Pervious Concrete-A portland cement concrete mix characterized by lack of fine aggregates, resulting in voids that allow percolation of water through the pavements.

(a) All lots appurtenant to other land uses shall be planted wrth trees at a ratio of one tree for every four surface parking spaces. The trees shall be located in such a manner and be of such a size that the trees are capable of producing an overhead canopy that will shade at least 50 percent of the parking stall area in summer after 10 years growth when the sun is at rts zenith at local solar time at the summer solstice. Placement of trees shall be coordinated with lighting, as required by the Los Angeles Municipal Code. A minimum of 50 square feet of unpaved area shall be provided at the base of each tree, the minimum dimension of which shall be 5 feet, to allow for water infiltration, gas exchange, and to avoid conflicts between car door swings and bumpers, and trees. The planted area under bumper overhangs may be utilized as part of the unpaved area.

(b) In parking lots of 50 or more spaces, maximum of fifty percent of the trees in paragraph (a) of this guideline may be substituted by vine-covered ramadas, whose placement, together with required trees, will shade at least 50 percent of the parking stall area in summer after 10 years growth when the sun is at rts zenith at local solar time at the summer solstice. A ramada is a freestanding overhead structure, open on all sides, designed to shade parking spaces.

(c) All trees required by this guideline shall be a minimum of 24" box in size, except for existing trees, and except for trees whose planting in such size would be horticunurally inappropriate. In order to encourage botanical diversity, unusual trees availabile only in smaller sizes may be planted.

(d) The area under bumper overhangs shall be landscaped. Such areas shall be a minimum of 24" deep, and shall contain no plant, irrigation device, or other object higher than 6" above the top ofthe curb.

(e) In any planting area adjacent to the side of a parking stall, starting at a distance 4 feet from the head of the parking stall, no tree may be planted within 4 feet of the parking stall, to allow for door swings of parked cars.

(f) Ground Water Recharge.

(1) Continuous curbs that may be otherwise required shall not be required when their presence would impede the flow of surface water to any ground water recharge area.

(2) Parking spaces in excess of those required by the Los Angeles Municipal Code may be incorporated into ground water recharge areas, by means of such devices as pervious concrete. However, even if planted by means of such devices as turf block, turf stone or similar materials, such parking spaces shall not be counted toward satisfying the planting requirements of this guideline.

(3) All ground water recharge areas shall be approved by the City Engineer.

(g) Any parking building having a level open to the sky shall be regulated by this guideline, provided that the lowest finish surface elevation of such level open to the sky is:

(1) Less than 5 feet higher in elevation than the highest adjacent top of curb elevation when the building abuts a street.

(2) Less than 5 feet higher in elevation than the highest finish grade or exterior finish surface elevation of abutting properties when the building does not abut a street.

(h) Provision of trees may negatively impact vehicles in certain situations. At the applicant's sole discretion, such trees in the interior of the parking lot shall not be required to be provided. In such case, the average albedo of all surfaces of the entire project (including buildings, walls, surfaces, building roofs, etc., not limited to landscape) shall be 0.45 or greater.

2. Vehicular Sales Areas

(a) Interiors of vehicular sales areas shall not be required to be landscaped.

(b) All vehicular sales areas shall be buffered in accordance with the provisions of guideline 7. However, a maximum of 100 linear feet of street yard of such sales areas, or 50 percent of the street yard, whichever is less, shall not be required to be provided with the durable barriers of this guideline, in order to allow the vehicles themselves to be the "signage" for the sales area.

(c) For the purposes of this guideline vehicular sales areas shall include exterior areas used for the display and sale or rental of vehicles, boats, trailers, construction equipment, manufactured homes, or similar uses.

3. Other Vehicular Use Areas

(a) Vehicular use areas, such as loading docks, service bays, repair yards, bus bays, trucking terminals, rail yards, transit platforms, motor home storage areas, etc., not normally open to public vehicular use, shall not be required to have landscaping in the interior of the vehicular use area. In such cases a minimum area equal to 5 percent of such areas shall be transferred to the buffer of the area or adjacent to any building in the area, or both. Such area shall be landscaped in accordance with the requirements for landscaping of Subdivision 12.42 C 2 (Guidelines C) of the Los Angeles Municipal Code.

(b) Vehicular use areas, such as drive-ins, car washes, gasoline stations, drive-thrus, etc., normally open to public vehicular use, shall have landscaping in the interior of the vehicular use area equal to a minimum of 5 percent of the use area, in addition to the buffer. Such area shall be landscaped with one 24 inch size tree for each 250 square feet of interior landscaped area or fraction thereof. Smaller sizes may be allowed if horticulturally more appropriate. Such interior landscaped area may be located anywhere in the vehicular use area of this guideline.

