City Manager Position Announcement Review by Kurt Bressner, FCCMA/ICMA Senior Advisor

The Mayor and City Council seek to recruit a new City Manager due to the recent resignation of the City Manager, who has served since 2005. The current City Manager is re-locating to a larger city. The new City Manager must have the skills and experience to guide Fellsmere with an appropriate combination of community orientation, leadership, and operational skills.

Fellsmere is a politically stable and diverse community with a population of 5,517 (2018 BEBR), comprising 55 square miles located in Indian River County, Florida, approximately an hour and a half from West Palm Beach and Orlanro. Fellsmere is a small-town community with a residential/agricultural atmosphere and opportunities for tremendous growth. While protecting the character of the core city, the City has also consciously positioned itself through annexation and economic development incentives with a progressive regulatory framework for-long-term sustainable growth.

Fellsmere operates under the Council/Manager form of government by Charter. The City Council is vested with policy-making and legislative authority. The City Council consists of the Mayor and four Council members, elected on a non-partisan basis with staggered 2-year terms. City Council members are not subject to term limits. The City Manager serves at the pleasure of the Council as the Chief Administrative Officer. The City Manager has oversight of the Police, Public Works/Utilities, Finance, and Community Development/Building Services departments. Fire/Rescue and Library services are provided by Indian River County. Including Council members, the City employs 33 staff, making teamwork a key work ethic. The FY 2019-20 General Fund Budget is $3,021,529 with a combined Funds budget of$11,570,569.

The ideal candidate will be a manager or assistant manager with at least 5 years of municipal management experience and a minimum of a bachelor's degree in public management or related field. A master's degree in Public Administration or a related field and Florida local government management experience are preferred. A demonstrated record of economic development, intergovernmental funding and grant solicitation/administration skills are highly desired. Because Fellsmere is a small community, the City Manager is expected to be a strong, hands-on, ethical, team-oriented leader with effective communication skills, a strong commitment to a diverse citizenry, and analytical problem-solving skills. ICMA membership is strongly preferred.

The City Council will provide a competitive salary and benefits. Starting salary will be $100.000 to$ __ , depending on qualifications. The City Manager is required to relocate to/live in Iridian River County. Mayor Tyson called the City Council Meeting to order at 7:00 p.m. and asked the Clerk to call the roll.

2. ROLL CALL: PRESENT: Council Member Fernando R. Herrera, Council Member Inocensia Hernandez, Council Member Sara J. Savage, Council Member Jessica Salgado, City Manager Jason Nunemaker, Attorney Warren W. Dill and Mayor Joel Tyson. ABSENT: None.

3. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge was recited.

4. INVOCATION Mayor Tyson gave the Invocation.

5. PRESENTATIONS:

a. FCCMA Senior Advisor Kurt Bressner - City Manager Search Process Overview

Mayor Tyson introduced Kurt Bressner, ICMA Senior Advisor who explained he's a retired City Manager and understands the importance of the responsibilities of the position. Finding a replacement for Jason is going to be a tough road, he's a unique person and a hard act to follow. Jason and you, Council, have unified goals and expectations. A determination of a starting salary needs to be made for the employment advertisement. I will be requesting Council's assistance in completing a Candidate profile. Utilizing the FCCMA there is no charge for the service and search firms charge between $22,000 and $24,000. Your only out of pocket cost will be the advertisements. And of course the background check which can be provided by your Police Department. He's able to assist in negotiating contracts if Council desires. Staff will also be required by law to redact certain information from the applicants prior to distribution of the candidates.

Council Member Savage interjected we should work with Mr. Bressner to find candidates for the interviews. She further recommended Council establish the starting salary and provide assistance with the candidate's profile.

b. Audited Financials by Carr, Riggs and Ingram for the 2017-2018 Audit.

Mayor Tyson introduced the audit and a member of the firm added that there is a clean unmodified opinion for the major three (3) funds. She referred to

• Pages 38-39 Priority Funds, Water, Wastewater and CDD which again shows a loss and it's not self-sustainable.

