The Canadian Musical ReproductionRights Agency (CMRRA) is the Canadianlicensing agent for the owner of the copyrightand is behind the action. CMMRA contactedSPG Music Productions, the Etobicoke, Ont.company which released the album, and toldits representatives that litigation could followif the album was not withdrawn from stores.SPG has agreed to comply with the requestand will hand over returned copies to CMRRA.

Trend marketing postfor Lorne LichtmanLorne Lichtman has been appointed nationalsales and marketing manager of Trend MusicGroup in Rexdale, Ont.

Lichtman plans on modernizing andreorganizing the company. He will also beactive in an A&R capacity in signing domesticartists, as well as working with productioncompanies and foreign licensing.

Lichtman is a 21 -year veteran of theCanadian music industry. He has worked inrack, retail, campus radio, wholesale andrecord company positions throughout hiscareer. Most recently he was national salesmanager for ERA International/K-TelInternational of Canada Ltd.

Guns concert rescheduledfor Sept. 13 in TorontoThe Faith No More, Metallica, Guns N' Rosesconcert in Toronto originally slated for Aug.9 has been rescheduled to Sept. 13 at ExhibitionStadium.

The concert, which begins at 4:30 p.m.,is one of the shows that had to be rescheduledafter Metallica's James Hetfield sufferedsecond and third degree burns to his forearmat an Aug. 8 concert at Montreal's OlympicStadium.

The same Montreal show provoked a riotwhich caused an estimated half -a -milliondollars damage after Guns N' Roses leadsinger Axl Rose stormed off the stage afterperforming for just 55 minutes. A woman whoattended the concert, and who wishes torepresent the 53,000 unhappy fans, is seekingpermission to file a class-action suit againstpromoter Donald K. Donald Productions andOlympic Stadium officials for breach ofcontract. She is seeking reimbursement oftwo-thirds of the cost of the $35 tickets. QuebecSuperior Court will decide in a few weekswhether to let the case proceed.

Guns N' Roses has been banned fromplaying Olympic Stadium again and thecancelled Aug. 17 Vancouver date for thethree bands won't be rescheduled becausethere are no available dates at B.C. Place.

Technocal: The Second Rave is scheduled fora September release.

Sprigg says the company will be morediligent from now on and will ensure that alllicensing agreements are in place on futurereleases. "It's a lesson," he says, "With technomusic there's so much sampling done that youhave to be very careful."

David Basskin, president of CMRRA,says he feels sorry for SPG but insists that hehad no choice but to take action because of theinstructions given to him by the music'spublisher. "My motivation is not to keep peoplefrom selling records. I make money whenpeople sell records, not when they don't sellrecords.

"If we'd received an application prior toSPG's release of this CD, we could have toldthem that the publisher refused to license thework and it would not have been necessary topull the product from the market. The cutsimply could have been left off the CD."

Import copies of a CD single containingfour different mixes of 0 Fortuna, which ismanufactured in the U.S. by Radikal Records,has also been available in some Canadianstores. Retailers who continue to sell eitherthe CD single or Too Technocal may be subjectto legal action. CMMRA has released noticesinforming retailers of the situation.

Canada's 125th birthdaycelebrated at the CNEThe Canadian National Exhibition will becelebrating Canada's 125th birthday with apresentation of talent from across the countryon Aug. 25.

McQueen, a Vancouver -based countrygroup, gets things started at the CNE Bandshellat 4:55 p.m. Rawlins Cross from St. John's goon stage at 6 p.m. to perform their spiritedblend of Celtic folk and rock music. Montreal'sSass Jordan will belt out songs from her currentRacine album at 7:20 p.m. And April Wine,currently based in Montreal but with rootsembedded in Winnipeg, will continue theircomeback with a set at 8:45 p.m. A fireworksdisplay will begin as April Wine ends their setat 10:15 p.m.

Blame it on the weather ... ! Broadcasters take note. Those with the most disposable

income are not in the 14 to 28 age group. It's more like the over 40 bunch. Live theatre in

Toronto is booming, and those most responsible, Garth Drabinsky and Ed and

David Mirvish, will probably attest to that. But who would have thought that bringing

back Evita would pull a good house? Well, it did, and the O'Keefe and CPI people were

surprised as well. Tickets for the opening night went like hotcakes just a couple of days

before showtime, and although there was a good representation from the geriatric crowd,

the sheer numbers of those in their early 40s was quite impressive. (EC: How about

Enthusiastic crowds help WOMAD set sales records

The fifth annual WOMAD Festival recently took Toronto by storm despite gloomy, wet

weather throughout the weekend. The three-day World Of Music, Arts and

Dance Festival broke all previous box office records at Harbourfront Centre and sales more

than doubled those of WOMAD '91. Craftspeople also had a banner year, with

sales for some more than tripling last summer' s

take.

When FACTOR was born in 1982 with a budget of only $200,000 supplied primarily

by CHUM Ltd., Moffat Communications, and Rogers Broadcasting Ltd., and other industry

factions, the future looked chancy at best. However, in celebrating 10 years of growth

(RPM - Aug. 22/92), the aggressive young organization now boasts 10 more sponsoring broadcasters with an annual budget of $4

million, of which $2.2 million comes from the Department of Communications (DOC), $1.1

million from broadcasters, and the balance from loan repayments and interest.

