Andrew Menkens trial was set to begin, defendant, who was a States witness inState v. Andrew Menken , testified that she did not conspire with Andrew Menkento extort Randy Aschinger. Previously, however, at her plea hearing, which was

on September 24, 2013, defendant, in providing the factual basis for her guiltyplea to Conspiracy to Commit Extortion, stated that she conspired with AndrewMenken to extort Randy Aschinger. Following this affirmation to the Court, theState provided the following reason it was recommending a deferred judgmentfor defendant: I need [defendants] testimony. I mean, simply I need for her torepeat what she just said here today on the witness stand [in State v. AndrewMenken ] --- the third Defendant in this matter, who [has] yet to come to trial . Thedefendant's act (here, testifying contrary to her affirmation to Judge Bice) wasdone with specific intent to obstruct the States prosecution of Andrew Menkenfor the above-mentioned crimes.

STATES MOTION TO RESCINDORDER FOR FINGERPRINTINGORDER

COMES NOW the State of Iowa and for its Motion to Rescind Order for

Fingerprinting states that due to inadvertency, the State submitted a proposed

order for fingerprinting. However, Defendant was committed of a simple

misdemeanor, and Iowa Code section 690.2 does not apply to convictions for

simple misdemeanor convictions.

WHEREFORE, the State respectfully requests that the Court rescind its

October 6, 2014, order for fingerprinting.
