1 新版國貿條規「 新版國貿條規「 新版國貿條規「 新版國貿條規「Incoterms 2010」 書第三所著墨的國貿條規 2000 版，已於 2010 年改新版，於書改版不及， 為了廣大讀者能獲得新國貿資訊，特附上剛啟的新版國貿條規。 新版國貿條規之實施 國際商會(ICC)制定之新國貿條規「Incoterms 2010」的應兼具「國際性」和「 面性」，不貿易業、銀行業、運輸業，甚至是保險業，都其應範之內，於 2011 年 1 1 開始適。 國際商會(ICC)制定的國貿條規僅為規則，供買賣通標準並沒有強制力， 於契約自原則，買賣自行於買賣契約中述明權利義務及費分攤；但有爭議須 請 ICC 裁時僅會依據新版做解釋，使已取消的條規，則 ICC 無法做栽。 新舊版國貿條規之較 新舊版國貿條規之較 新舊版國貿條規之較 新舊版國貿條規之較 一、買賣契約：買與賣訂定的易契約 有費細項與新版條規不，或說明 版時須特別訂明。 二、運送契約：貨人與運送人訂的運送契約通常口商的貨通知為依據，買 不易與口的運送人簽訂運送契約，常賣協助辦。 三、保險契約：買賣與保險公訂定的保險契約保為，運輸保險大是指航 程險，即效於起運倉庫終於的倉庫稱為倉庫條(Warehouse Clause) ，不 含二之內運輸，買賣契約規定承保範， CIP 規則規定至少應涵蓋賣 貨點至指定的。 、要運費與運輸工具：指運送貨物貨到送達要距離運輸的運費，而完成 之要運輸工具，飛機、輪船謂之。 六、On Board：新版條規對 FOB 條規貨中之定義為賣須排將貨物於船上放置 定位才完成貨。此點與舊條規定義為越過船舷有所不。 七、整櫃貨適：新版條規建議海運整櫃貨不宜 FAS、 FOB、CFR、CIF 條規， 貨櫃會移往內櫃或延伸貨站，但此條規僅規範到為，與規定的指定的 差別甚，曝險甚鉅，業者不不慎。 八、進口稅金：新版條規對 DDP 條中明確說明 DUTY 含進口的何之值稅及 其稅捐。 九、運送人：新版條規定義運送人(Carrier)為「與貨者訂運送契約的一」，空運即 為航空公或承攬業者(Forwarder)，海運則是船公或承攬業者。
