REGIONAL PRICE INDEX For the first time, Cocos Keeling Islands was included in the Government’s Regional Price Index (RPI). The CRC completed this last week and would like to thank everyone who assisted us by providing prices.

What is the RPI?

The RPI compares the difference in the cost of selected goods and services (the ‘basket of goods’) between regional towns and Perth. This data is used by both private and government organisations. The results of the 2019 RPI is expected to be released by late 2019. Information on past collections may be found on the Department of Primary Industries Regional Development (DPIRD) website at www.dpird.wa.gov.au

A stage.... During a performance for the high school talent show at the local theater, a hole was cracked in the stage floor. Subsequent acts managed to avoid the damaged area until little Freddy, juggling bowling pins, accidentally stepped through the hole up to his knee. He apologized to the audience for his clumsiness. But a heck-ler in the back of the theater shouted: "Don't worry, Freddy! It's just a stage you're going through!"

FEBRUARY COUNCIL MEETING: Council’s Annual Electors Meeting is scheduled for Wednesday 27 February at 3.45pm at the West Island CRC with the Ordinary Meeting of Council immediately following. Main items we will be presenting for Council to consider are the Mid Year Budget Review, an audit of our compliance against the Local Government WA 1995 and two development applications. MITINGAN COUNCIL BULAN FEBRUARY: Miting Tahunan Pengundi Council dirancangkan untuk Rebo 27 February pada 3.45pm di CRC Pulu Panjang dengan Mitingan Biasa Council langsung selepas itu. Perkara-perkara utama yang kami akan kemukakan untuk Council pertimbangkan ialah Pemeriksaan Keuwangan Pertengahan Tahun, pemeriksaan pematuhan terhadap Local Government WA 1995 dan dua pemohonan pembangunan. MAJU PULU KITA / ADVANCE OUR ISLANDS: We have been absolutely thrilled by the response to the workshop on Saturday. We are expecting around 90 people to join in planning for the future of Cocos. A massive and heartfelt thank you to everyone who has registered for so generously giving their valuable time and placing their trust in a cohesive and collaborative approach to future planning. Following the workshop on Saturday, the design team, led by talented Urban Designer, Malcolm Mackay, will develop some options and scenarios for review and comment by the community. For those who are not able to make it on Saturday, you can still join the fun and get involved by coming to one of two shorter sessions where the scenarios will be presented on Wednesday 27 February either at 9am—12noon on Home Island or 5pm—8pm on West Island. Please contact Luluk at the Shire if you would like to know more about what we are doing and why. OFF-ISLAND BATTERY DISPOSAL: As many residents would be aware, a major legacy issue we are facing is the responsible disposal of old batteries. I am pleased to advise that we are working on an off-island disposal solution. It is a long and labor-intensive process with each battery needing to be cleaned, washed and packed to ensure it can meet sea transport and export requirements. We aim to have this legacy issue resolved within the coming months. If you would like to know more, please contact me. PEMBUANGAN BATTERY KELUAR PULU: Sebagaimana semua penduduk mungkin tahu, suatu perkara besar yang kami hadapi adalah pembuangan battery-battery lama. Saya bergirang hati untuk memberitahu yang kami sedang usahakan solusi pembuangan ke luar pulu. Ia adalah proses yang lama dan kerja keras dengan setiap battery perlu dibersihkan, dicucik dan dipak untuk memastikan ia mematuhi syarat-syarat transport kapal laut dan export. Kami bertujuan untuk menyelesaikan beban ini dalam berberapa bulan kehadapan. Kamu kamu ingin mengetahui selanjutnya, silah hubungi saya. WASTE AND RECYCLING: Speaking of waste management, I had a great morning a couple of weeks ago when I joined our West Island Waste Management Team, Iku (Nek Izahan) and Hamiril (Nek Zathiyah) on their run collecting household waste. Theirs is such an important role and they do it with such commitment and dedication. Thank you gentlemen. I noticed that sadly many people do not take advantage of our glass and aluminum recycling and would urge residents to recycle wherever possible. To assist we will look at some improved signage and community education in the near future. SAMPAH DAN RECYCLING: Mengenai pengurusan sampah, saya mengalami pagi yang menyenangkan beberapa minggu yang lalu bila saya bersama Kumpulan Pengurusi Sampah kami, Nek Izahan dan Nek Zathiyah dalam pengangkatan sampah biasa. Kerjaan mereka adalah sangat penting dan mereka menjalankannya dengan bersungguh-sungguh. Terima kasih kepada tuan-tuan. Saya melihat sayangnya ramai orang tidak mengambil peluang recycling kaca dan aluminum kami dan saya ingin mendorong penduduk untuk recycle

