SUMMARY OF EVENTS

Initial Situation:

Fried Industries, Inc. is located at 11 Fresh Pond Road, East Brunswick, New Jersey. The site occupies 25.9 acres on Fresh Pond Road. It is bound by Fresh Pond Road on the east and an unnamed creek on the west. Fried Industries operations occupy the central four or five acres. The rest of the prooertv is covered by scrub veqetation. A stream running south to north is located on the west of the site. There is a large pond near Fresh Pond Road (Figures 1 and 2). Drainage from the site is into Bog Brook and Mill Pond thence to Lawrence Brook, tributary to the Raritan River.

Pried Industries, Tnc.'s operation consists of formulating and packaging aaueous detergent solutions (which contain water, surfactant, sodium metasilicate or soda ash and either ammonia, butyl cellosolve or sodium triphosphate), floor finishing products (which contain mineral spirits, butyl cellosolve or methyl carbitol and formaldehyde) and the resale of 1,1,1-tri-chloroethane. The facility was operated from 1978 to December 24, 1985, at which time Fried Industries and all lessors, employees, contractors or agents of Fried Industries ceased all production activities at the request of the EPA. The lessor mentioned is NOAL Corp., a formulator of automotive antifreeze products, which has leased the facility on a timeshare basis since 1980, NOAL's products contain methanol and ethelyne glycol. Fried Industries did toll manufacturing of cleaning products for Compuchem Corp. from 1982 until June, 1984. These products included several that contained toluene or 1,1,1-tri-chloroethane. Pried Industries also leased its facility on a timeshare basis to See Corp. from 1979 to 1981.

Located on this site are a holding tank, septic tank and impound­ment shed. The tanks contained.a variety of organic compounds, the primary constituents being methylene chloride, 1,1-dichloro-ethylene, I,1,1-trichloroethane and toluene. The tanks were filled to capacity, the contents overflowinq to the drainage entering Bog Brook and seeping into the ground thus threatening the Farrington Aouifer.

Based on "Interim Policy on nse of 311(k) Pollution Fund for Response to Hazardous Substances Discharges" (December 11, from Henry L. Lonqest II) citinn n.s. Coast Guard Headquarters telegram of November 27, 1985, on use of funds to conserve limited CERCLA funds, EPA II requested permission to apply 311(k) funds to the Fried Industries removal of aqueous wastes contaminated with toluene and chlorinated hydrocarbons. Toluene and the chlorinated hydrocarbons found, including dichloroethane, dichioroethylene, and chloroform are on the list of 297 hazardous substances designated in 40 CFR Part 116.

Removal Action:

The course of action agreed upon consisted of pumping the contents of the holding tank, septic tank and impoundment shed (septic tank overflow) into vacuum trucks (approximately 10,000 gal.) for treatment disposal at a licensed plant.

Chronology of Event!

December 11, 1985 Mr. Fried informed Middlesex County Department of Health (MCDH) that the facility's "holding tank" was full and in danger of overflowing.

MCDH requested that EPA make an on-site investigation of Fr'ied Industries.

EPA conducted a site visit- TAT took samples of the process waste tank and the septic holding tank for volatile organic analysis (VGA). Toluene and chlorinated hydrocarbons were found by analysis of samples.. There was also evidence that the facility's septic , tank had overflowed; '"•': : /*

On December 26, 1985, EPA Region II issued the Region's CERCLA notice form entitled "Notice to Responsible Party under CERCLA of 1980" to:

Phillip Fried, President Fried Industries, Inc.

The party indicated on December 26, 1985, that he would not take any corrective action on site at this time.

State and Local Forces:

The Middlesex County Department of Health (MCDH) received the report from Mr. Fried that his tanks were ready to overflow. MCDH notified EPA and requested EPA make an on-site investigation.

Federal Agencies and Special Forces:

The U.S. EPA alongvwlthvtheWeston/SFER Technical. Assistanc&^-^^^^ "r Team (TAT) developed the site stabilization plan, vEPA'directed ; its implementation. These stabilization measures were carried out by Clean Venture, Inc. The immediate threat to the environ­ment was abated within nine weeks . The Regional Response Team' (RRT) was not activated, nor was EPA's Environmental Response Team (ERT) or the Coast Guard Strike Team required. ' The Coast Guard did, however, make §311 Funding available.

PROBLEMS ENCOUNTERED

The cost of the project was increased by dividing work to cover two days. Had two vacuum trucks and crews been sent on the same day, EPA/TAT Monitoring would have been kept to a minimum. In addition, on February 6, 1986, EPA was not notified that Clean Venture would not be on site until after EPA/TAT had departed for the site. The'contamination of the waste in the truck on February 10, 1986 could have been avoided by Clean Venture's cleaning out their trucks and hoses between jobs. In the future, contamination of aqueous waste with oil phase waste, will 'be avoided by examining tank trucks brought on the removal site before their tanks are placed into service.