Being a FACTOR board member isn't an easy task. There are many variables that have

to be taken into consideration and often confrontations that would frustrate even the

most hard-nosed. Besides their regular jobs, some running huge organizations, they devote much time and effort ensuring that the needs

of fund -seekers from every nook and cranny of Canada are looked after. Some aren't, for

obvious reasons. Is it a thankless task? From an industry that's not too quick with the

platitudes, one might think so.

Emmett should have treated himself to a newhat rack.

He certainly undertook enough tasks onthe album; he wrote it, produced and arrangedit, sang all lead and some background vocals,played all guitar parts, and programmed somepercussion.

"It's very tiring and it's very wearingafter a while," Emmett says of the experience."Every single step is very intensive."

And time consuming, he might haveadded. From start to finish, it took Emmettalmost two years to release Ipso Facto.

"I wish I could speed the process up. Iwish I could get records to market quicker andhave it so I still felt fresh about some stuffwhen the public was first getting it and feelingfresh about it."

But the 38 -year -old former member ofTriumph is satisfied that all his labour hasresulted in a worthwhile album. Emmett sayshe felt more confident and relaxed makingIpso Facto than he did on his first solo album,Absolutely. He also simplified thearrangements this time out.

"It makes it more accessible. It makes iteasier for people' s ears to get inside the record

New IMAX/OMNIMAXfilm takes a look at musicA new IMAX/OMNIMAX film titled Why isMusic Music? is tentatively scheduled for a1995 release.

In the film, viewers will be able to interactwith the subject as they simultaneously hearand see vibrating giant screen images of soundwaves and patterns, travel through musicalinstruments, listen to the visual deconstructionof musical components, and experience thelanguage and science of music from aroundthe world.

and get all the way through it to the other side of it."

Though initial reactions to the album have been generally positive, Emmett doesn't hold lofty commercial expectations. The

industry veteran knows a number of factors have to come together to make a song or an

album a hit. "You just have to hope for the best and

hope you can get lucky with timing. You just hope that whatever the vibe is that gets created

for you will be a positive one." Ipso Facto is released in Canada by Duke

Street Records, a fairly small independent label. Because of the inherent limitations of

working with a minor label, Emmett realizes he has a restricted budget for publicity. And

since he's not the kind of artist who attracts media attention through stirring up

controversy, he hopes positive word of mouth will raise the album's profile. So far, Ipso

Facto has sold around 20,000 copies in Canada. The first cut on the 14 -song album, the

hard rocking Straight Up, was released as the first focus track in order to re-establish Emmett

at AOR radio. The follow-up, Bang On, is aimed more toward CHR as well as AOR

formats. The song also has a video. But Emmett believes that if he's going to achieve much commercial success, it will

come through the subsequent single releases of some of the ballads on the album. Let Love

Conquer All, Heaven In Your Heart, and Dig A Little Deeper all have potential.

Acid Test and Hhead at Toronto's Phoenix

Acid Test and Hhead, two Toronto bands that have been attracting major label attention, will show their appreciation to local fans by

playing a free show at the Phoenix on Sept. 3. Acid Test is also one of four Canadian

bands invited to perform at the 'In The City' Festival in Manchester, England in September.

Siberry to return to U.K. after completing album Warner Music Canada recording artist Jane Siberry is completing her sixth album.

Siberry produced most of the songs on her own in Vancouver and Toronto while

three tracks were produced by Brian Eno during Siberry's three-month residency in

London, England this past spring. The album is tentatively scheduled to be released in

January. Peter Gabriel recently invited Siberry to participate in Real World/WOMAD recording

week -- an annual event in which Gabriel invites artists from around the world to his studio in Bath, England to explore new musical ideas.

Siberry will play a week of U.K. dates with Bob Wiseman in early September and will also appear at Edinburgh Castle on Sept.

song, too. The album is also being distributed in

some European countries and Emmett did a promotional tour over there in July. He's still

shopping for an American deal, but he's confident something will come along because

of his firm fan base south of the border. Emmett has been playing selected

Canadian dates since July and is playing shows in Ontario and New York through August and

September before performing in San Francisco on Sept. 19. If things go well with Ipso Facto

overseas, he would like to extend his live playing to take in Europe and Japan as well.

He's once again been bitten by the bug which drives performers to strut their stuff in front of

a live audience. "I'll probably be touring for a good four -

to -six months, even if the record is only moderately successful," he says.

Stampeders are on the career comeback trail

The original three Stampeders have reunited after 16 years for two concerts at Lulu's in

Kitchener, Ont. on Sept. 25 and 26. Rich Dodson, Kim Berly and Ronnie

King already staged successful concerts at the Calgary Stampede in early July. And due to

the demand created by the emergence of classic rock radio, the band is also planning a Canada

- wide tour next spring to coincide with the

release of a new album. According to promoter Donald K.

