Background
1. The Petitioner Uttar Pradesh Rajya Vidyut Utpadan Nigam Limited
(UPRVUNL) is a company incorporated on 25th August 1980 with its principal
object of generating electricity.
2. The Uttar Pradesh Electricity Reforms Act, 1999 (UP Act No. 24 of 1999,
herein after referred to as the Reforms Act) set off the reforms in the power
sector of Uttar Pradesh. According to the provisions of subsections (1) and (2)
of Section 23 of the Reforms Act, vide notification No. 149/P1/200024,
Lucknow, January 14, 2000, Uttar Pradesh Electricity Reforms Transfer
Scheme, 2000 was notified. This transfer scheme had reorganized Uttar
Pradesh State Electricity Board (UPSEB) by unbundling it into three separate
entities i.e. Uttar Pradesh Power Corporation Limited (UPPCL), Uttar Pradesh
Rajya Vidyut Utpadan Nigam Limited (UPRVUNL) and Uttar Pradesh Jal
Vidyut Nigam Limited (UPJVNL) w.e.f. 14.1.2000. UPPCL was vested with the
responsibility of transmission and distribution of electricity, UPJVNL with the
responsibility of hydro generation and UPRVUNL, a company which also
existed prior to the date of reorganization of UPSEB, was vested with the
responsibility of thermal generation. UPRVUNL is a wholly owned company of
the Government of Uttar Pradesh.

3. UPRVUNL has submitted the petition for Multi Year Tariff Petition dated
06.07.2015 for Approval of Annual Revenue Requirement and determination
of Tariff for FY 201415 to FY 201819 in respect of existing thermal power
stations and Petition for determination of provisional tariff for Anapara ‘D’ of
Uttar Pradesh Rajya Vidyut Utpadan Nigam Limited (UPRVUNL)
4. UPRVUNL has submitted an additional submission dated 29.07 2015 on the
petition for Multi Year Tariff Petition for Approval of Annual Revenue
Requirement and determination of Tariff for FY 201415 to FY 201819 in
respect of existing thermal power stations and Petition for determination of
provisional tariff for Anapara ‘D’ of Uttar Pradesh Rajya Vidyut Utpadan Nigam
Limited (UPRVUNL)
5. UPRVUNL has also submitted the Petition for final True Up for FY 201112,
FY 201213 and FY 201314 based on audited accounts. However in line with
the earlier direction, the Commission has decided to proceed on the
consolidated basis for the two petitions.
6. UPPCL has submitted counter affidavit dated 17.12.2015 against Petition
No.1025/2015 filed by the Petitioner for determination of provisional tariff for
various thermal power stations for the period FY 201314 to FY 201819.
Hearing & Order
7. On scrutinizing the petition, the Commission observed a number of
discrepancies in the submission made by the Petitioner and issued a first
discrepancy note dated 26.08.2015 directing the Petitioner to submit the
additional/missing information, which was submitted by the Petitioner on
15.09.2015.

8. On scrutinizing the response of the Petitioner, the Commission observed that
the petitioner did not provide the complete information as directed. Thus in
order to gather the information and some additional data required for
verification of submissions made by the petitioner, a second discrepancy note
dated 08.10.2015 was issued, directing the Petitioner to submit the
additional/missing information, which was submitted by the Petitioner on
05.11.2015.
9. However, on the basis of scrutinizing the additional submission submitted by
the Petitioner, it was observed that the Petitioner had not submitted the entire
information as required. Hence an additional discrepancy note dated
06.11.2015 was issued wherein the Petitioner was directed to submit
additional clarifications/ information. The Petitioner submitted its response to
the discrepancy note on 18.11.2015.
10. UPRVUNL has submitted the information in replies to deficiency notes raised
by the Commission. During the hearing, UPRVUNL requested the Commission
for admission of their petitions.
11. The Commission admits the petitions subject to submission of all the
information on the points raised by the Commission in the deficiency notes as
per direction of the Commission within 7 days.
12. UPRVUNL shall publish the Public Notice within 3 days from the date of this
order detailing the salient information and facts of the petitions along with their
website address, in at least two daily statewide circulated newspapers (One
English and One Hindi) for two successive days inviting views / comments /
suggestions / objections / representations (to be submitted to the Commission
with a copy to UPRVUNL) within 15 days from the date of publication of the
Public Notice(s) from all stakeholders and public at large. The Public Notice
should also contain the year wise revenue requirement and per unit fixed cost.

UPRVUNL shall put all details on its internet website with intimation to the
Commission, in PDF format before publication of public notice, showing
detailed computations, the application made to the Commission along with all
filings, information, particulars and documents.
13. The Commission reserves the right to seek any further information /
clarifications as deemed necessary during the processing of these Petitions.
14. The Public Hearing shall be held on 9th February 2016 at 11:30 hrs.
