120 Act 2003-24 LAWS OF PENNSYLVANIA No. 2003-24 AN ACT SB 8 Amending Titles 18 (Crimes and Offenses), 42 (Judiciary and Judicial Procedure) and 75 (Vehicles) of the Pennsylvania Consolidated Statutes, further providing for impairment due to alcohol or controlled substances, for Department of Transportation records and for investigation by police officers; further providing for procurement; and making editorial changes. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Sections 6105(c)(3) and 7508.1(b) and (c) of Title 18 of the Pennsylvania Consolidated Statutes are amended to read: § 6105. Persons not to possess, use, manufacture, control, sell or transfer firearms. *** (c) Other persons.—In addition to any person who has been convicted of any offense listed under subsection (b), the following persons shall be subject to the prohibition of subsection (a): (3) A person who has been convicted of driving under the influence of alcohol or controlled substance as provided in 75 Pa.C.S. § [3731] 3802 (relating to driving under influence of alcohol or controlled substance) or the former 75 Pa.C.S. § 3731, on three or more separate occasions within a five-year period. For the purposes of this paragraph only, the prohibition of subsection (a) shall only apply to transfers or purchases of firearms after the third conviction. § 7508.1. Substance Abuse Education and Demand Reduction Fund. (b) Imposition.—Unless the court finds that undue hardship would result, a mandatory cost of $100, which shall be in addition to any other costs imposed pursuant to statutory authority, shall automatically be assessed on any individual convicted, adjudicated delinquent or granted Accelerated Rehabilitative Disposition or any individual who pleads guilty or nob contendere for a violation of the act of April 14, 1972 (P.L.233, No.64), known as The Controlled Substance, Drug, Device and Cosmetic Act, or a violation of 75 Pa.C.S. § [3731] 3802 (relating to driving under influence of alcohol or controlled substance). (c) Additional assessment.—In addition to the assessment required by subsection (b), a person convicted of or adjudicated delinquent for a violation of 75 Pa.C.S. § [3731] 3802 shall be assessed $200 where the amount of alcohol by weight in the blood of the person is equal to or greater than [.15% 1 0.16% at the time a chemical test is performed on a sample of

AmendingTitles 18 (CrimesandOffenses),42 (JudiciaryandJudicialProcedure)and75 (Vehicles)of the PennsylvaniaConsolidatedStatutes,further providingfor impairment due to alcohol or controlled substances,for DepartmentofTransportationrecordsandfor investigationby police officers;further providingfor procurement;andmakingeditorialchanges.

The GeneralAssemblyof the Commonwealthof Pennsylvaniaherebyenactsasfollows:

Section 1. Sections6105(c)(3)and7508.1(b)and(c) of Title 18 of thePennsylvaniaConsolidatedStatutesareamendedto read:§ 6105. Personsnot to possess,use,manufacture,control,sell or transfer

firearms.***

(c) Otherpersons.—Inaddition to anypersonwhohasbeenconvictedofany offense listed under subsection(b), the following personsshall besubjectto theprohibitionof subsection(a):

(3) A personwho hasbeenconvictedof driving underthe influenceof alcohol or controlledsubstanceas provided in 75 Pa.C.S.§ [3731]3802 (relating to driving under influence of alcohol or controlledsubstance)or the former 75 Pa.C.S.§ 3731, on threeor moreseparateoccasionswithin a five-year period. For the purposesof this paragraphonly, the prohibition of subsection(a) shall only apply to transfersorpurchasesof firearmsafter thethird conviction.

§ 7508.1. SubstanceAbuseEducationandDemandReductionFund.

(b) Imposition.—Unlessthe court finds that unduehardshipwouldresult,a mandatorycostof $100,which shall be in addition to anyothercosts imposed pursuant to statutory authority, shall automatically beassessedon any individual convicted, adjudicateddelinquent or grantedAcceleratedRehabilitativeDispositionor any individual who pleadsguiltyor nob contenderefor a violation of the act of April 14, 1972 (P.L.233,No.64),known as The ControlledSubstance,Drug, Device andCosmeticAct, or a violation of 75 Pa.C.S.§ [3731] 3802 (relatingto driving underinfluenceof alcoholor controlledsubstance).

(c) Additional assessment.—Inaddition to the assessmentrequiredbysubsection(b), a person convicted of or adjudicateddelinquent for aviolation of 75 Pa.C.S.§ [3731] 3802 shall be assessed$200 where theamountof alcoholby weightin theblood of thepersonis equalto or greaterthan[.15%1 0.16% at the time achemicaltestis performedon a sampleof

theperson’sbreath,blood or urine. For thepurposesof this subsection,thesampleof the person’sblood, breath or urine shall be taken within twohoursafter thepersonis placedunderarrest.

Section2. Sections7513 and7514of Title 18 arerepealed.Section 3. Sections933(a)(l)(ii), 15l5(a)(5), 1725.3(a), 3571(b)(4),

3573(b)(3),7002(b)and7003(5)of Title42 areamendedto read:§ 933. Appealsfrom governmentagencies.

(a) Generalrule.—Exceptas otherwiseprescribedby any generalruleadoptedpursuantto section503 (relatingto reassignmentof matters),eachcourtof commonpleasshall havejurisdictionof appealsfrom final ordersofgovernmentagenciesin thefollowing cases:

(1) Appealsfrom Commonwealthagenciesin thefollowing cases:

(ii) Determinationsof the Department of Transportationappealableunder the following provisions of Title 75 (relating tovehicles):

Section 1377 (relatingtojudicial review).Section 1550(relatingtojudicial review).Section4724(b)(relating to judicial review).Section7303(b)(relating to judicial review).Section7503(b)(relatingto judicial review).

Exceptas otherwiseprescribedby generalrules, thevenueshallbeinthe county of the principal place of businessof any salvor ormessengerservice,thelocationof anyinspectionstationinvolved, thecountywhere the arrestfor a violation of 75 Pa.C.S.§ [3731] 3802(relating todriving underinfluenceof alcoholor controlledsubstance)was madein appealsinvolving the suspensionof operatingprivilegesunder75 Pa.C.S.§ 1547 (relating to chemicaltesting to determineamountof alcohol or controlled substance)or the residenceof anyindividual appellantwherethe venueis not otherwisefixed by thissentence.In the caseof a nonresidentindividual venue, exceptasotherwiseprescribedby generalrules, shallbe in the countyin whichthe offense giving rise to the recall, cancellation,suspensionorrevocationof operatingprivilegesoccurred.

§ 1515. Jurisdictionandvenue.(a) Jurisdiction.—Exceptas otherwise prescribedby general rule

adoptedpursuantto section 503 (relating to reassignmentof matters),district justices shall, under proceduresprescribedby generalrule, havejurisdiction ofall of thefollowing matters:

(5) Offensesunder 75 Pa.C.S.§ (37311 3802 (relating to drivingunder influence of alcohol or controlled substance),if the followingcriteriaaremet:

(i) The offenseis the first offenseby the defendantundersuchprovisionin this Commonwealth.

(ii) No personal injury (other than to the defendant[or theimmediatefamily of thedefendant])resultedfrom theoffense.

(iii) Thedefendantpleadsguilty.(iv) No property damagein excessof $500 other than to the

defendant’spropertyresultedfrom theviolation.(v) The defendantis not subject to the provisionsof Chapter63

(relatingto juvenilematters).(vi) Thearrestingauthorityshallcauseto betransmittedacopyof

the chargeof any violation of 75 Pa.C.S.§ [3731] 3802 to the officeof the clerk of the court of common pleaswithin five daysafter thepreliminaryarraignment.

In determiningthat the above criteria aremet the district justice shallrely on thecertificationof thearrestingauthority.Certificationthat thecriteria are met need not be in writing. Within ten days after thedisposition,thedistrictjusticeshall certify thedispositionto the office ofthe clerkof thecourt of commonpleasin writing.

§ 1725.3. Criminal laboratoryuserfee.(a) Imposition.—A personwho is placedon probationwithout verdict

pursuantto section17 of theactof April 14, 1972 (P.L.233,No.64),knownas The Controlled Substance,Drug, Device and CosmeticAct, or whoreceivesAcceleratedRehabilitativeDispositionor who pleadsguilty to ornob contendereto or whois convictedof a crimeas defmedin 18 Pa.C.S.§ 106 (relating to classesof offenses)or 75 Pa.C.S.§ [3731] 1543(b)(1.1)(relating to driving whileoperatingprivilegeis suspendedor revoked) or3802 (relatingto driving underinfluenceof alcoholor controlledsubstance)or 3735 (relating to homicideby vehiclewhile driving underinfluence)or3735.1 (relating to aggravatedassaultwhile driving underthe influence)or 3808(a)(2) (relating to illegally operatinga motorvehiclenot equippedwith ignition interlock) or a violation of TheControlledSubstance,Drug,Device andCosmeticAct shall, in addition to any fines, penaltiesor costs,in everycasewherelaboratoryserviceswererequiredto prosecutethe crimeor violation, besentencedto payacriminal laboratoryuserfeewhich shallinclude, but not be limited to, thecostof sendingalaboratorytechniciantocourtproceedings.

§ 3571. Commonwealthportionof fines,etc.

(b) Vehicleoffenses.—

(4) Whenprosecutionunder75 Pa.C.S.§ [3731] 3802 (relating todriving under influenceof alcoholor controlledsubstance)is the resultof StatePoliceaction,50% of all fines, forfeited recognizancesandother

forfeitures imposed, lost or forfeited shall be payable to theCommonwealth,for credit to the Motor LicenseFund,and50%shallbepayableto the countywhichshallbefurtherdividedas follows:

(1) Fifty percentof the moneysreceivedshall be allocatedto theappropriatecountyauthoritywhich implementsthe countydrug andalcoholprogramto beusedsolely for thepurposesof aiding programspromoting drug abuse and alcoholism prevention, education,treatment and research. [Programs under this subparagraphinclude Project DARE (Drug and Alcohol ResistanceEducation).]

(ii) Fifty percent of the moneys received shall be used forexpenditures incurred for county jails, prisons, workhousesanddetentioncenters.

§ 3573. Municipal corporationportionof fmes,etc.

(b) Vehicleoffenses.—

(3) When prosecutionunder75 Pa.C.S.§ [3731] 3802 (relating todriving underinfluenceof alcoholor controlledsubstance)is the resultof local policeaction,50%of all fines,forfeited recognizancesandotherforfeituresimposed,lost or forfeited shall be payableto the municipalcorporationunderwhichthelocal policeareorganized,and50% shallbepayableto thecountywhich shallbefurtherdividedasfollows:

(i) Fifty percentof the moneysreceivedshall be allocatedto theappropriatecounty authority which implementsthe county drug andalcoholprogramto beusedsolelyfor thepurposesof aiding programspromoting drug abuse and alcoholism prevention, education,treatment and research. [Programs under this subparagraphinclude Project DARE (Drug and Alcohol ResistanceEducation).]

(ii) Fifty percent of the moneys received shall be used forexpenditures incurred for county jails. prisons, workhousesanddetention centers. -

§ 7002. Ignition interlock systemsfor driving under the influence;

(b) Second or subsequent offense.—In addition to any otherrequirementsimposedby the court, wherea personhasbeenconvictedof asecondor subsequentviolation of 75 Pa.C.S.§ 3731,the court shall orderthe installation of an approvedignition interlock device on each motorvehicleownedby thepersonto beeffective upontherestorationof operatingprivilegesby thedepartment.A recordshall besubmittedto thedepartmentwhenthecourthasorderedtheinstallationof anapprovedinterlcck’igaitiondevice. Before the departmentmay restore such person’s operatingprivilege, thedepartmentmustreceiveacertificationfrom thecourtthattheignition interlock system has been installed. If a secondor subsequent

violation of 75 Pa.C.S.§ 3731 occursafter September30, 2003,a court’sfailure to enter an order in compliancewith this subsectionshall notpreventthe departmentfrom requiring, and the departmentshall require,the personto install an approvedignition interlock devicein accordancewith this chapter.

§ 7003. Additional driver’s licenserestorationrequirements.In addition to anyotherrequirementsestablishedfor the restorationof a

person’s operating privileges under 75 Pa.C.S. § 1548 (relating torequirementsfor driving underinfluenceoffenders):

[(5) A person whoseoperating privilege is suspendedfor a secondor subsequentviolation of 75 Pa.C.S.§ 3731 or a similar out-of-Stateoffensewho doesnot apply for an ignition interlock restricted licenseshall not be eligible to apply for the restoration of operatingprivileges for an additional year after otherwise being eligible forrestoration under paragraph (1).]Section4. Chapter 70 of Title 42 is repealed.Section 5. Section 9763(c)of Title 42 is amendedto read:

§ 9763. Sentenceof intermediatepunishment.

(c) Restriction.—(1) A defendant[convicted under] subjectto 75 Pa.C.S.§ [3731(e)

(relating to driving under influence of alcohol or controlledsubstance)]3804 (relating to penalties) may only be sentencedtointermediatepunishment:

[(1) in a residential inpatient program or in a residentialrehabilitative center; or

(2) by housearrest or electronic surveillance combinedwith drugand alcohol treatment.]

(i) for afirst, secondor third offenseunder 75 Pa.C.S.Ch. 38(relating to driving after imbibingalcoholor utilizing drugs); and

(ii) after undergoingan assessmentunder 75 Pa.C.S. § 3814(relating to drugandalcoholassessments).(2) lIthe defendantis determinedto be in needofdrugandalcohol

treatment, the defendant may only be sentencedto intermediatepunishment which includes participation in drug and alcoholtreatment under 75 Pa.C.S. § 3815(c) (relating to mandatorysentencing).Such treatmentmay be combinedwith housearrest withelectronicsurveillanceor apartialconfinementprogram suchasworkrelease,a work campora halfwayfacility.

(3) If the defendantis determinednot to be in needof drug andalcohol treatment, the defendant may only be sentenced tointermediatepunishmentby:’

(i) house2arrestor electronicsurveillance;(ii) partial confinementprogramssuchas work release,work

campsandhalfwayfacilities; or(iii) any combination of the programs set forth in this

subsection.