REGIONAL DEVELOPMENT ORGANISATION MEETING: I attended a meeting of the RDO on Christmas Island last week as a guest of the Administrator. The meeting was productive and included working on a Business Plan for the Regional Investment Officer and reviewing the community input from surveys and meetings for the CKI Strategic Plan by the RDO. The RDO also considered a tourism proposal from CI residents and decided to form a Tourism Development Sub-Committee. This Sub-Committee will be working very closely with CKITA and CITA to try and leverage regional tourism development outcomes as outlined in the CI Strategic Plan. MITINGAN REGIONAL DEVELOPMENT ORGANISATION: Saya menghadiri mitingan RDO di Pulu Christmas pada minggu lewat sebagai tetamu Administrator. Mitingannya produktif dan mengandungi mengerjakan Business Plan untuk Regional Investment Officer dan memeriksa pandangan masyarakat yang dihasilkan daripada survey dan mitingan untuk CKI Strategic Plan oleh RDO. RDO juga mempertimbangkan cadangan pelancongan daripada penduduk CI dan memutuskan untuk membuat Tourism Development Sub-Committee. Sub-Committee akan bekerja rapat dengan CKITA dan CITA untuk mencoba menguatkan perkembangan pelancongan daerah sepertimana telah diterangkan dalam CI Strategic Plan. MEETING WITH WARREN SNOWDEN MHR, MEMBER FOR LINGIARI: The Deputy Shire President, Cr Young, Cr Dedian and Shire officers met with Mr Snowden in early February. Matters discussed included the following. • Housing—the need for additional housing; • Employment from runway upgrade project; • Drugs as an important health issue in the community; • The Shire’s work to develop a priority list of capital

works and master plan. • Family is the First Teacher – a Government program

that works with parents as the first and most important teacher.

ARTS AND CULTURE COMMUNITY INTEREST GROUP: We are really keen to hear from residents with an interest in art and culture and interested in attending a very informal and fun meeting to look at what we can do to increase arts and cultural offerings on Cocos. This could include all forms of art—visual, performance, written. WORKS UPDATE

PULU GANGSA SAND BAGGING: We have commenced the sand bagging project at Pulu Gangsa. With the low tide the crew is work at a rapid but safe rate to have this 210meter section completed within 2 weeks. ‘SAND BAG’ PULU GANGSA: Kami telah bermula projek mengator beg pasir di Pulu Gangsa. Dengan ayer kering ini, pekerja-pekerja sedangan bekerja dengan deras tapi selamat, untuk menyelesaikan bahgian 210meter ini dalam 2 minggu.

EWP: The hand over and training of the new EWP took place last week and was a great success. During the training the coconut trees at Trannies Beach were de-nutted.

This new piece of equipment will allow us to maintain more trees that would not have been able to do with the old EWP. It will also be useful in treating wasp nests.

EWP: Penyerahan dan trainingan untuk EWP baru dijalankan pada minggu lewat dan sangat berhasil. Dimasa trainingan, kelapa yang ada dipokok di Belakanga Batu Karang telah dirontokan. Pekakas baru ini akan mengizinkan kami untuk merawat pokok-pokok yang kami tidak dapat jaga menggunakan EWP yang lama. Ia akan sangat berguna untuk mengatasi rawatan tarangan wasp.

STREET FURNITURE: The new street furniture, table settings and bin surrounds have been installed for all to enjoy. We hope you like them. PEKAKAS JALANAN: Pekakas jalanan baru, meja-meja dan tutupan tempat sampah telah dipasang untuk semua menikmati. Kami berharap semua suka. RUBBISH PICKUP: The general rubbish pickup that is scheduled to be collected on Thursday 7th March will now be collected on Wednesday 6th March. The rubbish collection dates will then resume back to normal after. We apologise for any inconvenience. PENGANGATAN SAMPAH: Pengangkatan sampah yang dicadangkan untuk diangkat pada hari Khamis 7hb March sekarang akan dipungut pada Rebo 6hb March. Haribulan pengangatan sampah akan kembali semula pada biasa selepas hari tersebut. Kami mintak maaf kalau perkara ini menyusahkan. These are a few items that I think may be of particular interest but we are always willing to meet with members of the community who are interested in knowing more about Shire activities. Proposed Local Law The Shire of Cocos (Keeling) Islands proposes to adopt the following local law – 1. Shire of Cocos (Keeling) Islands Local Law 2019;

Purpose – for the management of meetings of the local government Effect – to repeal the existing Standing Orders Local Law, and provide for the conduct of Council, committee and electors meetings

A copy of the proposed local laws may be inspected at or obtained from –

− the Shire Office on Home Island during standard business hours or on West Island Tues and Thurs 12noon to 3pm

PUBLIC NOTICE - DISPOSAL OF PROPERTY LEASE OF PORTION OF LOT 103 FOR A RENEWABLE

ENERGY FACILITY PUBLIC SUBMISSIONS INVITED

Under the provisions of the Local Government Act 1995 (WA) (CKI) as amended, Council hereby gives public notice of the intent to dispose (by lease) of property.

