NEW DELHI, Nov 25:

No one can claim the namesof holy books and scriptures likeRamayana or Quran and usethem as trademarks for sellinggoods and services, the SupremeCourt has ruled.

"There are many holy and reli-gious books like Quran, Bible,Guru Granth Sahib, Ramayan, etc.The answer to the question as towhether any person can claim thename of a holy or religious bookas a trademark for goods or serv-ices marketed by him is clearly'No'," a bench of justices RanjanGogoi and R K Agrawal said.

It also said that allowingnames of gods or holy books tobe trademarked could offend"people's sensibilities".

The apex court ruling cameon an appeal filed by Bihar-based Lal Babu Priyadarshi,who had sought to trademark theword 'Ramayan' to sell incensesticks and perfumes, against theorder of the Intellectual PropertyAppellate Board (IPAB).

"The word 'Ramayan' repre-sents the title of a book written byMaharishi Valmiki and is consid-ered a religious book of theHindus in our country. Thus,using exclusive name of the book'Ramayan', for getting it registeredas a trademark for any commoditycannot be permissible under the(Trade and Merchandise Marks)Act," the apex court observed inits 16-page judgement.

The court also objected to pic-tures used by him on the incensestick packets and said "...The pho-tographs of Lord Rama, Sita andLakshman are also shown on thelabel, which is a clear indicationthat he is taking advantage ofGods and Goddesses, which isotherwise not permitted."

Priyadarshi had submittedbefore the court that through exten-sive use, wide advertisement andthe excellent quality of the prod-ucts, the trademark 'Ramayan' andthe carton in which the productsare sold had become distinctive insuch a manner that use of a similartrademark by any other personwould cause confusion and decep-tion in the trade and amongst thepublic. He claimed prior use, aver-ring that he was using theTrademark since 1981.

The court, however, observedthat "if any other word is added assuffix or prefix to the word'Ramayan' and the alphabets or

design or length of the words aresame as of the word 'Ramayan',then the word 'Ramayan' may loseits significance as a religious bookand it may be considered for reg-istration as a trade mark."

The court took note of theEighth Report on the Trade MarksBill, 1993, submitted by aParliamentary StandingCommittee, which said any sym-bol relating to gods or places ofworship should not ordinarily beregistered as a trademark.

Priyadarshi had come inappeal against the IPAB's deci-sion in favour of one AmritpalSingh, who had contended that'Ramayan' cannot be registeredas a trademark as the name of areligious book cannot bemonopolised by an individual.

Priyadarshi had contendedthat the law does not bar using thename of a religious book as atrademark, and there was no evi-dence on record to show that feel-ings of any section of Hindus havebeen hurt by doing so.

Brushing aside, Priyadarshi'scontention, the court said that asper the law, one cannot takeadvantage of gods and goddess-es to sell products.

It also concurred with Singh'sarguments that no individual canbe given an exclusive right overgods and holy books, especially tomake a profit. (PTI)

PM underlines message of harmonyon Guru Nanak Jayanti

NEW DELHI, Nov 25:

On the occasion of Guru Nanak's birthday, Prime MinisterNarendra Modi today underlined the message of harmony andcompassion propagated by the founder of Sikhism, a message thatassumes significance in the midst of "intolerance" debate.

"On Guru Nanak Jayanti, my greetings to everyone. GuruNanak Dev's message of service, compassion and harmony inspireeternally," Modi tweeted.

The Prime Minister's message assumes significance in view ofthe "intolerance" debate, which has been further fueled by film starAamir Khan's remarks that he was "alarmed" by a number of inci-dents and his wife Kiran Rao had wondered if they should moveout of India.

Guru Nanak Jayanti also known as Gurpurab and PrakashUtsav marks the birthday of the first Sikh Guru Guru Nanak. It isone of the most sacred festivals in Sikhism and is celebrated byHindus also with equal fervour. (PTI)

Under attack over hisremarks on intolerance,Bollywood superstar AamirKhan today asserted that hestood by his comments andmade it clear that neither he norhis wife Kiran Rao have anyintention of leaving the country.

50-year-old Aamir, who drewflak from BJP and a section offilm fraternity for expressing his"alarm and despondency" overthe rise in recent incidents ofintolerance, came out with astatement, saying he is "proud tobe an Indian".

"First let me state categori-cally that neither I, nor my wifeKiran, have any intention ofleaving the country. We neverdid, and nor would we like to inthe future.

"Anyone implying the oppo-site has either not seen my inter-view or is deliberately trying todistort what I have said. India ismy country, I love it, I feel fortu-nate for being born here, and thisis where I am staying," he said.

The actor had kicked up apolitical storm with his remarksat a function in Delhi onMonday about his wife express-ing fear for their child in thecurrent atmosphere.

CVC examines Wal-Mart’s top executives over corruption charges

NEW DELHI, Nov 25:

Top executives of the US-based world's biggest retailerWal-Mart have been examined byCentral Vigilance Commission(CVC) amid allegations that thecompany gave bribes to govern-ment officials to get customsclearances and obtain permits toset up stores in India.

The company officials havesubmitted balance sheets of pastseven years and sought time to givesome more documents required bythe anti-corruption watchdog.

"We had summoned Wal-Mart's officials. Following which,two of their senior executivesincluding company's India headhave been examined. They havesought time till December 15 tosubmit more documents relevant inthe case," Vigilance CommissionerT M Bhasin said here today. Theofficials were examined recently.

It is for the first time that theprobity watchdog has startedinvestigations involving a pri-vate company.

Bhasin said that both the offi-cials were summoned under therelevant section of the CVC Actwhich empowers it to summon andenforce the attendance of any per-son from any part of the countryand requisition any public recordor copy, among others.(PTI)
