He has also asked that we include the following message:- With the credit crunch starting to take its toll on the city banks and financial institutions it will only be a matter of time before communities start to feel the pinch. Local Development Plan - Rhyl Denbighshire County Council is currently drawing up the Local Development Plan for Denbighshire. This is a very important document which will decide how Denbighshire will be developed over the next 12 years. It will look at issues such as the number of houses to be built, where they will be built, public open space, land to be developed for employment and so on. You as residents should have been properly consulted over these very important issues. The previous Tory/ Independent Cabinet decided to open the consultation in three towns - Llangollen (population 5,000), Ruthin (pop. 5,000) and Rhuddlan (pop. 5,000). They did not include Prestatyn (pop. 19,000) or Rhyl (pop. 27,000). As a result, Denbighshire County Council received only 7 responses from Prestatyn and only 9 responses from Rhyl. I was made aware of the very poor response rate in early September. On Sept 12

th, together with my colleague Cllr Jeanette Chamberlain Jones I raised my concerns at

DCC's Local Development Plan working party and asked for the deadline for consultation to be extended. Other members of the working party including three Conservative councillors refused to back me. I am concerned that proper, meaningful communication has not taken place. Therefore, I include a form which I hope you will take time to consider. It outlines some of the key development issues facing Rhyl over the next 12 years. We believe that a meeting was called by Councillor Mc Evoy and chaired by Eric Davies at the Rhyl Town Hall on the 20th September 1990 at 7pm.

Do any residents remember that meeting?

The purpose of the meeting was to ask the residents of Park View what facilities would they like to see here on Llys

Brenig and Ffordd Elan.

This land was left by Whelmar for you the residents of Park View for recreation and open space. The conveyance clearly states this. The land was left by Whelmar after negotiations with the then residents association and local councillors, Chris Ruane was one of them. Questions now have to be asked " Why did the Planning Department accept a planning application from Anwyl which included this land.They are the trustees of this land and it is clear by their actions that they have let you the residents of Park View down and are not to be trusted.We call on you to voice your displeasure by writing to the Chief executive of the council Mr Ian Miller,and the leader of the council Mr Hew Evans and of course your local councillors and AMs and MPs.

Katherine Noble, Denbighshire County Council, Team Leader Public Realm, Botanical Gardens, Rhyl, Denbighshire, Dear Madam, Re: Dangerous condition of flagstoned areas along main entrance road ( Ffordd Elan ) into Park View Estate. In conversation with contractors on site surveying the two areas, it was mentioned that all the flagstones were to be lifted and disposed of and the land grassed over. A superb answer to the problem and we do not lose the trees in the process. From a recent article in the local press, it was highlighted how the costs in meeting claims against councils for uneven paving were escalating to astronomical proportions. A wholly unwelcome depletion of council resources. However there are always a few concerns and I think some consultation with the local residents who live facing these areas ( Ffordd Elan, Llys Cadnant, Llys Cowlyd, Llys Tegid, Llys Bodnant, Llys Padarn, Llys Peris and Llys Gwynant), would be very much appreciated, if only to advise of the changes being undertaken. The first concern is that of dog fouling. As you are aware the only area that dogs could have been exercised has been ring-fenced by a local developer and the Village Green has a restriction of use: no dogs allowed. A dog will always defecate on grass given the choice, hence the health concern. To encourage removal of offending material there is a real need for more bins. I am a responsible dog owner myself but frequently feel like a second-class citizen, as do many ratepayers, at the severe lack of community facilities on the Park View Estate. Now I have that off my chest, the Denbighshire County Council have a unique opportunity now to enhance their reputation with the residents. The two areas in question are predominantly at the entrance to this premier estate, therefore as well as grass, why not also have raised beds built surrounding the trees and completely covering the offending roots and at the same time providing welcoming flower beds!. Recently in Stafford town centre I saw large flower/shrub raised beds constructed using new railway sleepers. This also prevents the second concern, namely children playing ball games adjacent to the very busy Ffordd Elan road. Obviously the above would involve increased expenditure on the construction and future maintenance costs. However a partial solution to the latter would be to invite residents to form a group of volunteers to help maintain the flower beds under the supervision of a member of staff from the Parks Department. Apparently a Mr. Eric Black could secure from the community chest funding/grants to support this initiative. Please , please give this serious consideration. Review over Denbigh autism centre closure Jul 25 2008 by Tom Bodden, Daily Post Hyfrydle autism centre EDUCATION minister Jane Hutt yesterday ordered inspectors to review the closure of a North Wales residential centre for vulnerable children. There was an outcry from parents and staff when Denbighshire council decided to shut the much-needed facility for young people with autistic disorders. The Hyfrydle centre in Denbigh had been open for less than a year and the authority had been taking on extra staff shortly before the announcement. The minister intervened yesterday after a meeting with council leader Hugh Evans and interim corporate director of lifelong learning for Denbighshire Dr Mohammed Mehmet. She said in a written statement: “Improved leadership is now beginning to make a difference to the quality of education provided in Denbighshire. “However, the closure of Hyfrydle is a matter of concern, and raises questions about corporate decision-making within the authority.” The minister asked the social services inspectorate and schools inspectors Estyn to carry out a review, with financial watchdogs the Wales Audit Office. Any issues arising, including any wider and systemic matters, would be fed into the audit office’s scheduled review of Denbighshire’s corporate governance to take place in September, she said. Inspectors will consider the decision-making process through which it was decided to open a 52 week a year residential unit in November last year. It will report on the planning by the local authority to meet the needs of those young people already in residence, or intended to be in residence at Hyfrydle, once the closure decision had been taken. An assessment will take place of the potential effect of the closure on other social care and educational services at the Ysgol Plas Brondyffryn site. Ms Hutt said: “I anticipate this review will be complete by the time the Assembly returns from recess and I will make a further statement at that time.” Parents and child care staff broke down in tears after it was announced an autism centre would close. Denbighshire’s cabinet voted six to three in favour of shutting council-run centre after plunging thousands of pounds of taxpayers’ cash into it. Plaid AM Janet Ryder said: “I’m glad Jane Hutt has taken decisive action by sending in experts from CSSIW, Estyn and the Wales Audit Office to investigate why this new facility was closed just a few months after it opened. “I hope they will look closely at Denbighshire’s business plan and how they found themselves in this situation.” tombodden

