MR. PRESIDENT:

The Committees on Local Government; and Electoral and People's Participation, to

which was referred House Bill No. 4937, introduced by Representative Victor A. Yap

entitled:

“AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY CARE IN THE CITY OF

TARLAC, PROVINCE OF TARLAC"

have considered the same and have the honor to report it back to the Senate with the

recommendation that it be approved with the following amendments;

1. On page 1, line 4, before Sec. 2 (Conduct and Supervision of Plebiscite), insert a

new section to read as follows:

"SEC. 2. TERRITORIAL BOUNDARIES. - THE TERRITORIAL BOUNDARIES OF BARANGAY

CARE SHALL BE IDENTIFIED AS FOLLOWS:

Bounded on the Northeast (NE) and Southeast (SE), along lines 1 to 61, by Brgy.Tibag (Pb-03-000061);

On the Southeast (SE) and Southwest along lines 61 to 95, by Brgy. Tibagan (Pb-03-000061);

On the Southwest (SW) & Northwest (NW), along lines 95 to 106, by Tarlac City vs. Municipality of San Jose, both in Tarlac;

On the Northwest (NW), along lines 106 to 108, by San Jose Cadastre ((Pb- 03-000060);

On the Northeast (NE), along lines 108 to 114, by Tarlac City vs. Municipality of San Jose, Tarlac;

On the North (N) and West (W), along lines.114 to l 16 by San Jose Cadastre (Pb-03-000060;

On the Northeast (NE) and Northwest (NW), along lines 116 to 143 to the point of beginning by Barangay Sapang Maragul (Pb-03-000061), all of Tarlac City.

2. RENUMBER SUCCEEDING SECTIONS ACCORDINGLY.

3. On page 1, line 5, insert the phrase “ON MARCH 14, 1993" after the acronym

Canvassers on March 14, 1993".

AN ACT CREATING A DARANGAY TO BE KNOWN AS DARANGAY CARE IN THE CITY OF TARLAC, PROVINCE OF TARLAC

Be it enacted by the Senate and House o f Representatives o f the Philippines in Congress assembled:

1 Section I. Creation o f Barangay Care. - There is hereby created a

2 barangay to be known as Barangay Care in the City o f Tarlac, Province of

3 Tarlac.

4 Sec. 2. Conduct and Supervision o f Plebiscite. - The plebiscite

5 conducted and supervised by the Commission on Elections (COMELEC)

6 pursuant to Provincial Ordinance No. 2, Series of 1991 dated

7 September S, 1991 of the Sangguniang Panlalawigan of the Province o f

8 Tarlac, which ratified the creation o f Barangay Care as proclaimed by the

9 Plebiscite Board of Canvassers on March 14, 1993, shall serve as substantial

10 compliance with the plebiscite requirement under Section 10 of Republic Act

11 No. 7160, as amended, otherwise known as the “Local Government Code of

12 1991".

13 Sec. 3. Incumbent Barangay Officials. - The incumbent barangay

14 officials o f Barangay Care shall continue to bold office until such time that

13 their successors have been duly elected and qualified.

1 Sec. 4. Public Infrastructure and Facilities. — All public infrastructure

2 and facilities for public use existing therein at the time of the approval o f this

3 ■ Act are hereby transferred without cost or compensation to and shall be

4 administered by the new barangay.

5 Sec. 5.^ Internal Revenue Allotment Shares. — Barangay Care shall be

6 entitled to Internal Revenue Allotment (IRA) shares pursuant to Section 285 of

7 Republic Act No. 7160, as amended, otherwise known as the “Local

8 Government Code o f 1991”.

9 Sec. 6. Effectivity. — This Act shall take effect fifteen (15) days after

10 its publication in the Official Gazette or in a newspaper of general circulation.%
