EMD : Rs.1,00,000/- in the form of Demand Draft in favour of Secretary, Sports
Authority of India payable at New Delhi.

NOTICE INVITING PROPOSALS TO RUN A DISCIPLINE AND TO IMPART SPORTS COACHING BASED ON REVENUE SHARING MODEL
The stadia of Sports Authority of India in Delhi are having various facilities
which were either constructed/ renovated during Commonwealth Games held in New Delhi in 2010 or are developed subsequently.
In continuation with the Sports promotional policy of SAI, these stadia have been converted to multi disciplinary for use by various category of sports persons and the general public on pay and play basis under the scheme known as “Community Connect”.
The idea is to bring is to involve experts in running of the system and bring
more footfall, utilization of various facilities and spaces for core sports as well as for recreational sports including the facilities for senior citizens. The objective is also to make the system self sustaining.
Proposals are invited from the individuals/academies/eminent sports
persons/private agencies involved in sports and health related activities to impart coaching in following categories at SAI Stadia, Delhi. Applicants may apply for both or any one of the categories and for one discipline only in one or all the stadia.
(1) Name of the work
Category-I
The facilities/disciplines under this category are available for coaching on revenue sharing model at the ratio of 60 and 40 % i.e, 60% of total revenue generated through coaching goes to the agency and 40% retained by Sports Authority of India. The offer should be submitted in the form given at annexure –
‘A’. The coaching fee will be fixed by mutual agreement between the agency and SAI, the objective being maximum foot fall and quality coaching. Following facilities for which offers are invited are either already developed or work in progress :- Jawaharlal Nehru Stadium(JNS)
Archery, Athletics, Volleyball, Football, Table Tennis, Chess, Billiards & Snookers, Badminton, Fitness Centre, Weightlifting and Lawn Bowl.
Indira Gandhi Sports Complex(IGSC)
Billiards & Snookers, Basketball, Gymnastics, Volleyball, Skating, Table Tennis, Judo, Martial Arts and Badminton.
Major Dhyan Chand National Stadium(MDCNS)
Billiards & Snookers, Hockey and Volleyball.
Dr. Syama Prasad Mukherjee Swimming Pool Complex(Dr.SPMSPC)
Table Tennis, Volleyball, Skating and five lanes for swimming would be earmarked.
Dr. Karni Singh Shooting Range(Dr.KSSR)
Shooting Ranges, Volleyball, Billiards & Snookers, Carrom, Bridge, Dart Board Game, and Table Tennis.
Category-II The following facilities/disciplines are available for coaching on revenue
sharing model at the ratio of 60:40 i.e. 60% goes to the agency and 40% to Sports Authority of India. However, the assured monthly revenue to SAI should be indicated by the agency (the same may be quoted as per the Performa at annexure-B). The agencies will be allowed to fix the coaching charges at their own.
Swimming at Dr. SPMSPC, Golf at JNS & Dr. KSSR, Tennis at JNS & IGSC, Cricket at MDCNS & IGSC, Fitness Centre (Gym, Yoga, Sauna etc.) at JNS, IGSC, MDCNS & Dr. KSSR.
ELIGIBILITY CRITERIA FOR BOTH CATEGORIES:
a. The applicant should have the coaching experience of not less than 3 years in that field and the application must be supported by testimonials as proof for having conducted coaching duly authenticated by the Head of the Institutions / Organization wherever the coaching was provided by the agency/individual.
b. With regard to the Coaches, they should have the basic qualification as laid
down by the National and International Sports Federations of the respective Sports discipline. Diploma by the NSNIS (Netaji Subash National Institute of Sports) or LNCPE, SAI or a Govt. recognized Sports College / University/ Institute would be preferred and the copies of the testimonials should be attached with the proposal.
c. Coaching timings and durations of coaching, will be as per SAI’s norms. d. The venue and the Sports infrastructure provided at the facility can be seen
on any day in the week with prior intimation to the Administration. The proposal offering the service must include the bio-data, experience and
achievement testimonials of the coaches who will actually provide the coaching and references from two eminent sports personalities associated with the discipline. In case of an agency providing the coaches, the details of composition and ownership of the agency must also be provided. Two copies of passport size photographs along with the educational certificates, identity and residence proof as accepted in KYC norms prescribed by the RBI or NPR or UIDAI(Aadhar) must also be accompanied with the proposal.
The proposal must also list the coaching fee proposed for a person per hour
per day, timings and duration of coaching; revenue sharing ratio and any other requirement of the proposer for imparting coaching. The ideal coach-trainee
ratio recommended must also be indicated in the proposal. Since, the onus on business development and publicity of the coaching lies with the applicant, any proposal in this regard may also be indicated.
