5-year-old girl dies in gurdwara roofcollapse in DelhiNEW DELHI

A five-year-old girl died while four members of herfamily were severely injured when the roof of a gurdwaracollapsed in east Delhi's Geeta Colony area, police saidon Wednesday.The victims worked at the gurdwara andlived on its premises, police said, adding that the incidentwas reported in the early hours today.Three fire tenderswere rushed to the spot and a joint rescue operation wasconducted by Delhi Disaster Management Authority,Delhi Fire Services and Delhi Police after authoritieswere notified at around 2.30 am, said a senior police offi-cial.The five victims were rushed to LNJP Hospital,where the five-year-old girl, identified as Kuljeet Kaur,was declared brought dead.Her family members, whosustained severe injuries, have been identified asRajendar Singh (35), Rajender Kaur (30), Harmant PreetKaur (9) and Sagar (20), said the senior official."A casehas been registered under Section 304A (causing deathby negligence) of IPC and an investigation is under way,"the official added.

report that a Nepal-likeearthquake could wipe out90 percent of the popula-tion here, the Delhi HighCourt on Wednesdayrapped the Centre, the citygovernment and municipalbodies, saying they werewaiting for disasters tohappen as only 10-15 per-cent buildings in the capi-tal complied with thebuilding bye-laws. "Analarming situation wasrevealed through an affi-davit that 25 percent of thebuildings in the MCDareas fall underplanned/approved areaand 75 percent area isunplanned and unautho-rised..."

"Out of this 25 percent,people later carry outmore construction whichis not permissible underlaw. It means only 10 to 15percent comply with thebuilding bye-laws," abench of justices BadarDurrez Ahmed and

Sanjeev Sachdeva said.It further said "this is an

alarming situation and theconcerned authorities(Centre, Delhi govern-ment and municipal bod-ies) are waiting for disas-ters to happen".

It observed that "since75 percent of structureshave come up without fol-lowing the regulations, ifan earthquake like the onein Nepal occurs here, thecasualties would not be inthousands but 90 percentof Delhi's population will

be wiped out."The court made the

observation after it wastold by a civic body thatabout 75 percent of thebuildings in Delhi havecome up without comply-ing with regulations,including those relating tostructural stability.

It also observed thatnine out of the ten houseswill collapse if a majorearthquake hit the nationalcapital. Noticing that dur-ing the hearing no oneappeared on behalf of the

Delhi government and theCentre too was mum overthe steps taken to makecity safe from natural haz-ards like earthquakes, thecourt directed them to filestatus reports on the policywith regard to the structur-al integrity of buildings,keeping in mind that Delhifell in Seismic Zone IV.

Seismic Zone IV is ahigh damage risk zonewhich can expect the sec-ond highest level of earth-quakes. It said beforeSeptember 23, the con-

cerned authorities in theirstatus reports shall indi-cate the action taken bythem in ensuring that thestructural integrity of thebuildings in Delhi are incompliance with theNational Building Code2005 prescribed forSeismic Zone IV. Thebench further said that theauthorities have time toovercome such a situationbut do not want to do any-thing.

The court was disap-pointed with the affidavitfiled by the North DelhiMunicipal Corporation(NDMC), which hadrevealed such "alarming"data with regard to Delhi.

NDMC in its affidavitsaid that Delhi can be clas-sified into planned areahaving approved coloniesand unplanned area havingunauthorised, regularisedcolonies, villages, unau-thorised colonies, resettle-ment colonies, specialareas and agriculturalland.

It said the municipalbody was planning tolaunch a public awarenessprogramme wherein, peo-ple living in the buildingof about 30 or more yearsold will be asked to obtainstructural fitness certifi-cate for their buildings.

The court was hearing aPIL questioning how safewere the structures in thenational capital if anearthquake, like that inNepal, hits Delhi.

The PIL, filed by advo-cate Arpit Bhargava, alsoasked what action plansdid the corporations haveto tackle the threat.

Bhargava, in his peti-tion, also cited instancesof houses tilting and wallsdeveloping cracks whichwere reported fromTrilokpuri in east Delhiafter the recent earthquakein Nepal.

The petition has alsosought to know whataction plan does the cor-porations have to tacklethe issue.

absconding accused whohad submitted a forgedletter of the then JointSecretary in the PrimeMinister's Office allegedlyin a bid to secure admis-sion into an engineeringcourse at a Lucknow col-lege.

Farhan Akhtar, a resi-dent of Mau district ofUttar Pradesh, hadallegedly submitted theforged letter of the thenJoint Secretary in thePMO, Sanjay Mitra, datedJuly 31, 2010, to the vicechancellor of Lucknow'sIntegral University recom-mending that he be givenadmission in an engineer-ing course.Vice

Chancellor SW Akhtarsuspected the genuinenessof the letter and referredthe matter to the PMO,which informed him thatthe letter was forged.

Officer on Special Dutyin the PMO, KL Dhingra,had filed a complaint withCBI in this regard inApril, 2011, followingwhich the agency regis-tered a case of cheating onOctober 7, 2011.

"After investigation, acharge sheet was filed onJune 28, 2013, againstsaid accused (undercharges of cheating andforgery among others)...In the Court of SpecialJudicial Magistrate, CBICases, Lucknow. A sup-plementary chargesheet...

was filed on March 7,2014, against said accusedand another accused in thecourt," stated a CBIspokesperson.