Ian Miller, Chief Executive, said: “We are rather disappointed by the Minister’s statement, following the discussion that she had with the Leader and interim corporate director: lifelong learning on 23 July. The council was not consulted on the wording of her statement before it was issued”. Leader, Councillor Hugh Evans, said: “We will work with the Welsh Assembly Government on finding a viable, alternative use for the building as we did on the original development of Hyfrydle as 52 week residential provision. We have considered carefully at all times the implications of the closure decision for the young people placed at Hyfrydle and their families. We have also been mindful of the consequences for those who might have been placed in the coming weeks, and their families, and for staff of the unit. Intensive work is being taken forward both by our own officers, and those of other authorities, to find good alternative placements for the young people affected. We are also doing our utmost to avoid redundancy for the staff involved. “The Minister’s decision to ask two inspectorates and the Wales Audit Office to review the closure of this facility is noted. We look forward to being properly consulted on the detailed terms of reference for the study. “The council had already commissioned a review of the project from its conception 4 or 5 years ago, so that any relevant lessons can be learned and other action taken as necessary. We need to ensure that the inspectorate’s work does not duplicate the council’s review and does not divert resources in the council and other partners unnecessarily from other essential work. The terms of reference must also reflect the Welsh Assembly Government’s own involvement in the project and be based on a proper understanding of the facts – for example, the council is responsible for the planning of services for only two young people who are affected by the closure of Hyfrydle whereas the Minister’s statement implies that we are responsible for planning for all the young people affected. “No reference is made in the Minister’s statement to some of the key facts. The detailed work done by the council shows that the facility is not viable now and is not expected to

become viable. A significant element in that assessment is the existence of provision created by the private sector in North Wales and elsewhere in Wales. There are only two young people living in Hyfrydle, only one of whom is from Denbighshire. On this basis, the facility was losing the council £500,000 a year. Even if the three other young people for whom placements had been identified (again only one of them is from Denbighshire) had taken them up, the annual loss to the county council would still have been £300,000. Local residents and others would rightly question the council’s corporate governance and say it was “a matter of concern” if the council had not acted to stem such a significant financial drain on its resources. “We regret the Minister’s attempt to link a decision on one facility to “wider and systemic matters” and the council’s corporate governance. Major multi-functional organisations such as the Welsh Assembly Government and councils have a large range of projects, the majority of which are implemented satisfactorily. The council will receive a report on Tuesday about the £38.9 million capital programme for 2007-08: this illustrates the many projects that have been successfully managed and completed including the second phase of the development at Ysgol Tir Morfa, the special school in Rhyl, and the redevelopment of Ysgol Plas Brondyffryn.”