• Page 76 Internal Controls, two (2) are cleared and two (2) reappear as unimproved.

6. PROCLAMATIONS: National Travel & Tourism Week- May 5- 11, 2019. Mayor Tyson introduced the Proclamation and Attorney Dill read it in its entirety.

Amber Batchelor, Director of the SRACC thanked Council for the Proclamation and reminded them they are invited out to a function to celebrate Travel & Tourism.

National Police Week May 12-18, 2019

Mayor Tyson introduced the Proclamation and Attorney Dill read it in its entirety. Mayor Tyson asked Chief to come to the center to accept it and speak.

Chief Thanked Council and invited him in joining the Sherriff at the Court House honoring the fallen Officers.

Mayor Tyson read a Proclamation honoring Jason Nunemaker, City Manager adding we will all certainly miss you and thank you for all your efforts and hard work.

Jason thanked Council and Staff for all the support and trust over the years.

(b) R-2019-06/The City of Fellsmere is applying to the Florida Department of Economic Opportunity (DEO) for a grant under the Neighborhood Revitalization Category in the amount of $700,000 in the FFY2018 Small Cities Community Development Block Grant (CDBG) Program. For each activity that is proposed, at least 51% of the funds must benefit low and moderate-income persons. The activities, dollar amounts and estimated percentages benefit to low and moderate-income persons for which the City is applying/2nd and Final Public Hearing.

Mayor Tyson introduced the Ordinance and Attorney Dill read Resolution 2019-06, by title only.

City Manager Nunemaker interjected this is just the right size the City is paying $150,000.00 for Engineering Services and staff is excited about the project.

Mrs. Kathy Baker, Jordan Associates explained this is the last part of the application process for the 2018 funding cycle and the applications are due Monday. There are two (2) primary service areas on 10Qth Place and lQQth Lane, the grant will provide flooding drainage and paving. The grant further provides for a skate park at the Senior League Facility which will benefit the entire City. There is a third area of the project at the Park for flood mitigation and drainage. The area of 10Qth Lane and 10Qth Place will provide benefit to 51% of the community. They are completing the door to door surveys tomorrow.

Mayor Tyson opened the Public Hearing at 8:12 p.m. adding anyone may address the Council or asked questions he requested that those wishing to speak to please come to the podium and state there name and address for the record. Hearing none he closed the Public Hearing at 8:14 p.m.

Mayor Tyson entertained a Motion to adopt the Resolution.

MOTION by Council Member Herrera, SECONDED by Council Member Hernandez, to adopt Resolution 2019-06/ The City of Fellsmere is applying to the Florida Department of Economic Opportunity (DEO) for a grant under the Neighborhood Revitalization Category in the amount of $700,000 in the FFY2018 Small Cities Community Development Block Grant (CDBG) Program. For each activity that is proposed, at least 51% of the funds must benefit low and moderate-income persons. The activities, dollar amounts and estimated percentages benefit to low and moderate-income persons for which the City is applying/2nd and Final Public Hearing. ALL AYES: MOTION CARRIED. 5-0

9. OLD BUSINESS: (a) Rental Registration Mayor Tyson introduced the item and City Manager Nunemaker explained it was on the last meeting agenda in April and two members were absent so Council deferred action to this meeting. There is no telling the impact once the inspections occurs, there is anticipated magnification of the impact. We are open to meet anyone and walk through the rental. We have seen numerous issues such as a disposable propane tank hooked up in the interior of a home. Staff has considered setting inspections aside for six (6) to twelve (12) months out so residents can obtain assistance from staff.

It was decided amongst Council to amend Ordinance 2017-24 to an effective date of Section 18-122, Rental Properties, to October 1, 2020.

Bay Street, Jose Rendon, the Mediation occurred on Tuesday, as you recall the fine is for $126,112.93, the proposed slope change was accepted, the vehicles will be moved from the South Side to the North Side in two (2) weeks. Mr. Rendon has agreed to a two (2) year $10,000 payment plan of $150.00 and understands if he misses a payment he will be in default and again owe the City $126,112.93.