The applicant must also certify that no injury, investigation, case, departmental or other proceedings in relation any official case of criminal offence or allegation of moral turpitude have been initiated /or are against him/her pending and or the applicant has not been convicted / held guilty by any court or Authority in this regard.
The revenue to be based on time allocated to the academy (both category
‘I’ & ‘II’). SAI reserves the right to postpone or reschedule activities under
Community Connect for day / days the stadium is booked by outside agencies for sports and non-sports events. This would apply only in cases where the booked area incorporates the facilities being offered under category ‘I’ & ‘II’ of Community Connect. The right of admission are reserved by SAI.

A pre-bid conference would be held on 28.03.2014 at Conference hall, first

(1) A sportsperson who has played at International level and running the Academy since more than last 03 years (35 points)
(2) A sportsperson who has played National (medal winner) and running the
Academy since more than last 03 years (25 points) (3) Academy in existence for more than last 03 years being run by Dronocharya
Awardees (25 points) (4) Academy/Agency where Arjuna Awardees or Rajiv Gandhi Khel Ratna or
International player is associated as a Coach (20 points)
(5) Any sportsperson running the Academy for more than 05 years (15 points) (6) Academy in existence for last 10 years though not being run by any
sportsperson (20 points) (7) Academy which has produced (participated), as International players: 01 player (10 points) 02 players (20 points) 03 players or more (30 points) Work will be awarded to the firm/academy/individual subject to the following;
Getting minimum of 60 points(cumulative basis) and
Assured monthly revenue sharing to SAI for category B. More than one firm can be assigned the work on time sharing basis. The contract would be entered initially for two years and extendable by another one year.
Last date for receipt of proposals is on 11.04.2014 upto 5.00PM and will be
opened at 5.30PM on the same day. The proposals may be dropped in the tender box placed at ground floor in the office of Assistant Director(Stadia) within the scheduled date & time.

SPECIAL TERMS & CONDITIONS
Academy refers to the eminent sportsperson(s) / experienced individual(s) / Agencies / Organization(s).
1. The SAI reserves the right to refuse/cancel the proposals without assigning any reason at any time.
2. The Authority will hire the services on part time & contract basis for 02 years extendable to another one year for imparting coaching in Sports Authority of India Stadia, Delhi.
3. That this contract is valid upto two years extendable by another one year.
4. Only the designated FOP (field Of Play)/Courts shall be provided to the Academy/agency.
5. Timings – The timings of coaching will be decided by Administration.
6. The Coaching Charges – The coaching charges to be decided subsequently,
as mutually agreed.
7. The revenue sharing ratio – The revenue sharing ratio will be 60:40 (Agency: SAI).
8. Sponsors – sponsors may display the banners/hoarding by paying display
charges to Sports Authority of India as below; Sponsorship Banner: Rs.500/- per banner per day for size 2.5’x4’; Rs.1000/- per banner per day for size 5’x8’; Rs.2000/- per banner per day for size above 5’x8’ and upto 80 sq. feet ; For above 80 sq.ft. @ Rs.25/- per sq.ft. per day.
9. That the coaching charges will be collected by SAI at the Reception Centre
and receipt should be obtained. The share (60%) of the agency for the preceding month will be given in the first week of the current month. The Agency will ensure that only those persons who have a valid receipt are permitted to join coaching classes.
10. That the engagement of the coach is purely on part time and contract basis and he shall be free to take any other assignment provided the same does not infringe the coaching timings of the Complex. That the coaching shall be conducted only in the allotted courts and in scheduled date and time.
11. No markings in the grounds/courts with any kind of powder/tape/other
material would be permitted. The agency shall not cause or permit to be caused any damage to the said premises. Under no circumstances, the agency shall make any alteration to the said premises without the prior written permission of the SAI.
12. During the course of coaching, the academy would be responsible for any accident or loss of life of its employees and SAI will not be responsible.
13. The agency shall keep the premises neat and clean during coaching and the same will be handed over in neat and clean state once the coaching is over, it shall abide by the timings set down by the Administration from time to time.
14. No eatable would be served in the field of play. No pets are permitted inside the Complex.
15. Medical facility for any contingency during the coaching inclusive of Medical Kit, First Aid-Box, may be ensured by the academy. These arrangements shall be made in advance.
16. Nothing to be stuck on stadium walls. No material which will cause damage to the court/floor will be used inside the arena/stadium.
17. It will be the responsibility of the academy to ensure that any item brought inside the stadium complex are free from risks to Health, Safety, Security, fire hazards and any other risks.
18. SAI will not be responsible for any losses due to disturbance/failure/breakdown of electricity, air-conditioning, other installation, fire, storm, earthquake, other natural calamities or seepage of water in the main arena through the roof.