She said that in theevent of non-appearance,the court had issued a non-bailable warrant againsthim."

After sustained efforts,the accused was tracedand arrested inHyderabad. The arrestedaccused was producedbefore the Special JudicialMagistrate, CBI Cases,Lucknow and remanded tojudicial custody," sheadded.Akhtar was earlierarrested in the case onNovember 21, 2012, andreleased on bail after threedays.

These acts include the Coal BearingAreas Acquisition and Development Act1957, the National Highways Act 1956,Land Acquisition (Mines) Act 1885,Atomic Energy Act 1962, the IndianTramways Act 1886, the Railways Act1989, the Ancient Monuments andArchaeological Sites and Remains Act1958, the Petroleum and Minerals Pipelines(Acquisition of Right of User in Land) Act1962 and the Damodar Valley CorporationAct 1948.

The other ones include The ElectricityAct 2003, Requisitioning and Acquisitionof Immovable Property Act 1952, theResettlement of Displaced Persons (LandAcquisition) Act 1948 and the MetroRailways (Construction of Works) Act1978.

The Land Acquisition Act, 2013 hadexempted 13 acts from its purview with thecondition that they would be includedunder the purview of the act within oneyear. The NDA's ordinance brought these13 acts under the new land law.

If the ordinance lapses on 31 August, pro-visions of the new land law will no longerbe applicable to land acquisition beingdone under these 13 laws and hence theModi government has been claiming thatthe ordinance was re-promulgated thrice tomaintain continuity.

A Burnt Body ...Mukerjea, the wife of former Star TV CEO

Sheena Bora, who was Indrani's daughterfrom an earlier marriage, was allegedly last

seen a car with all three in 2012. Until yester-day, everyone thought she had gone to theUS.

Mumbai police commissioner RakeshMaria said Sheena was murdered in the caron 24 April, 2012. The car, with the body, wasallegedly parked overnight in PeterMukerjea's garage.

The next day, the body was taken in thesame car to Raigad, where Sheena's burntbody was found on 23 May. At the time, thepolice dismissed the body as unclaimed but,sources claim, preserved the DNA.

The police suspect Indrani was upset aboutSheena's relationship with her step-brotherRahul, Peter Mukerjea's son from a previousmarriage. But they have not ruled out a finan-cial dispute.

On an informer's tip-off, the police hadbeen quietly investigating Indrani for fourmonths but hit pay dirt only after arrestingher driver in an arms case.

"During his interrogation, he confessed tomurder. He took us to the spot where the bodywas dumped," said Mr Maria, who interrogat-ed Indrani Mukerjea.

Until Indrani Mukerjea's arrest last night,most of their friends and relatives thoughtSheena was her sister - even Peter Mukerjea,who said that he was "dumbstruck" by thecrime and shocked to learn that Sheena washis wife's daughter, not sister as she hadclaimed to the world.

While Mr Sinha was initially appointed witha three-year term, he was later given a two-year extension. As per his age, Mr Sinha is eli-gible for a one-year extension.

It could not be ascertained whether Mr Sinhawas offered an extension or not.

In addition to the post of Chairman, the gov-ernment is empowered to appoint five mem-bers on the board of this key regulatory body,which regulates stock exchanges, variouskinds of market entities including brokers,mutual funds, FIIs, rating agencies and invest-ment bankers, as also thousands of listed com-panies.

He said Samrat Bicycles defaulted andwent into liquidation and the land alongwith physical assets of the company wasauctioned by the Delhi High Court at theinstance of the Industrial FinanceCorporation of India Ltd. (IFCI).

"The Rajiv Gandhi Charitable Trust(RGCT) participated in the auction and wasdeclared a successful bidder on March 10,2011 by the Delhi High court," MrSurjewala said.

He said the RGCT took possession of theland and assets in August 2011 but the highcourt proceeded to approve the transferdeed in favour of the RGCT only in 2015.

Subsequently, the land was registered inthe name of the RGCT at the office of thesub registrar in Gauriganj in Amethi districtin February 2015.

He said that since the legal transfer tookplace only in February, the property was ina state of disuse and the RGCT will under-take activity in due course of time.

"The RGCT is only entitled to retain theproperty for the remaining period of 55years and has effectively stepped into theshoes of the company in terms of the auc-tion conducted by the Delhi High Court,"he said.

Mr Surjewala said that in the khatoni(record of cultivation in the revenuerecords) 49.5 acres out of the 65.57 acreswas entered in favour of Samrat Bicycles asthe owner prior to 1985 "instead of a lesseeof UPSIDC for 90 years".

He said the Gauriganj sub-divisional

magistrate in his order of August 26, 2015ordered correction of revenue record infavour of UPSIDC, upheld the right oflease of 90 years in favour of IFCI and alsoexecution of lease deed in favour of theRGCT.

"Correction of revenue record by SDMupholds the right of the RGCT as a lesseeof the land for remaining period of the 90years lease," the statement said.

Mr Surjewala said the RGCT shall put theland to use only in accordance with the UPState Industrial Development Authority Act(UPSIDA) and with necessary approvalfrom UPSIDC.

He listed a large number of welfare activ-ities done by the RGCT in Uttar Pradeshincluding women's development pro-grammes covering over 14.5 lakh ruralwomen across 42 districts.
