ROAD TRAFFIC REGULATION ACT 1984

CARSHALTON BEECHES AREA PERMIT PARKING AREA (CB)

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Sutton propose to make the following Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 19841, as amended -

(a) The Sutton (Charged-For Parking Places) (Amendment No. *) Order 202*; and

(b) The Sutton (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. *) Order 202*.

2. The general effect of the Orders would be to introduce:-

(a) the following new Permit Parking Area, which would be made up of a designated parking place indicated on-street by way of a traffic sign stating ‘resident permit holders parking only past this point’ in:-

Carshalton Beeches Area Permit Parking Area (CB) – which would operate Monday to Friday between 8am and 6.30pm on and include the following streets and certain lengths of streets: Carshalton Park Road between its junction with Beeches Avenue and No. 120, Glebe Road south of its junction with Grosvenor Avenue and Gordon Road,

Vehicles in respect of which a valid resident permit has been granted would be able to park anywhere at the kerb-side of a street, or where indicated by a traffic sign, parallel to the kerb and, within a Permit Parking Area parking place during the times of operation of the Permit Parking Area, with the exception of: any area marked out as a short-stay parking place or any length of waiting, loading or stopping restrictions during the hours of operation of those restrictions, or any location obstructing access to premises or the free movement of traffic.

(b) lengths of double yellow line ‘at any time’ waiting restrictions in the vicinity of the following locations:-

● Beeches Avenue in certain lengths on both sides of the road between No. 5 and the railway bridge

● Glebe Road in its turning head; and ● Gordon Road outside Nos. 1 to 3 ● Park Hill in certain lengths on both sides of the road between No. 53 and the

railway bridge.

(c) limited time parking bay operating Monday to Saturday between 8am and 6.30pm maximum stay 1 hour no return within 2 hours in Gordon Road in two locations opposite Carshalton Beeches Train Station.

3. To amend the map-based tiles to the schedule attached to The Sutton (Charged for Parking Places) Order 2017 and to The Sutton (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) Order 2017 to match conditions as they exist on site.

4. Permit charges for the new residents permit holders parking places referred to in items 2(a), preceding would be as follows:-

(a) the charge for residents parking permits would depend on the permit group, set by the Council based on the CO2 emissions of the vehicle for which the permit is issued (see Schedule 1 to this Notice) allocated to the vehicle for which the permit is issued, as set out in the following table -

Additional residents permits may be issued at the standard charge shown above, plus a surcharge of £25 for a second permit and £50 for a third, in respect of a household. Where the CO2 emissions of a vehicle are not known due to the vehicle’s age or similar, permit group 3 charges would apply. Wholly electric vehicles (EV’s) would be exempt from any charge. A maximum of 3 resident’s permits would be issued in respect of any household at any one time.

(b) residents visitors vouchers would be available free of charge to residents up to a maximum of 50 hours per household in any one year. Additional hours thereafter may be purchased at a charge of £61 per 100 hours.

(c) carer permits for essential care visits would be available at the following charges: (A) £35 per year for an individual permit, which allows a carer to park in any permit holders parking place; or (B) £50 per year for each organisational permit, which allows an organisation to park in any permit holder’s parking place for up to 3 hours maximum per day.

(d) child care permits which allow a person providing child care to park in any permit holders parking place specific to the relevant permit parking area for which it is issued would be available at a charge of £35 per year.

(e) There would be a £25 administrative charge for any alteration to a permit.

(f) For a full list of properties that would be eligible for permits, see Schedule 2 to this Notice.

5. Copies of the proposed Orders, of the Council’s Statement of Reasons for proposing to make the Orders and plans showing the locations and the effects of the proposals may be inspected at the Council’s Civic Offices, St Nicholas Way, Sutton, Surrey, SM1 1EA. Note: These permit groups would be available for vehicle types L1 to L7 inclusive, (motorised vehicles less than 4 wheels including motorcycles) and M1 only (vehicles used for the carriage of passengers and comprising not more than eight seats in addition to the driver’s seat), as defined by the DVLA vehicle type approval. For the avoidance of doubt this would not include vehicles designated by the DVLA as ‘special purpose vehicles’.

For the avoidance of doubt any vehicle of vehicle type N1, such as light goods vehicles, will be classified as permit group 5 regardless of taxation class.