4. Residual Areas. All areas not used for parking spaces. access ways, display areas, or other vehicular use. or trash areas, shall be landscaped, over and above any required interior or buffer landscape.

5. Durable Barriers.

(a) All vehicular use areas shalf contain in the buffer a wall, fence, berm, hedge, or other durable barrier, or any combination thereof, except across necessary driveways or walkways, and required openings, except as provided for in section 2 of this guideline and except where they adjoin commercial or manufacturing uses, parking structures, or parking lots.

(b) In the street yard, the durable barrier shall be 3 feet 6 inches in height and be opaque, provided that any portion of the durable barrier above 3 feet 6 inches remain open to public view.

(c) In the street yard, the durable barrier may exceed 3 feet 6 inches in height, provided that such portion of the durable barrier above 3 feet 6 inches remain open to public view.

(d) In all other buffers, the durable barrier shall be at least 6 feet in height above the vehicular use area, and shall be opaque.

(e) In lieu of a durable barrier along any street, the parking lot may be depressed a minimum of 3 feet 6 inches below the top of curb elevation of the street

6. All planted areas shall be irrigated in accordance with the provisions of Section 12.41 of the Los Angeles Municipal Code.

7. Buffers.

(b) In the case of conflicts between these Guidelines and provisions of the Code, such as required yards, setbacks, building lines, specific plans, Q Conditions, etc., the provisions of the Code shall control.

(c) If a parking lot is located more than 50 feet from the Project property line, then the buffer planting may be distributed throughout the Project.

(d) Buffers are a minimum of 5 feet wide. If for any reason buffer width is reduced in individual cases, required planting shall not automatically be reduced.

(e) No buffer requirement shall be construed as mandating the demolition, afteration or removal of any existing structures. However, demolition or removal of any structure occupying a buffer area shall cause the full buffer requirement to be applied to the space so vacated.

(f) When buffer landscaping abuts an existing wall on an adjacent lot, and with the written permission of the owner of the wall, vines on the wall may be substituted for up to one-third of any required trees.

(g) Minimum Landscape Abutting Alley. Except for required driveways and trash areas, all portions of any required yard in the multi-family residential zones abutting an alley shall be landscaped. A minimum of one tree per each 25 linear feet of landscaped area shall be provided. Any tree required by other provisions of the Los Angeles Municipal Code may be used to satisfy the tree requirement of this Guideline.

8. Trees for vehicular use areas may substitute for any other kind of required tree, providing trees for vehicular use areas are so situated that they can perform the functions of the trees substituted for.

The proposed project consists of the vacation of the public right-of-way along Shatto Street, between Witmer Street and Valencia Street in the City of Los Angeles. The total area to be vacated is approximately 30,113 square feet (0.691 acres). The vacated area would revert to the vestee(s) of the underlying fee title interest, which is generally the adjacent property owner(s). Frontage properties along both sides of Shatto Street are owned by the Hospital of the Good Samaritan (540 South Valencia Street, Los Angeles, CA 90017). Shatto Street would be closed to existing traffic.

Subsequent to the original publication, a request was received from the Applicant for the reconsideration of the ND for changes to the Project as follows:

• A General Plan Amendment to the Transportation Element, pursuant to the provisions of 12.32 of the Los Angeles Municipal Code, to permit the re-designation of Shatto Street between Witmer Street and Valencia Street from a collector street to a local street.

The Department of City Planning has determined that the previously issued Negative Declaration (Work Order E1401160) addresses all potential environmental impacts of the revised project and therefore, no new impacts were identified as a result of the project revision. In addition, no additional mitigation measures are required.

I. INTRODUCTION

A Purpose of an Initial Study

The California Environmental Quality Act (CEQA) was enacted in 1970 for the purpose of informing decision-makers and the public regarding potential environmental effects ol proposed projects; identifying methods of avoiding environmental damage; and disclosing to the public reasons for a project's approved even if it leads to environmental damage. The City of Los Angeles (City) Bureau of Engineering Environmental Management Group (EMG) has determined the proposed project is subject to CEQA and no exemptions apply Therefore, the preparation of an initial study is required.

An initial study is a preliminary analysis conducted by the lead agency, in consultation with other agencies (responsible or trustee agencies, as applicable), to determine whether there is substantial evidence that a proJect may have a significant effect on the environment. If the initial study concludes that the project, even with mitigation, may have a significant effect on the environment, an environmental impact report should be prepared; otherwise, the lead agency may adopt a negative declaration or mitigated negative declaration.