Council Member Hernandez translated the majority of the conversation for Mr. Rendon.

14. NEW BUSINESS: {a) Authorize Manager to hire a Full Time Utility Director, Kevin Burge. Mayor Tyson introduced the item and City Manager interjected we are looking to

bring on a local resource. He's unwilling to leave with utility vulnerabilities. Our current management company has assisted us and it's a true benefit to have a local here in the Offices to do plan review. He will be a Full-Time employee working thirty (30) hours, assuming the responsibility, this isn't a 9 to 5 job it's

can be a demanding 24 hour a day job. A Employment Agreement will be prepared.

Tractor Supply Application for Preliminary/Final Development Plan

Staff Report

Planned Development District (POD) rezoning with joint Preliminary/Final Development Plan for Tractor Supply retail establishment. Site is slightly less than five acres. The POD is being requested to allow for design relief as set forth herein.

In making its decision, the City Council shall consider the following facts. 1) Degree of departure of proposed planned development from surrounding areas in terms of

character and density. The proposed plan is similar to that of nearby nonresidential uses with parking and vehicular use areas in front and stormwater in the rear and providing for buffers adjacent to residential areas.

2) Compatibility within the planned development and relationship with surrounding neighborhoods. The POD is a single use and thus internal compatibility is not an issue. As state above, the proposed plan is similar to other existing nonresidential uses in design and provides for screening and buffering to residential areas and is this compatible.

3) Prevention of erosion and de radin of surround in area. Because staff finds the proposed plan similar with surrounding areas and compatible with adjacent residential areas, it is not expected to erode or degrade the surrounding area.

4) Adequate provision for future public education and recreation facilities, transportation, water supply, sewage disposal, surface drainage, flood control and soil conservation as shown in the reliminar develo ment ian. Concurrency has been met for the require water, sewer, drainage and transportation. A nonresidential use is not required to meet recreation or education concurrency.

5) The nature, intent and compatibility of common open space, including the proposed method for the maintenance and conservation of said common open space. The open space is designed in a similar manner as other nearby nonresidential uses. Maintenance will ultimately be the responsibility of the land owner since this is a single use development. The open space is conserved through the protections of the final development plan approval.

6) The feasibility and compatibility of the specified phases contained in the preliminary develo ment ian to exist as an inde endent develo ment. This is a single phase project.

7) The availability and adequacy of primary streets and thoroughfares to support traffic to be generated within the proposed planned development. Transportation concurrency has been met. The County, owner of all adjacent roadways, has reviewed the traffic analysis and will provide any conditions via the required County Right-of-way permit. Access to the site is from CR512 and 1 081h Avenue, both of which are currently serving as access to nearby nonresidential uses. The proposed project minimizes their impacts by providing shared access to the east and west.

8) The availability and adequacy of water and sewer service to support the proposed planned development. Water and sewer concurrency has been met. The County will provide water and sewer service to the property. The City is formally amending their service agreement with the County to accommodate this property in the County's service area.

9) The benefits within the proposed development and to the general public to justify the requested departure from standard land use requirements inherent in a planned development classification. The variances being requested are the minimum needed to accommodate the unique needs of Tractor Supply. Please see the list of variance within the PDP/FOP approval resolution. Staff believes the intent of the Code is maintained with these variances.

Parking & Loading Off-street parking spaces shall be provided in accordance with Section 7.2 of the Land Development Code and the approved development plan. Tractor supply, although a retail operation, does not generate the parking demand of a typical retail store. As such, they have requested relief from the strict application of the retail parking rate. The code requires 96 spaces while the proposed plan provides for 6 spaces of which 3 are oversized spaces for trucks with trailers. The parking variance is only applicable to Tractor Supply. Future tenants will have to meet the code required parking unless a future variance is granted.