19. Any loss/damage to infrastructure during / due to the coaching would be recovered from the academy based on CPWD norms.
20. SAI shall allow parking space inside the stadium for limited vehicles only on coaching days. No vehicles would be allowed beyond parking area.
21. No publicity and sponsorship of alcohol and tobacco products or any prohibited substances is permitted in the stadium.
22. SAI will be responsible for only the routine cleaning and upkeep of the stadium.
23. SAI will provide Toilet facilities, free water supply including drinking water, other than bottled water etc., as is normally available in the stadium.
24. Each item which will be brought in the stadium by the agency is to be informed to the Administrator in writing and while taking the said items / articles outside from the stadium, proper gate pass is to be obtained from the security office of the Complex.
25. Any other terms/conditions, guidelines which the Administration thinks fit,
the same should be strictly adhered by the academy.
GENERAL TERMS & CONDITIONS FOR IMPARTING COACHING AT SAI
STADIA, DELHI
(i) Change in the constitution/ share holding of the academy after award
of the work/ contract will not be allowed under any circumstances.
(ii) Sports Authority of India may at its discretion, accept any quotation /
proposals or reject any or all the quotations / proposals, without
assigning any reason, thereof
(iii) Before submitting the proposal, the agency may inspect the site and
satisfy himself about the location, area, equipment and assess its
business prospects.
(iv) The duration of the contract will be two year from the date of award of
contract and the same shall be extendable by one more year.
(v) Tender documents can be obtained / downloaded on the CPPP or
www.sportsauthorityofindia.nic.in
(vi) The proposals of only those agencies shall be opened, who have
submitted cost of tender, earnest money in the proper manner. No
request shall be entertained to deposit the same after the prescribed date
and time.
(vii) Canvassing whether directly or indirectly, in connection with proposals is
strictly prohibited and the proposals submitted by the agencies who
resort to canvassing will be liable for rejection.
(viii) The proposals of eligible firms would be evaluated and of those who get
Minimum 60 points (cumulative basis) would be opened. For the
category ‘B’. More than one agency can be enlisted for the same activity.
whoever quotes highest minimum assured monthly revenue to SAI
would be awarded the contract.
The overall control and supervision of the field of play shall remain vested with
the SAI and whose officials shall be entitled to inspect field of play.
a) The Agency shall not be entitled to sublet the said FOP or any part thereof.
b) On the earlier revocation thereof under terms and conditions fixed in the
agreement or under the rules prescribed thereof or on closure of the
premises (except an official closed day) even for a single day or on breach
of any other terms and conditions set forth above, the contract is liable to
be cancelled and the SAI will entitled to enter into the said premises and
deal with it in such manner as it may deem fit.
c) Agency shall faithfully follow and abide by all provisions of DMC Act, Bye-
laws, Rules & Regulations made there under the other laws made from
time to time and the Rules & Regulations made by SAI.
d) The Proprietorship or Partnership firm should qualify on its own and no
consortium, JV or SPV is allowed to participate in the tender process.
1. The earnest money of the successful firm will be forfeited if it does not fulfill
any of the following conditions within 7 days of the issue of the award letter of
license.
a) Security deposit equivalent to 3 months coaching fee(proposed) in the
form of Demand Draft of any scheduled bank in favour of Secretary,SAI
payable at New Delhi. The security so deposited shall be forfeited in the
event of breach of any of the clauses as contained in the agreement. The
same shall be refundable subject to fulfillment of the terms and conditions
of the agreement to the complete satisfaction of SAI and payment of dues,
if any.
b) Execution of the agreement and completion of other formalities.
2. In order to check the bonafide of the firms, documents like copies of payment
challans of VAT, sale tax, income tax, etc., experience certificate in respect of
previous work handled, bank statement photocopies, income tax TDS
certificates duly verified by a registered Chartered Accountant and shall submit
a certificate to the effect that the documents submitted are in order.
3. THAT the agency shall not display or exhibit pictures, posters, status or other
articles which are repugnant to morals or are of indecent, immoral or of other
improper character. It is expressly agreed that the decision of the SAI in this
regards shall be conclusive and binding on the agency and shall not be a
subject matter of dispute.
4. THAT agency shall not display or exhibit any advertisement in any part of the
interior or exterior of the FOP without prior permission of the SAI.
5. THAT the agency shall have no right, title or interest in the premises and shall
have no exclusive possession thereof, except for the permission to use the said
premises and shall not be deemed to have any right, title or interest in the said
FOP or any other premises inside the complex.
