(a) the steps taken by the Government to bring Pakistanis backfrom Libya due to the recent civil war in the said country; and

Will the Minister for Inter Provincial Coordination be pleased to state:

(a) whether it is a fact that the provinces had been empowered totake steps for power generation after the Constitution18th Amendment; if so, the steps taken by the FederalGovernment to facilitate the provinces in this regard;

(b) whether it is also a fact that Federal Government has failed tofacilitate the provinces to enhance the ceiling of their loans andto ensure their drawing power, besides sovereign guarantees ofthe Federal Government;

(c) if the answers to part (a) and (b) above are in the affirmative,the steps being taken to remove such anomalies to give autonomyto the provinces in true spirit?

Minister for Inter Provincial Coordination (Mr. Riaz HussainPirzada): (a) Prior to the Constitution (Eighteenth) Amendment Act, 2010, the

subject of Electricity was on the Concurrent Legislative List. On omission of thesaid List, the subject stood transferred to Part-II of the Federal Legislative List.However, the said 18th Amendment has kept the provisions of Article 157(2)consciously intact so that the powers of the Provinces before the 18th amendmentare not affected and the Provinces continue to contribute towards promotion ofenergy sector (Annex-I).

Electricity as a subject falls in the purview of the Council of CommonInterests (CCI) and the CCI in its meeting held on 28-04-2011 considered theSummary submitted by the Government of the Punjab on “Dispute arising fromthe interpretation of Article 157 of the Constitution by the Federation &appropriate amendment in the policy for power generation projects 2002 soas to bring it in line with the letter and spirit of the said Article” and approvedthe interpretation of Article 157 as explained in the Summary by the PunjabGovernment (Annex-II). It was, however, decided that amendments if required,in NEPRA Act etc. shall be finalized by Secretary, Ministry of Water & Power,Chairman, NEPRA and representatives of Provincial Governments.

As such, in terms of interpretation of Article 157 (2), the government of aprovince can construct power houses and grid stations and lay transmissionlines for use within the Province, according to their requirements themselvesor through an agency as well.

Further, the CCI in its meeting held on July 31, 2013 has approved theNational Energy (Power) Policy, 2013-2018 (Annex-III).

(b) The matter regarding sovereign guarantees of the Federal Governmentrelates to Finance Division/National Economic Council. However, the CCI in itsmeeting held on 10th February, 2014 has decided that the Finance Division willconvey Sovereign Guarantee for Thar Coal Mining Project. The Council alsodecided that this facility will be extended to all provinces for similar Coal basedprojects (Annex-IV).

(c) Article 157 (3) of the Constitution provides that “in case of anydispute between the Federal Government and a Provincial Government in respectof any matter under this Article, any of the said Governments may move the Councilof Common Interests for resolution of the dispute”.

120. *Dr. Mahreen Razaque Bhutto:(Deferred during 15th Session)

Will the Minister for Textile Industry be pleased to state the stepsbeing taken by the Government to improve the production of cottonin the country?

Minister for Textile Industry (Mr. Abbas Khan Afridi): Thegovernment has taken the following steps to improve the production of cotton inthe country:

• Efforts are made to ensure availability of certified / approved classof seed to farmer in a timely manner.

• The germination standard of the available seed was fixed at 75%instead of previously approved 50% to lessen the loss of farmers onthis account.

• 21 new varieties of cotton (including Bt cotton) were approved byNBC.

• Area under cultivation of cotton has been improved from 2.767 millionhectare to 2.861 million hectare despite flood losses of about 86000hectare.

• Number of steps have been taken to strengthen the premier CottonResearch Organization i.e. PCCC to enable the scientists to producenew better varieties of cotton.

• Government has fixed intervention price at Rs. 3000 per 40 Kgs forseed cotton phutti. This will save the farmers from any possible lossdue to price fluctuation. This step will encourage the farmers tocultivate more cotton in future.

• Due to above stated steps, the reports shows that all parameters ofcotton crop are significantly better than the last year.

• The overall cotton production is estimated as 13.5395 million ascompared to 12 million bales produced in the last year.

(a) the number of Trade Officers working in Pakistan Consulatesand Embassies abroad alongwith country-wise detail thereof;and

(b) the prescribed criteria and procedure for the appointment of thesaid officers?

Minister for Commerce (Engr. Khurram Dastigir Khan): (a) Presently48 trade officers are working in Pakistan Trade Missions abroad. Country wisedetail is placed at Annex-I.