Section6. Section9804(b)(3)of Title42 is amendedandthe subsectionis amendedby addingparagraphsto read:§ 9804. Countyintermediatepunishmentprograms.

(b) Eligibility.—

[(3) Any person receiving a penalty imposed pursuant to 75Pa.C.S. § 1543(b) (relating to driving while operating privilege issuspendedor revoked) or 3731(e) (relating to driving under-influenceof alcohol or controlled substance) may only be sentenced tointermediate punishmentprogram in:

(i) a residential inpatient program or a residentialrehabilitative center;

(ii) house arrest and electronic surveillance combined withdrug and alcohol treatment; or

(iii) partial confinement programs, suchaswork release,workcamps and halfway facilities, combined with drug and alcoholtreatment.](4) (i) Any person receivinga penalty imposedpursuant to 75Pa.C.S.§ 1543(b) (relating to driving while operatingprivilege issuspendedor revoked),3804 (relating to penalties) or 3808(a)(2)(relating to illegally operatinga motor vehicle not equippedwithignition interlock) shall undergoan assessmentunder75 Pa.C.S.§ 3814 (relatingto drugandalcoholassessments).

(ii) If the defendantis determinedto be in needof drug andalcohol treatment, a sentence to intermediate punishment shallinclude participation in drug and alcohol treatment under 75Pa.C.S. § 3815(c) (relating to mandatory sentencing). Suchtreatment may be combinedwith house arrest with electronicsurveillanceorapartialconfinementprogramsuchaswork release,a workcampora halfwayfacility.

(A) housearrestandelectronicsurveillance;(B) partial confinementprogramssuch aswork release,work

campsandhalfwayfacilities; or(C) any combination of the programs set forth in this

paragraph.(5) A defendantsubjectto 75 Pa.C.S.§ 3804 (relating topenalties)

may only be sentencedto intermediatepunishmentfor afirst, secondor third offenseunder 75 Pa.C.S.Cli. 38 (relating to driving afterimbibingalcoholor utilizing drugs).Section 7. Sections15 16(c) and (d) and 1532(b)(3) of Title 75 are

amendedto read:§ 1516. Departmentrecords.

(c) Dismissalof chargesfor violations.—Ifa chargefor violation of anyof the provisionsof this title againstany personis dismissedwhere therehavebeenno prior convictionsby any court of competentjurisdiction,norecordof thechargeanddismissalshall beincludedin thedriving recordofthe person.If the personhasbeenpreviouslyconvictedof the chargeandsuspensionwas imposedby the department.which suspensionwas eitherpartiallyor fully served,thedepartmentmaykeeparecordof theoffenseforthe purposeof showingthe suspensionwas imposedagainstthe person~.],but the offense shall not be usedfor the purpose of calculating therequisitenumberofoffensesundersection1542 (relating to revocationofhabitual offender’s license).In addition, the department may keep recordsof chargesthat havebeenfiled with the courts in order to determineaperson’seligibility for aprobationarylicenseundertheprovisionsof section1554(b)(3) (relating to probationary license). All records maintainedpursuantto thissubsectionshall bemaintainedfor administrative-andlawenforcementuseonlyandshall notbereleasedforanyotherpurpose.

(d) Updating driving record.—Driverswishing to have their recordreviewedby the departmentmay makesuch a requestin order that therecord be brought up to date. lii updating records, the departmentshallinclude recalculation of suspension or revocation segmentsand theassignmentandcreditingofanysuspensionor revocationtimepreviouslyassignedor credited toward a suspensionor revocationwhich resultedfrom a conviction which has been vacated,overturned, dismissedorwithdrawn. Anyfully or partially servedsuspensionor revocation timemay only be reassignedor credited toward a suspensionor revocationsegmentprocessedon the driver’s recordas of theactual commencementdateofthefully orpartially servedsuspensionor revocationtime.§ 1532. Suspensionofoperatingprivilege.

(b) Suspension.—

(3) The departmentshall suspendthe operating privilege of anydriver for 12 monthsupon receivinga certified record of the driver’sconviction of section [3731 (relating to driving under influence ofalcohol or controlled substance) or] 3733 (relating to fleeing orattemptingto eludepoliceofflcer)~,] ora substantiallysimilar [offenses]offense reported to the departmentunder Article III of section 1581(relating to Driver’s License Compact), or an adjudication ofdelinquencybased on section [3731 or] 3733. The departmentshallsuspendthe operating privilege of any driver for six months uponreceivinga certifiedrecordof a consentdecreegrantedunder42 Pa.C.S.Ch.63 (relating tojuvenilematters)basedon section[3731 or] 3733.

Section 8. Section 1534(b)of Title 75 is amendedand the section isamendedby addingsubsectionsto read:§ 1534. Noticeof acceptanceof AcceleratedRehabilitativeDisposition.

(b) Exception.—Ifa personis arrestedfor any offenseenumeratedinsection [3731] 3802 (relating to driving under influence of alcohol orcontrolledsubstance)andis offeredandacceptsAcceleratedRehabilitativeDisposition under general rules, the court shall promptly notify thedepartment.The departmentshall maintain arecord of the acceptanceofAcceleratedRehabilitativeDispositionfor aperiodof [seven]ten yearsfromthe date of notification. This record shall not be expungedby order ofcourt~.]orprior to the expiration of the ten-yearperiod.

(c) Expungement.—Immediatelyfollowing the expiration of the ten-yearperiod, the departmentshall expungethe recordof the acceptance-ofAcceleratedRehabilitativeDisposition. The departmentshall not requirean orderof courtto expungethe record.

(d) Exceptions to expungement.—Thedepartment shall not berequired to expunge the record of acceptance of AcceleratedRehabilitativeDisposition4f:

(1) during the ten-year period, the department revokes theoperatingprivilegesof a person pursuantto section1542 (relating torevocationof habitualoffender’s license);or

(2) the personwasa commercialdriver at the time of the violationcausing the disposition.Section 9. Sections1539(c), 1541(a.l),(c) and (d), 1542(b), 1543(b)

and1545 of Title 75 areamendedto read:§ 1539. Suspensionof operatingprivilegeon accumulationof points.

(c) Determinationof subsequentsuspensions.—Everysuspensionandrevocation under any provision of this subchaptershall be counted indetermining whether a suspension is a second, third or subsequent

suspension.Acceptanceof AccelerativeRehabilitativeDisposition for anoffenseenumeratedin section 1532 (relatingto revocationor suspensionofoperatingprivilege)or3802(relating to driving under influenceofalcoholor controlledsubstance)shallbe consideredasuspensionin making suchdetermination.

§ 1541. Periodof disqualification,revocationor suspensionof operatingprivilege.

(a.1) Credit toward serving period of suspension for certainviolations.—Credittoward serving the period of suspensionor revocationimposedfor sections[3731 (relating to driving under influence of alcoholor controlled substance),] 1543(b)(1.1) (relating to driving whileoperatingprivilegeis suspendedorrevoked),3732 (relating to homicidebyvehicle), 3735 (relating to homicideby vehicle while driving under theinfluence) [and], 3735.1 (relating to aggravatedassaultby vehiclewhiledriving underthe influence), 3802 (relating to driving underinfluenceofalcohol or controlled substance) and 3808(a)(2) (relating to illegallyoperatinga motor vehiclenot equippedwith ignition interlock) shall notcommenceuntil thedateof theperson’sreleasefrom prison.

(c) Restorationof revoked operating privilege.—Any personwhoseoperatingprivilege hasbeenrevokedpursuantto section 1542 (relating torevocation of habitual offender’s license) or 1543 [(relating to drivingwhile operating privilege is suspendedor revoked)] is not entitled toautomaticrestorationof the operatingprivilege.Such personmayapply fora learner’spermit, if permittedunder the provisionsof this chapter,uponexpirationof therevocation.

(d) Continuedsuspensionof operatingprivilege.—Adefendantorderedby thecourt undersection[1548] 3816(relatingto requirementsfor drivingunder influence offenders),as the result of a conviction or AcceleratedRehabilitative Disposition of a violation of section [3731 (relating todriving under influence of alcohol or controlled substance)]3802, toattenda treatmentprogramfor alcoholor drug addictionmustsuccessfullycompleteall requirementsof the treatmentprogramorderedby the courtbefore the defendant’soperatingprivilege may be restored.Successfulcompletion of a treatmentprogram includes the paymentof all court-imposedfinesandcosts,as well asfeesto bepaid to thetreatmentprogramby the defendant. If a defendant fails to successfullycomplete therequirementsof a treatmentprogram,the suspensionshallremain in effectuntil the defendantcompletesthe program and is otherwiseeligible forrestoration of his operating privilege. The treatment agency shallunmediatelynotify the court of successful completion of the treatmentprogram. The final decisionas to whethera defendanthas successfullycompletedthetreatmentprogramrestswith thecourt.

§ 1542. Revocationof habitualoffender’slicense.

(b) Offensesenumerated.—Threeconvictionsarisingfrom separateactsof anyoneor moreof the following offensescommittedby anypersonshallresultin suchpersonbeingdesignatedasahabitualoffender:

(1) Any violation of SubchapterB of Chapter37 (relating to serioustraffic offenses).

(1.1) Any violation of Chapter38 (relating to driving after imbibingalcohol or utilizing drugs) exceptfor sections3808(a)(1) and (b)(relating to illegally operating a motor vehicle not equippedwithignition interlock) and 3809 (relating to restriction on alcoholicbeverages).

(1.2) Anyviolation ofsection1543(b)(1 .1) (relatingto driving whileoperatingprivilege issuspendedor revoked).

(2) Any violation of section3367 (relating to racingon highways).(3) Any violation of section 3742 (relating to accidentsinvolving

deathor personalinjury).(3.1) Any violation of section3742.1 (relatingto accidentsinvolving

deathor personalinjury whilenot properlylicensed).(4) Any violation of section 3743 (relating to accidentsinvolving

damageto attendedvehicleor property).

§ 1543. Driving whileoperatingprivilege is suspendedor revoked.

(b) Certainoffenses.—(1) A personwho drivesamotor vehicleon a highwayor trafficway

of thisCommonwealthat atimewhenthe person’soperatingprivilege is -

suspendedor revoked as a condition of acceptanceof AcceleratedRehabilitativeDispositionfor aviolation of section[3731] 3802 (relatingto driving under influence of alcohol or controlled substance)or theformer section 3731, becauseof a violation of section 1547(b)(1)(relating to suspensionfor refusal) or 13731] 3802 or formersection3731 or is suspendedundersection 1581 (relating to Driver’s LicenseCompact) for an offensesubstantiallysimilar to a violation of section[3731] 3802 orformersection3731 shall, uponconviction,be guilty ofasummaryoffenseandshall besentencedto payafine of [$1,000]$500andto undergoimprisonmentfor a period of not less than [90] 60 daysnormore than90days.

(1.1) (i) A personwho hasan amountof alcohol by weight in hisblood thatis equalto or greaterthan.02%at the time of testingor [isunder the influence of a controlled substanceas definedin section1603 (relating to definitions)] who at the timeof testinghas in hisbloodany amountofa ScheduleI or nonprescribedScheduleII orIII controlled substance,asdefined in the act of April 14, 1972(P.L.233, No.64), known as The Controlled Substance, Drug,

Deviceand CosmeticAct, or its metaboliteand whodrivesa motorvehicleon anyhighwayor trafficwayof this Commonwealthat atimewhen the person’soperatingprivilege is suspendedor revokedas aconditionof acceptanceof AcceleratedRehabilitativeDispositionfora violation of section [3731] 3802 orformer section3731 or becauseof aviolation of section 1547(b)(1)or [3731] 3802 orformer section3731 or is suspendedunder section 1581 for an offensesubstantiallysimilar to aviolation of section [3731] 3802 orformer section3731shall,uponafirst conviction,be guiltyof asununaryoffenseandshallbe sentencedto pay a tineof $1,000andto undergoimprisonmentforaperiod of not lessthan90 days.

(ii) A second violation of this paragraphshall constitute amisdemeanorof the third degree,and upon conviction thereof thepersonshall be sentencedto pay a fine of $2,500and to undergoimprisonmentfor not lessthansix months.

(iii) A third or subsequentviolation of this paragraphshallconstitutea misdemeanorof the first degree,and upon convictionthereofthe personshallbe sentencedto paya fine of $5,000andtoundergoimprisonmentfor notlessthantwo years.(2) This subsectionshall apply to any personagainstwhom one of

thesesuspensionshas been imposedwhether the person is currentlyservingthis suspensionor whetherthe effectivedateof suspensionhasbeen deferredunderanyof the provisionsof section 1544 (relating toadditionalperiod of revocationor suspension).This provisionshallalsoapply until the person has had the operating privilege restored.Thissubsectionshallalsoapplyto anyrevocationimposedpursuanttosection-1542 (relating to revocationof habitualoffender’slicense)if anyof theenumeratedoffenseswasfor aviolation of section[3731] 3802orformersection3731or for anout-of-Stateoffensethat is substantiallysimilar toa violation of section [3731] 3802 or former section3731,for which arevocationis imposedundersection 1581.

§ 1545. Restorationof operatingprivilege.Upon therestorationof anyperson’soperatingprivilegewhich hasbeen

suspendedor revokedpursuantto this subchapteror pursuantto Chapter38 (relating to driving after imbibing alcohol or utilizing drugs), suchperson’srecord shall show five points, except that any additional pointsassessedagainstthe personsincethe date of the lastviolation resulting inthe suspensionor revocationshall beaddedto suchfive pointsunlessthepersonhasservedan additionalperiodof suspensionor revocationpursuantto section 1544(a) (relating to additional period of revocation orsuspension).This section shall not apply to section 1533 (relating tosuspensionof operatingprivilege for failure to respondto citation) or to 18Pa.C.S.§ 6310.4(relatingto restrictionof operatingprivileges).