B. Process

The proposal to adopt a negative declaration (or mitigated negative declaration) initiates a twenty-day public comment period. The purpose of this cornmeni period is to provide public

and Figure 3 - Project Site Location). The plan designated land use for adjacent parcels to the north and south of Shatto Street, as well as along Witmer and Valencia Streets is zoned "CW' (Central West Specific Plan, Figure 4 - Zoning Map), per the Central West Specific Plan Ordinance (166,703, Effective 4/31'1991). The vacation is entirely within existing, public right-of-way The easterly extension of Shatto Street (from Lucas Avenue to Witmer Street) was vacated in two Council actions (ORO. 134,144 (1967); ORO. 140,063 (1970)), while the westerly extension of of Shatto Street (from Union Avenue to Valencia Street) was vacated vis City Council Resolution (CF 2-2148 (2006)).

B. Purpose

The street vacation is intended to increase public safety by reduction of automobile traffic as well as to integrate and centralize the Hospital of the Good Samaritan, whose facility occupies both sides of proposed vacated street

The proposed project consists of the vacation of the public right-of-way along Shatto Street, between Witmer Street and Valencia Street in the City of Los Angeles. The total area to be vacated is approximately 30,113 square feet (0.691 acres). The vacated area would revert to the vestee(s) of the underlying fee title interest, which is generally the adjacent property owner(s). Frontage properties along both sides of Shatto Street are owned by the Hospital of the Good Samaritan (540 South Valencia Street, Los Angeles, CA 90017). Shatto Street would be closed to existing traffic.

Various conditions are established as the requirements to be complied with by the petitioner for this vacation. These conditions are specified in the Cental District Office memorandum dated December 21, 2009. The conditions are as follows

1. That the following dedications are to be provided adjoining the petitioner's properties in a manner satisfactory to the City Engineer:

a) Valencia Street (Collector). No dedication is required within the existing 70--foot right of way, except for a 15-foot--by-15-foot diagonal or 20-foot radius corner dedication at Wilshire Boulevard.

b) Witmer Street (Secondary Highway). Within the existing (80-foot right of way, the required half right of way is 45 feet Therefore, 15 feet of dedication is required. Also dedicate a 15-foot-by-15-foot diagonal or 20-foot radius corner dedication at Wilshire Boulevard.

c) 6th Street (Secondary Highway) The existing right of way is 82.5 feet The required half right of way is 45 feet Therefore, 3. 75 feet of dedication is required.

d) Wilshire Boulevard (Major Highway, Class II). The existing right of way is 90 feet. The required half right of way is 52 feet. Therefore, a 7-foot dedication is required. Also dedicate 15-foot-by-15-foot diagonal or 20 foot radius corner dedications at Witmer and Valencia Streets.

e) Shatto Street (to be vacated) [Local Street]. No dedication is required.

2. That the following improvements are constructed adjoining the petitioner's properties in a manner satisfactory to the City Engineer

a) Valencia Street Since the existing roadway width is 46 feet, no widening is required. However, street work will be required via 8-permit. This will involve removal of existing curb, gutter and sidewalk, and construction of new sidewalk, integral curb, and gutter at the intersection of Valencia Street and Shatto Street (to be vacated). Storm drain catch basins will require relocation or remodeling at this intersection.

b) Witmer Street. The existing half roadway width is 20 feet, and the required half roadway width is 35 feet. Therefore, 15 feet of widening is required via 8-perrnit. From the new property line, the applicant must construct a 1 0-foot sidewalk, integral curb and gutter, and asphalt pavement to provide for a 35-foot half roadway, and to also provide for a proper transition to existing improvements.

c) 6th Street The existing roadway is 58.5 feet (29.25-foot half-width). The required half roadway is 35 feet. Consequently, 5. 75 feet of widening is required. From the new property !ine, the applicant will construct a l 0-foot sidewalk, integral curb and gutter, and asphalt pavement to provide lor a 35· foot half roadway, and to also provide proper transition to existing improvements. A B-permit will be required.

d) Wilshire Boulevard (Major Highway, Class II). The existing roadway is 56 feet (28-foot half-width) The required half-roadway is 45 feet. Therefore, 17· feet of widening are required From the new property line, the Applicant will construct a 10-foot sidewalk, integral curb and gutter, and asphalt pavement to provide for a 45-foot half roadway. Provide proper transition to existing 'improvements. A 8-permit would be required.

e) Shatto Street. Close existing roadway via 8-permit.

