Introduction
BackgroundSuccessive governments have promised investigations after numerous instances ofhumanrightsviolationsinSriLanka, bothduringthewarandsubsequently.Despitethelong listofpromises, limited legalactionhasbeentakentoapprehend,prosecuteandholdallegedperpetratorstoaccount.Thefewcasesthathavewitnessedsomelegalactionhavedevolvedintolong,drawn-outinvestigations,afewarrestsandfewstepsaretakento indict and prosecute. Both the inability and the unwillingness to prosecuteperpetratorshashinderedprogresstowardsaccountabilityandultimatelycontributedtoacultureofimpunityinSriLanka.
Thelackofgenuineactionandtrustwithdomesticstructurestodeliveronjusticeledtothegrowingcallsforinternationalinvolvement, investigationsandaction, whichresultedin the United Nations Human Rights Council (UNHRC) Resolution 30/1 in 2015. TheResolution affirms a number of transitional justice commitments proposed by the SriLankangovernment, andonaccountabilityforpasthumanrightsviolationsinparticular, acommitmenttoestablishaspecialcounseltoinvestigateallegationsofviolationsandabuses of human rights and violations of international humanitarian law.1 Thiscommitment, reaffirmed again in UNHRC Resolution 34/1 in 2017, is welcome andnecessary. International involvement in truth and justice initiatives is not new in SriLanka–previousgovernmentshaveinitiatedmechanismsandappointedinternationalofficials,suchaswiththeInternationalIndependentGroupofEminentPersonsandtheAdvisoryCouncil,bothentitiesappointedbyPresidentMahindaRajapaksa.2
InMarch2019 theUNHRCwill takeupSriLankaandexamineprogressmadeon theimplementation of Resolutions30/1 and34/1. As seen in the past, there is generallyincreasedgovernmentactivityinimplementingcommitments,orrather,beingseentodoso,intheimmediateleaduptoUNHRCsessions.Thispatternhasbeenrepeatedthisyear,withincreasedmovementonseveralcommitmentssincethestartof2019.However,thegenuinenessofrushedprocesses in thismannermustalwaysbequestioned.3There isalso no known progress with the establishment of the accountability mechanism ascommittedtoin2015anditisyetunknownwhethertherewillbeanymovementonthisinthenearfuture.