Section9.1. Section 1547(a),(b)(1) and (2), (c), (d), (e) and(i) of Title75 areamendedandthesectionis amendedby addinga subsectionto read:§ 1547. Chemical testing to determineamount of alcohol or controlled

substance. -

(a) Generalrule.—Any person who drives, operatesor is in actualphysical control of the movement of a [motor] vehicle in thisCommonwealthshall be deemedto have given consentto one or morechemicaltestsof breath,bloodor urine for the purposeof determiningthealcoholic contentof blood or the presenceof a controlled substanceif apolice officer hasreasonablegroundsto believe the person to havebeendriving, operatingor in actual physical control of the movementof a[motor] vehicle:

(1) [while under the influence of alcohol or a controlled substanceor both] in violation of section1543(b)(1.1)(relating to driving whileoperatingprivilege is suspendedor revoked),3802 (relating to drivingunder influence of alcohol or controlled substance) or 3808(a)(2)(relating to illegally operating a motor vehicle not equippedwithignition interlock); or

(2) which was involved in an accidentin which the operatororpassengerof any vehicleinvolved or apedestrianrequiredtreatmentat-amedicalfacility or waskilled.(b) Suspensionfor refusal.—

(1) If any personplacedunderarrestfor a violation of section [3731(relating to driving under influence of alcohol or controlledsubstance)]3802 is requestedto submitto chemicaltestingandrefusesto do so, the testing shall not be conductedbut upon notice by the policeofficer, the department shall suspendthe operating privilege of theperson [for a period of 12 months.] asfollows:

(i) Exceptas setforth in subparagraph(ii), for a periodof12months.

(ii) Foraperiodof18 months41anyof the followingapply:(A) The person’soperatingprivileges have previouslybeen

suspendedunderthissubsection.(B) Thepersonhas,prior to the refusalunder thisparagraph,

beensentencedfor:(I) an offenseundersection3802;(II) an offenseunderformersection3731;(111) an offenseequivalent to an offenseundersubclause

(I) or (II); or(IV) a combinationof theoffensessetforth in thisclause.

(2) It shallbethedutyof thepoliceofficer to inform thepersonthat:• (i) theperson’soperatingprivilegewill besuspendedupon refusalto submittochemicaltesting~.];and

(ii) upon conviction, plea or adjudication of delinquency forviolating section3802(a),the personwill be subjectto the penaltiesprovidedin section3804(c)(relating to penalties).

(b.1) Othersuspensionfor refusal.—(1) if anyperson placed under arrest for a violation of section

1543(b)(1.1)or 3808(a)(2) is requestedto submit to chemicaltestingand refusesto do so, the testing shall not be conducted; but, uponnotice by the police officer and providedno suspensionis imposedpursuantto subsection(b), the departmentshall suspendthe operatingprivilegeofthe personfor aperiodofsix months.

(2) It shall be the dutyof the police officer to inform the personthat the person’soperatingprivilegeswill besuspendedupon refusaltosubmitto chemicaltesting.

(3) Notwithstandingsection3805(c) (relating to ignition interlock),if anypersonreceivesa suspensionpursuantto this subsectionwho atthe time ofthe offensewas required to complywith the provisionsofsection3805 prior to obtaining a replacementlicense under section1951(d) (relating to driver’s licenseandlearner’s license)thatdoesnotcontain an ignition interlock restriction, the suspension imposedpursuantto this subsectionshall result in the recall of any ignitioninterlock restricted license previously issued and the driver shallsurrender the ignition interlock restrictedlicense to the departmentorits agentsdesignatedunderthe authority of section1540 (relating tosurrender of licenses) and, prior to the issuanceof a replacementlicense under section 1951(d) that does not contain an ignitioninterlock restriction, the department shall require that the personcomplywith theprovisionsofsection3805.(c) Testresultsadmissiblein evidence.—Inanysummaryproceedingor

criminal proceedingin which the defendantis chargedwith a violation ofsection [3731] 3802 or any other violation of this title arising out of thesame action, the amount of alcohol or controlled substancein thedefendant’sblood, as shown by chemical testing of the person’sbreath,blood or urine, which tests were conductedby qualified personsusingapprovedequipment,shallbeadmissiblein evidence.

(1) Chemicaltestsof breathshall beperformedon devicesapprovedby the Departmentof Health using proceduresprescribedjointly byregulationsof the Departmentsof Health andTransportation.Devicesshallhavebeencalibratedandtestedfor accuracywithin aperiodof timeand in a mannerspecifiedby regulationsof the Departmentsof Healthand Transportation.For purposesof breathtesting, a qualified personmeansa personwhohasfulfilled the training requirementin the useofthe equipmentin a training programapprovedby the DepartmentsofHealth andTransportation.A certificateor log showing that a devicewas calibratedandtestedfor accuracyandthat the devicewas accurate

shall be presumptiveevidence of those facts in every proceedinginwhichaviolation of this title is charged.

(2) (i) Chemicaltestsof blood or urine, if conductedby a facilitylocated in this Commonwealth, shall be performed by a clinicallaboratorylicensedandapprovedby theDepartmentof Health-forthispurpose using procedures and equipment prescribed by theDepartmentof Health or by a PennsylvaniaState Police criminal

• laboratory.For purposesof blood andurine testing,qualified personmeansan individual who is authorizedto perform those chemicaltestsunder theactof September26, 1951 (P.L.1539,No.389),knownas TheClinical LaboratoryAct.

(ii) For purposesof bloodand urine testingto determinebloodalcohol or controlled substancecontent levels,the proceduresandequipment prescribed by the Department of Health shall bereviewedwithin 120 daysof the effectivedateof this subparagraphand at leasteverytwoyearsthereafter to ensurethat considerationis given to scient4fic and technological advancesso that testingconductedin accordancewith the prescribedproceduresutilizingthe prescribedequipmentwill be asaccurateandreliable asscienceand technologypermit.(3) Chemicaltestsof bloodor urine, if conductedby a facility located

outsidethisCommonwealth,shallbeperformed:(i) by a facility licensed and approvedby the Departmentof

Healthforthispurpose;or(ii) by a facility licensedto conductthe testsby the statein which

thefacility is locatedandlicensedpursuantto the Clinical LaboratoryImprovementAmendmentsof 1988 (Public Law 100-578, 102 Stat.2903).(4) For purposesof blood testing to determine the amountof a

ScheduleI or nonprescribedScheduleII or III controlledsubstanceora metabolite of such a substance,the Departmentof Health shallprescribeminimum levelsofthesesubstanceswhich mustbepresentina person’s blood in order for the test results to be admissible in aprosecutionfor a violation of section1543(b)(1.1),3802(d)(1), (2) or(3) or 3808(a)(2).(d) Presumptionsfrom amount of alcohol.—If chemical testing of a

person’sbreath,bloodor urineshows:(1) That theamountof alcoholby weightin thebloodof an adult is

0.05% or less, it shall be presumedthat the adult was not under theinfluenceof alcoholandtheadult shallnot be chargedwith anyviolationundersection 373l(a)(1), (4) or (5) (relating to driving under influenceof alcoholor controlledsubstance),or, if theadult wasso chargedpriorto the test,thechargeshallbe void abinitio. This fact shall not giveriseto anypresumptionconcerningaviolation of section3731(a)(2) or (3) or(i).

(2) That theamountof alcoholby weight in the blood of an adult isin excessof 0.05% but lessthan [0.10%] 0.08%,this fact shallnot giverise to anypresumptionthattheadultwasor wasnotundertheinfluenceof alcohol,but this fact maybeconsideredwith othercompetentevidencein determiningwhetherthe adult wasor was not under the influenceofalcohol.Thisprovisionshall not negatetheprovisionsof section3731(1).

(3) That theamountof alcoholby weightin theblood of:(i) an adult is [0.10%] 0.08%or more;or(ii) aminor is 0.02%or more,

this fact may be introducedinto evidenceif the personis chargedwithviolating section3731.(e) Refusal admissiblein evidence.—In any summaryproceedingor

criminal proceedingin which the defendantis chargedwith a violation ofsection [3731] 3802 or any other violation of this title arising out of thesameaction, the fact that the defendantrefused to submit to chemicaltesting as required by subsection(a) may be introduced in evidencealongwith other testimony concerning the circumstances of the refusal. Nopresumptions shall arise from this evidencebut it may be consideredalongwith other factorsconcerningthecharge.

(i) Requestby driver for test.—Anypersoninvolved in an accidentorplacedunderarrestfor aviolation of section [3731] 1543(b)(1.1),3802 or3808(a)(2) may requesta chemicaltestof his breath,blood or urine. Suchrequestsshallbehonoredwhenit is reasonablypracticableto do so.

Section 10. Section1547(d)of Title 75 is repealed.Section 11. Sections1548,1549(b)and 1552 of Title 75 areamendedto

read:§ 1548. Requirementsfor driving underinfluenceoffenders.

[(a) Evaluation using Court Reporting Network.—In addition to anyother requirements of the court, every personconvicted of a violation ofsection3731(relating to driving under influence of alcohol or controlledsubstance) and every person offered Accelerated RehabilitativeDisposition as a result of a chargeof a violation of section3731 shall,prior to sentencingor receiving AcceleratedRehabilitative Dispositionor other preliminary disposition, be evaluated using Court ReportingNetwork instruments issued by the department and any otheradditional evaluation techniques deemed appropriate by the court todetermine the extent of the person’s involvement with alcohol orcontrolled substances and to assist the court in determining whatsentencing, probation or conditions of Accelerated RehabilitativeDisposition would benefit the personor the public.

(b) Attendanceat alcoholhighway safetyschool.—In addition to anyother requirements of the court, every person convicted of a firstoffense under section 3731 and every person placed on Accelerated

Rehabilitative Disposition or other preliminary dispositionasaresult ofa chargeof a violation of section3731 shall, as apart of sentencingor asa condition of parole, probation or Accelerated RehabilitativeDisposition, be required to attend and successfully complete anapproved alcohol highway safety school establishedpursuant to section1549 (relating to establishment of schools). All persons required toparticipate in this program shall be given both oral and written noticeof the provisions of section1543(b) (relating to driving while operatingprivilege is suspendedor revoked). Persons convicted of a secondorsubsequentoffenseunder section3731 shall be required by the court tobe treated for alcoholor drug addiction pursuant to subsection(d).]

(c) Resultsof evaluation.—(1) This subsectionshall apply asfollows:

(i) To offenderssentencedundersection3804(a)(3), (b)(2)and(c)(1) (relating topenalties)afterJanuary 31,2004,andbeforeJuly1,2006.

(ii) To offenderssentencedundersection3804(a)(1) and(2) and(b)(1)afterJanuary31,2004,andbeforeJuly 1, 2009.(2) Basedon the resultsof evaluationandanyadditionalinformation

andevidence,thecourtmayin addition to any otherrequirementsof thecourt or this title determineand require, as part of sentencing orconditionof parole,probationor AcceleratedRehabilitativeDispositionor otherpreliminary disposition,that the personsuccessfullycompleteaprescribedprogram of individual or group intervention or supervisedinpatientor outpatienttreatmentor anycombinationof theseprogramsor treatmentsfor a period of up to [two years in duration] thestatutorily available maximum.Any program of individual or groupinterventionor supervisedinpatientor outpatienttreatmentshallbe of atype approvedby the Departmentof Health or operatedby a facility orhospitalthat is under the authorityof theUnitedStatesAnnedForcesorthe Departmentof VeteransAffairs. Basedon periodic reviewsof theperson’sprogress,the court may alter, modify or shortenor extendthedurationof therequirements.

(3) Thissubsectionshall expireJuly 1, 2009.(d) Orderfor alcoholor drugcommitment.—

(1) This subsectionshall applyasfollows:(i) To offenderssentencedundersection3804(a)(3), (b)(2) and

(c)(1) afterJanuary31,2004,andbeforeJuly 1, 2006.(ii) To offenderssentencedundersection3804(a)(1) and(2) and

(b)(1)afterJanuary31,2004,and beforeJuly 1, 2009.(2) If after evaluationand further examinationand hearing it is

detenninedthat a defendantis an allegedchronic abuserof alcohol orcontrolled substancesor that the person is a severely debilitatedcontrolledsubstanceor alcohol abuserwho representsa demonstratedand serious threat, the court may order the person committed for

treatmentat a facility or institution approvedby the DepartmentofHealth or operatedby afacility or hospitalthat is undertheauthorityofthe United StatesArmed Forcesor the Departmentof VeteransAffairs.If the defendanthasbeenconvictedof a previousviolation of section3731, the court shall order thepersoncommittedto a drug andalcoholtreatmentprogramlicensedby the Office of Drug andAlcohol Programsof the Departmentof Health or operatedby afacility or hospitalthat isunder theauthorityof theUnitedStatesArmedForcesor theDepartmentof VeteransAffairs:

[(1)] (1) Any personsubjectto thissubsectionmaybeexaminedbyanappropriatephysicianof the person’schoosingandthe resultof theexaminationshallbe consideredby thecourt.[(2)] (ii) Upon motion duly madeby the committed person, anattorneyor anattendingphysician,thecourtatanytimeafteran orderof commitmentmayreviewtheorder. After determiningthe progressof treatment,thecourtmayorderits continuation,theperson’sreleaseor supervisedtreatmenton anoutpatientbasis.[(3)1 (iii) Anypersonorderedby the court to receivetreatmentafter afirst offense,and any person requiredto receive treatmentafter asecondoffenseundersection3731 mustdemonstrateto the court thatthe defendanthassuccessfullycompletedtreatmentaccordingto allguidelinesrequired by the programbefore the person’soperatingprivilegemayberestored.(3) This subsectionshall expireJuly 1, 2009.

(e) Costs.—Costsof anyandall requirementsappliedunder this sectionshall be in addition to anyotherpenaltyrequiredor allowed by law andshall be the responsibilityof the personupon whom the requirementsareplaced.This subsectionshall expireJuly 1, 2009.

(I) Court-orderedinterventionor treatment.—(1) This subsectionshall applyasfollows:

(i) To offenderssentencedunder section3804(a)(3), (b)(2) and(c)(1) afterJanuary31, 2004,and beforeJuly 1, 2006.

