The Legislation Commission (LC) reached an important milestone.We completed the LC strategy for 2015 – Q3 2018 and established the new IFU LC strategy for Q4 2018-2021 during the Legislation Commission meeting in October 2018.

The new strategy reflects the LC mission & vision, builds on our accomplishments of the past three years and supports the overall IFU 3-year plan. The strategic priorities are shown on the picture:

Among major achievements of the IFU Legislation Commission during 2015 – Q3 2018 (that we will capitalise on for the future) are:

1.Broader monitoring of the international regulatory landscape The IFU LC broadened its activities at Codex Alimentarius:

9 participates in 13 Codex Committees 9 has been an active member of 21 electronic working

groups by Codex during the past three years.

Next, IFU has started cooperation with the World Customs Organization (WCO) and monitors activities of the Food and Agriculture Organization (FAO), the World Health Organization (WHO), the World Trade Organization (WTO) and international press.

2.Effective prioritisation and execution of regulatory dossiers The IFU LC was instrumental in the creation/revision of Codex/WCO international standards - these standards reflect the needs of the international Juice Sector for

Next, during the October meeting the LC also confirmed its priorities at Codex for Q4 2018 - 2019 (point 2 of the strategy) and has been working on them accordingly:

innovation, freedom to operate and sustainable international trade. Few examples:

9 WCO – Harmonized StandardsThe Harmonised System committee of WCO adopted IFU recommendations on the clarification techniques, as well as the differentiation between Pomelos & Grapefruit and Vaccinium idea & Cranberries.

9 Codex - Processed tomato concentrates – Lead limit revocation

The IFU LC did raise concerns about the definition and partnered with the World Tomato Processing Council (WTPC) on the resolution of the issue. The proposal for the maximum limit for lead in processed tomato concentrates was cancelled by Codex. Instead, the existing limit for fresh tomatoes will be used considering the concentration factor.

9 Codex – Berries and small fruit juices/nectars, Lead limits reflect ALARA

The IFU provided the data from members around the world and was instrumental in the revision of the Codex standards on maximum limits

for lead in juice and nectars. The standards reflect ALARA principles (as low as reasonably achievable) and the members data.

9 Codex - Addition of vitamins & minerals remains permitted in juices and nectars

The IFU participated in discussions. The proposal to create the ”negative list of foods that cannot be fortified” including juices/nectars was dismissed.

3.External communication2015: IFU LC participated in the WHO campaign “World Health Day” 2015: IFU LC established cooperation with WCO 2016: IFU LC established cooperation with CropLife International2017: IFU LC established cooperation with World Tomato Processing Council (WTPC).2017: IFU activities and contribution quoted in the Codex Alimentarius Committee Report 20172018: IFU LC participated in the WHO campaign “World Food Safety Day”

4.Internal communicationThe LC closely cooperates with the peer committees in IFU. In addition, we have broadened the frequency and the reach to all members – to update members on news and the status of LC activities, as well as seek input/feedback from all members.

5.Regulatory advisory service to members The new Regulatory Information Centre, including the depository of national and regional legislation for juices/nectars via the IFU website, was introduced and made available to all members in 2017.

6.Reaching out to emerging markets and growing the membershipThe IFU LC increased its membership by 30% in the past three years - new members represent Algeria, Australia, China, Gulf countries, Israel, Turkey and the UK. The members of the IFU LC are leading experts in their chosen subject from around the world.

Some of these subjects were already discussed during the Codex meetings in the Q4 and the IFU participated in discussions:

9 CODEX COMMITTEE ON NUTRITION AND FOODS FOR SPECIAL DIETARY USES, CCNFSDU 40

The nutrient profile and biofortification were considered during the CCNFSDU 40 end November in Berlin. Romana Vanova-Hrncirik represented the international juice sector.

9 Nutrient profile The recommendation by Costa Rica and Paraguay to start new work on Guidelines to establish nutrient profiles (NP) was not approved. It was agreed that Costa Rica and Paraguay would undertake the stock-take on NPs and further work on the discussion paper while addressing comments by members, WHO, as well as the information from the Codex Committee on Food Labelling (CCFL). The matter will be discussed again during the next year session.The IFU will keep monitoring developments.

9 BiofortificationIt was, while holding the work on the definition at Step 4, agreed to forward the proposed definition to CCFL and request CCFL to consider if the definition would meet their intended needs and clarify the intended use of the definition and where the definition would be placed.The IFU is a member of the EWG and established the position on the matter (supported the definition with a minor caveat). The IFU will keep monitoring developments and participating in discussions.The Codex Committee on Food Hygiene (CCFH) and the Codex Committee on Food Import and Export Inspection and Certification Systems (CCFICS) also met in Q4 2018. The IFU has been monitoring developments and participating in discussions of both committees:

PRINCIPLES OF FOOD HYGIENE AND ITS HACCP ANNEX - The draft text has

been returned to Step 2 and an eWG will continue to develop the text for presentation at CCFH51.

