiles de toute sorte (pierres, ciseauxet d'autres objets) dans l'exercice de leurs fonctions. Les membres des FCont quelques fois repliques aux attaques en effectuant la motion de lancerlea pierres recues en direction de leurs assaillants afin de les eloignersans toutefois les atteindre ou les blesaer.

11. Lors de son entrevue Ie 10 fev 2009, Ie capt NAULT, cmdt de la troupe,a indique que p1usieurs membres de l'escadron ont recu des projectiles detoutes sortes incluant des grenades. Afin de faire peur a leuraaasaillants, les membres de la troupe ramassaient des roches, faisaient

The VQswere administered during the DAG process for outgoing members, conducted atthe New Canada House Theatre, Kandahar Air Field (KAF). WO ROSS wasaccompanied by MCpl JUTEAU, MP Coy Roto 4 on 02 Mar 08 and then on 04, 05,07 and 08 Mar 08 was accompanied by Capt LAPRADE, MP Coy Roto 4 for thepurpose of French translation.

2. All VQs collected by WO ROSS were cross-referenced with the nominalroll for the Battle Group. The following details the number of VQscollected per day:

b. 04 Mar 08 - 96;

c. 05 Mar 08 - 51;

d. 07 Mar 08 - 56; and
