NEPRA CREATION

NEPRA was created through the Act called thegRegulation of Generation, Transmission andDistribution of Electric Power Act, 1997 on 16th

fDecember, 1997 as part of strategic powersector reforms program envisaged byGovernment of Pakistan (GoP)Government of Pakistan (GoP).

MANDATE OF NEPRA

The Parliament passed NEPRA Act and the Authority wasset up on 16th December, 1997. Pursuant to Section 7 of theNEPRA A t th d t i t A th it i l dNEPRA Act, the mandate given to Authority includes:

To develop and pursue a Regulatory Frameworkwhich ensures provision of safe reliable efficient andwhich ensures provision of safe, reliable, efficient andaffordable electric power to the electricity consumersof Pakistan.

To facilitate transition from a protected monopolyservice structure to a competitive environment.

To maintain a balance between the interests of theconsumers and investors.

CONSTITUTION OF THE AUTHORITY

The Authority comprises of a Chairman who isappointed by the Federal Government.

TARIFF DETERMINATION

NEPRA determines tariffs for the three sectors namelyGeneration, Transmission and Distribution:

Under Section 7 (3) (a) of the Regulation of Generation, Transmission and Distribution of Electric Power Act (XL of 1997) NEPRA is exclusively responsible to determine tariff, rates, charges and other terms and conditions for supply of electric power services by the Generation, Transmission and Distribution Companies and precommend to the Federal Government for notification.

NEPRA TARIFF REGIME

NEPRA determines tariffs for the three sectors namelyGeneration, Transmission and Distribution:

Tariff for Generation Companies are determined on rate ofreturn (cost plus basis) in most cases, under long term (25

)to 30 years) PPAs;Tariff of Transmission Company is determined on annualcost plus basis where in addition to the costs certaincost plus basis where, in addition to the costs, certainreturn on equity or assets is allowed;Distribution Companies are mostly given tariffs on costplus basis, whereas multi-year tariffs (Performance Based)have also been determined by NEPRA for FESCO andKESC.

CRITERIA FOR TARIFF DETERMINATION

PUBLIC PARTICIPATION IN TARIFF DETERMINATION

During processing of petition for Determination of tariff, NEPRA’s procedure involves:

Petitions. – To issue notices of proceedings (Admission/Hearing).– Intervention: Any person who desires to participate in any

PERFORMANCE STANDARDS

In exercise of the powers conferred by Section 46 of the Regulation of Generation , Transmission and Distribution of l t i P A t 1997 d ith S ti 34 th felectric Power Act, 1997 read with Section 34 thereof,

National Electric Power Regulatory Authority, with the approval of the Federal Government has prescribed and notified:

Performance Standards (Distribution) Rules, 2005 thnotified in 11th January, 2005.

Performance Standards (Transmission) Rules, 2005 notified on 15th November, 2005.,Performance Standards (Generation) Rules, 2009 notified on 17th November, 2009.

The standardsinclude:― Power supply restoration time (Hrs).― Annual number and duration of individual consumer power supply

interruptions.― Voltage range of + 5% and frequency range + 1% from nominal

― Time limits for new connections categorized based on size of theload and voltage level.

― Electric safety standards.― Non-discriminatory principles and priorities of load shedding to be

NEPRA pursuant to Section 39 of the Act deals with

Consumer Service Manual in respect of 9 distributioncompanies was approved and circulated to all DISCOs forimplementation.Complaint Handling and Dispute Resolution ProcedureRules, 2009 is under review and will be sent to FederalRules, 2009 is under review and will be sent to FederalGovernment shortly for approval and notification.Since creation of a Consumer Affairs Division in 2002,NEPRA received 5 553 complaints out of which 5 326 were