The Applicant has demonstrated on the plans an arrangement of truck loading and unloading facilities such that in the process of loading or unloading no truck will block or extend into any other private or public drive or street used for vehicular circulation unless specifically approved as part of the POD approval. Loading and delivery zones will be clearly marked.

Access, Traffic Control Connectivity and Right-of-Way Access to the property will be provided off an uncontrolled driveway to CR512 and a secondary driveway to1oath Avenue that has a signalized intersection with CR512. Since CR512 is county­owned, approval from Indian River County for the access location and design. This stretch of CR512 maintains the 200' right-of-way (ROW); no right-of-way dedication is required along CR512. However, 1 oath Venue has a ROW width of only 50' while the county's standard is 100". A 50' ROW dedication is required along 10ath Avenue.

The project is designed for cross access with Racetrac to the west as well as future commercial uses to the east. Staff recommends the applicant enter into a cross-access agreement with the City to ensure such cross access remains in perpetuity.

Traffic control will not be impacted by the project. A traffic study has been submitted demonstrating the adequacy of traffic controls along CR512 and at the 1 oath Avenue intersection with CR512,

An access barrier is required by 3-21 .H.1.n(1 ), LDC. This barrier is provided by curbing of the parking lot in areas, adjacent Racetrac fencing, and perimeter buffer landscaping and grading adequate to serve as a an access barrier.

Density /Intensity The proposed development contains a 19,097sf building area that equates to a floor area ratio of 9.4% Although the POD regulations do not dictate a maximum intensity, the C-2 zoning district regulates maximum floor area ratio at 50%. The POD regulations for maximum impervious coverage is ao%. The proposed lot coverage after development will be approximately 57% which is less than the maximum allowed.

Architectural standards and Lighting No architectural standards exist for the subject property. The maximum length of a building shall not exceed 400 feet as provided by 3-21.H.1.1, LDC. The proposed building is in compliance. The height of all principal buildings shall not exceed thirty-five (35) feet except as provided by 3-21.H.1.1, LDC. The proposed building is in compliance.

The POD regulations encourage decorative lighting and do not allow standard cobra head or similar lighting styles. The proposed lighting standards are consistent with the POD regulations set forth in Section 3-21.H.1.b Lighting. The applicant has demonstrated compliance with these lighting requirements.

Signs The proposed project envisions one monument sign along CR512, a directional sign on 1081h

Avenue and a wall sign on the building . All signs are consistent with the LDC sign regulations.

Compatibility and Consistency The proposed use is allowed as a permitted use within the planned development district and is therefore consistent with the Comprehensive Plan and Land Development Code. Development of the site will require site design features to maintain compatibility with adjacent residential uses to the rear (south). These site design features are addressed under "Landscaping, Buffers, Fences and Walls". The surrounding uses are as noted below.

As required by Section 3-21 .H.1.d, LDC, all utilities shall be underground including telephone, television cable, and electrical systems but excluding primary overhead power lines. Large transformers shall be placed on the ground and contained within pad mounts, enclosures or vaults. The developer must provide landscaping with shrubs and plants to screen all utility facilities permitted above ground. The proposed plans are consistent with these regulations.

Open Space Open Space is regulated by Section 3-21.G, LDC. The Applicant is proposing the required open space be privately owned (developer). The Code requires under this arrangement for the common open space such space shall continue to conform to its intended use and remain as expressed in the final development plan through the inclusion in all deeds of appropriate restrictions approved by the City Attorney. The deed restrictions shall run with the land and be for the benefit of present as well as future property owners, shall contain a prohibition against partition and shall require City Council approval to amend or terminate.

For development projects of less than ten (1 0) acres, a minimum of twenty (20) percent of the gross area of land to be committed to a Planned Development District must be for use as common open space, which may include parks, recreation areas, conservation areas, bicycle and pedestrian paths and facilities, marinas, swimming beaches, common open space, common landscaping or planting areas. Stormwater treatment facilities may be used in the computation of open space when otherwise meeting the requirements of Section 3-21.G.5(a), but no more than fifty (50%) percent of such area may be counted toward the common open space. In total, the project provides for a total of 23.4% open space.