(b) As per criteria approved by the Prime Minister in 2005, followingsteps are involved in the selection of Commercial Counsellors in Pakistan trademissions abroad:—

i. Advertisement in newspaper.ii. Written test by Testing Organization.iii. Interview by Special Selection Board.iv. Approval of the Prime Minister.

63. *Dr. Nafisa Shah:

Will the Minister for Foreign Affairs be pleased to state:

(a) whether the policy to allow hundreds of acres land to ArabPrinces for hunting of the houbara bustard is being reviewed;

(b) if not, the benefits accrued to Pakistan therefrom; and

(c) whether those Arab countries allow the same facility toPakistanis?

Minister for Foreign Affairs : (a) The policy of issuance of huntingpermits to the Arab dignitaries is reviewed every year by the Government.

Meanwhile, hunting permits are issued on receipt of requests fromrespective embassies and after approval of the Prime Minister.

(b) Most of these dignitaries have taken keen interest in the developmentof the areas allocated to them.

(c) There is no practice of hunting of Houbara Bustard in the Gulf States.

64. *Dr. Nafisa Shah:

Will the Minister for Textile Industry be pleased to state whether it isa fact that a number of textile units have been closed down due toreduction in gas quota; if so, the remedial measures taken by theGovernment in this regard?

Minister for Textile Industry (Mr. Abbas Khan Afridi): It is observedthat the units are working as per routine but due to Load-shedding of gas andpower failures a few units temporarily stopped their production. After resumptionof the gas and the power these units the production activity is resumed there is noreport of closure due to reduction of Gas quota. However, it impacts the viabilityof industry production due to low main hour utilization for which industry isprotesting. In this connection the government has taken following measures tohelp the industry

Ministry of Water & Power and Ministry of Petroleum & NaturalResources have been requested by MinTex to ensure availability of power and

gas to the Textile Industry which is export-based and has to meet the demands ofInternational Supply commitments in time. Furthermore, the Prime Ministerconstituted a committee headed by the Finance Minister with Minister for Petroleum& Gas and Textile Minister as its members for solution of such problem. MinTexhad various meetings with the quarters concerned for uninterrupted supply of Gasand electricity to the textile units.

Will the Minister for Overseas Pakistanis and Human ResourceDevelopment be pleased to state the mechanism evolved throughwhich the Ministry liaises with Pakistani Embassies/Missions to solvethe issues of Pakistanis living abroad?

Minister for Overseas Pakistanis and Human ResourceDevelopment (Pir Syed Sadaruddin Shah Rashidi): There are 19 CommunityWelfare Offices have been established in 16 Pakistan Mission in 14 countrieshaving sizeable concentration of Pakistani community. These offices maintain closeliaison with Pakistani community as well as authorities of the host country to resolvetheir issues and problems. (b) whether there is any proposal under consideration of theGovernment to conduct an inquiry to probe such disbursement;if so, the details thereof alongwith the steps being taken by theGovernment against the persons responsible therefor?

Minister for Inter-Provincial Coordination (Mr. Riaz HusainPirzada): (a) Ministry of Inter Provincial Coordination /Pakistan Sports Boarddid not release any grant to Pakistan Olympic Association (led by Mr. AkramSahi) till todate. However, money was released in the year 2012-13 for organizingof Sports event.

Minister for Overseas Pakistanis and Human ResourceDevelopment (Pir Syed Sadaruddin Shah Rashidi): (a) The mandate of thisMinistry is only to export manpower for overseas employment purpose. The totalnumber of Pakistanis sent/registered for employment abroad during the period2013 and 2014 is 1,255,056.

Pakistani emigrants proceed abroad through licenced overseasemployment promoters (OEPs), Overseas Employment Corporation (OEC) anddirect employment visa on the demand and criteria fixed by the foreign employer.

(b) The selection of workers for employment abroad is carried out bythe foreign employers themselves or through their representatives in the country.

Minister for Commerce (Engr. Khurram Dastigir Khan):(a) The totalquantity of wheat exported during the year 2013-14 was 20,037 M.T and foreignexchange earned by exporting wheat was US$ 7 million and in the first quarter ofcurrent financial year 2014-15 (July-September) only 27 MT of wheat has beenexported and foreign exchange earned is US$ 10,000.

(b) The name of countries to whom wheat was exported in year 2013-14is placed at Annex-A.