At the Ordinary Meeting of Council on 23 January 2019, Council resolved to give public notice of the intent to dispose (by lease) of property. Details of the proposed lease are as follows:

Property: A Portion of Lot 103 Home Island in two parts (Part One: 7,500sqm; and Part Two: 12,500sqm - giving a total lease area of 2.00 Hectares);

Proponent: Island Power Co Pty Ltd on behalf of project company Island Power Co HI Pty Ltd;

Period: 15 Years Plus 15 Years;

Lease value: $4,200 ($0.21psqm) per annum as determined by the independent professional valuation by Opteon and subject to annual CPI review;

Purpose: For the development of a renewable energy facility.

ANNUAL GENERAL MEETING OF ELECTORS 2019 The Shire of Cocos (Keeling) Islands’ Annual General Meeting of Electors will be held on Wednesday 27th February 2019. All members of the community are welcome to attend.

CRC Conference Room, West Island Wednesday 27th February 2019, Commencing at

3.45pm For members of the public who wish to raise any specific questions, please send them in writing to the Chief Executive Officer by 12pm Monday 25th February 2019.

2017/2018 ANNUAL REPORT The Local Government Act (1995) requires all Councils to prepare and accept an Annual Report for each financial year no later than 2 months after the auditor’s report becomes available. In accordance with section 5.55 of the Local Government Act (1995), a copy of the Shire of Cocos (Keeling) Islands 2017/2018 Annual Report is available for viewing at the Shire Administration Offices and Community Libraries on both Home Island and West Island during opening hours, and also available on our website.

MITING TAHUNAN PENGUNDI Miting Tahunan untuk Pengundi Shire Pulu Cocos (Keeling) akan diadakan pada hari Rebo 27hb February 2019. Semua penduduk masyarakat dipersilahkan untuk hadir.

The WWC Check visit to the islands in November/December – An update from Susan Burton and Lynette Ryan

We visited Cocos (Keeling) Islands in late November / early December last year, working alongside our colleagues from the Equal Opportunity Commission and ‘Sport and Rec’. We welcomed the opportunity to meet with people on Home Island and West Island and extend a sincere thank you to everyone who made time to meet with us and share ideas. At the end of the day we are all committed to building healthy communities and healthy children.

While on island we promoted the WWC Check as a screening tool to help identify risks to child safety. The WWC Check assesses a person’s criminal records to see if they have any offences and associated behaviours which indicate they may harm a child.

If you are an organisation or employer who provides services to children, then you must make sure that your employees or volunteers who are doing ‘child-related work’ apply for a WWC Check or hold a current WWC Card.

We have been visiting the Cocos (Keeling) Islands since 2013 and have learnt a lot about its special characteristics. We try hard to put ourselves in your shoes when we receive any questions or calls for help. If we can be of assistance with any aspect of the WWC Check and child safety, then please contact us:

Kami melawati Pulu Cocos (Keeling) pada penghujung November / awal December tahun kemarin, bekerjasama disamping rakan pekerja kami dari Equal Opportunity Commission dan ‘Sport and Rec’. Dimasa berada dipulu kita membuat promosi WWC Check sebagai alat pemeriksaan untuk membantu menimbulkan risiko terhadap keselamatan anak-anak. WWC Check memeriksa rekod kriminal seseorang untuk melihat jika mereka mempunyai pelanggaran dan tingkah laku yang berkaitan yang menunjukkan mereka mungkin boleh menyakiti seorang anak.

Kalau kamu sebuah pihak persatuan atau majikan yang memberi serbis kepada anak-anak, kamu mesti memastikan yang pekerja-pekerja kamu atau voluntir yang menjalankan ‘kerjaan yang kena-mengena dengan anak-anak’ mendapatkan WWC Check atau mempunyai Kad WWC pada saat ini.

“LAWA's IOTs Service is fully funded by the Australian Government” Criminal offences of assault II

These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation. This article is about the criminal offences of assaults with intent (to do another offence) and “serious assaults”. The last article dealt with the definition of an assault, what are circumstances of aggravation and two types of more serious assault. Assaults with intent (to do another offence) These are all dealt with under a particular section of the Criminal Code. You can be charged with assault with intent if you: • Assault someone with the intention of committing an offence or helping an offence to be committed. An example

is if you punch someone in their house to knock them out so that you can rob their house. Another example might be grabbing someone and throwing them out of their car, so you can steal the car in a carjacking.

