Minutes for the Monthly Meeting of Llantrisant Community Council held at Caerlan Hall, Llantrisant on 21 January 2020 at 6:30 pm

Present: Councillors S Powell (Chair), T Crutcher, M Davies, R Hunt, A Matheson, D Nicholas, V Nicholas and P Williams.

In attendance: Clerk: Catherine Craven.

3. Minutesi) It was agreed that the minutes of the Monthly Meeting held on the 10 December 2019was a true record of the meetings decisions and were duly signed by the Chair.

4. Action TableA223 and A220 Clerk reported a meeting with Centre Great had been organised inFebruary to discuss festive lights.A122. The RFO has sourced an incumbent board costing £946.70 and details werecirculated at the meeting.It was agreed that a framed hardwood honours board as shown and quoted fromGreenbarnes be purchased using the Chairs Allowance.A202. Clerk has requested good quality images of the logos required on the banner fromthe PCSO. Llantrisant and Talbot Green Ward Members reported that the future of PACTmeetings was uncertain. The Council would be very concerned too lose its local PACTmeetings and agree these are beneficial for all in the community.The Clerk was instructed to write to the Police Chief Superintendent to confirm the Police’sintentions on the future of PACT meetings.

Correspondence i) It was agreed that the following comments were made to Welsh Government on its Consultation on changes to planning application fees. Q1: Do you agree with the proposed 20% increase in application fees, excluding pre-application services? If not, why not? No. A 20% increase in application fees is too high. Q2: Do you agree with introducing a fee of £230 for applications for Certificates of Appropriate Alternative Development, made under section 17 of the Land Compensation Act 1961? If not, why not? No. Introducing a fee of £230 for applications for Certificates of Appropriate Alternative Development is not necessary. Q3: Do you have any comments to make, or evidence to put forward in relation to the current fee regime, or any suggestions for improvements? Any increases deemed necessary should be reasonable. Q4: We would like to know your views on the effects that changes for planning and related applications fees would have on the Welsh language, specifically, on opportunities for people to use Welsh and on treating the Welsh language no less favourably than English. What effects to you think there would be? How could positive effects be increased, or negative effects be mitigated? Welsh language should not suffer any effects should changes be implemented. Council noted the Clerk was attending the Planning Inspectorate Wales event on the 23 January in Builth Wells. A230

iii) To consider an event to mark VE75. The Events Committee were requested to organise an event at Beddau Centenary Garden and Welfare Hall for May 8th. A231 iv) No comment was made on the RCTCBC consultation on proposals to enhance learning support class provision. v) It was agreed to enter the Annual Report and Launch Bunny Walk for the One Voice Wales Innovative Practice Awards.A232 vi) Following a discussion it was agreed the Clerks drafts up a response from the comments made by the Council to RCTCBC’s Llantrisant Traffic Consultation. Members will have the opportunity to comment before it is sent to the Highways Department. A233. Comments made included supporting the proposed 20 mph speed restriction but question how effective speed cushions would be, suggesting alternatives such as painted road surfaces, chicanes and average speed cameras to slow down the speed of vehicles travelling through the town. The Council supports the proposed roundabout at Dan Caerlan. Some road closures, or one way systems should also be considered at some locations including the Common road and the entrance to Castle Street.

8. Officers Report To receive an update on becoming a Caru Cymru – KWT Litter Picking Hub. Report was noted and the Events Committee were requested to organise a launch with Keep Wales Tidy. A234 9. ii) To agree a precept for the 2020/21 financial year.It was agreed that an increase to the Council D tax band of £2.00 from £41.00 to £43.00per household. When multiplied by the Council tax base provided by RCT of £5358.37 thiswill generate a precept of £230,409.91. SLCC ADVICE NOTE: PLANNING – A SIMPLE GUIDE TO WHAT IS A ‘MATERIAL CONSIDERATION’ The law requires that when a decision is made on a planning application or planning issue, that only certain issues are taken into account. These issues are known as ‘material considerations’.

It is important, therefore when commenting on a planning issue that a Council only considers 'material considerations.

There is, however, no statutory list of what is a 'material consideration' but there is considerable case law and precedent on what and what is not a 'material consideration'. Examples of a material consideration include:

• Consistency with neighbourhood, district/borough, county and national • planning policies. • Any emerging new planning documents that have been through at least • one stage of public consultation. • Previous planning decisions. • Highway issues, e.g. traffic and highway safety. • Overlooking, loss of privacy and overshadowing. • Scale of the development. • Design, appearance, layout and materials to be used. • Loss of important open space or sporting facilities. • Crime and anti-social behaviour. • Noise, disturbance or smells, including proposed hours of operation. • Capacity of physical infrastructure, e.g. public drainage or water systems. • Deficiencies in social facilities, e.g. spaces in schools. • Storage and handling of hazardous materials. • Loss or effect on trees. • Impact on nature conservation and biodiversity. • Effect on listed buildings and conservation areas, • Local financial considerations offered as a Section 106 agreement, • Community Infrastructure Leve or similar. • Inadequate or inappropriate landscaping or security measures. • Effect on a building or asset of special importance to the community, e.g. • pubs, shops and community facilities. • Where the application is 'major', pre-application planning consultation, • including with the parish council.

The relative importance (commonly known as 'weight' in planning terms) attached to material considerations in reaching a decision is largely a matter of judgement for the decision-maker, i.e. the local planning authority; however, the decision-maker is required to demonstrate that in reaching that decision they have considered all relevant matters. It should also be noted that greater 'weight' will be attached by a decision maker to a material consideration issue which is supported by evidence, e.g. if a parish council considers that it is not consistent with national and planning policy state why and which policy (though it is generally not necessary to quote the policy verbatim). Issues that are not relevant (and the law regards they should not be taken into account) include:

• Effect on the value of property. • Possible future development not included in the application. • Matters controlled under building regulations or other non-planning legislation,

e.g. structural stability, drainage details, fire precautions etc. • Effect on business competition. • Private property rights such as boundary or access disputes or covenants. • The background, morals or motives of the developer. • Applicant’s personal circumstances (unless exceptional, e.g. provision of facilities for someone with a

physical disability).

AGENDA ITEM 7 (i) – Llantrisant Guildhall’s Medieval Event September 2020

ACTION: To decide on request for financial assistance of £750 towards the event.

Correspondence Received:

Llantrisant Guildhall is developing into a new attraction for the town and we want to build on its success by bringing a medieval fayre to the Castle Green on Saturday September 5 and Sunday 6. Our previous medieval fayre was a great success and brought hundreds of people into the town – which ultimately benefited many of the businesses.

The next fayre is a two day event featuring the Medieval Combat Society and the Cosmeston Archers. The cost for both is £1,500. They will reside on the Green over the weekend and create a “medieval village”.

The Guildhall Trust would like to make an approach to the Community Council to ask whether they would consider offering 50% funding support for the event which will of course be advertised as another great joint initiative. Working together on the Christmas event was a great success and we are confident that this partnership approach will continue to enhance the visitor experience to the town.