Section 3-21.G.5.(a), LDC requires all stormwater treatment facilities in which open space credit is desired be either 1) permanent water bodies improved with gazebos, overlooks, elevated boardwalks or pathways, docks or piers, and a littoral zone or 2) permanent dry retention or detention areas designed in accordance with the University of Florida guidelines for low impact design. The project has not proposed such plantings; therefore, no stormwater areas are credited toward required open space.

Landscaping, Buffers, Fences and Walls Section 3-21.H.1.i, LDC requires a minimum 25' Type 8 buffer be placed around the perimeter of the site; however, the south property line is required to have a Type A buffer due to the adjacent residential zoned land. The Applicant has requested design relief from the width of the required buffer from 25' to 15'. Staff supports the request since the adjacent uses to the north, east and west will be compatible commercial uses while the residential zoned land to the south is separated by a local road ROW and will provide a Type 'A' buffer.

Tree preservation or mitigation is required for all hardwoods that are 6" or greater in diameter by Section 3-21.H.1.f, LDC. The project has a total of 198 inches of hardwoods that are being removed from the property. The Applicant has elected to accommodate a portion on site and pay into the Arbor fund an amount of $23,850.00 in lieu of planting on site.

Bikeways and Sidewalks As a commercial use, the project is required to provide an 8' multiuse path along CR512 and a 5' sidewalk along 1081h and 94th. Since a sidewalk exists at Racetrac to the west along CR512, the proposed development will extend the sidewalk to its eastern property boundary. Likewise,

Since the project has not interaction with 94th, Staff supports a payment into the sidewalk fund for the sidewalk along 94th Street.

Fire and Emergency access The project has been reviewed for fire and emergency access. No special conditions have been requested. A fire hydrant exists within the required distance to the establishment. A stabilized access exists to within the required distance of the structure.

WHEREAS, Ro-Ed Corp., a Florida corporation, as Successor by merger with American Mutual Corp., a Florida corporation recorded in Official Records Book 467, Page 462, Public Records of Indian River County, Florida (hereinafter "Ro-Ed Corp."), the Owner ofland described herein, has petitioned the City of Fellsmere to annex a parcel ofland lying substantially contiguous to the City limits, consisting of 12.655 acres more or less; and

WHEREAS, Ro-Ed Corp. has petitioned the City to amend the City's Comprehensive Plan Future Land Use Maps to incorporate thereon a portion of the 12.655 acres more or less, which portion consists of 4.876 acres more or less of said annexed land described on Exhibit "A" attached hereto and by this reference made a part hereof (hereinafter the "Land"); and

WHEREAS, the City Council has considered the application of Ro-Ed Corp. for a small scale amendment to designate a land use classification for 4.876 acres more or less of the property considered for annexation from its existing County Future Land Map designation of C/I (Commercial/Industrial) to a City designation of General Commercial (GC); and

WHEREAS, the City Council has considered the applicable provisions of the existing Comprehensive Plan 2035, the Florida Statutes and the recommendations of its staff and Planning and Zoning Commission sitting as the Local Planning Agency; and

WHEREAS, duly advertised noticed public hearings were held before the Planning and Zoning Commission sitting as the Local Planning Agency and City Council concerning this small scale amendment, wherein it was determined that these actions are consistent with the existing Comprehensive Plan 2035, the Florida Statutes and the future development goals of the City.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, AS FOLLOWS:

SECTION 1. RATIFICATION. The above recitals are hereby ratified, adopted and incorporated herein as legislative findings of the City CounciL

SECTION 2. DESIGNATION. Subject to the conditions set forth in Section 3 of this Ordinance the Comprehensive Plan Future Land Use Maps shall be amended to include the following described Land and designate the same as General Commercial (GC) in accordance with the requirements of Florida Law:

See Exhibit "A" attached hereto and by this reference made a part thereof.