9 CODE OF PRACTICE ON FOOD ALLERGEN MANAGEMENT FOR FOOD BUSINESS OPERATORS - The Committee agreed to forward the draft code for adoption by CAC42 at Step 5 and seek the advice of CCFL on the appropriateness of the use of a precautionary allergen labelling statement, the related definition and submit the food labelling provisions to CCFL for endorsement.

9 FUTURE WORK - it was decided to develop a discussion paper on principles for the safe use of water in food processing.

9 DISCUSSION PAPER ON FOOD INTEGRITY AND FOOD AUTHENTICITYAn EWG will conduct analysis of existing relevant Codex texts to avoid overlapping or intrusion onto the mandate of other Codex general subject or commodity committees. There is a reference to authenticity in the Codex General Standard for Fruit Juices and Nectars 247-2005 therefore we will continue to closely monitor the work of the EWG.

Finally, the calendar of the Codex meetings for 2019 is enclosed in the table below. IFU will represent the member’s interests in these sessions and their working groups.

12 experts met in Antwerp on the 16th October, under the chairmanship of Mikko Hofsommer from GfL.The meeting opened with a presentation from a new member Biosystems - a Spanish company, based in Barcelona, which initially specialised in instrumentation for automatic assays for clinical applications. Recently they have attempted to diversify their offering into other fields, which have included the analysis of wines and juices. They offer four spectrophotometer systems that are linked with enzymes assays to determine the levels of a range of important components in both wines and fruit juices. The assays employ similar enzymes to those employed in the other enzymic assay kits used in the field. Their instruments vary from a potable system, which could be used in the “field” and operates on battery power, to bench type systems for use in the laboratory to a high throughput system capable of carrying out 400 analyses per hour. IFU 7a. Determination of Sulphur Dioxide.Due to the performance of the method close to the LOD (10 mg/l) and the recent discussions there has been at AIJN concerning the use of sulfite preservation of “organic”

grape juices. There has been some discussion about the method producing false positive results in this 10 mg/l region, which presents the “need” to verify if a “positive” result is real or is a function of the analysis method. Therefore, it has been decided to add an addendum to IFU 7a to cover this issue. The new addition uses a typical modification that can be used for matrices that are known to liberate organo-sulfur compounds like cabbage, garlic & liquorice, that gives a false positive result when using the simple titration method. In this method the liquid collected in the receiver flask/s is analysed for the sulphate ion using ion chromatography. If this is detected in the liquid it clearly proves that sulfite had been used during the extraction process or during storage of the juice. The revision was published at the end of October 2018.Revision of Recommendation #2 for patulin. Two suggested revisions to the existing patulin recommendation were prepared over the summer. It was decided to combine elements of both of these revisions and publish to revised procedure early 2019.IFU # 66 Acetic acid. This method will be updated by including the appropriate performance criteria and published in early 2019.Recommendation #15 Quality

systems for juice labs. This recommendation is useful for application in most operations therefore it will be translated into 5 languages. Japanese, Spanish, Arabic, Chinese and French. If successful, then other procedures and recommendations may be translated.The commission are working on many more projects which provide lots of new and revised information in 2019.The next meeting will be in Athens on the 5th March. e-learning videos of IFU methods.IFU 7a Determination of Sulphur Dioxide and IFU 8 Determination of Soluble Solids using a refractometer are already available via the website. Now a video on IFU #1a Determination of Relative Density using a density meter has also been listed.

NEW BEST PRACTICE GUIDANCEThe Science and Technology Commission have formed working groups to develop a series of Best Practice Guidance to assist members with their operations and provide a knowledgeable reference for those involved in the industry. 2 groups have worked very hard to complete the first of these publications, which are now available via the website.

#1.0 FRUIT WASHING AND SANITATION (2018)This is a 43-page detailed and well-illustrated practical guideline for the correct handling, sorting and washing of fruits at the processing site to minimize fruit damage, reduce the risks of final product contamination, ensure product safety and quality. It gives examples of practical applications for the washing of apples, tropical fruits, citrus and carrots.