GA2 Statutory Consultation - Statement of Reasons In accordance with the Sutton Borough Council’s Parking Strategy 2016 and following a number of public consultations seeking views from the public the following proposals are being advertised for the statutory formal Traffic Management Order consultations. New Permit Parking Areas (PPA) in the following areas:

● CA1 PPA (Wallace Crescent area) – operating Mon-Fri, 8am-6.30pm ● CA2 PPA (Talbot Road area) – operating Mon-Fri, 9-11am & 4-6pm ● CB PPA (Gordon Road area) – operating Mon-Fri, 8am-6.30pm ● CH PPA (Peaches Close area) – operating Mon-Fri, 8am-6.30pm ● BH2 PPA (Heath Drive area) – operating Mon-Sun (all week), 8am-6.30pm

Amendments to the existing Cheam CPZ - Free bay scheme Loading restriction blips on existing double yellow line locations Various waiting restrictions Time extension to existing limited time waiting bays Additional limited time waiting bays Loading Bays Disabled bays The above Permit Parking Areas are proposed to establish and maintain a fair system of parking prioritising local residents over non-residential / commuter parking during the times specified above. These schemes allow residents and their visitors to utilise these areas using the appropriate permits during the times of operation. As part of the Cheam CPZ proposals, the opportunity has been taken to formalise restrictions around road junctions by preventing parking through the use of no waiting at any time restrictions to maintain visibility at junctions on site line and road safety grounds. In addition some restrictions proposed include no loading at any time where parking is taking place on existing double yellow lines and causes road safety issues for the free flow of traffic. At any time Waiting restrictions are proposed at all main junctions throughout the Geographical Area under consultation. Additional “at any time” waiting restrictions and time specific restrictions are proposed in locations where obstruction, congestion and access issues are apparent. Limited time waiting bays are introduced near local shops to provide a fair system of parking prioritising local residents and non-residential / commuter parking during specific times. Loading bays are proposed to facilitate local shops providing a specific location to load / unload their goods. Additional Disabled parking bays have been proposed in locations such as Churches and local attractors to better facilitate blue badge holders. Properties eligible for vehicle permits and visitor permits are those specified in the schedule of eligibility indicated in the respective Traffic Management Order and the latest permit charges as displayed on the Council’s website.

The Council of the London Borough of Sutton, after consulting the Commissioner of Police of the Metropolis, in exercise of the powers conferred by sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 19841, as amended, and all other powers thereunto enabling, hereby makes the following Order:-

Citation and commencement

1. This Order may be cited as The Sutton (Charged-For Parking Places) (Amendment No. **) Order 202* and shall come into force on ** Month 202*.

Interpretation

2. (1) In this Order:-

“Council” means the Council of the London Borough of Sutton;

“map schedule legend” means the map schedule legend attached to the Order of 2017 which, when used in conjunction with a map tile, identifies the specific type of parking place or loading place designated by or waiting restriction provided by this Order and, where specified, certain of their governing provisions;

“map tile” means an individual map with a specific tile reference, being part of the map based schedule attached to this Order;

“map based schedule” means a collection of map tiles attached to this Order and listed in the Schedule to this Order which depicts the parking places and loading places designated by and the waiting restrictions provided by this Order and, in conjunction with either the map schedule legend or a map tile label, or both, identifies the type of each particular parking place or loading place or length of waiting restrictions, and, where specified, certain of its governing provisions:

Provided that the Council does not accept responsibility for any inaccuracies contained in the Ordnance Survey data relied upon to create the map based schedule and where a parking place, loading place or length of waiting restrictions is depicted in the map based schedule, that parking place,

loading place or length of waiting restrictions will continue to apply irrespective of any subsequent changes that have been made to the underlying Ordnance Survey data; and

“the Order of 2017” means The Sutton (Charged-For Parking Places) Order 20172.

(2) Any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment; and

(3) Unless the context otherwise requires, any expression used in this Order which is also used in the Order of 2017 shall have the same meaning as in that Order.

Substitution of map tiles

3. (1) Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, the Order of 2017 shall have effect as though:

(a) for the map tiles attached to that Order of 2017 and specified in column 1 of the Schedule to this Order, there were substituted the map tiles attached to this Order and specified in relation thereto in column 2 of that Schedule; and

(b) for the revision numbers specified in Schedule 2 to that Order of 2017 in relation to the map tiles referred to in sub-paragraph (a) above there were substituted the revision numbers given in column 2 of Schedule 1 to this Order in relation to the corresponding map tiles.

(2) The substitution of any map tile referred to in Article 3(1) of this Order will have the effect of revoking any provision provided or designated by a previous version of that map tile and not incorporated into the latest version.

Amendment of the Order of 2017

4. Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, the Order of 2017 shall have effect as though:-

(a) there was added to Article 3(1) of that Order under “Permit Parking Area”

Part XIV - Carshalton Beeches Area Permit Parking Area (CB); and

(b) there were added as Part XIV to Schedule 3 to that Order the table and headings to that table set out in Schedule 2 to this Order.

Designation of parking places and application of the Order of 2017 thereto

5. (1) Each area on a street identified in a map tile in the map based schedule as a parking place and, where applicable, by way of either a map tile label or the map schedule legend, or both, as an area marked out and signed for the use therein of specified classes of vehicles following the conditions specified in the Order of 2017 in relation to that type of parking place, is designated as a parking place.

