Submission of the Ld. Counsel for the Applicant is that,

retirement age of officers Col (Selection Grade) in AMC,

including Medical Officers, Nursing Officers and Army Dental

Corps Officers is 58 years where retirement age of officers of

Col (selection Grade) (non technical) is 57 years whereas they

are paid same grade pay according to their rank and they wear

the same uniform. It is clear violation of Article 14 and 16 of the

Constitution of India.

Statement has been made by the Respondents that keeping

in view the case of Union of India vs Atul Shukla and others,

reported in SCC (2014) 10 Supreme Court Cases 432, service

tenure of technical & non technical is likely to be revised.

Ld. Counsel for the Respondents has submitted that as per

Govt of India, Ministry of Defence, letter dated 10.11.2006,

retirement age for Colonel (Selection Grade) non technical has

been fixed 57 years. Respondents had enhanced the age of

retirement of Colonel (Selection Grade) non technical from 56

years to 57 years. Now again in view of the Apex Court

judgment (Supra) respondents are processiing to revise the

age. Hence it shall be appropriate that the applicant may also

represent his case before the respondents so that while taking

decision in the light of Atul Shukla’s (Supra) case, the

applicant’s representation may also be considered while

reaching any conclusion with regard to superannuation.

Accordingly we permit the applicant to represent his cause to

the respondents within a month who shall take it into account

while taking decision in the light of Apex Court judgement.

With aforesaid directions we dispose of the petition with the

consent of the parties with liberty to file a fresh case, if he so

desires.

paid. This Tribunal has passed following orders :-

“In view of what has been discussed above,

the T.A. is allowed. The impugned order dated

07.06.2006 (Annexure A-1) to the writ petition) is

hereby quashed. We direct the respondents to

extend all consequential benefits to the

petitioner, including salary and arrears of salary,

if any, and also grant notional promotions, if he is

eligible and entitled to, which would have been

granted to him had he been in service till his

actual date of superannuation. Entire exercise

be undertaken within a period of four months

from the date certified copy of the judgment is

made available to the learned counsel for the

respondent”.

Plain reading of the operative portion of the order

shows that respondents were directed to grant

consequential benefits including salary and arrears of

salary. Ld. Counsel for the Respondents submits that

since the petitioner has not physically performed the

duty hence he has not been paid allowances. The

order passed by the Tribunal clearly indicates that

petitioner will be granted all consequential benefits.