(ii) To offenderssentencedundersection3804(a)(1) and (2) and(b)(1)after January31,2004,andbeforeJuly 1, 2009.(2) A record shall be submittedto the departmentas to whether the

courtdid or did not ordera defendantto attenda programof supervisedindividual or group counseling treatmentor supervised inpatient oroutpatient treatment.If the court orders treatment,a report shall beforwarded to the departmentas to whether the defendantsuccessfullycompletedthe program.If a defendantfails to successfullycompleteaprogram of treatmentas ordered by the court, the suspensionshallremain in effect until the departmentis notified by the court that thedefendanthassuccessfullycompletedtreatmentand the defendantisotherwiseeligible for restorationof his operatingprivilege. In order toimplement the recordkeeping requirements of this section, the

departmentand the court shall work togetherto exchangepertinentinformation about a defendant’s case, including attendanceandcompletionof treatmentor failure tocompletetreatment.

(3) This subsectionshall expireJuly 1,2009.§ 1549. Establishmentof schools.

(b) Alcohol highwaysafetyschools.—(1) Eachcounty, multicounty judicial district or group of counties

combinedunder oneprogramshall, in compliancewith regulationsofthe departmentand theDepartmentof Health,establishandmaintainacourseof instructionon the problemsof alcohol anddriving. Thetimeduring which the courseis offeredshall accommodatepersons’workschedules,including weekendand eveningtimes.

(2) Theseregulationsshall include,but not be limited to, auniformcurriculum for the course of instruction, training and certificationrequirementsfor instructorsandprovision for thegiving of both oral andwritten noticeof the provisionsof section 1543(b)(relating to drivingwhile operating privilege is suspendedor revoked) to all programparticipants.

§ 1552. AcceleratedRehabilitativeDisposition.The court of commonpleasin eachjudicial district andthe Municipal

Court of Philadelphia shall establishand implement a program forAcceleratedRehabilitativeDisposition for personschargedwith aviolationof section [3731] 3802 (relating to driving under influenceof alcohol orcontrolledsubstance)in accordancewith the provisionsof this chapterandrulesadoptedby theSupremeCourt.

Section 12. Section 1553(b)(1), (c), (d)(6), (8) and (9), (e) and(t) ofTitle 75 areamendedandthe sectionis amendedby addingsubsectionstoread:§ 1553. Occupationallimited license.

(b) Petition.—(1) The applicant for an occupational limited license must file a

petitionwith thedepartment,by certified mail, settingforth in detail theneedfor operating a motor vehicle. The petition shall be on a formprescribedby thedepartmentandshallidentify thespecificmotorvehicleor vehiclesthe petitionerseekspermissionto operate.The petition shallincludean explanationas to why the operation of a motor vehicle isessentialto the petitioner’soccupation,work, trade,treatmentor study.The petition shall identify the petitioner’s employer, educationalinstitution or treatmentfacility, asappropriate,andshall includeproofof financial responsibilitycovering all vehicles which the petitionerrequests to be allowed to operate. The department [may] shallpromulgateregulations to require additional information as well asadditionalevidenceto verify theinformationcontainedin thepetition.

(c) Fee.—Thefee for applyingfor an occupationallimited licenseshallbe [$25] $50. This fee shall be nonrefundableand no other fee shall berequired.

(d) Unauthorizedissuance.—Thedepartmentshall prohibit issuanceofan occupationallimited licenseto:

(6) Any person who has beenadjudicateddelinquent,granted aconsentdecreeor [convicted ofi grantedAcceleratedRehabilitativeDispositionfor driving under the influence of alcohol or controlledsubstanceunless the suspension or revocation imposed for thatconvictionhasbeenfully served.

(8) [Any] Except as setforth in subsections(d.1) and (d.2),anyperson who has been [granted a consent decree or AcceleratedRehabilitative Disposition for] convictedofdriving under the influenceof alcohol or controlled substanceand whoselicensehasbeensuspendedby the department unlessthe suspensionimposedhasbeenfully served.

(9) [Any] Exceptas setforth in subsection(d.3), anypersonwhoseoperating privilege has beensuspendedfor a violation of 18 Pa.C.S.§ 6308 (relating to purchase,consumption, possessionor transportationof liquor or malt or brewed beverages)unless the suspensionimposedhasbeenfully served.

(d.1) Adjudication eligibiity.—An individual who hasbeenconvictedof an offenseundersection3802 (relating to driving underinfluenceofalcohol or controlled substance)and doesnot have a prior offenseasdefinedin section3806(a) (relating to prior offenses)shall be eligibleforan occupationallimited licenseonly 4f the individualhas served60 daysofthe suspensionimposedfor the offense.

(d.2) Suspensioneligibility.—(1) An individual whoselicensehas beensuspendedfor aperiodof

18 monthsundersection1547(b)(1)(ii) (relating to chemicaltestingtodetermineamountofalcoholor controlledsubstance)or 3804(e)(2)(ii)(relating to penalties) shall not be prohibitedfrom obtaining anoccupationallimited licenseunderthissectionif the individual:

(i) is otherwiseeligiblefor restoration;(ii) has served12 monthsof the suspensionimposedfor the

offense;(iii) has no more than one prior offenseasdefinedin section

3806(b);(iv) only operatesa motor vehicle equippedwith an ignition

interlock systemasdefinedin section3801 (relating to definitions);and

(v) hascertWedto the departmentunderparagrapht’3.).

(2) A periodof ignition interlock acceptedunderthis subsectionshall not count towards the one-yearmandatoryperiod of ignitioninterlock imposedundersection3805(relating to ignition interlock).

(3) If an individualseeksan occupationallimited licenseunderthissubsection,the departmentshall require that each motor vehicleownedor registeredto thepersonhasbeenequippedwith an ignitioninterlocksystemasdefinedin section3801 asa conditionofissuinganoccupationallimited licensewith an ignition interlockrestriction.(d.3) Suspensioneligibility related to Title 18 violation.—An

individualwhoseoperatingprivilegehasbeensuspendedfora violation of18 Pa.C.S.§ 6308 shall be eligible for an occupationallimited licenseunlessthe individualhaspreviouslyviolated18Pa.C.S.§ 6308.

(e) Offensescommitted during a period for which an occupationallimited license has been issued.—Any driver who has been issued anoccupationallimited license and as to whom the departmentreceives areport of conviction of an offensefor which the penaltyis a cancellation,disqualification,recall,suspensionor revocationof operatingprivilegesorareport undersection3815(c)(4) (relating to mandatorysentencing)shallhave the occupational limited license recalled, and the driver shallsurrenderthe limited licenseto the departmentor its agents designatedundertheauthorityof section1540.

(f) Restrictions.—Adriver who hasbeenissuedan occupationallimitedlicenseshall observethe following:

(1) Thedriver shalloperateadesignatedvehicleonly [between]~(i) Between the driver’s place of residence and place of

employmentor studyandasnecessaryin thecourseof employmentorconducting a business or pursuing a course of study where theoperationof a motor vehicle is a requirementof employmentor ofconductingabusinessor of pursuinga courseof study.

(ii) To andfrom a placefor scheduledor emergencymedicalexaminationor treatment. This subparagraphincludestreatmentrequired under Chapter 38 (relating to driving after imbibingalcoholor utilizing drugs).(2) A driver who has beenissuedan occupational limited license

shallnot operateaschoolbus.(3) Anypersonwhoviolates theconditionsof issuanceor restrictions

of theoccupationallimited licensecommitsasummaryoffenseandshall,upon conviction, pay a fine of $200 and, upon receiptof a certifiedrecordof conviction,thedepartmentshallrecall thelimited license.

(4) The operatingprivilege of a driver who has been issued anoccupationallimited licenseremains under suspensionor revocationexcept when operating a motor vehicle in accordance with theconditions of issuance or restrictions of the occupational limitedlicense.

(5) A driver who has beenissuedan occupationallimited licenseshall possessa completedoccupationallimited licenseaffidavit on aformprescribedby thedepartmentat all timeswhenoperatinga motorvehicle.Thedrivershallexhibitthecompletedformupon demandby apolice officer. Theaffidavit shall indicate that the driver is operatingthe motorvehicleat a timeandbetweenplacesin accordancewith therestrictionsofparagraph(1). An occupationallimited licenseaffidavitshall contain information required by regulations which shall bepromulgatedby thedepartment.Thedriver is not requiredto possessacompletedoccupational limited license affidavit when operating amotorvehicle toa locationfor emergencymedicaltreatment.

Section 13. Sections 1554(0(8), 1575(b), 1586, l6ll(a)(l), 3101(b),3326(c),3327(e),3716(a)and 3731(a)(4)(i) and(a.l)(1)(i) of Title 75 areamendedto read:§ 1554. Probationarylicense.

(1) Unauthorized issuance.—Thedepartment shall not issue aprobationarylicenseto:

(8) A personwho hasbeenconvictedof a violation of section[3731]3802 (relating to driving under influence of alcohol or controlledsubstance)orformersection3731,within theprecedingsevenyears.

§ 1575. Permittingviolation of title.

(b) Penalty.—Anypersonviolating the provisionsof subsection(a) isguilty of asummaryoffenseandis subjectto thesamefine asthe driver ofthe vehicle. If the driver is convictedunder section [3731 (relating todriving under influence of alcohol or controlled substance) or] 3735(relating to homicideby vehicle while driving under influence) or 3802(relating to driving underinfluence of alcohol or controlled substance),the person violating subsection(a) shall also be subject to suspensionorrevocation,as applicable,under sections1532 (relating to revocationorsuspensionof operatingprivilege) [and], 1542 (relating to revocationofhabitualoffender’slicense)and3804(e)(relating to penalties).

§ 1586. Dutiesof department.The department shall, for purposesof imposing a suspensionor

revocation under Article IV of the compact, treat reportsof convictionsreceivedfrom partystatesthatrelateto driving, operatingor beingin actualphysical control of a vehicle while impaired by or under the influenceofalcohol, intoxicating liquor, drugs,narcotics,controlledsubstancesor otherimpairing or intoxicatingsubstanceasbeingsubstantiallysimilar to section13731] 3802 (relating to driving under [the] influence of alcohol or

controlledsubstance).The fact that the offensereportedto the departmentby a party statemayrequireadifferent degreeof impairmentof aperson’sability to operate,drive or controla vehicle thanthat requiredto supportaconviction for a violation of section [3731] 3802 shall not be abasis fordetermining that the party state’s offense is not substantiallysimilar tosection[3731] 3802 for purposesof Article IV of the compact.§ 1611. Disqualification.

(a) Disqualificationfor first violation of certainoffenses.—Uponreceiptof a certified copy of conviction, the departmentshall, in addition to anyotherpenaltiesimposedunderthis title, disqualifyany personfrom drivingacommercialmotorvehicleor schoolvehiclefor a period of oneyear forthe first violation of:

(1) section [3731] 3802 (relating to driving under [the] influence ofalcohol or controlled substance)or former section3731, where theviolation occurred while the person was operating a commercial motorvehicleor schoolvehicle;

§ 3101. Application of part.

(b) Serious traffic offenses.—Theprovisionsof section3345(relating tomeeting or overtaking school bus) [and], Subchapter B of Chapter 37(relating to serious traffic offenses)and Chapter 38 (relating to drivingafter imbibing alcohol or utilizing drugs) shall apply upon highways andtrafflcways throughout this Commonwealth.§ 3326. Duty of driver in construction and maintenance areas or on

highway safetycorridors.

(c) Fines to be doubled.— For any of the following violations, whencommitted in an active work zone manned by workers acting in theirofficial capacity or on a highway safety corridor designatedunder section6105.1 (relating to designationof highway safetycorridors), the fine shallbedouble theusual amount:

§ 3716. Accidentsinvolving overturnedvehicles.(a) Speeding,carelessdriving, etc.—If a commercialmotor vehicle

overturnsin anaccidentresultingfrom aviolation of section3361 (relatingto driving vehicleat safespeed),3362 (relating to maximumspeedlimits),3714 (relating to carelessdriving) or [3731] 3802 (relating to driving underinfluenceof alcohol or controlled substance),the operatorof the vehicleshall, upon convictionof any of the aforementionedoffenses,be sentencedto payafine of $2,000,in additionto anyotherpenaltyauthorizedby law.

§ 3731. Driving underinfluenceof alcoholor controlledsubstance.(a) Offensedefmed.—Apersonshall not drive, operateor be in actual

physical control of the movementof a vehicle in any of the followingcircumstances:

(4) While theamountof alcoholby weightin theblood of:(i) an adult is [0.10%]0.08%or greater;or

(a. 1) Primafacieevidence.—(1) It is primafacieevidencethat:

(i) an adult had[0.10%] 0.08% or moreby weight of alcohol inhisor her blood at the timeof driving, operatingor being in actualphysical control of the movementof any vehicle if the amount ofalcoholby weight in theblood of thepersonis equaltoor greaterthan[0.10%] 0.08% at thetime a chemicaltest is performedon asampleof theperson’sbreath,bloodor urine;

of anotherpersonastheresultof aviolation of section[3731] 3802 (relatingto driving under influenceof alcohol or controlledsubstance)and who isconvictedof violating section[3731] 3802 is guilty of a felonyof the seconddegreewhenthe violation is the causeof deathandthe sentencingcourtshallorder thepersonto serveaminimum termof imprisonmentof not-lessthan threeyears.A consecutivethree-yearterm of imprisonmentshall beimposedfor eachvictim whosedeathis theresultof theviolation of section[3731] 3802.

§ 3735.1. Aggravatedassaultby vehiclewhile driving undertheinfluence.(a) Offensedefined.—Anypersonwhonegligentlycausesseriousbodily

injury to anotherpersonas the resultof a violation of section[3731] 3802(relating to driving under influenceof alcoholor controlledsubstance)andwho is convictedof violating section [3731] 3802 commitsa felony of theseconddegreewhentheviolation is thecauseof theinjury.