(2) Unless otherwise so identified, a parking place shall be, either:-

(a) an area bounded on one side of its length by the edge of the carriageway and marked out to a road marking and indicated by a regulatory sign, either

(b) an area comprising the full width of the carriageway and indicated by a regulatory sign of the type prescribed in item 5 of the table in Schedule 5, Part 3 of The Traffic Signs Regulations and General Directions 2016.

(3) The provisions of the Order of 2017 (other than Articles 4 and 23) shall apply to an area designated as a parking place by this Order as if in those provisions any reference to a parking place included a reference to an area designated as a parking place by this Order.

EXPLANATORY NOTE

(This note is not part of the Order)

The purpose of this Order is to:-

1. replace certain map tiles attached to The Sutton (Charged-For Parking Places) Order 2017 the general effect of which is to introduce a new Permit Parking Area, which would be made up of designated parking places indicated on-street by way of a traffic sign stating ‘resident permit holders parking only past this point’ in:-

Carshalton Beeches Area Permit Parking Area (CB) – which would operate Monday to Friday between 8am and 6.30pm on and include the following streets and certain lengths of streets: Carshalton Park Road between its junction with Beeches Avenue and No. 120, Glebe Road south of its junction with Grosvenor Avenue and Gordon Road,

Vehicles in respect of which a valid resident permit has been granted would be able to park anywhere at the kerb-side of a street, or where indicated by a traffic sign, parallel to the kerb and, within a Permit Parking Area parking place during the times of operation of the Permit Parking Area, with the exception of: any area marked out as a short-stay parking place or any length of waiting, loading or stopping restrictions during the hours of operation of those restrictions, or any location obstructing access to premises or the free movement of traffic.

(2) Unless otherwise so identified, a parking place or loading place shall be bounded on one side of its length by the edge of the carriageway and be an area marked either by a traffic sign or by another method of indicating the extent of a parking place or a loading place as specified in the Traffic Signs Regulations and General Directions 20163.

(3) The provisions of the Order of 2017 (other than Articles 4 and 15) shall apply to an area designated as a parking place or loading place by this Order as if in those provisions any reference to a parking place or a loading place included a reference to an area designated as a parking place or a loading place by this Order.

Waiting restrictions applicable to restricted streets

5. Without prejudice to the validity of anything done or to any liability incurred in respect of any act or omission before the coming into operation of this Order, the Order of 2017 shall have effect as though any waiting restriction identified in a map tile in the map based schedule and, where applicable, by way of either a map tile label or the map schedule legend, or both, and marked out and signed as a waiting restriction shall be construed as through it were a restricted street referred to in the Order of 2017.

Placing of traffic signs, etc

6. The Council shall:

(a) place and maintain traffic signs or other appropriate markings on the surface of the street indicating the limits of each parking place and each loading place designated by this Order; and

(b) carry out such other work as is reasonably required for the purpose of the satisfactory operation of a parking place or loading place.

EXPLANATORY NOTE

(This note is not part of the Order)

The purpose of this Order is to:-

1. replace certain map tiles attached to The Sutton (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) Order 2017, the general effect of which will be to introduce or amend in the vicinity of the following locations

(a) lengths of double yellow line ‘at any time’ waiting restrictions in the vicinity of the following locations:- Beeches Avenue in certain lengths on both sides of the road between No. 5 and the railway bridge ● Glebe Road in its turning head; and ● Gordon Road outside Nos. 1 to 3 ● Park Hill in certain lengths on both sides of the road between No. 53 and

the railway bridge. (b) limited time parking bay operating Monday to Saturday between 8am and 6.30pm

maximum stay 1 hour no return within 2 hours in Gordon Road in two locations opposite Carshalton Beeches Train Station.

2. accommodate and reflect the provisions of The Sutton (Charged-For Parking Places) (Amendment Order) Order 202* to introduce a new Permit Parking Area, which would be made up of designated parking places indicated on-street by way of a traffic sign stating ‘resident permit holders parking only past this point’

Carshalton Beeches Area Permit Parking Area (CB) – which would operate Monday to Friday between 8am and 6.30pm on and include the following streets and certain lengths of streets: Carshalton Park Road between its junction with Beeches Avenue and No. 120, Glebe Road south of its junction with Grosvenor Avenue and Gordon Road,

Vehicles in respect of which a valid resident permit has been granted would be able to park anywhere at the kerb-side of a street, or where indicated by a traffic sign, parallel to the kerb and, within a Permit Parking Area parking place during the times of operation of the Permit Parking Area, with the exception of: any area marked out as a short-stay parking place or any length of waiting, loading or stopping restrictions during the hours of operation of those restrictions, or any location obstructing access to premises or the free movement of traffic.

3. To amend where necessary the map-based tiles to the schedule attached to The Sutton (Charged for Parking Places) Order 2017 and to The Sutton (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) Order 2017 to match conditions as they exist on site.