• Assault someone with the intention of doing grievous bodily harm (GBHgbh) to them. Grievous bodily harm is either life-threatening harm, or harm that is likely to be life-threatening, or it is harm that is permanent (life-long) or likely to be permanent. An example might be slashing someone in the face with a broken bottle, telling them that you intend to scar them for life.

• Assault someone intending to resist arrest, or to prevent the lawful arrest or detention of someone who could be you, or could be someone else. An example might be punching a police officer in the face to prevent her from arresting you.

The offence of assault with intent will be dealt with by the Magistrates Court unless either you or the Prosecution ask for it to be dealt with by the District Court (called “on indictment” and the Magistrate agrees. There are rules that the Magistrate must apply in making this decision. If dealt with summarily, that is, by the Magistrates Court, the maximum penalty is 2 years imprisonment and/or a fine of $24,000, or 3 years imprisonment and/or $36,000 if there are circumstances of aggravation or racial aggravation. If dealt with by the District Court, the maximum penalty is 5 years imprisonment, or 7 years imprisonment if there are circumstances of aggravation or racial aggravation. Serious assaults These are assaults on particular categories of people. They include:

A public officer (eg a police officer, a public servant) • Someone acting to assist a public officer • A driver of

− A taxi − A ferry − A vehicle on a railway − A bus

• An ambulance officer • An FES worker (firefighter), SES worker, Volunteer Marine Rescue Service worker • A hospital worker • A worker providing health services to the public • A court security officer • A prison officer. An offence of this kind must be dealt with by the District Court if you are armed with an offensive or dangerous weapon immediately before, during or after the offence or you are in company with another person or other people. Examples of offensive or dangerous weapons might be a knife or a blood-filled syringe. If dealt with by the District Court, the maximum penalty is 7 years imprisonment, or 10 years imprisonment if you are armed or in the company of another person or other people. If dealt with by the Magistrates Court, the maximum penalty is 3 years imprisonment. Where imprisonment is mandatory (you must be imprisoned) for serious assaults If the assault is on: • a police officer, court security officer, prison officer, youth custodial officer, ambulance officer or transit guard (a

“public officer”) whilst they are doing their job and • results in bodily harm to that person

then a sentence of immediate imprisonment is mandatory. This means the sentence of imprisonment cannot be suspended.

If you are an adult, you must receive a mandatory minimum prison sentence of: • 9 months if you are armed with a dangerous or offensive weapon, or in company of another person or other

people • otherwise 6 months. If you are 16 years but under 18 years, you must receive a mandatory minimum prison or detention sentence of 3 months. A conviction must be recorded against you. If you are given a sentence of detention, the Court can also impose a conditional release order, which has the effect that the detention is served in the community. Defences to assault charges There are a quite a number of potential defences to assault charges. Some examples are provocation, self-defence, accident, lawful authority (where you have the authority to touch or use reasonable force with the person, such as where you are arresting them), preventing a mentally impaired person being violent, using a certain amount of reasonable force to discipline your child and stopping a riot. There are others. Many of these defences have rules that apply to them. If you are charged with an assault, you should get legal advice. Annie Gray, Legal Aid WA

Kamu boleh di dakwa dengan penyerangan dengan niat kalu kamu: • Menyerang seorang dengan tujuan untuk membuat pelanggaran atau membantu sesuatu pelanggaran dilakukan.

Contohnya ialah kalau kamu menumbuk sesorang selagi berada dalam rumahnya untuk kelengarkannya supaya kamu dapat merompak rumahnya. Satu contoh lagi mungkin kamu menangkap seseorang dan melemparnya keluar dari keretanya, supaya kamu boleh menyurik keretanya.

• Menyerang seseorang dengan tujuan untuk menyebabkan kecederaan badan yang terok kepada mereka (GBHgbh). Kecederaan badan yang terok diantaranya kecederaan yang mengancam kehidupannya, atau kecederaan yang mungkin mengancam kehidupannya, atau kecederaan yang seumur hidup atau berkemungkinan kekal. Satu contoh ialah mungkin kamu geret muka sesorang dengan botol pecah, memberi tahu mereka kamu berniat sepaya berkekas seumur hidup.

• Menyerang seseorang dengan tujuan untuk tidak mau ditangkap, atau untuk mengelak daripada menangkapan menurut undang-undang atau pertahanan seseorang yang mungkin kamu, ataupun orang lain. Contohnya mungkin kamu menumbuk seorang opisa police dimukanya kerana mau lari daripada kenak tangkap.

Pelanggaran mengenai penyerangan dengan niat akan diurusi oleh Magistrates Court kecuali kamu atau Prosecution memintak untuk diurusi oleh District Court (yang dipanggil “on indictment” dan Magistrate bersetuju. full of fibre and packed with antioxidants, vitamins and minerals. Particularly good for your eyes as they contain the antioxidants zeaxanthin and leutin that have been shown to reduce the risk of macular degeneration.
