PUBLIC NOTICE

In pursuance of Rule 158 of the Haryana School Education Rules 2003,

amended from time to time, all the private recognized schools (affiliated to BOSE or any

other Board) in the State of Haryana are directed to submit Form-VI online upto 31-12-2017

into their login provided to them for online students admission on MIS Portal i.e.

hryedumis.gov.in. or through a link available to this effect on the official website

www.schooleducationharyana.gov.in. It is made clear that Form VI submitted at DEO/DEEO

level will be treated as non submission of Form VI.

In the event, the school fails to submit From- VI online to the Directorate, the

appropriate departmental action under relevant rules would be initiated against the school and

fees structure as provided in Form-VI for 2017-18 would remain in force. All such schools

are further directed not to charge any fees/funds from the students in excess which are not

permissible under Haryana School Education Act, 1995 and Rules framed thereunder.

4. That the letter dated 10.01.2017 an. order of 600 MT was placed with the Mill for supply of paper.

The Board received a reply dated 18th Jan 2017 from Mill wherein they have regretted the delay in supply of paper due to non-arrival of their Engineers from abroad, further requesting the Board to make alternate arrangements for purchase of paper and that non supply of paper may be covered under Force Majeure clause of the said agreement.

5. As per during this period the record, this Mill supplied 3800.767 MT of paper to NCERT New Delhi, which shows that this Mill as per the version of the Board deliberately did not supply any paper to the Board thus putting the Board in a embarrassing situation resulting in delayed publication of text book and further resulting in late supply of text book.

The Facts Of the case are:- .That M/s Katyayini Paper Mills Pvt. Ltd Village Kuddiyawala near Sodhi Farm, Jaspur Kashipur Road, Kashipur (U.S. Nagar) Uttrakhand.through its GM (Marketing) (hereinafter) referred to as Supplier-Mill on the one part and the Secretary, PSEB, PhVIII SAS Nagar (Mohali) Punjab. (hereinafter) referred to as the Board on the other part entered into an Agreement on 30.12.2016 at its Head Quarter at W. Nagar, Mohali, Punjab for the supply of 3500 MT White Maplitho PrintiniTaper with' Water Mark of Board's Insignia in 75 GSM Maplitho Paper Duly ISI Marked BIS 1848/2007 Type-A in Sheets/ reels and as per general technical requirements. That the rate as approved ,by DGS & D ,with the Supplier-mills was Rs 46,936/- per MT for supply of paper in financial year 2017-18. As mentioned in clause,`4 of the agreement, the rates were fixed as per the norms of DGS & D fOr the> supply of printing paper and the schedule was

6. As per record, the Board issued a show cause .notice (Letter No. 55 dated -25-04-2017) to the Mill for non-supply of 3500 Metric ton of printing paper. Mill sent its reply to the show cause notice on 03-05-2017, in which, it has admitted its refusal to abide by the Agreement dated 30-12-2016.

7. The Mill filed Writ Petition in Hon'ble High Court of Delhi at New Delhi.

the Hon'ble Court vide its order dated 26th May, 2017 observed as under:-

"In the meantime, it is directed that in case the respondent No. 2 seeks to black list the petitioner, the petitioner shall be issued a show cause notice and provided an,opportunity of being heard".

8. In wake of above orders of the Hon'ble High Court. A fresh Show Cause Notice dated 28.8.2017 was issued to the Mill as to explain its wilful •

. evading from the Agreement thereby breaching the contract causing financial losses as well as loss of reputation to the Board besides loss of study of the students of Punjab due to non-supply of text books.

'In reply to show cause notice dated 16.09.2017, Mill have mentioned that in view of the terms of Clause 5.4 of DGS & D -1001, the supply order dated January 12, 2017 was not ,accepted by them and they had informed about their inability to supply the paper. They at no stage requeste e

Board to revise the delivery sOhedule. Moreover, the Board had no time to re-schedule as the academic session of the students which were to start from April and they were to be supplied text book'Sin April, 2017 by all means.

The reply to Show,Canse Notice, therefore, was found unsatisfactory. The G.M of the Mill was further given opportunity of Personal hearing in compliance of the orders of the Hon'ble High Court as stated above vide

office letter dated 16.10.20J7. Mr. Bhuvnesh Varsane_ appeared before me on behalf of the Mill.

During personal hearing representative from the Mill told the Board that the • ,, -

Board sent a letter regarding return of CD containing water mark of Board Insignia before the last date of supply schedule for printing paper i.e.10.4.2017. As a result mill could not supply the printing paper. But as per office record, the said letter was sent by e-mail on 11.04.2017 (letter no. 1891 dated 11.04.2017) that is after the last date of supply period fixed as per agreement. The affidavit regarding return of CD by Mill was signed on 18.04.2017and attested by notary on 19.04.2017. Thus the affidavit and CD

were submitted on or after 19.04.2017. 9. That the Representative of the Mill told the Board Authorities that no

revised schedule was issued by the Board in lieu o previous schedule for supply of printing paper. The Mill representative was asked to indicate whether, they have met the Board authorities personally in this matter. He admitted that they have never met Board authorities to set the re-schedule

• for supply of printing paper. 10. That the Mill representative could not reply satisfactorily regarding supply

of 3880:767 M.T printing paper to N.C.E.R.T New Delhi between December

2016 to May 2017. 11.That the Mill representative also told the Board authorities about the Messrs

Fiber Marx Papers Private Limited., Kashipur (Uttralchand) and Messrs Setia

Ind. Ltd., Rupana (Muktsar) (Punjab), who had not got timely payment of . maplitho printing paper supplied to the Board. The Board told the mill

representative that they were wrongly informed, and on the basis of wrong information they had not supplied printing paper to the Board. Whereas, Board always make timely payment of printing paper supplied by the mills.

