Keynote speakersJustice Jose Antonio Dias Toffoli President, Supreme Federal Court of Brazil, BrasiliaJustice Jose Antonio Dias Toffoli is the current President of Brazil’s Supreme Federal Court. He was first named to the Supreme Court in 2009, becoming one of the youngest justices to ever sit on the country’s highest court. Justice Dias Toffoli previously served as Federal Solicitor General, and also headed Brazil’s Superior Electoral Tribunal from 2014–2016.

Justice Paulo Tarso de Vieira Sanseverino Justice, Brazil’s Superior Court of Justice, Porto AlegreJustice Paulo de Tarso Vieira Sanseverino was appointed to Brazil’s Superior Court of Justice in 2010. He served as a judge and later as a justice of the Supreme Court of the State of Rio Grande do Sul from 1986–2010, after four years as a public prosecutor. Justice Sanseverino holds a Master´s Degree in Law and a Doctor´s Degree in Law from the Federal University of Rio Grande do Sul.

The Judiciary and insolvency: judicial activism and litigation fundingIn general, insolvency proceedings are commenced and supervised by the court. The court can assign various tasks to insolvency practitioners, including, among others, administration and management of the company under the insolvency proceedings, restructuring or realisation by way of transfer of undertakings, and conducting of court proceedings against third parties. The judge and the practitioners appointed by the court have in common that they are independent and apply the law in the best interest of the estate or the creditors of the insolvent company. What are the limits of their freedom and independence? To what extent flexibility in the application of the law can be allowed? The panel will discuss such limitation and flexibility through the examples of

judicial activism and litigation funding.

Conference sell-outsThe IBA places its conference in venues of a suitable size for the event; however there are times when our conferences may sell out. Should this happen, prospective delegates will be informed and a waitlist will operate. The waitlist will function on a ‘first come, first served’ basis, subject to receiving registered delegate cancellations. The IBA will not be liable for any travel or accommodation expenses incurred by an individual who travels to the conference without a confirmed place at the event.

Cancellation of registrationIf cancellation is received in writing at the IBA office by 10 April, fees will be refunded less a 25 per cent administration charge. Refunds will be made minus any monies owed to the IBA. We regret that no refunds can be made after this date. Registrations received after 10 April will not be eligible for any refund of registration fees.

Provided you have cancelled your registration to attend an IBA conference in accordance with the terms of the ‘cancellation of registration’ clause included in the ‘Information’ section of the relevant conference programme, you must then confirm to us in writing at the IBA office as soon as possible but in no event later than one year (12 calendar months) from the date of any such conference all necessary details to enable any reimbursement owed to you to be paid. We regret that no refunds will be made after the date that is one year (12 calendar months) after the date of the relevant conference.

Insolvency Section overviewThe Insolvency Section of the IBA is the most prominent international association of lawyers interested in restructuring, insolvency

and creditors’ rights law, as well as related company law, transactional and litigation practices.

Its principal goals are to:

• provide a forum, at conferences twice a year (the IBA’s annual conference and the Insolvency Section’s own conference, usually

in May), for substantive educational sessions presented by genuine experts on the most cutting-edge issues in restructuring,

insolvency and creditors’ rights;

• create a lively network of lawyers (private practitioners, corporate counsel, judges, academics and law reform opinion leaders)

from common and civil law systems in developed, emerging and formerly centrally controlled economies; and

• contribute to the reform and harmonisation of insolvency (and related) laws through permanent expert delegations to

organisations such as the United Nations Commission on International Trade Law (UNCITRAL), the World Bank and the

International Monetary Fund.

Latin American Regional Forum overviewThe Latin American Regional Forum covers all countries in Latin America as well as Mexico, Puerto Rico and Spanish-speaking areas

of the Caribbean. The LARF provides a focus for all activities in the region. The group organises sessions at IBA Conferences and

in particular has been instrumental in ensuring that a Latin American perspective is addressed during relevant special sessions. The

LARF is closely affiliated with the North American Forum as the regions are geographically proximate and share many issues.