#2.0 CLOUDY APPLE JUICE: INFLUENCE OF RAW MATERIAL, PROCESSING AND STORAGE (2019)Cloudy apple juice is one of the most popular juices consumed. As the nature and stability of the cloud particles are an important quality feature for the consumer this review considers the composition of those particles and the various factors that influence the cloudy nature of the juice which should help manufacturers obtain consistent appealing products. In order to maintain the natural reputation of juices with the use of additives to control cloud stability this document provides an important scientific reference for the physical steps that can be taken.

A working group has been set up that will review relevant scientific papers published since then in order to revise the document and bring it up to date.NEXT MEETING.The next commission meeting will be held on the 5th March, the day before the technical workshop. In his presentation “Food Fraud in the Juice Industry” he pointed out that the fruit juice industry had a long tradition of fraud awareness and a very unique concept to approach this issue based on the official IFU methods of analysis, the AIJN Code of Practice reference guidelines and the industrial self-control SGF.

Several case studies were discussed such as a black carrot addition to blood orange juice for colour improvement, mixing apples and pears and the addition of acid to lemon juice concentrate. Also, a novel method approach was

suggested to detect cane sugar in pineapple juice which is a particular challenge. Generally, in a vulnerability assessment one should focus on the question “what makes the prices”. Looking at specifications and following the money should be considered to anticipate food fraud.

On the 20th December the United Nations General Assembly adopted a resolution proclaiming a World Food Safety Day. Starting in 2019, every 7 June will be a time to celebrate the myriad benefits of safe food.“World Food Safety Day will be a chance for everyone to take a moment to think about something we often take for granted: food safety”, said Codex Secretary Tom Heilandt. “Thanks to the widespread efforts of Codex Members and Observers, the international community will speak with one voice on 7 June to promote awareness and inspire actions for safer food”, he said.Unsafe food is a threat to human health and economies, disproportionally affecting vulnerable and marginalized people, especially women and children, populations affected by conflict and migrants. It also damages global trade leading to further food waste, which can no longer be tolerated in a world where many still suffer from hunger. The new annual observance, established thanks to concerted efforts led by Costa Rica, will draw attention and direct efforts to stopping the roughly 600 million cases of foodborne illnesses that occur annually.Please join IFU in celebrating and promoting World Food Safety Day on the 7th June. This meeting was organised by Interpol to build up awareness and expertise in the Middle East region on the topic of food fraud. The main emphasis here was combating counterfeit goods which they perceive as involving organised crime gangs from around the world working together to make an illicit profit. Around 50 people attended the meeting mainly from the local area; Jordan, Egypt, Morocco, Tunisia and United Arad Emeritus. There were also representatives from FAO, Interpol, US patent office as speakers & other speakers from Unilever, Coca Cola, Apimondia (Honey Association) & IFU. The first day was set aside to look at regional issues. After the initial welcomes and introductions, the talks were started off by a Gentleman from the US patent and trademark office. Mr. D. Mazurkevich (USPTO) described how food fraud and counterfeit goods was handled in the US and highlighted several recent cases. He highlighted issues with counterfeit alcohol which had been prepared from denatured “rubbing alcohol”, re-dated eggs of poor quality & a counterfeit energy drink. He also highlighted the typical fines and or jail terms that the perpetrators might expect to receive. He also highlighted the need for large to medium sized companies to have

a “food defence” plan in place by July 2019 as part of the implementation of the FSMA rules. Mr M. Mikhail (FAO) defined the issues there were around agricultural frauds and food security which can be conflicting. Often if the production/sale of sub-standard agro-chemicals (pesticides, fertilisers) seeds & animal feeds is blocked this can in the short-term leads to issues of food supply. The mis-representation of pesticides and/or fertilisers can be a major issue with the substitution of either under-strength or worse un-approved materials being sold to farmers. This is perceived to be a major issue in Asia in general. He highlighted the normal problems he had seen such as mis-labelling of fish species, organic foods, and undeclared use of water binding agents in meat, plus the use of non-approved additivesMr M Musumeci (Unicri) This organisation tracks and blocks the trade and sale of counterfeit goods. They use the same approaches that the DEA and other drugs related agencies do to track and bloke the trade in these fake goods. It has been noted that some drugs cartels are now handing this type of thing as they expand diversify their business models!Looked at the flow of fake materials out of China, Thailand Etc into a. Morocco, Spain and then EU in

generalb. Italy and EU c. Spain direct & EUOften goods split, and parts are sent in many small consignments to various addresses where materials assembled & sold on through organised crime-based retail outlets (Italy).Crime groups then use illicit profits to invest in legit business which can assist in the flow of fake goods (textiles, sunglasses, jewellery), including logistic companies to hide the transactions of goods. The meeting then went on to look at issues that the various participants had faced in their countries.