Will the Minister for Foreign Affairs be pleased to state the stepsbeing taken by the Government on diplomatic front regarding recentkillings of Pakistani citizens as a result of firing by India on the borderalongwith the outcome thereof, so far?

Minister for Foreign Affairs: Pakistan has shown restraint andresponding to India’s acts of aggression, resulting in the loss of 14 innocent lives.Director General Military Operations (DGMO) contacted his Indian counterpartto devise ways and means for de-escalation. However, his efforts were coldshouldered. Prime Minister, chairing a high level meeting of the National SecurityCouncil (NSC) regretted the unprovoked ceasefire violations in total disregard ofthe auspicious occasion of Eid-ul-Azha.

2. Our leadership has reached out to the global community in an effortto highlight Indian intransigence and belligerence. Advisor to the Prime Minister onForeign Affairs and National Security, Mr. Sartaj Aziz in his telephonic conversationwith the UNSG, urged him to use his good offices for resolution of all outstandingdisputes between the two countries, including the core issue of Jammu and Kashmir.At the same time, Pakistani envoys in different capitals around the world haveraised the issue of ceasefire violations by India with their interlocutors and expressedPakistan’s desire for a peaceful and stable neighborhood.

3. Steps taken by the Foreign Office at the diplomatic front arehighlighted as follows:

• Protest Lodged with the Indian Deputy High Commissioner byDirector General South Asia & SAARC on 6 October, ProtestNote sent (Annex - B).

• Spokesperson’s Statement condemning Indian Violation of Ceasefire6 October, (Annex - C).

• Adviser to the Prime Minister on National Security & Foreign Affairs’Statement expressing concern over continued ceasefire violationsby the Indian Security Forces - 7 October, (Annex - D).

The Adviser instatement, highlighting the Indian acts of belligerence, and the effortstaken by the Ministry Foreign Affairs in response.

• Issued instructions to our missions abroad to take up the matter ofceasefire violations by India with their interlocutors, insisting India todeescalate in the light of 2003 Ceasefire Agreement.

Outcome

4. The Ministry brought into international focus the hostile acts of Indianforces, impressing upon the need to strengthen the existing mandate of UnitedNations Military Observer Group for India and Pakistan (UNMOGIP) given to itby UN Security Council. We also stressed upon UN to carry out impartial inquiryinto the incidents of ceasefire violations through UNMOGIP.

5. Furhtermore, the steps taken by the Ministry of Foreign Affairsinternationally projecting the Indian belligerence, demonstrated by intense,unprovoked and indiscriminate firing and shelling, resulted in the cessation ofceasefire violations and had a sobering effect on the Indian government.

6. Our efforts also culminated in putting the ceasefire violations intoperspective and effectively countered the Indian media’s propaganda that ceasefireviolations originated from Pakistan.

i. Capital Administration and Development Division (CADD) hasestablished a field hospital at DHQ Bannu with 50-55 Doctors /Para-medical Staff managed by PIMS from FGPC and NIRM,Islamabad.

ii. Agency Surgeon office shifted in FR Bannu for provision of healthservices to TDPs.

iii. Five Mobile Health Units provided for TDPs at Bannu.

iv. Free medical services extended to the TDPs residing with the hostfamilies.

v. BHU established at Bakka Khel Camp. The detail is placed atAnnexure-I.

(b) Education Sector:

To provide Education facilities in camps Two High Schools (01 Male &01 Female) have been established in the TDPs Camp Bakka Khel FR Bannu.Boys High School contains 1492 students enrolment wherein 23 male teachershave been posted. Whereas Girls High School has 542 students enrolments and10 Female teachers have been deployed in the Female school. All the studentshave been provided Text Books Free of Cost. Minister for Commerce (Engr. Khurram Dastagir Khan): (a) Ministryof Commerce announced its Trade Policy 2012-15 on January 31st, 2013. Oneof the goals was to increase Pakistan’s cumulative exports to $95 billion during2012-15. No sector-wise break ups were announced.

(b) Since there were no sector-wise targets set, hence no targets wereachieved. But the exports of textile sector have grown in 2013-14 as compared tothe year 2012-13 by 5.3%. The data is placed at Annex-A.

