1. Σύντομη παρουσίαση του διαγράμματος της παρούσας εργασίας: Το θέμα Στο παρόν πόνημα επιχειρείται μια ερμηνεία του άρθρου 20 §1 του ελληνικού Συντάγματος υπό το πνεύμα του Άρθρου 6 §1 της Ευρωπαϊκής Σύμβασης των Δικαιωμάτων του Ανθρώπου. Ειδικότερα, η εργασία επικεντρώνεται στη θεμελίωση της αρχής του κράτους δικαίου στην προαναφερθείσα διάταξη του Συντάγματος όπως αυτή εξειδικεύεται στο δικαίωμα παροχής εννόμου προστασίας. Πρώτα λοιπόν θα εξετασθεί η έννοια του κράτους δικαίου και οι επιμέρους δικαϊκές αρχές που αυτή περιλαμβάνει. Στη συνέχεια το ενδιαφέρον θα στραφεί ειδικότερα στο δικαίωμα παροχής έννομης προστασίας. Πιο συγκεκριμένα, αρχικά θα γίνει μια ιστορική αναδρομή εν σχέσει με την κατοχύρωση του σχετικού δικαιώματος σε προηγούμενα ελληνικά Συντάγματα. Έπειτα θα αναλυθεί το προστατευτικό αντικείμενο και οι φορείς του δικαιώματος αυτού γενικά. Το βασικό θέμα της παρούσας εργασίας είναι η έγκαιρη δικαιοσύνη, η οποία περιλαμβάνει αφενός την καθυστέρηση στην εκδίκαση των υποθέσεων και στην απονομή της, αφετέρου δε το δικαίωμα σε προσωρινή δικαστική προστασία. Σε ό,τι αφορά στο πρώτο ζήτημα επομένως, θα αναλυθεί αρχικά το εύλογο του χρονικού διαστήματος εντός του οποίου απαιτείται να εκδικασθεί μια υπόθεση, τα σχετικά κριτήρια και παραδείγματα από αποφάσεις του Δικαστηρίου του Στρασβούργου αλλά και ελληνικών δικαστηρίων, η σημασία της γρήγορης αλλά όχι βιαστικής απονομής της δικαιοσύνης, θα σκιαγραφηθεί η στάση και η πρακτική που ακολουθεί η Ελλάδα στο σχετικό θέμα όπως αυτή έχει πλειστάκις αποδοκιμασθεί από το Στρασβούργο, θα γίνει αναφορά σε ελληνική και διεθνή νομολογία αλλά και μια συγκριτική επισκόπηση του ζητήματος σε ευρωπαϊκό επίπεδο. Σε σχέση με την προσωρινή προστασία, θα αντιμετωπιστεί το ζήτημα του αν κατοχυρώνεται ή όχι με το άρθρο 20 §1 του Συντάγματος με αναφορά των σχετικώς διατυπωθεισών απόψεων, θα αναλυθεί το περιεχόμενο του δικονομικού αυτού δικαιώματος και τα ασφαλιστικά μέτρα ειδικότερα, οι προϋποθέσεις εφαρμογής του καθώς και πολλά παραδείγματα από την ελληνική νομολογία.

HE RIGHT TO A SPEEDY TRIAL AND THE RULE OF LAW
Synopsis
In this project we deal with the primary aspect of the principal of the rule of law, which is the right to a fair trial as it is protected both from the Greek Constitution and the European Convention On Human Rights. In particular, we regard the fact that justice should be delivered on time as our main subject, and stress out that a fair trial presupposes that the proceedings are of a reasonable length. After a brief introduction and a mention to the theories developed in the past, we attempt to point out the matters to which the first paragraph of article 20 of the Greek Constitution extends to, its protective core, the individuals who have the right to judicial protection as well as its content, and we do the same with the first paragraph of article 6 of the European Convention On Human Rights. We focus mostly on the right to a speedy trial and comment on the situation in Greece, a country that, based on the jurisprudence of the European Court of Human Rights, has violated the aforementioned article on many instances. We analyze some of these decisions, as well as examples of the jurisprudence of Greek Courts.
