1 新版國貿條規「 新版國貿條規「 新版國貿條規「 新版國貿條規「Incoterms 2010書第三所著墨的國貿條規 2000 版,已於 2010 年改新版,於書改版不及, 為了廣大讀者能獲得新國貿資訊,特附上剛啟的新版國貿條規。 新版國貿條規之實施 國際商會(ICC)制定之新國貿條規「Incoterms 2010」的應兼具「國際性」和「 面性」,不貿易業、銀行業、運輸業,甚至是保險業,都其應範之內,於 2011 1 1 開始適。 國際商會(ICC)制定的國貿條規僅為規則,供買賣通標準並沒有強制力, 於契約自原則,買賣自行於買賣契約中述明權利義務及費分攤;但有爭議須 ICC 裁時僅會依據新版做解釋,使已取消的條規,則 ICC 無法做栽。 新舊版國貿條規之較 新舊版國貿條規之較 新舊版國貿條規之較 新舊版國貿條規之較 一、買賣契約:買與賣訂定的易契約 有費細項與新版條規不,或說明 版時須特別訂明。 二、運送契約:貨人與運送人訂的運送契約通常口商的貨通知為依據,買 不易與口的運送人簽訂運送契約,常賣協助辦。 三、保險契約:買賣與保險公訂定的保險契約保為,運輸保險大是指航 程險,即效於起運倉庫終於的倉庫稱為倉庫條(Warehouse Clause) ,不 含二之內運輸,買賣契約規定承保範, CIP 規則規定至少應涵蓋賣 貨點至指定的。 、要運費與運輸工具:指運送貨物貨到送達要距離運輸的運費,而完成 之要運輸工具,飛機、輪船謂之。 六、On Board:新版條規對 FOB 條規貨中之定義為賣須排將貨物於船上放置 定位才完成貨。此點與舊條規定義為越過船舷有所不。 七、整櫃貨適:新版條規建議海運整櫃貨不宜 FAS、 FOB、CFR、CIF 條規, 貨櫃會移往內櫃或延伸貨站,但此條規僅規範到為,與規定的指定的 差別甚,曝險甚鉅,業者不不慎。 八、進口稅金:新版條規對 DDP 條中明確說明 DUTY 含進口的何之值稅及 其稅捐。 九、運送人:新版條規定義運送人(Carrier)為「與貨者訂運送契約的一」,空運即 為航空公或承攬業者(Forwarder),海運則是船公或承攬業者。