Minister for Inter-Provincial Coordination (Mr. Riaz HusainPirzada): The Government is committed to provide maximum possible financialinfrastructure and administrative support to the National Sports Federations forpromotion of their respective games. The government through Pakistan SportsBoard is providing financial assistance to the affiliated National Sports Federationsin the shape of annual grants to meet their day-to-day requirements and specialgrants for participation in international competitions at home and abroad. PakistanSports Board also bears the expense on preparation and participation of Pakistancontingents in Olympic Games, Asian Games, Commonwealth Games, South AsianGames, Islamic Men & Women Games as well as other mega sports events.The following are the principal areas through which efforts are being made toimprove the standard of sports in the country:—

(a) Holding of National Training Camps for I preparation and participationin mega events like Olympic, Asian, Commonwealth, South Asianand Islamic Games with standard facilities.

(b) Organize coaching and training courses for coaches in different partof the country to update the knowledge and methodology of coachingof the participating coaches.

(c) Expenses on participation in Olympic, Asian, Commonwealth, SouthAsian, Islamic and other Regional Games are borne by the PSB.

(g) PSB organizes Inter Board tournaments every year to promote thesports at school and college level.

(h) Inter Provincial games will be organized by PSB at Islamabad during2015 in which sports teams from the provinces as well as AJK,Gilgit Baltistan and FATA would participate. The position holderswill he awarded lucrative awards to encourage the potential of theathletes.

Hence, Export of fish and its products has increased in FY 2013-14 insteadof decreasing when compared with FY 2012-13.

(b) During FY 2012-13, export earnings from fish and its products weremillion US$ 317.65 whereas export earnings from fish and its products in FY2013-14 were million US$ 369.46.

It is therefore, not correct that US$ 23.2 million foreign exchange hasbeen earned, rather US$ 369.46 million has been earned during 2013-2014.

It is pertinent to mention that the Government has taken a number of stepsto improve fisheries sector, which, inter-alia, include strengthening of extensionservices, introduction of aquaculture techniques, diversification of fishing efforts,improvement in post-harvest techniques, development of value added products,and up-gradation of socio-economic condition of the fishermen’s community.

Minister for States and Frontier Regions [Lt. Gen. (Retd) AbdulQuadir Baloch]: (a) Due to the Operation Zarb-e-Azab in NWA a total of 121,597families have been dislocated. NADRA has verified 74,368 families. The detail isplaced at Annexure-I.

(b) Each NADRA verified family is being provided following facilities:

i. Federal Government is providing a monthly Cash Assistance @Rs. 12,000/-.

ii. Rs. 5000/- Non Food Items (NFI Kits) one time.

iii. Ramazan Package @ Rs. 20000/- per family was provided.

iv. A camp for TDPs has been established at Bakka Khel FR Bannu toaccommodate 3000 families. The facilities provided at the TDPsCamp are as placed at Annexure-II. At present it has over 19000individuals.

(c) Federal Government has released Rs.5119.630/- Million for paymentof cash grant and allied expenditures of North TDPs.

(d) “Payment of cash assistance to North TDPs is electronically madethrough ZONG and no ATM card issued.”

• 19 Community Welfare Attaches in 14 manpower-importing countriesmake constant efforts to enhance export of manpower.

• Ministry issues licenses to the Overseas Employment Promoters whomake all possible efforts to obtain manpower demands especiallyfrom private sector of manpower importing countries.

• Ministry also tries to get manpower demands from foreign countries(generally from public sector) through Overseas EmploymentCorporation.

Minister for Foreign Affairs: (a) Pakistani nationals living abroad areissued passports by our missions in accordance with rules /regulations without anydelay. All efforts are made to facilitate the Pakistani community. In cases whereverification of particulars of the applicant are required from different agencies inPakistan, the process takes a little longer that causes delay. Such delays normallyoccur due to incomplete information provided by the applicant. Pakistan Missionsabroad also facilitate issuance of CNIC/NICOP, for which applications are alsoreceived and forwarded to the NADRA office in Islamabad. Since these cards

(b) Pakistan Missions abroad are issued instructions from time to timeto extend all possible assistance to Pakistani Community in issuance of passportsand NADRA cards to them without loss of any time.

The Government of Pakistan has already introduced issuance of the MRP/NADRA facilities in some of our Missions while efforts are underway to extendthe facility to other Missions also.

——————————————————————————————Allegations/Charges: The Indian prisoners detained in Pakistan jails

are imprisoned for various allegations/offences such as Foreigners Act, Army Act,Pakistani Control of Entry Act, and Secret Act. Indian fishermen are imprisonedunder Foreigners act and fishery Act.