SECTION 3. CONDITIONS OF APPROVAL. The amendment to the Comprehensive Plan Future Land Use Maps as requested by Ro-Ed Corp. is subject to compliance with the following conditions and requirements, which shall run with the land.

1. The owner/developer shall demonstrate prior to Preliminary Development Plan and Final Development Plan approval that all concurrency provisions have been addressed or met including but not limited to: sanitary sewer, solid waste, drainage, potable water, parks and recreation, and transportation facilities, including mass transit, where applicable.

2. The provisions of the Annexation Agreement shall apply. 3. The owner/developer are responsible to pay for all costs associated with any new or

expanded public facilities and services required to make their project meet concurrency regulations or to provide their proportionate or fair share contributions therefore.

SECTION 4. SEVERABILITY. If any section, part of a sentence, phrase or word of this Ordinance is for any reason held to be unconstitutional, inoperative or void, such holdings shall not affect the remaining portions hereof and it shall be construed to have been the legislative intent to pass this Ordinance without such unconstitutional, invalid or inoperative part.

SECTION 5. CONFLICT. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of conflict.

SECTION 6. EFFECTIVE DATE. The effective date ofthis Comprehensive Plan Future Land Use Maps amendment shall be thirty-one (31) days after this Ordinance is adopted as provided in Section 163.3187(5)(c) Florida Statutes 2018, as amended.

WHEREAS, duly advertised noticed public hearings were held before the Planning and Zoning Commission and City Council concerning this amendment to the Official Zoning Map; and

WHEREAS, the Planning and Zoning Commission/Local Planning Agency held a duly noticed public hearing on~ ~ d..O I q , 2019, made a finding that the zoning change was consistent with the Compreh s1ve Plan 203 5 and the standards m SectiOn 17.17 of the Land Development Code and recommended that the City Council approve the rezoning request; and

SECTION 1. RATIFICATION. The above recitals are hereby ratified, adopted and incorporated herein as legislation findings of the City Council.

SECTION 2. CONSISTENCY WITH THE COMPREHENSIVE PLAN AND LAND DEVELOPMENT CODE. The Application to amend the City's Official Zoning Map is consistent with the Comprehensive Plan and applicable provisions of the Land Development Code of the City ofFellsmere. The following findings of facts are made:

1. The amendment is not in conflict with any applicable portions of the Land Development Code;

2. The amendment is consistent with all elements of the City of Fellsmere Comprehensive Plan;

3. The amendment is consistent with existing and proposed land uses within the area;

4. The surrounding land uses in the area of the amendment support the amendment;

5. The amendment would not result in excessive demands on public facilities, and the amendment would not exceed the capacity of such public facilities, including but not limited to transportation facilities, sewage facilities, water supply, parks, drainage, schools, solid waste, mass transit and emergency medical facilities;

6. The amendment would not result in significant adverse impacts on the natural environment;

7. The amendment would result in an orderly and logical development pattern;

8. The amendment would not be in conflict with the public interest, and is in harmony with the purpose and interest of the Land Development Code.

SECTION 3. ZONING. The following described Land is hereby given a City Zoning Classification ofPDD Planned Development District: ·

A RESOLUTION OF THE CITY OF FELLSMERE, INDIAN RIVER COUNTY, FLORIDA, APPROVING THE PRELIMINARY DEVELOPMENT PLAN AND FINAL DEVELOPMENT PLAN FOR A TRACTOR SALES AND SUPPLY FACILITY IN THE PLANNED DEVELOPMENT DISTRICT (PPD) ZONING DISTRICT; PROVIDING FOR RATIFICATION; PROVIDING FOR CONSISTENCY WITH COMPREHENSIVE PLAN AND LAND DEVELOPMENT CODE; PROVIDING FOR PRELIMINARY DEVELOPMENT PLAN AND FINAL DEVELOPMENT PLAN APPROVAL WITH CONDITIONS; AND FURTHER PROVIDING FOR SEVERABILITY, REPEAL OF CONFLICTING PROVISIONS AND AN EFFECTIVE DATE.

