CHIPPEWA COUNTY PLANNING & ZONING COMMITTEE NOTICE OF PUBLIC HEARING
STATE OF WISCONSIN PUBLIC NOTICE is hereby given to all persons in the County of Chippewa, Wisconsin, that a public hearing will be held on May 21st, 2015 beginning at 7:00 P.M. in Room 302, third floor of the Courthouse, Chippewa Falls, Wisconsin, relative to the following request: APPELLANTS: James & Janice Docksey
Location: Lot 1, CSM 4241, located in the NE/NW, Section 12, Township 29 North, Range 08 West, Town of Anson.
Conditional Use: To allow grading, filling and excavation on slopes of more than 35 percent and allow grading, filling and excavation in excess of 4,000 square feet on slopes less than 12% in accordance with sections 54-129(b)(1)a & 54-129(b)(1)c of the Chippewa County Shoreland Ordinance.
Specific information regarding this hearing can be obtained at the Chippewa County Department of Planning & Zoning. All persons interested are invited to attend said hearing and be heard.

Conditional Use Information – 2015-0010
1. Appellant Name: James & Janice Docksey, property owners. Mark Erickson, Kramer Land Design Studio project engineer. Lloyd Stunkel, Natural Touch Landscaping.
2. Conditional Use Permit: To allow filling/grading/excavation on slopes of more than 35% and in excess of 4,000 square feet on slopes less than 12% for stump removal and leveling. Submitted plans also identify a 4 foot wide at-grade stairway to the water, firepit area with retaining walls, and a sitting bench area outside the scope of the original CUP permit. This CUP is being applied for to cover the area and activities not previously addressed by CUP 2014-0006.
3. Town Recommendation: The Town of Anson was notified of this request.
4. Recommendation For CUP: If granted, the following conditions should be considered by the Planning and Zoning Committee:
a. Activities allowed under the permit would be the after-the-fact filling/grading/excavation necessary to level the identified areas and for the proposed construction of a 4 foot wide at-grade stairway to the water, firepit area with retaining walls, and a sitting bench area based on the submitted plans and within the requirements of the Chippewa County Shoreland, Zoning, and Floodplain Ordinances. Actual building plan review and permitting are required separate of this CUP process.
1. Two areas adjacent the “existing asphalt pathway” will also be modified with construction of diversion berms and small catchment basins. Those features shall also be included with this CUP.
b. Only the stairway construction is permitted within the 75 foot shoreland setback per Section 54-126(a).
c. Erosion control fencing must be installed along the downslope edge of any disturbed area and at the bank of the shaded/disturbed area. Depending on site disturbance or precipitation, additional fencing may be required. Planning & Zoning Department personnel shall be called once the fencing is installed and prior to removal of fencing to verify vegetation is reestablished.
d. Any breach or failure in the silt fencing may require a reapplication or modification to this CUP if the total disturbed area on-site substantially increases beyond the area that is identified in the plans.
e. Proposed site development (i.e. retaining walls, sitting bench, …) must be located above the Regional Floodplain Elevation of 903’ MSL. The submitted plan identifies the base of the hill at approxiamtely 912’ MSL.
f. Unless otherwise shown or specified, erosion control measures shall comply with the WDNR "Stormwater Management Technical Standards" (available on the WDNR web site at dnr.wi.gov/topic/stormwater/standards/const_standards.html). Depending on site disturbance or precipitation additional erosion control measures may be required.
1. Revise the plans as site conditions change during construction and improve the plans if current BMP’s are not effectively controlling erosion and sediment. The revised plans require Planning and Zoning department review.
g. Downspouts or drainage ways shall be temporarily directed away from any disturbed area until vegetation is permanently established.

h. No vegetation removal outside the 30 foot corridor is permitted within 35 feet of the river and all site development within 35 feet is required to occur with the 30 foot corridor (i.e. stairways to water, docks/piers, boathouses).
i. When final slopes are established and properly seeded and/or erosion control mat placed, Planning & Zoning Department personnel shall be called for final inspection. Once vegetation is completely established and the site inspected, Planning and Zoning will issue written approval to remove silt fencing. Silt fence must remain in place and in good working order until such time as the approval for removal is issued.
1. Additional topsoil may be required by the department to improve soil growing conditions on the steep, rocky slope.
j. Failure to maintain erosion control measures (i.e. silt fence, drainage ways, straw bales, culverts) on-site shall be considered a violation and enforcement action(s) per section 54-31 of the Chippewa County Shoreland Ordinance will apply. A stop work order will be issued until the erosion is controlled and/or cleaned-up.
k. This permit, if granted, does not supersede any permitting required by any other jurisdiction (i.e. WI DNR, USACE.).
l. Any other conditions that the Committee feels necessary in order to protect the site.