§ 3755. Reportsby emergencyroom personnel.(a) Generalrule.—If, as a resultof amotorvehicleaccident,theperson

who drove,operatedor was in actualphysicalcontrol of the movementofany involved motor vehicle requiresmedical treatmentin an emergencyroom of a hospitaland if probablecauseexists to believe a violation ofsection [3731] 3802 (relating to driving under influence of alcohol orcontrolled substance)was involved, the emergencyroom physician or hisdesigneeshallpromptlytake bloodsamplesfrom thosepersonsiand-transmitthem within 24 hours for testing to the Departmentof Health or a clinicallaboratory licensed and approvedby the Departmentof Health andspecificallydesignatedfor this purpose.This sectionshall be applicabletoall injured occupantswho were capableof motor vehicleoperationif theoperatoror personin actualphysicalcontrol of themovementof themotorvehiclecannotbedetermined.Testresultsshall be releasedupon requestofthe persontested,his attorney,his physician or governmentalofficials oragencies.

§ 3801. Definitions.The following wordsand phraseswhenusedin this chaptershall have

the meaningsgiven to them in this section unless the context clearlyindicatesotherwise:

“Adult.” An individualwhois atleast21 yearsof age.“Ignition interlock system.” A system approvedby the department

which preventsa vehiclefrom beingstartedor operatedunlessthe operatorfirst providesa breathsampleindicating that the operatorhasan alcohollevel lessthan0.025%.

“Minor.” An individual whois under21 yearsof age.§ 3802. Driving underinfluenceof alcoholor controlledsubstance.

(a) Generalimpairment.—(1) An individual may not drive, operateor be in actualphysical

control of themovementof avehicleafter imbibing a sufficient amountof alcohol such that the individual is rendered incapable of safelydriving, operatingor beingin actualphysicalcontrolof themovementofthe vehicle.

(2) An individual maynot drive, operateor be in actual physicalcontrol of the movementof a vehiclealterimbibing asufficient amountof alcohol suchthat the alcoholconcentrationin the individual’s bloodor breathis at least0.08%but lessthan0.10%within twohoursafter theindividual hasdriven,operatedor beenin actualphysicalcontrol of themovementof thevehicle.(b) High rateof alcohol.—Anindividual maynot drive, operateor be in

actual physical control of the movement of a vehicle after imbibing asufficient amount of alcohol such that the alcohol concentrationin theindividual’s blood or breathis at least0.10% but less than 0.16% withintwo hours after the individual has driven, operatedor been in actualphysicalcontrol of themovementof thevehicle.

(c) Highestrateof alcohol.—Anindividualmaynot drive,operateor bein actualphysical control of the movementof a vehicleafter imbibing a

sufficient amount of alcohol such that the alcohol concentrationin theindividual’s blood or breathis 0.16% or higher within two hoursafter theindividual hasdriven, operatedor been in actualphysical control of themovementof thevehicle.

(d) Controlledsubstances.—Anindividualmaynot drive, operateor bein actualphysical control of the movementof a vehicleunder any of thefollowing circumstances:

(1) Thereis in theindividual’s bloodanyamountof a:(i) ScheduleI controlledsubstance,as definedin the act of April

14, 1972 (P.L.233, No.64), known as The Controlled Substance,Drug, DeviceandCosmeticAct;

(ii) ScheduleII or ScheduleIII controlledsubstance,as definedinTheControlledSubstance,Drug, DeviceandCosmeticAct, whichhasnotbeenmedicallyprescribedfor the individual; or

(iii) metaboliteof a substanceundersubparagraph(i) or (ii).(2) The individual is underthe influenceof adrug or combinationof

drugsto a degreewhich impairs the individual’s ability to safely drive,operateor bein actualphysicalcontrolof themovementof thenvehicle.

(3) The individual is underthe combinedinfluenceof alcoholandadrugor combination of drugs to adegreewhich impairs theindividual’sability to safely drive, operateor be in actual physical control of themovementof thevehicle.

(4) The individual is under the influenceof a solvent or noxioussubstancein violation of 18 Pa.C.S.§ 7303 (relating to saleor illegal useof certainsolventsandnoxioussubstances).(e) Minors.—A minor maynot drive, operateor be in actualphysical

control of the movementof a vehicleafter imbibing a sufficient amountofalcoholsuchthat thealcoholconcentrationin theminor’s blood or breath is0.02% or higher within two hoursafter the minor hasdriven,operatedorbeenin actualphysicalcontrolof themovementof thevehicle.

(0 Commercial or school vehicles.—An individual may not drive,operateor be in actualphysicalcontrol of themovementof a commercialvehicle,schoolbus or schoolvehiclein anyof thefollowing circumstances:

(1) After the individual has imbibed a sufficient amount of alcoholsuchthat thealcoholconcentrationin theindividual’s bloodor breathis:

(i) 0.04% or greaterwithin two hours after the individual hasdriven,operatedor beenin actualphysicalcontrolof themovementofacommercialvehicleother thana schoolbusor aschoolvehicle.

(ii) 0.02% or greaterwithin two hours after the individual hasdriven,operatedor beenin actualphysicalcontrol of themovementofaschoolbusor aschoolvehicle.(2) After the individual has imbibed a sufficient amountof alcohol

suchthattheindividual is renderedincapableof safelydriving, operatingorbeing in actualphysicalcontrolof themovementof thevehicle.

(3) While the individual is under the influence of a controlledsubstanceor combinationof controlledsubstances,as definedin section1603 (relatingto definitions).

(4) While the individual is under thecombinedinfluenceof alcoholanda controlledsubstanceor combinationof controlledsubstances,asdefinedin section 1603.(g) Exceptionto two-hour rule.—Notwithstandingthe provisions of

subsection(a), (b), (c), (e) or (0~wherealcohol or controlledsubstanceconcentrationinan individual’s bloodor breathis anelementof theoffense,evidenceof such alcoholor controlledsubstanceconcentrationmorethantwo hours after the individual has driven, operated or been in actualphysicalcontrolof themovementof the vehicleis sufficientto establishthatelementof theoffenseunderthefollowing circumstances:

(1) where the Commonwealthshowsgood causeexplaining why thechemicaltestcouldnot beperformedwithin twohours;and

(2) where theCommonwealthestablishesthat the individualdid notimbibeany alcoholor utilize a controlledsubstancebetweenthetimetheindividualwasarrestedand the time thesamplewasobtained.

§ 3803. Grading.(a) Basicoffenses.—

(1) An individual whoviolatessection 3802(a) (relating to drivingunderinfluenceof alcoholor controlledsubstance)andhasno morethanoneprior offensecommitsa misdemeanorfor whichthe individual maybe sentencedto a termof imprisonmentof not morethansix monthsandto paya fine undersection3804 (relating to penalties).

(2) An individual who violates section 3802(a) and hasmorethanoneprior offensecommitsamisdemeanorof theseconddegree.(b) Other offenses.—

(1) An individualwhoviolatessection3802(b),(e) or (0 andwhohasno morethan oneprior offensecommitsa misdemeanorfor which theindividualmaybesentencedto aterm of imprisonmentof notmorethansix monthsandto payafine undersection3804.

(2) An individualwho violatessection3802(c)or (d) andwhohasnoprior offensescommitsa misdemeanorfor which the individual may besentencedto a termof imprisonmentof not more thansix monthsandtopayafine undersection3804.

(3) An individualwhoviolatessection3802(b),(e) or (0 andwhohasmorethanoneprior offensecommitsamisdemeanorof thefirst degree.

(4) An individual whoviolates section 3802(c) or (d) andwho hasoneor moreprioroffensescommitsamisdemeanorof thefirst degree.

§ 3804. Penalties.(a) Generalimpairment.—Anindividual whoviolates section 3802(a)

(relating to driving underinfluenceof alcoholor controlledsubstance)shallbesentencedas follows:

(1) For afirstoffense,to:

(i) undergoaperiodof probationnot to exceedsix months;(ii) payafineof $300;(iii) attend an alcohol highway safety school approvedby the

department;and(iv) comply with all drug and alcohol treatmentrequirements

imposed under sections 3814 (relating to drug and alcoholassessments)and3815 (relating to mandatorysentencing).(2) Forasecondoffense,to:

(i) undergoimprisonmentfor not less than five daysnor morethansix months;

(ii) payafme of not lessthan$300normorethan$2,500;(iii) attendan alcohol highway safety school approvedby the

department;and(iv) comply with all drug and alcohol treatmentrequirements

imposedundersections3814 and3815.(3) For a thirdor subsequentoffense,to:

(i) undergoimprisonmentof not less thantendaysnormorethantwo years;

(ii) payafine of not lessthan$500normorethan$5,000;and(iii) comply with all drug and alcohol treatmentrequirements

imposedundersections3814 and3815.(b) High rateof blood alcohol;minors; commercialvehiclesandschool

busesandschoolvehicles;accidents.—Exceptas set forth in subsection(c),an individual who violatessection 3802(a)(1) wheretherewasan accidentresulting in bodily injury, seriousbodily injury or deathof any personordamageto avehicleor otherpropertyor whoviolatessection3802(b),(e) or(0 shallbe sentencedasfollows:

(1) For a first offense,to:(i) undergoimprisonmentof not less than 48 consecutivehours

normorethansix months;(ii) payafme ofnot lessthan$500 normorethan$5,000;(iii) attendan alcohol highway safety school approvedby the

department;and(iv) comply with all drug and alcohol treatmentrequirements

imposedundersections3814and3815.(2) For asecondoffense,to:

(i) undergoimprisonmentof not lessthan30 daysnor morethansix months;

(ii) payafine of not lessthan$750nor morethan$5,000;(iii) attendan alcohol highway safety school approvedby the

department;and(iv) comply with all drug and alcohol treatmentrequirements

imposedundersections3814and3815.(3) For athird offense,to:

(ii) payafme of not lessthan$1,500normorethan$10,000;and(iii) comply with all drug andalcohol treatmentrequirements

imposedundersections3814 and3815.(4) For afourthor subsequentoffense,to:

(i) undergoimprisonmentof not lessthanoneyearnor morethanfive years;

(ii) payafine of not lessthan$1,500normorethan$10,000;and(iii) comply with all drug andalcohol treatmentrequirements

imposedundersections3814 and3815.(c) Incapacity; highest blood alcohol; controlled substances.—An

individual who violatessection 3802(a)(1)and refusedtestingof blood orbreath or an individual who violates section 3802(c) or (d) shall besentencedas follows:

(1) Fora firstoffense,to:(i) undergoimprisonmentof not lessthan72 consecutivehours

normorethansix months;(ii) payafine of not lessthan$1,000normorethan$5,000;(iii) attend an alcohol highway safety school approvedby the

department;and(iv) comply with all drug and alcohol treatmentrequirements

imposedundersections3814and3815.(2) Forasecondoffense,to:

(i) undergoimprisonmentof not lessthan90 daysnor morethanfive years;

(ii) paya fine of not lessthan$1,500;(iii) attendan alcohol highway safety school approvedby the

department;and(iv) comply with all drug and alcohol treatmentrequirements

imposedundersections3814 and3815.(3) For athird or subsequentoffense,to:

(i) undergoimprisonmentof notlessthanoneyearnor morethanfive years;

(ii) payafine of not lessthan$2,500;and(iii) comply with all drug and alcohol treatmentrequirements

imposedundersections3814and3815.(d) Extendedsupervisionof court.—If apersonis sentencedpursuantto

thischapterand,after theinitial assessmentrequiredby section3814(1),theperson is determinedto be in needof additional treatmentpursuanttosection3814(2),thejudgeshallimposea minimumsentenceasprovidedbylaw andamaximumsentenceequalto thestatutorilyavailablemaximum.Asentenceto the statutorilyavailable maximum imposedpursuantto thissubsectionmay, in the discretionof the sentencingcourt, be orderedto be

servedin a countyprison, notwithstandingthe provisionsof 42 Pa.C.S.§ 9762(relating to sentencingproceeding;placeof confinement).

(e) Suspensionof operatingprivilegesuponconviction.—(1) The departmentshall suspendthe operatingprivilege of an

individualunder paragraph(2) upon receivinga certified recordof theindividual’s convictionof or anadjudicationof delinquencyfor:

(i) an offenseundersection3802; or(ii) an offense which is substantially similar to an offense

enumeratedin section3802 reportedto the departmentunderArticleIII of the compact in section 1581 (relating to Driver’s LicenseCompact).(2) Suspensionunderparagraph(1) shallbe in accordancewith the

following:(i) Exceptasprovidedfor in subparagraph(iii), 12 monthsfor an

ungradedmisdemeanoror misdemeanorof the seconddegreeunderthis chapter.

(ii) 18 monthsfor a misdemeanorof the first degreeunderthischapter.

(iii) Thereshall be no suspensionfor an ungradedmisdemeanorunder section 3802(a) where the person is subject to the penaltiesprovidedin subsection(a) andthepersonhasno prior offense.

(iv) For suspensions imposed under paragraph (1)(ü),notwithstandinganyprovision of law or enforcementagreementto thecontrary,all of thefollowing apply:

(A) Suspensionsshall be in accordancewith SubchapterD ofChapter15 (relating to theDriver’s LicenseCompact).

(B) In calculatingtheterm of a suspensionfor anoffensethatissubstantiallysimilar to an offenseenumeratedin section3802,thedepartmentshallpresumethatif theconductreportedhadoccurredin this Commonwealththen thepersonwould havebeenconvictedundersection3802(a)(2).(v) Notwithstandingany other provision of law or enforcement

agreementto thecontrary,thedepartmentshall suspendthe operatingprivilegeof a driver for six monthsupon receivinga certified recordof a consentdecreegrantedunder 42 Pa.C.S.Ch. 63 (relating tojuvenilematters)basedon section3802.

(0 Community serviceassignments.—Inaddition to the penaltiessetforth in this section, the sentencingjudge may imposeup to 150 hours ofcommunity service. Where the individual has been orderedto drug andalcohol treatmentpursuantto sections 3814 and 3815, the communityservice shall be certified by the drug and alcohol treatmentprogram asconsistentwith any drugandalcohol treatmentrequirementsimposedundersections3814and3815.

