My Aunt “Byo”

by Bernie NiehausChairman of the BoardSplinters

Viola Fuller died last week at the age of 94.She was my aunt and I gave her the name of“Byo” when I was a little boy and couldn't sayViola. Ever since that time she has beenknown to my family and my nineteen grand-children as “Aunt Byo.”As a little boy, I usedto go to her house and play. She lived right

across the street from the old firehouse on Second Street (whereVincennes University Davis Hall now sits). I loved to watch the firetrucks come and go.

Byo was preceded in death by her two sisters, Ella Mae Hunter, NaomiNiehaus (my mother) and a brother, James Oakes. Their mother diedwhen Byo was only eleven years old. In his eulogy at the funeral, herson B.D. told us that their mother had gathered them all togetherbefore her death and ask Byo to take care of her siblings. They haveall died now - my mother being the last - so now Byo’s job was done. She is survived by her son B.D. Fuller and his wife Karen and her twograndchildren, Brook and his wife,Holly Fuller, and Brittney and her hus-band Brian Kirwer.

Byo and my mother both worked at theBrown Show Factory during theDepression for .25 an hour. They saidthey did the fancy stitching on theshoes. Her husband, Bert Fuller diedin 1967. After his death, she came towork at our Niehaus Home Center. She was one of the first females on oursales floor. Byo was an energetic andfriendly person who all the customersliked. She later managed our PaintDepartment and was a valuable asset to the company.

While B.D. was growing up, Byo took a very active role in his child-hood, as he related in his eulogy. She was a PTA President, a RoomMother, a Den Mother and a partner in his many practical jokes. Byospent many hours at the kitchen table sticking sticks in hot dogs (overa million, I think) for B.D.’s Pronto Pup stand - she was a good moth-er.

Byo was also a very Christian woman, joining the First ChristianDiciple of Christ Church in 1940. She was active in the church servingas a Sunday School Teacher for over 20 years. B.D. found over seven-teen perfect attendance medals in her cedarchest. Byo will be missed by many andlike my mother she was a GREAT LADY.

ICE Your Cell Phone For Safety

(CBS News)A campaign to use cell phones in the treat-ment or identification of accident and disas-ter victims has taken off worldwide since thefirst bomb attacks in London earlier thismonth.

Mobile phone users are being urged to entera number in their phone’s memory with theacronym ICE, for In Case Of emergency, with the contact person’s name and number.

Paramedics or police would be able to swift-ly find the number and use it to reach a rela-tive or friend who could help identifydeceased victims and treat injured ones, byproviding vital personal information, includ-ing details of any medical conditions.

ICE is not foolproof - when somebody locksthe phone out, or if the phone is broken in anincident or accident obviously it would notwork. It does have potential to save lives, however, individuals should still carry somecontact/identification with them.

We would like to take this opportunity tosalute our material handlers in our AristokraftCabinet Distribution Center located atWholesale Building Materials in Vincennes.

The overall operations manager is Brian Lett.He oversees the warehouse, the Door Mill andthe Top Shop. This is a huge area that sits onseveral acres. Brian does a great job at keep-ing things running smoothly.

In the cabinet area the two lead men are MickGormley and Matt Carter. They too, do a greatjob at loading and unloading and keeping stockand orders straight.

Since the warehouses cover many thousandsquare feet, they are not air conditioned orheated - so working conditions during summerand winter are not always comfortable. Thereare semi’s either being loaded or unloadedalmost constantly since they are on the roadday and night at least 6 days a week. So, theseguys are kept busy keeping up with thedemand. A big thanks to all of you. You areappreciated!

Innocent Spouse ReliefWhile filing a joint tax return offers married taxpayers a number of ben-efits, it can also result in one spouse being penalized for the other's erro-neous reporting. When taxpayers file a joint report, both taxpayers arejointly and individually responsible for the tax and interest or penaltiesdue on their joint return. The IRS can hold either spouse responsible forpaying applicable taxes and penalties, regardless of who earned theincome or whether a divorce decree states that one spouse will be heldresponsible.

The IRS does, however, offer relief from the tax, interest, and penaltiesdue on a joint tax return - innocent spouse relief. You may request inno-cent spouse relief if your spouse improperly reported items or omitteditems on your joint tax return. In order to qualify for innocent spouserelief, you must meet the following conditions:

• The understatement of tax on your return must be due to erroneous

items reported by your spouse. Erroneous items, as defined by the IRSinclude unreported income, and incorrect deductions or credits.

• You must prove that you did not know about the understatement of tax

at the time that you signed the return; further, you must establish thatyou had no way of knowing about the errors. In considering if you had areason to know about the errors, the IRS will look at the nature of theerroneous item, you and your spouse's financial situation, your educa-tional background, the extent of your participation in the activity thatresulted in the error, and whether you failed to question items on thereturn that a reasonable person would question.

• Your situation is such that, when all circumstances are considered, it

would be unfair to hold you liable. Circumstances considered includewhether you received a significant benefit from the understatement, whether your spouse deserted you, and whether you were divorced orseparated when the error occurred.

• You and your spouse must not have transferred property to each other

in an attempt to defraud the IRS or anyother individual.

To apply for innocent spouse relief, youmust file Form 8857, Request for InnocentSpouse Relief within two years of the datethe IRS began collection attempts, and youmust attach a separate statement explaining why you qualify for relief.

If you have any questions about filing for innocent spouse relief, contactthe professionals at Kemper CPA Group LLP today.