(c) Prisoners released by both countries were convicted/sentenced bythe courts of law and after expiry of the sentence were released. Details of themost offences under which they were convicted were; Foreigners Act, PassportAct, Official Secret Act, carrying Fake Indian currency notes (FICN), drugtrafficking, overstaying after visa expiry etc. Pakistani fishermen are convicted fortrespassing in the Indian territorial waters under M.Z.I. Act.

The Indian prisoners detained in Pakistani jails were also convicted by thecourts of law and offences under which they were convicted were Foreigners Act,Army Act, Pakistani Control of Entry Act, Secret Act, Indian fishermen areimprisoned under Foreigners Act and Fishery Act.

Majority of the Pakistani prisoners are deported after they complete thesentence awarded by the Courts. The prisoners so released/deported by the Saudiauthorities were convicted / sentenced by the court of law. Their details cannot beshared due to non-provision of the data by the Saudi Authorities.

Most prisoners repatriated to Pakistani are convicted or sentenced by theCourt of Law in the US.

(d) The practice being followed by Pakistan in case of Indian prisonersis that once the prisoners have served their jail term and their nationality status hasbeen confirmed by Indian authorities, they are released.

Majority of the Pakistani prisoners are deported after they complete aredeported after they complete the sentence awarded by the courts. The prisonersso released / deported by the Saudi Authorities were convicted/sentenced by thecourt of law. The details cannot be shared due to non provision of the data by theSaudi Authorities.

The majority of the prisoners were kept under detention during theprosecution of their cases in courts and were deported to Pakistan soon aftercompletion of their deportation documents. In the US a prisoner cannot be kept inprison for more than the sentenced period. Therefore, the prisoners are releasedor held up in the detention centers for deportation after completion of theirsentences.

(e) The Government of Pakistan has signed a Consular AccessAgreement with India in May, 2008. Some important points of bilateral Agreementare as follows:

i. Each Government shall maintain a comprehensive list of the nationalof the other country under its arrest, detention or imprisonment. Thelists shall be exchanged on 1st January and 1st July each year;

ii. Immediate notification of any arrest, detention or imprisonment ofany person of the other country shall be provided to the respectiveHigh Commission;

iii. Each Government shall provide consular access within three monthsto nationals of one country under arrest, detention or imprisonmentin other country;

iv. Both Governments agree to release and repatriate persons withinone month of confirmation of their national status and completion ofsentence.

There is no bilateral agreement between Saudi Arabia and Pakistan withregard to the release of the prisoners. The prisoners are released/deported eitheron completion of awarded sentences or acquittal by the Courts.

There is no bilateral agreement between the US and Pakistan for prisonersreleased. The prisoners are released upon completion of their sentences or trials.

Parents of late Abdul Waheed Shakir, in their application of March 2013,had contended that it was the responsibility of kafeel of their late son to get aniqama issued and get it registered with General Organization for Social Insurance(GOSI), after which claims could become admissible.

However, under Saudi laws, kafeel is responsible only if he does not getiqama issued or registered with GOSI within 90 days of the arrival of employee inthe Kingdom. Since late Abdul Waheed Shakir came to KSA on 16 May 2012and passed away on 30 July 2012, before expiry of the stipulated period, kafeelcannot be held responsible. Moreover, since late Shakir was working as an “Azad”employee in contravention of Saudi Labour Laws, legal heirs are not entitled toany insurance death compensation in Saudi Arabia.

However, UAE authorities have asked to providenames with passport number of each woman to proceed further in the matter.

(b) Since no such woman has reportedly been detained in any jail inUAE, this part of the question does not apply.

(a) whether dialogue has been held with India to resolve Kashmirissue during the last two years;

(b) if so, the details thereof alongwith the results achieved therefrom?

Minister for Foreign Affairs: (a) The last round of composite dialogueon Kashmir was held in New Delhi between the two Foreign Secretaries on4-5th July, 2012. Wherein, Pakistan reiterating its principled position on Kashmir,proposed a joint working group with a defined mandate to find an amicable solutionto the Kashmir dispute. We also, underscored the need for expanding travel andtrade across Line of Control (LoC) for Kashmiris on both sides.

The Prime Minister of Pakistan,Nawaz Sharif addressing the 69th Session of the United Nations General Assembly(UNGA) said that, “We cannot draw a veil over the issue of Kashmir, until it isaddressed in accordance with the wishes of the people of Jammu and Kashmir”.