(g) Sentencingguidelines.—Thesentencingguidelinespromulgatedbythe PennsylvaniaCommission on Sentencingshall not supersedethemandatorypenaltiesof this section.

(h) Appeal.—TheCommonwealthhastheright to appealdirectly to theSuperiorCourtany orderof courtwhich imposesasentencefor violation ofthis section which does not meet the requirementsof this section.TheSuperiorCourtshallremandthecaseto thesentencingcourtfor impositionof a sentencein accordancewith theprovisionsof thissection.

(i) First classcities.—Notwithstandingtheprovision for direct appealtothe SuperiorCourt, if, in a city of the first class,a personappealsfrom ajudgmentof sentenceunder this section from the municipal court to thecommonpleascourt for a trial de novo, the Commonwealthshall havetheright to appealdirectly to theSuperiorCourt from theorder of thecommonpleascourtif thesentenceimposedis in violation of thissection.If, in acityof the first class,a personappealsto the court of common pleas afterconvictionof aviolation of this sectionin themunicipalcourtandthereafterwithdraws his appealto the commonpleascourt, therebyreinstating thejudgmentof sentenceof themunicipal court, theCommonwealthshallhave30 days from the dateof the withdrawal to appealto the SuperiorCourt ifthe sentenceis in violation of this section.

(j) Additional conditions.—Inaddition to any other penalty imposedunderlaw, thecourtmaysentenceapersonwhoviolatessection3802to anyother requirementor condition consistentwith the treatmentneedsof theperson,therestorationof thevictim to preoffensestatusor theprotectionofthe public.§ 3805. Ignition interlock.

(a) Generalrule.—Ifapersonviolatessection3802 (relating to drivingunder influenceof alcoholor controlled substance)andhasaprior offenseas definedin section 3806(a) (relatingto prior offenses)or if apersonhashad their operating privileges suspendedpursuantto section 1547(b.1)(relating to chemicaltestingto determineamountof alcohol or controlledsubstance)or 3808(c) (relating to illegally operatinga motor vehiclenotequippedwith ignition interlock) and the person seeksa restoration ofoperatingprivileges,thedepartmentshallrequireasacondition of issuingarestrictedlicensepursuantto thissectionthat thefollowing occur:

(1) Eachmotor vehicle owned by the person or registeredto thepersonhasbeenequippedwith an ignition interlock systemandremainssofor thedurationof therestrictedlicenseperiod.

(2) If thereareno motor vehiclesownedby thepersonor registeredto the person that the person so certify to the department.A personsocertifying shall be deemedto have satisfied the requirement that allmotor vehicles owned by the person or registeredto the personbeequipped with an ignition interlock system as required by thissubsection.

(b) Applicationfor arestrictedlicense.—Apersonsubjectto this sectionshall apply to the departmentfor an ignition interlock restrictedlicenseundersection 1951 (relating to driver’s licenseandlearner’spermit), whichshall be clearly markedto restrict the personto only driving, operatingorbeing in actualphysicalcontrolof themovementof motorvehiclesequippedwith an ignition interlock system.Upon issuanceof an ignition interlockrestrictedlicenseto any person,thedepartmentshall notify the personthatuntil the personobtainsan unrestrictedlicensethe personmay not own,register,drive, operateor be in actualphysicalcontrol of the movementofanymotorvehiclewhich is not equippedwith an ignition interlocksystem.

(c) Issuanceof unrestrictedlicense.—Oneyearfrom thedateof issuanceof an ignition interlock restrictedlicenseunder this section, if otherwiseeligible, apersonmaybeissuedareplacementlicenseundersection1951(d)that doesnot containtheignition interlocksystemrestriction.

(d) Prohibition.—Exceptas setforth in subsections(e) and(0. until thepersonobtainsan unrestrictedlicense, the personmay not own, register,drive,operateor be in actualphysicalcontrol of themovementof anymotorvehicle within this Commonwealthunlessthe motor vehicle is equippedwith an ignition interlocksystem.

(e) Economic hardship exemption.—A person subject to therequirementsof subsection(a) may applyto the departmentfor ahardshipexemption to the requirementthat an ignition interlock systemmust beinstalled in each of the person’s motor vehicles. Where the departmentdeterminesthat the applicantestablishesthat such a requirementwouldresultin unduefinancial hardship,thedepartmentmaypermittheapplicantto install an ignition interlock systemon only oneof the applicant’smotorvehicles.However, the applicantin accordancewith section3808 (relatingto illegally operatinga motor vehiclenot equippedwith ignition interlock)shall be prohibited from driving, operatingor being in actual physicalcontrol of the movement of any motor vehicle, including any of theapplicant’smotorvehicles,which is not equippedwith an ignition interlocksystem.

(1) Employmentexemption.—Ifa person with a restrictedlicense isrequired in the courseand scopeof employmentto drive, operateor be inactualphysicalcontrol of the movementof amotor vehicleownedby theperson’semployer,thefollowing apply:

(1) Except as set forth in paragraph (2), the person may drive,operateor be in actualphysicalcontrol of the movementof that motorvehiclein thecourseandscopeof employmentwithout installationof anignition interlock systemif:

(i) the employerhasbeennotified that the employeeis restricted;and

(ii) the employeehasproofof the notification in the employee’spossessionwhile driving, operatingor beingin actualphysicalcontrolof the movement of the employer’s motor vehicle. Proof of the

notification maybe establishedonlyby the notarizedsignatureof theemployer acknowledgingnotification on a form which shall beprovided by the departmentfor this purposeand shall include acontacttelephonenumberof theemployer.(2) Paragraph (1) does not apply in any of the following

circumstances:(i) To the extentthat an employer-ownedmotor vehicle is made

availableto theemployeefor personaluse.(ii) If the employer-ownedmotor vehicle is ownedby an entity

which is wholly or partially owned by the personsubject to thissection.

(iii) If theemployer-ownedmotor vehicle is aschoolbus; aschoolvehicle;or a vehicledesignedto transportmore than 15 passengers,includingthedriver.

(g) Prohibition of authorization.—Thissection shall not give thedepartmentauthorizationto imposean ignition interlock requirementon apersonthat has committed an offenseunder former section 3731 prior toOctober1, 2003,without theissuanceof acourtorder.

(h) Departmentapproval.—Anignition interlock systemrequiredto beinstalledunder this title mustbe a systemwhich hasbeenapprovedby thedepartment.Thedepartment’sapproval of ignition interlock systemsshallbe publishedin the PennsylvaniaBulletin. Systemsapprovedfor useunderformer 42 Pa.C.S. § 7002(d) (relating to ignition interlock systemsfordriving under the influence) and any contracts for the installation,maintenanceandinspectionof the systemsin effectas of theeffectivedateof this section shall continue to be approvedand in effect until thedepartmentagainpublishesapproval of ignition interlock systemsin thePennsylvaniaBulletin and enters into new contractsin support of thesystems.

(i) Offensescommittedduringaperiodfor whichan ignition interlockrestricted license has been issued.—Except as provided in sections1547(b.1) and 3808(c) (relating to illegally operatinga motor vehiclenotequippedwith ignition interlock), any driver who has been issued anignition interlock restrictedlicenseandasto whom thedepartmentreceivesa certified record of a conviction of an offense for which the penaltyis acancellation,disqualification,recall, suspensionor revocationof operatingprivilegesshall have the ignition interlock restrictedlicenserecalled,andthe driver shall surrenderthe ignition interlock restrictedlicense to thedepartmentor its agents designatedunder the authority of section 1540(relating to surrenderof license). Following the completion of thecancellation, disqualification, recall, suspensionor revocation whichresulted in the recall of the ignition interlock restricted license, thedepartmentshall require that the person complete the balance of theignition interlock restrictedlicenseperiod previouslyimposedprior to the

issuanceof a replacementlicense under section 1951(d) that does notcontainanignition interlockrestriction.§ 3806. Prior offenses.

(a) Generalrule.—Exceptas setforth in subsection(1,), the term “prioroffense” as used in this chaptershall meana conviction, adjudicationofdelinquency, juvenile consent decree, acceptance of AcceleratedRehabilitativeDisposition or other form of preliminary dispositionbeforethesentencingon thepresentviolation for anyof thefollowing:

(1) an offenseundersection3802(relatingto driving underinfluenceof alcoholor controlledsubstance);

(2) an offenseunderformersection3731;(3) an offensesubstantiallysimilar to anoffenseunderparagraphs(1)

or (2) in anotherjurisdiction; or(4) anycombinationof theoffensesset forth in paragraphs(1), (2) or

(3).(b) Repeatoffenseswithin ten years.—Thecalculationof prior offenses

for purposesof sections1553(d.2)(relating to occupationallimited license)and 3804(relating to penalties)shall includeanyconviction,adjudicationofdelinquency, juvenile consent decree, acceptance of AcceleratedRehabilitativeDispositionor other form of preliminary dispositionwithinthe tenyearsbeforethepresentviolation occurredforanyof thefollowing:

(1) an offenseundersection3802;(2) an offenseunderformersection3731;(3) an offensesubstantiallysimilar to an offenseunderparagraph(1)

or (2) in anotherjurisdiction; or(4) anycombinationof the offensesset forth in paragraph(1), (2) or

(3).§ 3807. AcceleratedRehabilitativeDisposition.

(a) Eligibility.—(1) Exceptas set forth in paragraph(2). a defendantchargedwith a

violation of section3802 (relatingto driving under influenceof alcoholor controlled substance)may be consideredby the attorney for theCommonwealth for participation in an Accelerated RehabilitativeDisposition programin acounty if the programincludesthe minimumrequirementscontainedin thissection.

(2) The attorneyfor the Commonwealthshall not submit a chargebroughtunder this chapterfor AcceleratedRehabilitativeDispositionifanyof thefollowing apply:

(i) Thedefendanthasbeenfound guilty of or acceptedAcceleratedRehabilitativeDisposition of a chargebrought under section 3802within ten yearsof the date of the currentoffenseunlessthe chargewas for an ungradedmisdemeanorundersection3802(a)(2)andwasthe defendant’sfirst offenseundersection3802.

(ii) An accident occurred in connection with the eventssurrounding the current offense and an individual other than the

defendantwaskilled or sufferedseriousbodily injury asaresultof theaccident.

(iii) Therewas a passengerunder 14 yearsof agein the motorvehiclethedefendantwas operating.

(b) Evaluation and treatment.—(1) A defendantofferedAcceleratedRehabilitativeDispositionfor a

violation of section 3802 is, as a condition of participation in theprogram,subjectto the following requirementsin additionto anyotherconditionsof participationimposedby thecourt:

(i) The defendant must attend and successfullycomplete analcohol highway safety school established under section 1549(relating to establishmentof schools).A participatingdefendantshallbe given both oral and written notice of the provisionsof section1543(b)(relating to driving while operatingprivilege is suspendedorrevoked).

(ii) Prior to receivingAcceleratedRehabilitativeDisposition orotherpreliminarydisposition,the defendantmustbeevaluatedundersection 3816(a)(relating to requirementsfor driving under influenceoffenders) to determinethe extent of the defendant’sinvolvementwith alcohol or otherdrug andto assistthecourtin determiningwhatconditionsof AcceleratedRehabilitativeDispositionwould benefit thedefendantandthe public. If the evaluation indicates there is a needfor counselingor treatment,the defendantshall be subjectto a fullassessmentfor alcohol and drug addiction in accordancewith theprovisionsof section 3814(3) and (4) (relating to drug and alcoholassessments).

(iii) If the defendantis assessedundersubparagraph(ii) to be inneedof treatment,the defendantmust participateandcooperatewithalicensedalcoholor drugaddictiontreatmentprogram.The level andduration of treatment shall be in accordance with therecommendationsof the full assessment. Nothing in thissubparagraphshall preventa treatmentprogram from refusing toaccepta defendantif the programadministratordeemsthedefendantto be inappropriate for admission to the program. A treatmentprogram shall retain the right to immediately dischargeinto thecustodyof the probationofficer an offenderwho fails to comply withprogramrules and treatmentexpectationsor refusesto constructivelyengagein thetreatmentprocess.

(iv) The defendantmustremainsubjectto courtsupervisionfor sixmonths.

(v) The defendantmust make restitution to any person thatincurred determinablefinancial loss as a result of the defendant’sactionswhich resultedin the offense.Restitutionmust be subject tocourtsupervision.

(vi) The defendantmust pay the reasonablecostsof a municipalcorporationin connectionwith the offense.Fees imposedunderthissubparagraph shall be distributed to the affected municipalcorporation.

(vii) The defendantmust pay any other fee, surchargeor costrequiredby law. Exceptas set forth in subparagraph(vi) or (viii), afee or financial condition imposed by a judge as a condition ofAccelerated Rehabilitative Disposition or any other preliminarydispositionof any chargeunder this chaptershall be distributed asprovided for in 42 Pa.C.S. §~3571 (relating to Commonwealthportion of fines, etc.) and 3573 (relating to municipal corporationportionof fines,etc.).

(viii) The defendant must pay the costs of compliance withsubparagraphs(i), (ii) and(iii).(2) Thedefendantshallbesubjectto afull assessmentfor alcoholand

drugaddictionif anyof thefollowing apply:(i) The evaluationunderparagraph(l)(ii) indicatesa likelihood

thatthedefendantis addictedto alcoholor otherdrugs.(ii) The defendant’sblood alcohol content at the time of the

offensewasat least0.16%.(3) Theassessmentunderparagraph(2) shallbeconductedby oneof

the following:(i) TheDepartmentof Healthor its designee.(ii) The countyagencywith responsibilityfor county drug and

alcoholprogramsor its designee.(iii) Theclinical personnelof afacility licensedby the Department

of Health for the conductof drug and alcohol addiction treatmentprograms.(4) The assessmentunder paragraph(2) shall consider issuesof

publicsafetyandshall includerecommendationsfor all of thefollowing:(i) Lengthof stay.(ii) Levelsof care.(iii) Follow-upcareandmonitoring.