My science teacher brought a sprig of horse chestnut into the classroom and stuck it in a vase. 'When you come in on Monday this will be in full leaf. The sticky buds are about to burst,' she told us. With all the accumulated wisdom of a ten-year-old boy, I knew this to be rubbish. Returning to school on Monday, I was confident noth ing would have changed except the sprig would be a good deal wetter. But when I rushed over to look, there was the horse chestnut sprig in full bloom. It was the moment my love for trees was born. Forty years later, I have been touring Britain for a BBC2 series to find out whether we still value the trees that have shaped our landscape. What I discovered made me realise they are being threat ened like never before. Over the past few years, hundreds of thousands have been chopped down by councils due to ludicrous health and safety concerns and over-cautious insurance companies. In London more than 40,000 street trees have been felled in the past five years. Not only is this chainsaw mas sacre bad for the environment -trees reduce greenhouse gases by taking in carbon dioxide - but it is ruining the appearance of our suburbs, reducing air quality and having a detrimental effect on our quality of life. The disappearance of ancient established trees such as horse chestnuts and London planes -called shade trees because they create a large canopy - is particu larly worrying. In some cases, the old trees were diseased or dying, but in many oth ers bureaucrats ordered culls for ridiculous reasons, such as the 'danger' posed to children from falling conkers. The main culprits, however, are insurance companies. Of the 40,000 street trees felled in London since 2003, 40 per cent were removed because of subsidence claims. Yet 90 per cent of these claims were unwarranted. Subsidence occurs only on shrinkable soils such as clay, and while there are pockets of clay throughout the country, most homes are built on sand. Furthermore, a tree that has been growing for more than 100 years has formed a natural eco-system, It soaks up enough moisture to survive and doesn't do too much damage. More often, the reason houses suf fer from subsidence is because of broken Victorian drains or because the owners have paved over their front gardens so they can park their cars. As a result, less water goes into the soil and it shrinks. But insurers see a tree in the street and that gets the blame. While filming our series, we dis covered five fully-grown horse chestnuts at the East of England showground in Peterborough that were threatened with the chainsaw because they were hi the way of the 'outside events' arena. Fortunately, we persuaded the developers that the five-ton trees could be hauled out of the ground with a huge machine and moved just over quarter of a mile to the other side of the showground. Last month, in a bid to stem our tree-felling culture, the London Tree Officers Association devised a way of pricing trees according to their size, health, historical significance and how many people live nearby to enjoy them. An old plane tree in Berkeley Square, Mayfair, was valued at a stagger ing £750,000, making it Britain's most expensive tree. According to the LTOA, London's trees are worth more than £6.4 billion.

If the pricing system is adopted by local authorities, insurers will be obliged to prove a link between a tree and subsidence before they can start up their chainsaws. The higher the tree's value, the more proof firms will need before they chop it down. Ironically, many insurers dont realise that by culling trees they could actually be creating more problems. Why? Because by soak-big up moisture in the atmosphere, trees are a crucial defence against flooding. In China, millions of people were left homeless because tree felling in the mountains caused the central basins to flood. We have got to leam the same lessons in Britain. Trees intercept up to half of the rainfall in this country and if there isn't a tree or lawn to soak up the water, our rivers will flood. It's not until we lose trees that we realise their significance. In 1967, Dutch Elm disease hit Britain and 25 million trees died in a decade. That had a real impact on people. Suddenly, they realised their landscape was changing and began rediscovering their love for trees. Within a few years, however, this enlightened attitude was forgotten. The same thing happened in 1987 after a hurricane swept across the South East, destroying 15 million trees. It ted to the establishment of groups such as Trees For Cities to carry out replanting schemes. But today, again, we have forgot ten how important trees are. They have played a crucial role in making Britain the nation it is, providing us with materials for war, heating, food, fuel, building and transport. PRIME Minister Gordon Brown has been accused of ignoring the concerns of a group of Denbighshire resi dents fighting plans for large-scale housing devel opment. Last month a petition con taining almost 1,200 signa tures was sent to him by peo ple living in the Prestatyn area who said they had no faith in Denbighshire County Council as a planning authority and asking him to appoint a well-qualified official to investigate the authority's handling of planning issues. The concerns surround the coun cil's proposal in its Local Development Plan for a total of 7,500 new homes to be built in the county over the next 14 years, with only 50 of them believed to be south of the A55 corridor. The vast majority, therefore, will be built around Rhyl and Prestatyn, much of which is a flood plain, and local concerns have deepened after two recent inci dents of flooding in Prestatyn. Last week it was announced that Welsh Water are to spend £1.2m on improving drainage. Organisers of the petition, who are calling for a moratorium on building in the coastal area, say they have no confidence in the council or its officers who have already allowed too much develop ment, over-riding local objections. The objectors sent copies of the letter to Mr Brown to First Minister Rhodri Morgan, Denbighshire council leader Hugh Evans, chief executive Ian Miller and others. Only Vale of Clwyd AM Ann Jones replied. The covering letter with the peti tion said: "We fully appreciate that planning is a devolved issue to the Welsh Assembly, however as the experience of the majority of the signitaries to this petition have no

