BE it enacted by the Kin~'s Most Excellent Majesty, by and with the advice and consent of the Legis­

lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows ;-

1. This Act may be cited as " The North Coast Rail­way Act 0/1910."

in" The Railways Acts, 1863 to 1906,"* the Commissioner is hereby authorised and directed to prepare the plans and thereupon forthwith proceed with the construction of the said Railway ..

The said Railway shall consist of five Sections, namely-

Section A-Commencing at or near Rockhampton, on the .\orth Coast Railway, and proceeding in a northerly direction to a point north of St. Lawrence, on the northern boundary of the Railwav .District constituted for Section A as hereinabfter provided, by a route delineated in the First Schedule to this Act, being a total length of construction of one hundred and twenty-three miles or thereabouts;

Section B-Commencing at the terminal point of S~ction A, and proceeding in a northerly direction by way of Kelvin Grove to a point on the Mackay Railway about three and a-half miles south-west of Mackay, commencing again at a point on the Mackay Railway, and proceeding in a northerly direction to near Midge Point, on the nortllcrn boundary of the Railway District constituted for Section B as hereinafter provided, by a route delineated in the First Schedule to this Act, being a total length of construction of one hundred and twenty-two miles or thereabouts;

Section C-Commencing' at the terminal point of Section B, and proceeding in a northerly direction to near Bowen, including the Proserpine Tramway if and when such Tram­way is acquired under this Act, commencing again at Bobawaba, on the Bowen Railway, and proceeding in a northerly direction to the southern bank of the Burdekin River, on the northern boundary of the Rail way District constitutAd for Section C as hereinafter pro­vided, by a route delineated in the First Schedule to this Act, being a total length of construction of thirty miles and to be acquired of t.hirty-eight miles or thereabouts;

Section D-Commencing at the terminal point of Section C, and proceeding in a northerly direction to near Townsville, including the Ayr Tramway if and when such Tramway is acquired under this Act, commencing again at Townsville and proceeding in a northerly direction by way of Ingham to a point near . Cardwell, on the northern boundary of the Railway District constituted for Section D as hereinafter provided, by a route delineated in the First Schedule to this Act, being a total leng,th of construction of ninety-one miles and to be acquired of forty-four miles or thereabouts;

Section E-Commencing at the terminal point of Section D, and proceeding in a northerly direction by way of Geraldton to Cairns, including the Cairns-Mulgrave Tramway if and when such Tramway is acquired under this Act, commencing again near Geraldton, and proceeding by a branch line to Mourilyan Harbour, by a route delineated in the First Schedule to this Act, being a total length of construction of eighty-eight miles and to be acquired of thirty-s~ven miles or thereabouts:

Provided that it shall be lawful for the Commissioner,. if and when he thinks it necessary so to do, to deviate the Railway to a distance not exceeding ten miles on either side of the route as delineated in the First Schedule to this Act.

3. The Railw2.y Districts for Sections A, B, C, D, and E, respectively, shall be the areas of country the respective boundaries whereof are delineated in the First Schedule to this Act, and are described in the Second Schedule to this Act.

4. "The Railways Acts, 1863 to 1906,"* shall, save as is herein otherwise provided, apply to the North Coast Railway constructed or acquired within the aforesaid Railway Districts.

5. Section four of "The Railways Act of 1906 "t shall not apply to the aforesaid Railway Districts.

6. (1.) lThe Commissioner is hereby empowered for Purchase

and on behalf of the State of Queensland to enter into a ~~:~~ay. contract witp. the Ayr rframway Board for the purchase of the Ayr Tr~rri'vay. 'fhe consideration which shall be given or pas~ for the purchase of the said Tramway shall be the absMute extinguishment of the amount of the loans borro,*e'd from the Treasurer for the construction of the said 1'ra~way, with interest accrued on such amount, and the rele~se of the said Board and of the Local Authori-ties of Towrj.sville, Thuringowa, and Ayr from all liability or obligatior. in respect of such loans, and in additi.~n a cash pay~ent to the said Board of such sum as wIll make the total consideration amount to the sum or value of eighty-fi~e thousand pounds,and the said Board is hereby empowered ~nd authorised to enter into the said contract upon its o"\yn behalf and for and on behalf of the said Local A uth~rities. (3.) Upon the purchase of any Tramway in this section mehtioned, the same shall become vested in the Commissi01er, and shall be and be deemed for all pur­poses to be 'part of the North Coast Railway authorised by this Actto be constructed and of the Section thereof within the Railway District for which the same is con­stituted, a~d shall be worked and managed in connection therewith. 1I . (4.) For the purposes of" The Railways Act 0(1906,"* the actual cost of' any such 'l'ramway, when so purchaspd as· aforesaid, shall be deemed to be such sum as the Com­mis~ioner shall by his certificate declare, and that amount shall be included in the certificate to be given by the Commissioner under section five of the said Act as part of the actual cost of the construction of the Section whereof the said Tramway forms pa.rt.

(2.) The certificates of the Commissioner given pur­suant to section five of the said last-mentiol!ed Act, with respect to the actual cost of construction of the said Tramways as so extended, 8hall be deemed to be given for the purposes of this Act and for the purposes of "TIle Railways Act (if 1906."* The respective amounts of such certificates shall be included 'in the certificate to be given by the Commissioner under section five of the said last­mentioned Act as part of the actual cost of the construction of Section B of the North Coast Rail way.

(3,) From' and after the completion of the said extension of the said Tramways and the making of the' certificates mentioned in the last preceding subsection, the Railway Districts respectively constituted pursuant to " The Mackay Railway Extension and Mc Gregor Creek Branch Railways Act of1909 "t shall be abolished, and the said Act shall be repealed', and the accounts kept by the

. Commissioner for the purposes of the said Districts and the said Tramways, includin~ such extensions, shall be transferred to the accounts to be kept for Section B of the North Coast Railway and taken into account accordingly.

public traffic, by a. certificate under his hand and published in the Gazette, declare the actual cost of the construction of such part, including the land resumption and rolling­stock, and shall thereafter, as and when the remaining parts of the Section are completed and opened for public traffic, give similar certificates, including in each the amount

. of all prior certificates given in pursuance of this Act, until the whole Section is completed and opened for public traffic. (i.) With respect to Sedioll A, by the ratepayers of the City of Rockhampton and the Town of North Rockhampton conjointly one-fifth, by the remaining ratepayers of the Railway District fonr-fifths ;

(ii.) With respect to Section B, by the ratepayers oE the Town of Mackay one-tenth, by the remaining ratepayers of the Railway District

(iii.) 'With respect to tlection C, by thc ratepayers of the Town of Bowen one-tenth, by the remaining ratepayers of the Rail way District nine-tenths;

(iv.) With respect to Section D, by the ratepayers of the City of Townsville one-fifth, by the remaining ratepayers of the Railway District. four-fifths;

(v.) With respect to Section E, by the ratep3yers of the 'rown of Cairns one-tenth, by the re­maining ratepayers of the Railway District nine-tenths.

BE it enacted by the King's :M:ost Excellent Majesty, by and with the advice and consent of the Legis­

lative Council and Legislative Assembly of Queensland in Parliament assembled, and by: the authority of the same, as follows :- .

1. This Act ma v be cited as " The Commercial Cause8 Act of 1910." .

2. In this Act, unless the context otherwise indicates, the following terms have the meanings respectively assigned to them, that is to say,-

" Commercial causes" include causes arising out of the ordinary transactions of merchants and traders; amongst others those relating to the