3. That the following additional conditions be required in a manner satisfactoty to the City Engineer:

a) Repair and/or replace all other existing public improvements that rnay get damaged during the renovation to the vacation.

b) A public main sewer line is to be abandoned within the proposed vacated street, which will require a 8-permit. Use of the abandoned sewer

for onsite improvements, would require modification to meet City standards for private sewers.

c) Storm drain catch basins would require relocation and possible redesign to accommodate new street flow conditions

d) Street light standards in the area are to be vacated, and will require either abandonment of relocation per requirements of the Bureau of Street Lighting In addition, ownership transfer of five existing street trees would have to meet the requirements of the Bureau of Street Services (Urban Forestry Division).

e) The vacation street area may not need modification for non-motorized transportation purposes.

f) Vacation areas are neither passable nor available and travel for vehicular access.

g). The proposed vacated Public Ailey area is not necessary for public use for traffic circulation.

h) Revocable Permit: Applicant is adv1sed to apply for and secure a revocable permit from the Bureau of Engineering Central District Office for the Alley closure and use of ailey as shown on the preliminary vacation map (See Figure 1) prior to completion of Street Vacation process.

i): Utility poles that lie within the area to be vacated. Any easements with public utilities must be maintained.

The analysis in this document assumes that, unless otherwise stated. the project will be designed, constructed and operated following all applicable laws, regulations, ordinances and formally adopted City standards (e.g., Los Angeles Municipal Code and Bureau of Engineering Standard Plans). Also, this analysis assumes that construction will follow the uniform practices established by the Southern California Chapter of the American Public Works Association (e.g., Standard Specifications tor Public Works Construction and the Work Area Traffic Control Handbook) as specifically adapted by the City of Los Angeles (e.g., The City of Los Angeles Department of Public Works Additions and Amendments to the Standard Specifications For Public Works Construction (AKA "The Brown Book," formerly Standard Plan S-610)).

Ill. EXISTING ENVIRONMENT The project site and vicinity are located within a fully urbanized area. Shatto Street runs east west and is a designated local street

The proposed project is located in Shatto Street, a 55-foot wide (total) improved nght of way. The roadway is improved with curb; gutter as well as concrete sidewalks on the southerly margin (8-feet wide) and northerly margin (10-feet wide) Parcels that are zoned for commercial uses and are developed with facilities of the Good Samaritan Hospital surround the project site. (Refer to Figure 3 for an aerial view of the project site).

The project site is located within the Hollywood Quadrangle of the United States Geological Survey 7.5-Minute series topographic map (see Figure 1) and is situated at approximately 330 feet above mean sea level. No bodies of water are present on or adjacent to the project site; however, the nearest water body is an artificial lake at McArthur Park, 2,600 feet to the west.

The project site is not located within an Alquist-Priolo fault zone area, an earthquake landslide or liquefaction hazard area, high wind area, very high fire hazard severity zone, flood hazard area, or area subject to inundation from a tsunami or dam failure. There are no oil wells within the boundaries of the project site.

A search of the California Department of Fish and Game, California Natural Diversity Database found six species which are federally and/or state listed as endangered or threatened, within the Hollywood Quadrangle of the USGS topographic map set However, the project site does not contain any habitat suitable for these species_

The Shatto Street vacation site lies in the Community of Westlake, approximately 2 miles west of City Hall in downtown Los Angeles. Surrounding land use is highly urbanized, both commercial and institutional.

The nearest parks, and/or recreation centers are McArthur Park (2,600 feet to the west), Miguel Contreras Learning Center Pool (2, 100 feet to the northeast), as well as Hope and Peace Park (2, 750 feet to the southwest).

Numerous MTA transit lines serve the area. The nearest transit lines run parallel to Shatto Street, along Wilshire Boulevard to tt1e south (Red Line Subway, Lines 20 and 720) and along 61

h Street to the north (Line 18). Foothill Transit (Line 481) offers rush hour service along Wilshire Boulevard, while DASH (Line E) connects Good Samaritan Hospital with points downtown.

However, none of the habitats {freshwater marsh, closed~cone coniferous forest, chaparral, coastal scrub, valley and foothill grassfand) associated with these species are present at the project site. pub!ic water suppliers in the Los Angeles metropolitan area, and is used by private industries, as well as a limited number of private agricultural and domestic users. A project would normally have a significant impact on groundwater supplies if it were to result in a demonstrable and sustained reduction of groundwater recharge capacity or change the potabfe water levels sufficiently that it would reduce the ability of a water utility to use the groundwater basin for public water supplies or storage of imported water, reduce the yields of adjacent wells orwell fields, or adversely change the rate or direction of groundwater flow.