(c) Insurance.—(1) This subsectionshall only apply to a healthinsurance,health

maintenanceorganization or other health plan required to providebenefits under section 602-A of the act of May 17, 1921 (P.L.682,No.284),known asThe InsuranceCompanyLawof 1921.

(2) If an individual who is insured by a health insurance, a healthmaintenanceorganization or other health plan, that is doing businessinthis Commonwealth, the individual may not be deprived of alcohol andother drugabuseandaddictiontreatmentor coveragewithin thescopeofthat plan due to the identification of an alcohol or other drug problemwhich occursasa result of an assessmentunder this section.

(d) Mandatorysuspensionof operatingprivileges.—Asa condition ofparticipation in an AcceleratedRehabilitativeDisposition program, thecourt shallorderthedefendant’slicensesuspendedasfollows:

(1) Thereshall be no license suspensionif the defendant’sbloodalcoholconcentrationatthetimeof testingwas lessthan0.10%.

(2) For 30 daysif thedefendant’sbloodalcoholconcentrationat thetimeof testingwasatleast0.10%but lessthan0.16%.

(3) For 60daysif:(i) the defendant’sblood alcohol concentrationat the time of

testingwas0.16%orhigher;(ii) thedefendant’sbloodalcoholconcentrationis notknown; or(iii) an accidentwhich resultedin bodily injury or in damageto a

vehicle or other property occurredin connectionwith the eventssurroundingthecurrentoffense.

(e) Failuretocomply.— -

(1) A defendantwho fails to complete any of the conditions ofparticipation contained in this section shall be deemed to haveunsuccessfullyparticipatedin an AcceleratedRehabilitativeDispositionprogram, and the criminal record underlying participation in theprogramshallnot beexpunged.

(2) The court shall direct the attorney for the Commonwealthtoproceedon thechargesasprescribedin theRulesof Criminal Procedureif thedefendant:

(i) fails to meetanyof therequirementsof this section;(ii) is chargedwith or commits an offenseunder 18 Pa.C.S.

(relatingto crimesandoffenses);or(iii) violatesanyothercondition imposedby thecourt.

§ 3808. Illegally operatinga motor vehicle not equippedwith ignitioninterlock.

(a) Offensedefined.—(1) An individual requiredto only drive, operateor be in actual

physicalcontrol of themovementof a motor vehicleequippedwith anignition interlock system under section 1553(d.2) (relating tooccupationallimited license)or 3805 (relatingto ignition interlock)whodrives, operatesor is in actualphysical control of the movementof amotor vehicle within this Commonwealth without such a systemcommitsa summaryoffenseand shall, upon conviction,be sentencedtopay a fine of not less than $300 and not more than $1,000 and toimprisonment for not more than 90 days.

(2) An individual required to only drive, operate or be in actualphysicalcontrol of the movementof a motor vehicleequippedwith anignition interlock systemunder section 1553(d.2)or 3805 who drives,operatesor is in actualphysical control of the movementof a motorvehiclewithin this Commonwealthwithout sucha systemandwho hasan amountof alcoholby weight in his blood that is equalto or greater

than0.025%atthe timeof testingor whohasin his bloodanyamountofaScheduleI or nonprescribedScheduleII or III controlledsubstance,asdefinedin the actof April 14, 1972 (P.L.233, No.64), known as TheControlledSubstance,Drug,Device andCosmeticAct, or its metabolitecommitsa misdemeanorof the third degreeandshall, uponconviction,be sentencedto pay a fine of $1,000andto undergoimprisonmentfor aperiod of not lessthan 90days.(b) Tampering with an ignition interlock system.—A person that

tampers with an ignition interlock system required by law commits amisdemeanorof the third degreeandshall, upon conviction, be sentencedtopay a fine of not less than $300 nor more than $1,000 and to undergoimprisonment for not more than 90 days. The term “tampering,” in additionto any physical act which is intended to alter or interfere with the properfunctioning of an ignition interlock systemrequired by law, shall includeattempting to circumvent or bypass or circumventing or bypassing anignition interlock systemby:

(1) meansof using another individual to provide abreath sample;or(2) providing a breath sample for the purpose of bypassing an

ignition interlocksystemrequiredby law.(c) Suspensionof operating privilege.—Notwithstanding section

3805(c)and(i):(1) If a personwhois requiredto only drive, operateor bein actual

physical control of the movementof amotor vehicleequippedwith anignition interlock systemviolates this section,upon receiptof acertifiedrecordof the conviction, the departmentshall not issue a replacementlicenseto thepersonundersection 1951(d) (relating to driver’s licenseand learner’s permit) that does not contain an ignition interlockrestrictionfor aperiod of oneyearfrom thedateof conviction.

(2) Upon receiptof a certified record of a secondconviction of aviolation of this section committedby a personwho is requiredto onlydrive, operateor be in actualphysical control of the movementof amotorvehicleequippedwith an ignition interlock systemwhich occurredduring the same ignition interlock restricted license period, thedepartmentshall suspendthe person’soperatingprivilegesfor a periodof oneyearand recall1 the ignition interlock restrictedlicense,andtheperson shall surrenderthe ignition interlock restrictedlicenseto thedepartmentor its agentsdesignatedunderthe authorityof section 1540(relating to surrender of license). Following completion of thesuspensionperiod, the departmentshall requirethat the personcomplywith the requirements of section 3805prior to being eligible to receiveareplacementlicense under section 1951(d) that does not contain anignition interlock restriction.

(d) Applicability.—Notwithstanding section 3101 (relating toapplicationof part), this section shall apply in all areasthroughoutthisCommonwealth; however, it shall not apply to persons installing,maintainingor inspectingignition interlock devicesin the courseandscopeof theiremployment.§ 3809. Restrictionon alcoholicbeverages.

(a) Generalrule.—Exceptas set forth in subsection(b), an individualwho is an operatoror an occupantin a motor vehicle may not be inpossessionof an openalcoholicbeveragecontaineror consumeacontrolledsubstanceas definedin theact of April 14, 1972 (P.L.233,No.64),knownas The Controlled Substance,Drug, Device and Cosmetic Act, or analcoholic beveragein a motorvehiclewhile the motor vehicle is locatedonahighwayin thisCommonwealth.

(b) Exception.—This section does not prohibit possession orconsumptionby anyof thefollowing:

(1) A passengerin the passengerareaof a motor vehicledesigned,maintainedor usedprimarily for the lawful transportationof personsforcompensation.Thisparagraphincludesbuses,taxis andlimousines.

(2) An individual in the living quartersof a housecoachor housetrailer.(c) Penalty.—An individual who violates this section commits a

summaryoffense.§ 3810. Authorizedusenot adefense.

Thefact that a personchargedwith violating this chapteris or hasbeenlegally entitled to usealcoholor controlledsubstancesis not adefenseto achargeof violating this chapter.§ 3811. Certainarrestsauthorized.

(a) Warrantnot required.—Inaddition to anyotherpowersof arrest,apolice officer is authorizedto arrestan individual without a warrantif theofficer hasprobablecauseto believethatthe individualhasviolatedsection1543(b)(1.1) (relating to driving while operatingprivilege is suspendedorrevoked),3802 (relating to driving underinfluenceof alcoholor controlledsubstance)or 3808(a)(2)(relating to illegally operatinga motorvehiclenotequipped with ignition interlock), regardlessof whether the allegedviolation wascommittedin thepresenceof thepoliceofficer.

(b) Territory.—The authority under subsection•(a) extends to anyhospital or other medical treatmentfacility locatedbeyondthe territoriallimits of the policeofficer’s political subdivisionat which an individual tobe arrestedis found or was taken or removedfor purposesof emergencytreatment,examinationor evaluationas long as thereis probablecausetobelieve that the violation of section 1543(b)(1.l), 3802 or 3808(a)(2)occurredwithin thepoliceofficer’s political subdivision.§ 3812. Preliminaryhearingor arraignment.

(relating to driving while operatingprivilege is suspendedor revoked),3802(relating to driving under influenceof alcoholor controlledsubstance)or3808(a)(2)(relating to illegally operatingamotorvehiclenot equippedwithignition interlock) shall not reduceor modify the original chargeswithoutthe consentof theattorneyfor theCommonwealth.§ 3813. Work release.

In any case in which an individual is sentencedto a period ofimprisonmentas a result of a conviction for violating a provision of thischapter,thejudicial officer imposingthe sentenceshall considerassigningthat individual to a daytime work releaseprogram. Any work releaseprogram permittedunder this section shall be certified by the Drug andAlcohol Treatmentprogramadministrationas beingconsistentwith anydrug and alcohol treatment requirementsimposed under section 3814(relating to drugandalcoholassessments).§ 3814. Drugandalcoholassessments.

If adefendantis convictedor pleadsguilty or no contestto aviolation ofsection 3802 (relating to driving under influenceof alcohol or controlledsubstance),thefollowing applyprior to sentencing:

(1) Thedefendantshall be evaluated under section3816(a) (relatingto requirements for driving under influence offenders)and any otheradditional evaluation techniquesdeemedappropriateby the court todeterminethe extent of the defendant’sinvolvement with alcohol orotherdrug andto assistthe court in determiningwhat typeof sentencewould benefit the defendantandthepublic.

(2) Thedefendantshallbesubjectto afull assessmentfor alcoholanddrug addictionif anyof thefollowing subparagraphsapply

(i) The defendant,within tenyears prior to the offensefor whichsentenceis being imposed,hasbeensentencedfor anoffenseunder:

(A) section3802;(B) former section3731;or(C) an equivalentoffensein anotherjurisdiction.

(ii) Either:(A) the evaluation under paragraph (1) indicatesthere is a need

for counselingor treatment;or(B) the defendant’s blood alcohol content at the time of the

offensewasatleast0.16%.(3) Theassessmentunderparagraph(2) shallbeconductedby oneof

the following:- (i) The Departmentof Healthor its designee.

(ii) The county agencywith responsibilityfor county drug andalcoholprogramsor its designee.

(iii) Theclinical personnelof a facility licensedby theDepartmentof Health for the conduct of drug and alcohol addictiontreatmentprograms.

(4) The assessmentunder paragraph(2) shall consider issuesofpublicsafetyandshallincluderecommendationsfor all of thefollowing:

(i) Length of stay.(ii) Levelsof care.(iii) Follow-upcareandmonitoring.

§ 3815. Mandatorysentencing.(a) Countysupervision.—Notwithstandingthe lengthof any maximum

term of imprisonment imposed pursuant to sections 3803 (relating tograding) and 3804 (relating to penalties), and notwithstanding theprovisionsof section 17 of the act of August6, 1941 (P.L.861, No.323),referredto as the PennsylvaniaBoard of Probationand Parole Law, thesentencingjudge may grant parole under the supervisionof the countyparolesystemto any offenderservingasentencefor a violation of section3802(relating to driving underinfluenceof alcoholor controlledsubstance)and,if applicable,servinganyconcurrentsentenceof imprisonmentfor anymisdemeanoroffense arising from the same criminal episode as theviolation of section3802.The powerof thesentencingjudgeto grantparoleshall apply only to thoseoffenderswhosesentencesarebeing served in acounty prison pursuant to 42 Pa.C.S. § 9762 (relating to sentencingproceeding;placeof confinement)or section3804(d).

(b) Parole.—(1) An offenderwho is determinedpursuantto section3814 (relating

to drug and alcohol assessments)to be in need of drug and alcoholtreatmentshall be eligible for parolein accordancewith the termsandconditionsprescribedin this section following the expiration of theoffender’smandatoryminimum termof imprisonment.

(2) Thefollowing shall beconditionsof parole:(i) If theoffenderis not determinedundertheproceduresset forth

in section 3814 to be addictedto alcoholor anothersubstance,theoffendermustrefrainfrom:

(A) theuseof illegalcontrolledsubstances;and(B) the abuseof prescriptiondrugs,over-the-counterdrugs or

anyothersubstances.(ii) If the offenderis determinedundertheproceduresset forth in

section 3814 to be addictedto alcohol or anothersubstance,theoffendermustdoall of thefollowing:

(A) Refrainfrom: -

(I) theuseof alcoholor illegal controlledsubstances;and(II) the abuseof prescription drugs, over-the-counterdrugs

or any other substances.(B) Participate in and cooperate with drug and alcohol

addictiontreatmentundersubsection(c).(c) Treatment.—

(1) Treatmentmustconform to assessmentrecommendationsmadeunder section3814.

(2) Treatmentmustbe conductedby a drug andalcohol addictiontreatmentprogramlicensedby theDepartmentof Health.

(3) Thetreatmentprogramshall report periodically to the assignedparoleofficer on the offender’s progressin the treatmentprogram.Thetreatmentprogram shall promptly notify the parole officer if theoffender:

(i) fails to complywith programrules andtreatmentexpectations;(ii) refusesto constructivelyengagein thetreatmentprocess;or(iii) without authorization terminates participation in the

treatmentprogram.(4) Upon notification underparagraph(3), the parole officer shall

report the offender’s actions to the parole authority and to thedepartmentfor compliancewith section 1553(e) (relating to occupationallimited license).Theparoleauthorityshall schedulearevocationhearingto consider recommendationsof the parole officer and the treatmentprogram.

