UNFINISHED BUSINESS - 09 MARCH 2015 REGULAR SESSION:

Committee Report Nr. LAWS-2014-004 1st Indorsement dated 18 November 2013 of the Office of City Mayor Hon. Mauricio G. Domogan, forwarding for information and appropriate action the Supplemental Memorandum of Agreement between the City Government of Baguio represented by Hon. City Mayor Mauricio G. Domogan and R & R Management and Sanitary Services represented by its General Manager, Ruperto V. Alvar, for the proposed putting up of comfort room at Block 4, Baguio City Public Market. The Committee on Laws recommends confirmation of the above stated Supplemental Memorandum of Agreement. (Item 3, 09 March 2015 Agenda)

    6.

Committee Report Nr. UPLH-2014-010 SECOND READING BEFORE PUBLICATION Proposed Ordinance Nr. PO 0038-14 authored by Hon. Leandro B. Yangot Jr. entitled, "Requiring all persons operating or doing business within the territorial jurisdiction of the City of Baguio for the mandatory submission of environmental sustainability action plan upon securing or renewing business and/or Mayor's permit and providing penalties for violations thereof."

(NOTE: [a] FIRST READING - 09 June Regular Session [Agenda Item Nr.78]; and [b] Rule IV, Sec. 2A of the Internal Rules of Procedures states "On second reading before publication of an ordinance shall be open for discussion, proposals and amendments to know whether or not the proposed ordinance will be approved before publication. Amendments may be allowed prior to publication.")

The Committee on Urban Planning, Lands and Housing recommends APPROVAL of the above proposed ordinance on SECOND READING BEFORE PUBLICATION.

Hon. Joel A. Alangsab, Member of the Committee, signified "clarifications on some issues". (Item 7, 09 March 2015 Agenda)

    7.

Committee Report Nr. PUTTL-2014-015 Letter dated 11 February 2014 of Hon. City Mayor Mauricio G. Domogan, furnishing a copy of the decision of the Traffic, Transportation and Management Committee (TTMC) denying the request of GL/LIZARDO TRANS and "A" TRANS and requesting that the denial be answered by a resolution from the August Body.

(NOTE: Attached to the letter are the following: [a] Res. No. 513, s. 2013, of Bontoc, Mountain Province entitled, "A resolution endorsing and supporting the citizen's and riding public's petition for the exemption of GL/LIZARDO Trans and "A" Trans in the implementation of the number coding ordinance of Baguio City."; [b] Resolution No. 99-2013, of Tadian, Mountain Province entitled, "A resolution endorsing and supporting the petition of the concerned riding public of Mountain Province for the exemption of GL/LIZARDO Trans and "A" Trans in the implementation of number coding ordinance of Baguio City."; [c] Resolution No. 52, series of 2013, of Besao, Mountain Province entitled, "Resolution strongly endorsing the petition of the people of Besao, Mountain Province to the City Mayor of Baguio City, Hon. Mauricio G. Domogan to kindly exempt the GL/LIZARDO Trans in the implementation of the number coding ordinance of Baguio City."; and [d] Resolution No. 106-2013, of Sagada, Mountain Province entitled, "Resolution endorsing to the Honorable Mayor of Baguio City, Mauricio G. Domogan, the petition of the people of Mountain Province to kindly exempt the GL/ LIZARDO Trans and A Trans in the implementation of the number coding ordinance within the central district of Baguio City.")

The Committee on Public Utilities, Transportation and Traffic Legislation reiterates its prior decision to maintain the recommendation of the TTMC denying the request of GL/Lizardo Trans and "A" Trans for an exemption from the Number Coding in the City of Baguio on the following grounds:

    a. If granted the same will be a precedent that can be used by other public utility buses and vans that we cannot deny that can result to the deflect of the purpose of our Number Coding Ordinance;

    b. That the companies (if ever it want its buses to ply the route on Number Coding days) are advised to pay the Passage Fee in the amount of One Thousand Pesos (P1,000.00) per unit per month to the City Treasurer's Office and to submit its vehicle license plate numbers as basis for evaluation.

Likewise, the observation of Hon. Fred L. Bagbagen that what is also involved here is the ambient quality of our air here in the City of Baguio should be given credence and it would also be tantamount to class legislation as observed by the Presiding Officer, the Hon. Vice Mayor Edison R. Bilog.

However, this is without prejudice to the filing of an amendment to the Number Coding Ordinance as pointed out by some of the City Council members.

As to the observation that exemptions are being given to buses in La Trinidad, although it does not mean that Baguio City, as an independent LGU with different conditions and situation should follow it, the Chair of the Committee, upon inquiry, found out that what is being given exemption is only one bus, the only bus plying a route so that applying the coding will deprive the commuters of one day service. (Item 8, 09 March 2015 Agenda)

    8.

Committee Report Nr. LAWS-2014-040 3rd Indorsement dated 17 July 2014 from the Office of the Honorable City Mayor Mauricio G. Domogan, forwarding to the Hon. Vice Mayor Edison R. Bilog, inviting attention to the advice of the Legal Office, for information and appropriate action on the 2nd Indorsement dated 16 July 2014 of Atty. Melchor Carlos R. Rabanes, OIC- City Legal Office, Re: Draft Memorandum of Agreement (MOA) on the Program to Grant the Sale of Rice on Credit between the National Food Authority and the City Government of Baguio.

The Committee on Laws recommends that a City Council Resolution be adopted to authorize the Hon. Mayor Mauricio G. Domogan, to enter into the above stated Memorandum of Agreement in behalf of the City Government. (Item 9, 09 March 2015 Agenda)

It has always been the position of the Committee on Laws that Resolutions may or may not be signed by the City Mayor considering that these Resolutions are used as vehicles for legislative action and to express the sentiment of the City Council on important public policy issues.

To put the matter into rest, the Committee on Laws recommends that the word "APPROVED" by the City Mayor, which appears in the final form of the Resolution, be changed to "NOTED" by the City Mayor. (Item 10, 09 March 2015 Agenda)