WHEREAS, Ro-Ed Corp., A Florida corporation as Successor by merger with American Mutual Corp., a Florida corporation recorded in Official Records Book 467, Page 462 of the Public Records of Indian River county, Florida, through its agent (the "Applicant", which includes all grantees, successors or assigns in interest), filed an Application with the City of Fellsmere for a Preliminary Development Plan and Final Development Plan for a tractor sales and supply facility in the POD zoning district; and

WHEREAS, the Applicant owns the land consisting of 4.876 acres more or less as described on Exhibit "A" attached hereto and by this reference made a part hereof(the "Property"); and

WHEREAS, the Planning and Zoning Commission/Local Planning Agency held a duly noticed Public Hearing on~~ 2/2/tJ , 2019 to review the Preliminary Development Plan and Final Development I for the tractor sales and supply facility and determmed that they are in conformance with the official plans and policies of the City and the requirements of the Land Development Code and recommended that the City Council approve the Preliminary Development Plan and Final Development Plan; and

WHEREAS, the City Council has determined at a duly advertised public hearing that the Preliminary Development Plan and Final Development Plan are in the best interest of the public health, safety, environmental and general welfare and that it is appropriate to approve the Preliminary Development Plan and Final Development Plan subject to the conditions contained herein.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fellsmere, Indian River County, Florida, as follows:

SECTION 1. RATIFICATION. The above recitals are hereby ratified, confirmed and adopted as legislative findings by the City Council.

SECTION 2. CONSISTENT WITH COMPREHENSIVE PLAN AND LAND DEVELOPMENT CODE. The Preliminary Development Plan and Final Development Plan for a tractor sales and supply facility meet the provisions of the Comprehensive Plan 2035 and Land Development Code. The following findings of fact are made:

a. There are adequate public facilities to service the proposed use and complies with Section 17.24 of the Code.

b. There is adequate fire protection to service the proposed use.

c. Ingress and egress to property and proposed structures are adequate with reference to automotive and pedestrian safety, traffic flow and control, provision of services, and access in case of fire or catastrophe.

d. Off-street parking areas are adequate with conditions imposed, with attention to automotive and pedestrian safety, traffic flow and control, access in case of fire or catastrophe, convenience to the units it is designed to serve, and landscaping for the buffering of abutting property where applicable.

e. Recreation and open spaces are adequate, with attention to the location, size and development of the areas in regard to their adequacy, their effect on privacy of adjacent living areas, and their relationship to community wide open spaces and recreation facilities.

f. Density of development is adequate, within the framework of the permitted density.

g. General character and compatibility are adequate, with reference to ensuring the proposed development will be designed so as not to cause substantial depreciation of property values or reduce the safety, light and general convenience of neighboring developments.

h. The environmental impact of the development is acceptable on the total land area of the property including how development will affect protected species, wetlands, surficial aquifer recharge areas, physical features, and natural resources . .

1. Rendering, architectural elevation, or photograph of the proposed development are adequate.

J. Water and sewer improvements are in accordance with standards and specifications of the city.

k. The site plan provides for dedication of any necessary rights-of-way.

SECTION 3. PRELIMINARY DEVELOPMENT PLAN AND FINAL DEVELOPMENT PLAN APPROVAL WITH CONDITIONS. The Preliminary Development Plan dated , 20 19 prepared by as signed by the Mayor on , 20 19 and maintained on file in the Community Development Department and City Clerk's office is approved. The Final Development Plan dated _______ ,. 2019 prepared by as signed by the Mayor on , 2019 and maintained on file in the Community Development Department and City Clerk's office is approved. The following conditions shall apply:

a. The Applicant shall obtain all required Federal, State, County and Local permits as may be applicable to any new development, redevelopment or use of the Prope11y and to continuously keep such permits current and in good standing.

