WHEREAS, the Township and the Contractor anticipate that as a result oftheContractor's use oftownship roads, accelerated deterioration may occur. Thus repairs orimprovements-will be required and additional maintenance expenses will be inClJn'ed by theTownship; and ' .

1. PURPOSE:

This Haul Route Agreement shall be completed for existing, new, and expanded haulingoperatiOns that may cause a.cc=l~ated d~(erioration oftowcilhip roads. These baulingopeJ'ati~g sball include b~tnot be limited to: contractors. subcontractors and developers.,

2. DEFINITIONS .

A. Additional Maintenance. "Additional Maintenance" means gradin~ graveling,reshapin~ repair, and/or modifica:tion performed on township roads in eXQesG ofth= same operations perforined as 'routine maintenance by the Township.

B. Township Road. "Township Road" means a meet, road, or·other pliblic way,including shouldexs, and rlght-of-'way designated for the purpose ofvebiclllartraffic and under the jurisdiction ofllie Township. '

C. Haul Road. "Haul Roaii" means .any Township road, bridge~ or other atrocturewhich is used for transporting items including but not limited to products,equipments, materials and/or,supplies and as a result incurs deterioration.

D. Haul Routa. '''Haul Route" means the system of haul roads between a. source siteand the destination.and/or the source site and 'the nearest major intersection asdetermin~ by the Township.

E. Improvements. "Improvements" mean roadway improvemems required by theDireaorbecause ofthe Con1ractor's use ofthe haul road.

3. QENERAL AGREEMENT AS TO ROAD USE;

The Contractor undeIstands and agrees that, although the haul roads covered by thisAgreement are on 1he Township Road Systcln and are subject to l10rmal traffic use theCon1raCtOr. 'by virtt1e of its.use ofthe road I1S a haul route, assomes fCSponsibility for ,additiocal maint~ce and signing costs on such roads resulting from its wse ofsuchroads as a haul route. '

The Township hereby agrees to the Contractor's use of1be haul J'Q~ covered by theAgr=ement subject to the conditions contained herein. The Contractor shall berespo~ble for obtaining any other pemti1:s at' licenses which the Township or anyothcrgovernmental entity may required to operate or move it!! vehicles on county roads. 'IbisAgreement sJui!.l nol serve to reli~e any op~ator ofa Contrilctor's vehicle n-om 'complying with applicable~d Iimits, weigh1 restriclions, or otherposted :restriDtions.

Any improVements to 01' widening of the road necessitated by the Contmctor"soperations, including modification of roadway approaches to accommodate transportvehicles, shall be considered incidental to the hauling performed, shall be made- at theCon'tractor's sole ex.pense unless otherWi~e authorized in 2lD ~dmdum tl:! this Agreement.Any such bnproyement shall beaua.wnzed by Townshippcrmit. .

4. GENERAL TERMS:

A. Compliance with Laws and Regulations

The Contractor shall com.pty with all Fcdcr~ State, Ill1d local laws and regulations.

B. Severa.bility

Ifany portion ofthis Agreement is held invalid it shall have no effect upon thevalidity ofthe remaining portions ofthis Agreement

B: Said Principal shall indemnify, save and keep said obligee, and its officialsand employees harmless of and from any claims, damages, liabilities, losses,actions, suits, or judgements which may be presented, sustained, brought orobtained against said Obligee or its officials,·or employees because of saidconstruction, or by any'accidents caused by or resulting there fr,om: and

C. Said Principal shall pay all damages imposed upon it for violation of anyCounty of State Law or conditions of any permit issued there under: and

D. Said Principal shall replace or perform again in a faithful and adequatemanner all work and materials to areasonable standard, which are not inaccordance with the applicable county or State law and permits; and

E. Said Principal shall faithfully satisfy all judgements based on tort liabilitywhich are obtained by reason of negligence through said construction whichnegligence is att~ibutableto said Principal or his agent;

F. In no event shall the aggregate liability of the Surety hereunder exceed thepenal sum stated above.

G. If th~ Principal shall satisfy all of the above conditions then no obligation shallarise under this bond.

If the principal fails to perform any of the above conditions, then the Principal and Suretyshall be liable under this bond to the extent necessary to satisfy the breach of conditions.