(5) Nothing in this subsectionshall preventa treatmentprogramfrom refusingto acceptanoffender if the programadministratordeemsthe offender to be inappropriatefor admissionto the program. Atreatmentprogramshall retain the right to immediatelydischargeintothecustodyof theassignedparoleofficer an offenderwhofails tocomplywith program rules and treatment expectations or refuses toconstructivelyengagein thetreatmentprocess.(d) Enforcement.—

(1) This subsectionappliesto an offenderorderedto participatein atreatmentprogramundersubsection(b)(2)(ii) who:

(i) fails to complywithprogramrulesandtreatmentexpectations;(ii) refusesto constructivelyengagein thetreatmentprocess;or(iii) terminatesparticipationin the treatmentprogram without

authorization.(2) Notwithstandingany otherprovisionof law, all of the following

applytoanoffenderunderparagraph(1):(i) The offender’s parole, prerelease,work releaseor anyother

releasestatusshallberevoked.(ii) The offender shall be ineligible for parole, prerelease,work

releaseor any otherreleasefrom the correctionalfacility prior to theexpiration of the offender’s maximum term unless the offender ispermittedtobereadmiuedto atreatmentprogram.(3) Nothing in this subsectionshallbeconstruedto grantalegalright

to paroleto an offenderpreviouslyineligible for parole,on the groundsthat theoffender is currentlypreparedto participatein, comply with andconstructively engage in the treatment process. Under suchcircumstances,paroleor reparoleof the offender shall be at the paroleauthority’sdiscretion.

(e) Follow-up.—Afteran offenderhascompletedthe treatmentprogramundersubsection(c), theparoleofficer shall takereasonablestepstoensurethattheoffenderdoesnot abusealcohol,useillegal controlledsubstancesorabuse prescription drugs, over-the-counter drugs or any other suchsubstances.Thesereasonablesteps includerequiringchemical testingandperiodicreassessmentof theoffenderby thetreatmentprogram.

(0 Fees.—(1) Except as set forth in paragraph(2), the paroleauthorityshall

imposeupon an offendersubjectto this sectionreasonablefees to coverthecostof anyof thefollowing:

(i) Chemicaltestingof theoffenderrequiredunderthis section.(ii) An assessmentof theoffenderrequiredunderthis section.(iii) Drug or alcohol treatmentprovided in accordancewith the

assessment.(2) If the paroleauthority finds the offender to be unableto paythe

full amount of the fees requiredby paragraph(1) andsection 1541(d)(relating to period of disqualification, revocation or suspensionofoperatingprivilege), it shall require the offender to pay as muchof thefee as is consistentwith theoffender’sability to payandshall direct theassignedparoleofficer to establishareasonablepaymentschedulefor theoffender to payas muchof the remainingfeesas is consistentwith theoffender’sability to pay.(g) Insurance.—

(1) This subsectionshall only apply to a health insurance,healthmaintenanceorganizationor other health plan required to providebenefits under section 602-A of the act of May 17, 1921 (P.L.682,No.284),knownasTheInsuranceCompanyLawof 1921.

(2) If an individual who is insuredby a healthinsurance,a healthmaintenanceorganizationor otherhealthplan, thatis doing businessinthis Commonwealth,the individual may not be deprivedof alcoholandotherdrugabuseandaddictiontreatmentor coveragewithin the scopeofthat plandue to the identification of an alcoholor otherdrug problemwhich occursasaresultof an assessmentunderthis section.(h) Additional funding.—In order to support and augment the

diagnosticassessmentandtreatmentservicesprovidedunder this section,the Department of Health, the department and the PennsylvaniaCommissionon Crime and Delinquencyshall seek all availableFederalfunding, including funds available through the United StatesNationalHighway Traffic SafetyAdministrationand the Departmentof HealthandHumanServices.§ 3816. Requirementsfordriving under influenceoffenders.

(a) Evaluation using Court Reporting Network.—In addition to anyother requirementsof the court, every personconvictedof a violation ofsection 3802 (relating to driving under influenceof alcoholor controlledsubstance)andeverypersonofferedAcceleratedRehabilitativeDisposition

as a result of a charge of a violation of section 3802 shall, prior tosentencingor receiving AcceleratedRehabilitative Disposition or otherpreliminary disposition, be evaluated using Court Reporting Networkinstrumentsissuedby the departmentandany other additionalevaluationtechniquesdeemedappropriateby the courtto determinethe extentof theperson’sinvolvementwith alcoholor controlledsubstancesandto assistthecourt in determining what sentencing, probation or conditions ofAcceleratedRehabilitativeDisposition would benefit the person or thepublic.

(b) Court-ordered intervention or treatment.—A record shall besubmittedto the departmentas to whetherthecourt did or did not order adefendantto attenddrugandalcoholtreatmentpursuantto therequirementsof sections3804(relating to penalties),3814 (relating to drug andalcoholassessments)and 3815 (relating to mandatory sentencing).If the courtorders treatment,a report shall be forwarded to the departmentas towhetherthe defendantsuccessfullycompletedthe program.If a defendantfails to successfullycomplete a program of treatmentas orderedby thecourt, the suspensionshall remainin effect until the departmentis notifiedby the court thatthedefendanthassuccessfullycompletedtreatmentandthedefendantis otherwiseeligible for restorationof hisoperatingprivilege. Inorder to implement the recordkeepingrequirementsof this section, thedepartmentand the court shall work together to exchangepertinentinformationabouta defendant’scase,includingattendanceandcompletionof treatmentor failure tocompletetreatment.§ 3817. Reportingrequirementsfor offenses.

(a) Requirement.—Thedepartmentshall makean annual report on theadministrationof thischapter.Thedepartment.theAdministrativeOffice ofPennsylvaniaCourts and the PennsylvaniaSentencingCommissionshallwork togetherto exchangepertinentinformationnecessaryto completethisreport.

(b) Contents.—Thereport shall include the following information bycounty:

(1) Thenumberof offenderschargedwith aviolation of section3802(relating to driving under influenceof alcoholor controlledsubstance)sortedby thesubsectionunderwhichtheoffenderwascharged.

(2) The numberof offenders convictedof violating section 3802sortedby the subsectionunderwhichtheoffenderwasconvicted.

(3) The number of offenders admitted to an AcceleratedRehabilitativeDispositionprogramfor violating section3802 sortedbythesubsectionunderwhichtheoffenderwascharged.

(4) The number of offenders completing an AcceleratedRehabilitativeDispositionprogramfor a violation of section3802sortedby thesubsectionunderwhichtheoffenderwascharged.

(5) The numberof personsrefusing a chemical test sortedby thenumberof prioroffenses.

(8) Thenumberof offenderssentto treatmentfor alcoholanddrugproblemsandaddiction.

(9) The namesof the treatmentfacilitiesprovidingtreatmentandthelevel of careandlengthof stayin treatment.

(10) Thenumberof offenderssuccessfullycompletingtreatment.(11) The number of first, second, third and subsequentoffenders

sortedby the subsectionof section 3802 underwhich the offender wascharged.

(12) The number of first, second, third and subsequentoffenderssortedby the subsectionof section 3802 underwhich the offenderwasconvicted.

(13) The numberof offenderswho violatedsection 3802 for whomcostsfor assessmentandtreatmentwerewaivedby thecourt.

(14) Thenumberof offenderswho violated section3802 for whomfinesandcostswerewaivedby thecourt.(c) Recipients.—Theannualreport shall be submittedto the Judiciary

Committee,Public Health and Welfare Committeeand TransportationCommitteeof the Senate; the Health and Human Services Committee,Judiciary Committee and Transportation Committee of the House ofRepresentatives;andthe Departmentof HealthBureauof DrugandAlcoholPrograms,who shall utilize the data for programplanningpurposes.TheBureauof Drug andAlcohol Programsshall considerincreasesin countydrug andalcoholprogramcoststhat result from the implementationof thischapterwhenproposingannualappropriationsrequests.Thereport shallbemadeavailableto thepublic.

Section 17. Sections6308(b)and6506(a)(7)of Title 75 areamendedtoread: -

§ 6308. Investigationby policeofficers.

(b) Authority of policeofficer.—Whenevera policeofficer is engagedina systematicprogramof checkingvehicles or drivers or has [articulableand reasonablegroundsto suspecta violation of this title,] reasonablesuspicionthata violation of this title is occurringor hasoccurred,hemaystop a vehicle, upon requestor signal, for the purposeof checking thevehicle’sregistration,proofof financialresponsibility,vehicleidentificationnumberor enginenumberor the driver’s license,or to securesuch otherinformationastheofficer mayreasonablybelieveto benecessaryto enforcetheprovisionsof thistitle.

§ 6506. Surcharge.(a) Levy andimposition.—In addition to any fines, fees or penalties

leviedor imposedasprovidedby law, under this title or anyotherstatute,asurchargeshall be levied for dispositionin accordancewith subsection(b)asfollows:

(7) Upon conviction of offenses under [section 3731] section1543(b)(1.1)(relating to driving while operatingprivilege is suspendedor revoked),3802 (relating to driving under influenceof alcohol orcontrolled substance)or 3808(a)(2) (relating to illegally operatingamotor vehiclenot equippedwith ignition interlock), or uponadmissionto programs for AcceleratedRehabilitative Disposition for offensesenumeratedin section [3731,] 1543(b)(1.1), 3802 or 3808(a)(2), asurcharge,respectively,of:

(i) $50 for the first offense.(ii) $100for the secondoffense.(iii) $200for thethird offense.(iv) $300for thefourth andsubsequentoffenses.

Theprovisionsof this subsectionshall not applyto anyviolation committedby the operatorof amotorcycle,motor-driven cycle,pedalcycle,motorizedpedalcycleor recreationalvehiclenot intendedfor highwayuse.

Section18. Theadditionof 75 Pa.C.S.§~3814and3815 shall applyasfollows:

(1) Exceptas set forth in paragraph(2) or (3), after June30, 2009,for anoffendersentencedunderthischapter.

(2) On and after the effective date of this section for an offendersentencedfor amisdemeanorof thefirst degree.

(3) After June30, 2006,foranoffendersentencedpursuantto section3804(a)(3),(b)(2) and(c)(1).Section 19. Notwithstandingany otherprovisionof law to the contrary

and in order to facilitate the prompt implementationof this act, initialcontractsenteredinto by the Departmentof Transportationnecessarytocarryout any of theprovisionsof this act,including theprocurementof anynecessarycomputerhardware,software, licensesor relatedservices,shallnot be subjectto the provisionsof 62 Pa.C.S.The departmentshall solicitmultiple bids and shall provide written justification for the selection ofsuccessful vendors. Contracts madepursuant to the provisions of thissectionshallnot exceedtwo years.

Section20. TheDepartmentof Transportationhasthefollowing duties:(1) In order to implementtheamendmentor addition of 75 Pa.C.S.

§~1553(b)(1), (c), (d)(6), (8) and(9), (d.1), (d.2), (d.3), (e) and(0 and3805,thefollowing shallapply:

(i) Thedepartmentshalladoptanduseguidelines,which shallbepublishedin the PennsylvaniaBulletin. The guidelinesshall not be

subject to review under section 205 of the act of July 31, 1968(P.L.769,No.240),referredto astheCommonwealthDocumentsLaw,and the act of June 25, 1982 (P.L.633, No.181), known as theRegulatoryReviewAct.

(ii) By September30, 2004,the departmentshall, in accordancewith law, promulgateregulationsto replacethe guidelines undersubparagraph(i).

(iii) Theguidelinesundersubparagraph(i) shall:(A) take effectFebruary1, 2004,or immediately,whicheveris

later; and(B) expireon theearlierof:

(I) the effective dateof regulationsundersubparagraph(ii);or

(II) September30,2005.(2) By October 1, 2004,the departmentshall promulgateregulations

to implement75 Pa.C.S.§ 1549(b).(3) Enlist the cooperationof all individuals and entitieswho are

authorizedto physicallyseizeaperson’sdriver’s licenseandreportbackto theGeneralAssemblyaboutwhat policies arein placeto ensurethatthe departmentis notified and that the term of suspensionbeginsuponseizure of the person’s driver’s license. The report shall includeinformation aboutthe numberandnatureof complaintsregardingthissystemand efforts undertakenby the variousagenciesto improvethisprocess.Thereport shall beissuedwithin 180 daysof the effectivedateof thissection.Section21. Thefollowing shallapply:

(1) The repeal of 18 Pa.C.S. § 7513 shall not affect offensescommittedprior to February1, 2004.

(2) Therepealof 18 Pa.C.S.§ 7514 and75 Pa.C.S.§ 3731 shall notaffect offenses committed prior to February 1, 2004, or civil andadministrativepenaltiesimposedasaresultof thoseoffenses.

(3) An individual sentencedunder 18 Pa.C.S.§ 7514 or 75 Pa.C.S.§ 3731 shallbe subjectto administrativeandcivil sanctionsin effect onJanuary31, 2004.

(4) An individual sentencedunder75 Pa.C.S.Ch. 38 shallbe subjectto administrativeandcivil sanctionsunderthis act.

(5) The following apply to offensescommitted beforeFebruary1,2004:

(i) Exceptas setforth in subparagraph(ii) or (iii), this actshallnot affect an offensecommitted before February 1, 2004, or anycriminal, civil andadministrativepenaltyassessedas a resultof thatoffense.

(ii) Subparagraph(i) does not apply if a provision addedoramendedby this act specifiesapplicationto an offensecommitted

(iii) Subparagraph(i) doesnotapplyto the following provisions:(A) The amendmentof 42Pa.C.S.§ 7003(5)in section3 of this

act.(B) Theamendmentof 75 Pa.C.S.§ 1516(c)and(d).(C) Theamendmentof 75 Pa.C.S.§ 1534(b).(D) Theamendmentof 75 Pa.C.S.§ 1547(d)in section9.1 of

thisact.(E) The amendmentof 75 Pa.C.S. § 3731(a)(4)(i) and

(a.l)(1)(i) in section13 of thisact.Section22. Thisactshalltakeeffect as follows:

(1) Thefollowing provisionsshall takeeffect immediately:(i) Section19 of thisact.(ii) Section20 of thisact.(iii) This section.

(2) Thefollowing provisionsshall takeeffect September30, 2003,orimmediately,whicheveris later:

(i) The amendmentof 42 Pa.C.S.§~7002(b) and 7003(5) insection3 of thisact.

(ii) Theamendmentof 75 Pa.C.S.§ 1547(d)in section9.11 of thisact.

(iii) The amendmentof 75 Pa.C.S.§ 3731(a)(4)(i) and(a.1)(1)(i)in section 13 of thisact.(3) Theremainderof this actshall takeeffectFebruary1, 2004.