Donald, the Stampeders were the top Canadian concert draw from 1971 to '74, and were the

first Canadian band to tour from one end of the country to the other. In addition to their double -

platinum single, Sweet City Woman, the band also had hits with such songs as Oh My Lady,

Then Came The White Man, Playing In The Band, Hit The Road Jack, and New Orleans.

The Stampeders also made some of the first rock videos by a Canadian act. Five of

those are included in a one -hour video entitled Canada's Rock Legends

- The Stampeders,

which is available on Quality Special Products and will soon be aired on MuchMusic.

Richie signs worldwide withLionel Richie has signed a long-term, multi -album, worldwide recording contract withPolyGram's Mercury Records following theexpiration of his agreement with Motown.

Under the new contract, PolyGram willrelease Richie's repertoire on its Mercurylabel in North America and on its Polydorlabel in the rest of the world. The contractbegins with Richie's next recording, which heis expected to start work on soon.

Bob Wiseman keeps going,and going . . . and goingThe hectic activity never seems to end for BobWiseman.

He recently finished a tour of southernOntario with Jane Siberry. He then went toNew York to guest on the upcoming John &Mary (ex -10,000 Maniacs) album. After thathe went to Vancouver for a week to co -writea few songs for Eugene Ripper's new recording.

From VancouVer Wiseman will fly toNew York City to perform at an industryshowcase at CBGB 's on Aug. 29. The next dayhe'll hop on another plane to join up withSiberry in the United Kingdom. The pair willbe splitting a bill for a week of shows inScotland, Ireland and England.

Immediately upon Wiseman's return toCanada, he will enter CBC's studios tocompose the score for each episode of thetelevision show, Material World. The weeklyprogram also features Separated -- a cut fromWiseman's latest Warner release, PresentedBy Lake Michigan Soda -- as its new themesong. During the weekends of this period,Wiseman will be in various local recordingstudios working on his next solo project.

Wiseman also provided the mood musicfor European dance diva Laura Taller's filmand dance extravaganza.

Warner Music pulled a wild stunt on the day ofrelease of Gordon, the debut album fromBarenaked Ladles. Kim Cooke, Dale Kotyk andKen Green dressed up to re-enact the insidegraphics of the album, and called on Torontoradio, video and retail outlets, and RPM'S StanKlees.

PolyGram's Mercuryunder its worldwide distribution and licenseagreement which it signed with Motown lastyear.

Debbie Johnson's careermakes her dance with joyDebbie Johnson's day job is history and she'strying to make it history.

The former child performer gained a lotof exposure in the pop/adult market in themid -1980s, but when it came to the beginningof a new decade, Johnson started fresh too. Inthe fall of 1990, Johnson decided to take anew, more aggressive direction by giving hermaterial a more dance -oriented edge.

With the help of a team that includedformer Stampeder and current producer RichDodson, composer/arranger Don Breithaupt,and writers Derrick Brin and Brooks Hale,Johnson secured a licensing deal with KeithBrown and Aquarius Records that gave her thesupport of a committed label with major(Capitol) distribution.

The album that resulted from this groupof collaborators, So Excited, revealed newdimensions to Johnson's music. The firstsingle, I'll Respect You, was a top dance hitand also gave Johnson her first national CHRchart action. Power To The People, EverlastingLove, and the newest single, So Excited, havefollowed the same course.

Johnson hasn't left her AC past behindher, however. Those stations have been playingEverlasting Love, I Know You Very Well,Behind Closed Doors and Let Me Go from thealbum.

Aquarius has also just released a speciallypriced compact disc called The Dance Mix,which features two new and different versionsof each of Johnson's four dance hits.

Bud Talent Search winners Fredericton's Paul Dwayne, who will represent the Atlantic

Region at the national finalsin Hamilton, and P.E.I. winner Darlene Bradley will also

contribute one track each on the 12 -track album. Gilles Godard will produce the session which will be recorded at Solar Sound in

Halifax. Stations taking part are CHQM-FM Moncton, CHFX-FM Halifax, and Q93

Charlottetown. Jim Ferguson, PD of the Charlottetown station, who brainstormed three

similar projects for P.E.I. will be executive producer for the expanded package. All proceeds from the sale of the album will go to

the Children's Wish Foundation.

Royalty's R. Harlan Smith sends news that the label has entered into a record tracking and

promotion agreement with LuAnn Reid of Vancouver. A longtime fan of country music,

Reid has an extensive background in radio and television promotion. Reid's initial chore will be the tracking of Greg Paul's Papa track and Different Shades Of Blue by Chris Nielsen,

both of which are included on Royalty's CD sampler #7.

Lisa Logan, not to be confused with Lisa Brokop, sent along her new Roto Noto album,

For Always, which includes her latest charted single, Most Every Night. She also sent along

a tape of Through The Eyes Of An Eagle, which she performed during Canada Day

celebrations at Hamilton's Gage Park. The song got an overwhelming response from the

audience. As Logan explains, Mark LaPointe of 820 CHAM Country called her one morning

with the lyrics he had written. "I called him back that afternoon with the music for it." It was through the efforts of Bob Doidge, who

made time available at Hamilton's Grant