The proposed project would not utilize existing groundwater resources nor would it interfere with groundwater recharge. Any future development is expected to be an expansion of the hosprtal facility and would use existing water supplies rather than groundwater.

Comment: Although the proposed project involves a street vacation, the extension of Shatto Street, west of Valencia Street, has been dosed to through traffic since 1998 and has been used by adjacent businesses for circulation to and from buildings, parking structures, and surface parking lots. That closure was originally granted in an effort to reduce crime, thereby stabilizing the envJronment for local residents and tenants. The adjacent stree'l system adequately served the needs of the community.

b) Conflict with any applicable land use plan, policy, or regulation of an agency with jurisdiction over the project (including, but not limited to the genera! plan, specific plan, local coastal program, or zoning ordinance) adopted for the purpose of avoiding or mitigating an environmental effect? project would create the potential for an estimated 78,200 square feet of future commercial development. The Central City West Specific Plan projected significant commercial development that did not occur and is not anticipated to occur within the life of the plan The potential future development would fall within the limits of the planned development and can therefore be considered as accounted for in the Community Plan. Although the 1997 update of the community plan identifies the project area as a collector street, the Department of City Planning has confirmed that this designation was a mapping error and the current designation should be as a local street, thus not requiring a General Plan amendment for its vacation

The proposed project consists of the vacation of Shatto Street between Valencia Street and Witmer Street as shown on Figure 2. An area consisting of approximately 30,113 square feet of land would be vacated. The vacated land would be reverted to adjacent parcels. One property owner (Good Samaritan Hospital) would be affected. Under the current commercial zoning of the adjacent parcels, C2 (CW)-U3, the 30,113 square feet of vacated land would create the potential for an estimated 75,234 square feet of future commercial development However, no development is currently planned or proposed as part of this project No Significant impacts have been identified and no mitigation measures are necessary.

VII. COMPATIBILITY WITH EXISTING ZONING AND PLANS

The project site lies within the Central City West Specific Plan area. The proposed project has been designed to be compatible with the underlying zoning and land use

A Summary

The proposed project will vacate the public right-of-way in the following street adjacent to the applicant's property: Shatto Street between Valencia Street and Witmer Street, in the Central City West Specific Plan of the City of Los Angeles. The total area to be vacated is approximately 30,113 square feet (0.691 acres). The vacated area would revert to the vestee(s) of the underlying fee title interest, which is generally the adjacent property owner(s).

The project site is surrounded by parcels, which are zoned commercial and are developed with facilities of the Good Samaritan HospitaL There is a potential for future development However, no development is proposed as part of this proJect The vacation would consolidate the proposed areas to be vacated with the adjoining properties owned by the Good Samaritan Hospital (applicant). The vacation will further the Authority's ability to promote airport security

An Initial Records Search conducted by the South Central Coastal Information Center indicates that no archeological work is needed prior to approval of the street vacation. However, a halt­work condition should be in place in the event that cultural resources are discovered during any construction activities. No other potential impacts have been identified

RECOMMENDATIONS

Consider the Negative Declaration, prepared in accordance with the California Environmental Quality Act (CEQA), which finds that the project will not cause significant impacts to the environment, adopt this report and then forward this report and transmittals to City Council with the following recommendations:

1. Adopt the Negative Declaration.

2. Approve the project as Described in the Initial Study.

FISCAL IMPACT STATEMENT

The Project is privately funded.

BACKGROUND The project will be located within the Public Right-of-Way along Shatto Street, between Witmer Street and Valencia Street, Community of Westlake, City of Los Angeles. Processing responsibilities were delegated to the Land Development Division of the Bureau of Engineering.

PURPOSE The street vacation is intended to increase public safety by reduction of automobile traffic as well as to integrate and centralize the Hospital of the Good Samaritan, whose facility occupies both sides of proposed vacated street

DESCRIPTION The proposed project consists of the vacation by the City of Los Angeles of the previously described, public right-of-way in the City of Los Angeles The total area to be vacated is approximately 30,113 square feet (0.691 acres). The vacated area would revert to the vestee(s) of the underlying fee title interest, which is generally the adjacent property

owner(s). Frontage properties along both sides of Shatto Street are owned by the Hospital of the Good Samaritan (540 South Valencia Street, Los Angeles, CA 90017). Shatto Street would be closed to existing traffic.

DISCUSSION

The proposed Negative Declaration and Initial Study (NG-1 i-272-BE), were prepared and filed with the City Clerk on September 19, 2011, and circulated for public and agency review and comment during a 21-day period, from September 19, 2011 to October 12, 2011. No comments were received. No significant impacts are anticipated and no mitigation measures will be implemented for this project.