A. Clean Venture, Inc.. with whom an Authorization to Proceed with removal was signed, submitted the fees for evaluation of the aqueous waste at SCA-Newark, subsidiary of Waste Management, Inc.. EPA II AWM has notified ERRD that SCA-

.Newark's operating status is acceptable with respect to RCRA. reauthorization regulations.

B. Clean Ventures is also searching for other TSD candidates should SCA not be able to treat the waste. (DuPont's Deepwater waste facility rejected the waste earlier due to its septic nature.)

3. MEASURES WHICH COULD AVOID RELEASES OF SIMILAR NATURE:

A. The releases of mixed process and septic waste on the Fried Industries site could have been avoided through separation of process and septic wastes together with a scheduled pumping routine, coordinated with plant operations, and well in advance of tank over-flow conditions'

B. From EPA II Air and Waste Management personnel it is known that Fried Industries has neglected to establish EPA Generator status and thus has found it difficult to hire Waste contractors to remove wastes from the plant site. Corrective measures for prevention of future releases should, start with adherance to EPA regulations under RCRA.

4. FUTURE PLANS AND RECOMMENDATIONS:

EPA II will proceed with the pumping, transport'and treatment/disposal of the wastes as soon as a waste disposal facility will accept the material.

A. Operations at Fried Industries have been shut down since 12/24/85. The full tanks together with the impoundment in a nearby shed, described in POLREP One, are receiving no further waste material. A disposal firm. Perk Chem Co., has been selected by Clean Venture to dispose of the process waste. Perk Chem Co. will dispose of the waste at Modern Transport, Kearny, N.J. Part of the waste also contaminated with septic material has been qualified for acceptance at Middlesex County Utilities Authority (MCUA).

B. The removal will be done against PIC No. 2-6-0025 issued *l/3/86. EPA will employ I.D. No. NJP000789271 and act as the generator for purposes of the removal.

Ci EPA II is in the process of checking the RCRA status of treatment/disposal subcontractors Perk and Modern.

ACTION TAKEN:

A. EPA conducted a site visit on February 3, 1986 to monitor the removal, by contractor Clean Venture, of 5,000 gallons of the part of the solvent containing waste that is contaminated with septic material.

B. A total of 1,500 gallons of the waste was pumped from the septic tank and the remaining 3,500 gallons were pumped from the shed covered impoundment.

C. By previous arrangement this waste was taken to MCUA for treatment and disposal.

D' Clean Venture, Inc. is standing by to remove the remaining volume, estimated at up to 5000 gallons of process waste from the process waste holding tank.

MEASURES WHICH COULD AVOID RELEASES OF SIMILAR NATURE:

A. The releases of mixed process and septic waste on the Fried Industries site could have been avoided through separation of process and septic wastes together with a scheduled pumping routine, coordinated with plant operations, and well in advance of tank over-flow conditions.

B. From EPA II Air and Waste Management personnel it is known that Fried Industries has neglected to establish EPA Generator status and thus has found it difficult to hire waste contractors to remove wastes from the plant site. Corrective measures for prevention of future releases should start with adherence to EPA regulations under RCRA.

FUTURE PLANS AND RECOMMENDATIONS:

EPA II will monitor the pumping, transport and treatment and disposal of the remaining waste scheduled to begin on 2/7/86.

2. ACTICTg TAKEN:

A. On this day, 10 February, EPA monitored the removal of the contents of the process waste tank on the Fried Industries site as performed according to the 3 January Authorization-To-Proceed and order stipulating the work attadied thereto.

B. A total of 1,500 gallons of the waste Wcis pumped from the tank (no free board remaining) by Clean Venture. The OSC acconpemied the tank truck to Perk Chem in Elizabeth, N.J. to v^om sanples of the waste had been previously submitted with contents stated. Iterk Chan made an independent ansdysis of the sanple and found it to be acceptable for treatment/disposal.

C. Perk Chan sampled the truck tank cc»itents on our arrival from Fried Industries and found the material to be contaminated with oil that was wetting the interior of the Clean Venture truck tank.

D. Perk Chem has held the 1500 gal. pending a suitable disposal site other than Modern. ' - >w

2. ACTION TAKEN:

A. The shipment of 10 February containing approx. 500 ppb toluene, 100 ppb 1,1 dichloroethane, 90 ppn methylene chloride, 6 ppb ethyl­benzene and 590 ppb Zn, 205 ppb tt> wais transported to Perk Chemical vAiere it was found to have picked up a skim of fuel oil from the tanker truck. It was retested to insure that only hydroccurbons were added to the aqueous naterial, and then nenifested ais waste oil combustible liquid to United Oil Recovery, Meridan CT 06450 under manifest CrD021816889.

B. The contractor's charges for the two days of marpower, equipment and fees (including laboratory evaluation of samples at SCA/Newark) are in the process of being invoiced by Clean venture. The values anticipated are....
