New Developments in Employment Law and future reforms

We will cover:

The impact for HR professionals and employment lawyers ( if any) of the vote in the Referendum on Brexit. including TUPE, discrimination, working time.

Key developments and risks for employers in holiday calculations, holiday pay assessment and historical claims for holiday pay. This session will cover all key holiday pay issues including the impact of decisions for your businesses in Lock v British Gas Trading and others and Bear Scotland v Fulton. We will also look at the tricky issues, which often arise with holiday including holiday and sickness, part time work, and Working Time Regulations holiday contrasted with contractual holiday entitlement. We will use case studies to illustrate how holiday pay claims can be managed to minimise risk to your business including distinguishing between WTR holidays and contractual entitlements.

The National Living Wage – we will look at how this is calculated, who is entitled and the impact for employers.

Judicial review of employment tribunal fees and the compensation cap in tribunals – what is the current state of the law, following permission to appeal to the Supreme Court being granted to Unison and what developments can we expect? What impact have fees and the compensation cap had? The impact of devolution of Scottish Employment Tribunals. In April 2016, the government is introducing financial penalties for employers who fail to pay tribunal awards. We will look at the new regime and the impact. A brief general round up of the current costs, fees and penalties system in employment tribunals will be provided.

New rules are expected on postponements of tribunal hearings and we will look at how these operate in practice.

Equal Pay and the impact of Gender Pay Reporting obligations. We will look at the Regulations affecting all employers with more than 250 employees and the data which must be supplied - mean and median figures, quartiles, bonuses and commission.

The Posted Workers Directive is being amended giving employees who work for contractors enhanced rights to make claims in a chain of contractors. We will look at the impact for employers and how risks can be managed.

We will provide an update on the Modern Slavery Act reporting obligations and how these have impacted employers. What do you need to do?

Data protection

We will look at the recent European Court decision in Barbules cu v Romania – 61496/08 (2016) and how this impacts an employer’s right to examine an employee’s emails and data at work as well as the current state of the law for companies trying to export employment data to the US.

Rapid fire questions

Our traditional rapid fire time is your chance to ask any questions (which you can send anonymously in advance) on any employment issue – whether it is in our programme or not.

Redundancy/variation of contract

Most employers are constantly wanting to make changes to employment contracts to increase efficiencies and bring uniformity or save costs. We will work through an extended case study on a contract variation exercise where employment is terminated to achieve the change in contract terms i.e. a technical “redundancy situation” - both collective and individual. We will discuss what happens when employees try to elongate or thwart the process through stress absence and how this is best managed. We will discuss best practice for achieving employee buy in and tactics for achieving a variation to terms even though they are to the employees’ detriment. We will discuss the role of trade unions and employee representatives and how best to manage the collective as well as the individual side. We will also cover proposed potential changes to obligations on collective consultation in the UK. There will be a TUPE angle as part of the workforce recently transferred into the business and is claiming protection for their employment contract terms. Another section of the workforce may be outsourced as a costs savings exercise and there are some arguments about who is assigned to the outsourced part of the business.

Settlement Agreements and the death of the £30,000 tax free exemption

We will look at current best practice on settlement agreements and how to draft them. We will analyse a case study where an employer is trying to persuade a poor performing employee to enter into a settlement agreement and the tactics which may be applied. We will cover the changes to tax on termination payments and also the tax treatment of personal injury, holiday and ex gratia payments and how the new regime works.

Case study – Managing poor performance

The case study will contrast using performance improvement plans, warnings and informal processes in an effort to achieve a speedy settlement. What tactics will you apply, running meetings, scripts, grievances and outcomes?

Adam Hartley has in depth experience of employment issues arising in the financial services sector and, in particular, the insurance sector. In particular, Adam’s capabilities include advising and managing international restructures as well as solving employee disputes, injunctions and other high court employment matters both in the UK and throughout Europe. As well as representing financial services clients, Adam also acts for a number of clients in the recruitment, medical, technology and retail sectors. Adam has a masters in Human Resources Management and his dissertation focused on the Acquired Rights Directive/TUPE.

Jonathan and Mary are both senior practising employment lawyers and advise major UK and international employers on all aspects of employment law, contentious and non-contentious. CLARE COLLEGE

Clare College is the second oldest of Cambridge’s thirty-one colleges (its foundation having been anticipated, among surviving institutions, only by Peterhouse).

It was founded in 1326, and generously endowed a few years later by Lady Elizabeth de Clare (Lady de Burgh), a granddaughter of King Edward I (1272-1307). In 1336 King Edward III (1327-77) granted licence ‘to his cousin Elizabeth de Burgo’ to establish a collegium (the word originally meant ‘a corporation of scholars’, not, as in modern English ‘college’, the buildings in which the scholars were housed); although it was in the first instance referred to unspecifically as ‘the House of the University of Cambridge’, it became known as Clare Hall as early as 1339 (the present simplified title, ‘Clare’, dates from 1856).

The college boasts 17th century architecture, stunning gardens and a convenient location in central Cambridge, either side of the River Cam.

YOUR STAY AT CLARE COLLEGE

All meals and accommodation are included in the price of the Summer School. Accommodation will be provided in ensuite rooms. These are student rooms so although they are spotlessly clean they are student accommodation so rooms are quite basic. All rooms have towels (bath and hand), bedlinen, a welcome pack (containing shampoo, soap etc), and tea and coffee making facilities. All bedrooms have wireless and wired connections, the meeting rooms are wireless. The Wi-Fi Network is a ticket per user service, we will provide you with a ticket on arrival.

Most of our meals will be taken in the college’s magnificent great hall which is an experience in itself.

Car ParkingThe college has an arrangement with a nearby sports ground where cars can be parked. There is a charge each day and these spaces need to be booked in advance so please contact us if you wish to book one. We can confirm the price and invoice you when booking a place.

We will send full travel details with the joining instructions nearer the time which will include car parks close by and city maps.

Social ProgrammeThe social programme gives you the chance to meet and network with fellow delegates which, from our experience, is a hugely important part of this kind of course.