b. After the first year following the adoption of this Resolution, the City Council shall have the authority to hold hearings at any time to review the business activity for compliance with all conditions and requirements of approval and all applicable ordinances and resolutions of the City. If the use of the Property is not in compliance, the City Council may revoke or suspend the Local Business Tax Receipt (occupational license), terminate the Conditional Use Permit or refer the matter to the Code Enforcement Special Master as a code violation for other sanctions as deemed appropriate.

c. The use, occupancy, development or redevelopment of the Property shall be in accordance with the Final Development Plan, Landscape Plan, and Building Elevations attached hereto as Composite Exhibit "B" and by this reference made a part hereof. Where specific provisions in this Resolution or in the Land Development Code are not addressed on the Final Development Plan, Landscape Plan, or Building Elevations, the specific provisions of this Resolution or in the Land Development Code shall apply to the development on the Property.

d. All public or private improvements required under the terms of this Resolution shall be constructed at the expense of and by the Applicant as approved by the City.

e. The Applicant shall connect to the Indian River County central water and sewer system.

f. The Applicant shall contract with the City's solid waste provider for year round pick up at the Property.

g. Prior to issuance of the Certificate of Occupancy, the Applicant shall record in the public records of Indian River County a Unity of Title approved by the City Attorney to run with the property in perpetuity for the benefit of present and all future owners of the Property prohibiting the partition or division by any means of the Property. The Unity of Title shall require City Council approval to amend or terminate.

h. Prior to issuance of the Certificate of Occupancy, the Applicant shall enter into a Non-Exclusive Cross Access Easement with the City agreeing to cross access at such time in the future as the City determines that such cross access is beneficial in relation to the development or redevelopment of adjacent properties.

2. Section 7.9.A.2, Sidewalks, bicycle facilities and multi-use paths - exempt from the provision of sidewalks, bicycle facilities and multi-use path along 94th Street subject to payment of $5,220.00 into the City's Sidewalk Fund.

3. Section 7-2.G, Required off-street parking - exempt the initial Tractor Sales and Supply operator from _the total number of required parking spaces, provided a minimum of at least 66 parking spaces are provided. This relief shall not be available for any other tenants or occupants of the Property. All future tenants or occupants will be required to demonstrate compliance with the parking requirements of the Code or obtain approval of the City Manager for a reduced parking rate.

4. Section 11.4.D.l, Required buffer tier landscaping -exempt the Tractor Sales and Supply facility from the required additional two tier landscape along the south buffer in exchange for the use of higher quality grass in front of the building and because the Applicant has landscaped the building foundation in excess of code. Applicant shall make a $23 ,850.00 payment to the City's Arbor Fund.

J. The Preliminary and/or Final Development Plan granted by this Resolution or the Development Permit may be revoked for:

I. Violation of any condition imposed in this Resolution. 2. Upon complaint and proof of adverse effect on adjacent

properties. The Preliminary and/or Final Development Plan or Development Permit may be revoked only after the City Council holds a public hearing, unless the permittee consents to a revocation of the Preliminary and/or Final Development Plan or Development Permit. If the permittee provides written consent to the revocation to the City Manager or designee, he shall revoke the Preliminary and/or Final Development Plan or Development Permit and notify the City Council of the revocation.

k. A violation of any of the conditions or requirements of approval shall constitute a code violation subject to enforcement through the Code Enforcement Special Master, unless a different remedy is specifically provided in any such condition or requirement, in which case such different remedy shall supersede this provision.

SECTION 4. SEVERABILITY. If any section, part of a sentence, paragraph, phrase or word of this Resolution is for any reason held to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions hereof and it shall be construed to have been the legislative intent to pass this Resolution without such unconstitutional, invalid or inoperative pa11.

SECTION 5. REPEAL OF CONFLICTING PROVISIONS. All previous resolutions or parts thereof, which conflict with the provisions of this Resolution, to the extent of such conflict, are superseded and repealed.

SECTION 6. EFFECTIVE DATE. This Resolution shall take effect concurrently with the effective date of Resolution No. 2019-05. If Resolution No. 2019-05 does not become effective, this Resolution shall automatically become void and of no further force or effect.