Seen issues with re-dated out of date foods, brand factories were counterfeit products were prepared for internal sale and local export to surrounding countries.

JORDANMany issues with brand mis-representation counterfeit products, if found goods destroyed and the value of goods lost carried by importer/agent. Cases are taken up with brand owner and action taken if support from them to protect the brand items. Had issues with canned tuna, tea from Ceylon packed in Jordan!!, out of date and poor-quality rice (filth), Maggi gravy cubes. The second day covered mostly case stories from the industry side together with more instances from Governments.The first presentation was given by the president of ApimondiaMr P J McCabe described his organisation, which represents the interest of world bee keepers. He also described how the technical side of the organisation works through specific committees. Looked at the issues there are in the field at present with price pressure from a. Falling bee numbersb. Imports of unripe honey from

China to EU and the USc. Exports of fake honey from China

and other areasd. Manuka honey sales being 10

times higher than production figures from New Zealand

Looked at the methods for controlling the issue 13C-IRMS and more recent 1H-NMR screening.Dr D A Hammond looked at the issues there had been around the world with the production and sale of fake juices and the legal actions various countries had taken to try and stamp this out. Described some of the methods used in the detection of fake juices. Mr J Allen looked at the issues faced by Coke around the world with brand fraud and the steps that the organisation needs to take to protect all its brands. This mainly looked at Cola although other beverage products were also mentioned.

Mr D Al Zahran looked at the issues faced by Unilever in the MENA area. This covered production in country of counterfeit products to the importation of fake products from China and other areas into the MENA region. The group has a team both regionally and globally to control the issues. This also involves use of intelligence to block the exportation of fake products from China or importation into the Mean region by co-operation with local Governments. Finally looked at Customs issues in Jordan.Here as highlighted in other countries issues with counterfeit products imported and exported. Had issues with out of date Maggi from Egypt that was re-dated and imported to Jordan. Fake production of Strepsils in country but had no support from brand owner on this one so no follow up action. Also had issues with cigarettes coming into the country without filters that were sent separately to hide the issue. Also had issues with out of date coffee and consignments of seeds described as “cardamom” which were not. Country uses intelligence to try and block imports and extensively use x-ray at ports but hard on small border crossings and to x-ray everything so intelligence is critical to know “where and when to look”. Mr L. Veglia (ICQRF) in Italy looked at how the importation of fake goods is handled in Europe. Many routes used by organised crime via northern Africa into Spain and or Italy using gangs in those countries to facilitate the trade. This is a major issue for the EU due to the free movement of goods once cleared at the point of entry. The unit often follow goods internally to collect the chain involved in the action. The final half day was dedicated to local projects aimed at the region and there was a round table group of small teams to look at best practice and how it could be handled better in the MENA region.

LYONS, FRANCE NOVEMBER 2018Following the Jordan conference, the Lyon gathering intended to look at progress made so far in combatting the trade in fraudulent goods,

including food and in particular juice. Future operations were also outlined building on the success of previous activities.

The IFU presentation covered the following topics• How to check for authenticity of

juices• IFU methods and how they can

be used• International and local standards

for juices. • The definition of juices, nectars

and raw materials• Examples of authenticity

problems• The role of other organisations

such as the SGF A number of national authorities and multinational companies presented information on their own experiences, investigations and outcomes. An example was given on the conversion of Brazilian orange juice concentrate into Italian orange juice. Apart from the juice industry other product categories discussed were organic (presented by the EU), coffee, honey and chocolate. In the case of one famous chocolate bar a factory had been built with the sole purpose of making counterfeit chocolate bars using replica equipment, which was constructed so well the company bought it to make their branded product. Mr Mykhail Malkov from the FAO presented on the trade of false pesticides. In one country it was estimated that the 26% of the pesticide supply was considered to be unofficial. The use of fraudulent seeds was also shown to be a problem. The advice was to always know your supplier. Our co-operation will continue in 2019

SGF International e.V. (SGF) and International Fruit and Vegetable Juice Association (IFU) are holding a fourth edition of the SGF-IFU Road Show in conjunction with the European Fruit Juice Association (AIJN), after the successful tours 2016 (Latin America), 2017 (Asia) and 2018 (Africa). The SGF-IFU Road Show consists of five seminars for the juice industry that will be held in five different countries in Eastern Europe/Asia.

The objective of the Road Show is to get engaged with local juice producers and supporting companies in the country of the roadshow. It is a unique opportunity to share information with an audience that has not either had an event for a while or never had one in their country. Now in our fourth year we have used our expertise to make the events even better than before. This is a not for profit event so ticket prices are offered at an affordable level in the country to attract as many people as possible.