In a response from Downing Street a spokesman said that as the Prime Minister received thou sands of letters each week he was unable to reply personally to them all. "He does appreciate the time that people take to write to him and he has asked me to assure you that the points you make will be carefully noted," he wrote. But that reply has left the organ izers dissatisfied, and another let ter has been sent to the Prime Minister asking how he plans to progress the matter. "Is there little wonder that we feel that we are not being taken seriously?" said spokesman Jim Jones. Dear Sir/Madam Denbighshire Unitary Development Plan Review - Expressions of Interest As you may be aware the Denbighshire Unitary Development Plan (UDP) 1996 – 2011 was adopted in July 2002. The UDP sets out the Council’s, as Local Planning Authority, policies and proposals for the developmentand use of land to meet expected and future development needs. You are being contacted because you either made representations to the adopted UDP, or represent an organisation that we feel can make an important contribution to the Review of this important document. There is a statutory requirement that adopted UDPs are formally reviewed within 5 years. To achieve this, a start needs to be made now. Several key issues need early review to ensure the UDP is kept up to date, relevant and assists in meeting the continuing and changing development needs of the County. These include: · Housing, including affordable housing · Employment land · Town centres, retailing · Community facilities including provision of schools and recreational open space · Highways, transport · Minerals waste and energy · Protection/enhancement of the natural and built environment The UDP Review also needs to take account of the national policies and guidance and various other relevant reports and documents that have been issued since adoption. THE REASON(S) for the Council's decision to refuse permission is (are):

1. The site lies outside the defined settlement limits of Rhyl, as set out in the adopted

Denbighshire Unitary Development Plan, where restrictive policies apply to new

residential development. The proposal would lead to an unacceptable outward

expansion of the settlement of Rhyl and would set an unwanted precedent for further

such residential development and is contrary to Unitary Plan policies STRAT 6, GEN

3, GEN 4, GEN 6, HSG 2, HSG 5, and HSG 6. 2. The proposed development would be located within Zone C1 as defined on the

Development Advice Maps accompanying WAG Technical Advice Note 15 :

"Development and Flood Risk". The local planning authority does not consider the

development meets the justification tests in TAN 15 and the consequences of

flooding cannot be managed to an acceptable degree for this type of highly

vulnerable development. It is considered the development is likely to be at an

unacceptable risk from flooding, contrary to Policy ENP6, criteria x) of Policy GEN 6,

CPZ 4 of the Denbighshire Unitary Development Plan and advice contained within

Planning Policy Wales and TAN 15 "Development and Flood Risk". 3. In the opinion of the Local Planning Authority the scheme does not make satisfactory

provision for affordable housing or open space, contrary to policies HSG 10 and REG

2 of the Denbighshire Unitary Development Plan, related Supplementary Planning

Guidance Note No. 22 - Affordable Housing in New Developments, and Note No. 4 -

Recreational Public Open Space, and advice in Welsh Assembly Government

Technical Advice Note 2 - Planning and Affordable Housing and TAN 16 - Sport and

Recreation 1998. 4. It is the opinion of the Local Planning Authority that the siting of the proposed

buildings would be unacceptable and out of keeping with existing development in the

locality, and would have a detrimental impact on the character of the surrounding

locality and Green Barrier, which separates the towns of Rhyl and Prestatyn. The

proposals are considered contrary to policies and GEN 6 (i) and (ii), CPZ 2 criteria (i)

and policy GEN 5 and REC 7 of the Denbighshire Unitary Development Plan. 5. The proximity and juxtaposition of the proposed two storey buildings, in particular

proposed building plot numbers 1, 2, 3 and 4 would lead to an overbearing effect and

unacceptable overlooking and loss of privacy for the occupiers of No. 3 and 186

Brynheddydd Bay, contrary to policy GEN 6, criterion (v). 6. The Local Planning Authority considers that, in the absence of detailed ecological

surveys and any relevant mitigation measures, it is not possible to adequately assess

the potential impact on wildlife, and hence it is not possible to determine whether the

scheme is in compliance with policies ENV 1, 6, 7 and GEN 6, criteria ii), REC 7,
