Major Issue from Focus Group: • Paper filers get earlier notice

of publication than those who have authorized electronic communications.

• As a result of the focus groups, electronic notices of publication are emailed when the paper advance notice normally sent.

Best Method of Maintaining a Use-Based Register

• In re Bose Corp., 580 F.3d 1240 (Fed. Cir. 2009) changed the fraud standard from the line of cases following Medinol Ltd. V. Neuro Vasx Inc., 67 USPQ2d 1205 (TTAB 2003).

• Bose raised issues of the integrity of register regarding allegations of use