12.In compliance of the orders of the Hon'ble High Court Delhi, further relying upon clause no. 12 of the agreement and based upon the material facts on record. I am convinced that the Mill has failed to supply the paper by 10-04-2017 that is by due date fixed as per agreement and hence I black list M/s Katyayini Paper Mills Pvt. Ltd Village Kuddiyawala near Sodhi Farm, Jaspur Kashipur Road, Kashipur (U.S. Nagar) Uttrakhand.

Note: Terms and Conditions:-

1. The candidates (above) would be entitled for benefits of promotion i.e. pay and seniority w.e.f. 10.2.2014 notionally and actually from the date of joining duty on post of Headmaster. It is also clarified that the service on post of Lecturer would be considered as 'ex cadre service' and pay fixation would be done in accordance to Master cadre pay scale as submission of fresh option before Hon'ble High Court in their concerned writ petition regarding promotion. However, the present candidates would not be eligible to claim the benefits of service rendered by them as Lecturer.

2. If the integrity of the promotee is found doubtful, he would be reverted without giving any notice.

3. The inter-se-seniority of the promotee is subject to the claim of their seniors, who have not been promoted in this order due to unknown/various reasons.

4. If any official/master is found senior to the above candidates at any stage due to rectification in seniority, the junior promotee shall be reverted without giving any notice or opportunity of personal hearing.

5. If at any stage, it is found that any official has been promoted in these orders inadvertently who was otherwise actually not fit or eligible for promotion or he has concealed true facts of his service, he would be reverted to feeder cadre post without any notice.

6. That these promotions are subject to the condition that all the particulars and data supplied by the concerned candidates and by the field offices are correct. Eventually, it is found that information is found factually incorrect, erroneous or misrepresented, the promotion so granted shall be withdrawn forthwith without affording any further opportunity.

7. That if the seniority of any official is fixed later on in accordance with the instructions contained in Govt. letter No. 22/73/92-3GS-III, dated 14.10.1999, he/she would be entitled to seniority accordingly.

8. That the candidates would remain on probation for a period of one year from the date of joining on promotional post i.e. Headmaster which may be extended, if there service is not found satisfactory as under service rules.

9. That after joining at the school allotted herein, the candidate shall proceed on a School Leadership Training Programme to bc_imparted through Teacher Education Institutions controlled by the SCERT, Haryana. The detail programme in this respect would be communicated by the SCERT, Haryana.

10. That the District Education Officer concerned shall personally ensure the following:-

(a) That these promotion orders are being issued'against vacant post. The Headmaster so promoted is advised to report in the Directorate through the concerned District Education Officer if he finds that the post against which he is appointed is not vacant then he be adjusted at some other place.

(b) That the Headmaster is not being posted at any Urban Area by default or any oversight on the part of Directorate.

(c) That these promotions are subject to the condition that there is no adverse remark pertaining to integrity in the ACRs of the candidate/employee.

(d) That the concerned District Education Officers will not allow the promotee to join duties if any complaint/enquiry under Rule-7 of the Haryana Civil Services (Punishment & Appeal) Rules-1987 is found pending against him/her.

Note: Terms and Conditions:-

1. The candidates (above) will be entitled for benefits of promotion i.e. pay and seniority w.e.f. 10.2.2014 notionally and actually from the date of joining duty as Headmaster. It is also clarified that the service as Lecturer would be considered as ex cadre service and pay fixation would be done in accordance to Master cadre pay scale. It is further clarified that due to submission of fresh option before Hon'ble High Court in their concerned writ petition regarding promotion, the present candidates would not be eligible to claim the benefits of service rendered by them as Lecturer.

2. If the integrity of the promotee is found doubtful he would be reverted without giving any notice.

3. The inter-se-seniority of the promotee is subject to the claim of their seniors, who have not been promoted in this order due to unknown/various reasons.

4. If any official/master is found senior to the above candidates at any stage due to rectification in seniority, the junior most promotee shall be reverted without giving any notice or opportunity of personal hearing.

5. If at any stage, it is found that any official has been promoted in these orders inadvertently who was otherwise actually not eligible for promotion or he has concealed true facts of his service, he would be reverted to feeder cadre post without any notice.

6. That these promotions are subject to the condition that all the particulars and data supplied by the concerned candidates and by the field offices are correct. Eventually, it is found that information is found factually incorrect, erroneous or misrepresented, the promotion so granted shall be withdrawn forthwith without affording any further opportunity.

7. That if the seniority of any official is fixed later on in accordance with the instructions contained in Govt. letter No. 22/73/92-3 GS-III, dated 14.10.1999, he/she will be reverted without any notice.

8. That the candidates would remain on probation for a period of one year from the date of joining on promotional post i.e. Headmaster which may be extended, if there service is not found satisfactory as under service rules.

9. That after joining at the school allotted herein, the candidate shall proceed on a School Leadership Training Programme to ,13-6 imparted through Teacher Education Institutions controlled by the SCERT, Haryana. The detail programme in this respect would be communicated by the SCERT, Haryana.

10. That the District Education Officer concerned shall personally ensure the following:-

(a) That these promotion orders are being issued against vacant post. The Headmaster so promoted is advised to report in the Directorate through the concerned District Education Officer if he finds that the post against which he is being appointed is not found vacant then he be adjusted at some other place.

(b) That the Headmaster is not being posted at any urban place by default or any oversight on the part of Directorate.

(c) That these promotions are subject to the condition that there is no adverse remark pertaining to integrity in the ACRs of the newly promoted Headmaster.

(d) That the concerned District Education Officers will not allow the promotee to join duties if any complaint/enquiry under Rule-7 of the Haryana Civil Services (Punishment & Appeal) Rules-1987 is found pending against it.