6. THAT the agency shall not be entitled to allow any other person to use the
premises in its stead or to use any part thereof. In the event of the death of
any partner / proprietor or becoming insolvent, or to be amended or
dissolved, prior to the expiry of the period fixed herein, the contract shall
stand terminated automatically and the legal heirs or the legal representatives
of the agency shall not be entitled to use the premises. However, with the
express approval of the SAI in writing such legal heirs or representatives may
be permitted by the SAI after discharging any liability under the contract,
without causing injury to the premises, to remove fitting or fixtures within
three weeks of such demise of the contact.
Technical Support:-
1) The name / parentage, qualification and address of such personnel should
be supplied along with the proposals if possible, if not, the same may be
supplied at the time of award of contract and a list of their names and
addresses shall be displayed by the contractor on the notice board of the
complex. If the required personnel as detailed above are not available
during the shift or part thereof the management shall deduct an amount of
Rs.1000/- for each person per day. Besides, the management can itself
deploy personnel at the cost of SAI, which will be deducted from the
security deposit available with SAI. Photograph of individuals should also
be pasted on the bio-data of individuals for proper authenticity.
2) The qualification / experience certificate and other documents as asked for
in the proposals shall be verified beforehand.
3) It would be the sole responsibility of the agency to ensure that all those
personnel whose Bio-Data has been mentioned by the one agency should
not from part of any other agency which is participating in the proposals.
4) Frequent changing of manpower supplied by the agency shall be avoided.
If any change is required due to exigencies of service, the change will be
done only with the prior permission of Administrator of the complex.
5) All staff shall be placed only after police verification and confirmation to the
Administrator of the Complex. The agency awarded the work undertakes
to ensure that its staff will maintain due courtesies to all users and
decorum and not involve in activities detrimental to a conducive
environment for imparting coaching.
6) All the persons required to be deployed for imparting coaching should wear
uniforms with their name tags.
7) The agency shall have to maintain an attendance register of the staff and
the same should be available at site.
8) THAT the agency shall also pay all taxes including service tax as payable to
the Government or Municipal or Local bodies concerned in connection with
the business at the said premises as applicable from time to time.
9) THAT the agency shall cater to the requirement of the users while utilizing
Stadium facilities. Failure to do so shall be deemed as breach of the terms
of this contract.
10) THAT the agency shall keep and maintain a complaint book to be issued by
the SAI and shall make it available to every bonafide member or visitor
whoever demands the same for recording any complaint in respect of
coaching. The agency shall submit the said complaint book before theSAI /
authorized person every month on or before 15th and shall abide by the
instructions of the SAI issued thereon.
11) THAT the SAI shall have the right to revoke the contract in the event of
breach of any of the terms and conditions of this agreement or any
instruction issued there under. In such eventually, the SAI shall be entitled
to forfeit the security deposit in part or in full at its sole discretion.
12) THAT the SAI shall have the right to terminate the contract after giving one
month notice without assigning any reason therefore.
13) The agency shall ensure that only authorized users holding valid
membership / authorization card/receipt issued by the SAI in printed or
proper forms are allowed to enter the Complex. The SAI shall have the
authority to carry out checking/supervision to ensure that no person
utilizes the facility without making payment and that proper record of
receipts is maintained by the agency.
14) THAT the dealings of the agency / his employees with users of the facility
of Stadia shall be polite and courteous. The agency shall not indulge in any
anti social activities, which may cause harm to the interest of the sports
complex or its employees. If any employee of the agency is found or
reported to be misbehaving or is discourteous, the agency shall pay to SAI
compensation of a sum of Rs.5,000/-for each instance. Repetition of this
on more than three occasions shall result in cancellation of the contract.
Decision of the SAI in this regard shall be final and binding.
15) THAT for minor breach of any terms and conditions, the agency can be
ordered to pay to Rs.5,000/- compensation of a sum of upto Rs.10,000/-
per occasion while for major breach the contract can be terminated.
16) THAT the agency would be required to sign an inventory of the fittings and
fixtures installed at the premises at the time of its occupation and will be
required to hand over the charge of the same without causing any damage
at the time of vacating it.
17) THAT the agency shall be responsible for all damages or loss of property
due to the reasons for which he or his servants are directly responsible and
shall be liable to make good any loss or damage that may be sustained by
the agency except the damage which are caused by storm, earthquake or
any natural calamities beyond its control. The decision of the SAI with
regard to the extent and quantum of compensation, if any, to be paid shall
be binding upon the agency.
18) THAT the premises allotted shall not be used for residential purpose, or for
a purpose other than that for which it is allowed. The agency shall not be
permitted to utilize, or to carry on any other trade along with the
authorized business of the agreement during the period of contract from
the premises. The agency shall not claim any additional facilities other
than those available at the time of awarding. However If any assistance
needed, the same may given in writing to the Administrator.
19) The agency can charge advance utilization fees for a maximum period of
one month only at time as per the approved utilization fees. Besides, the
agency can only charge fees for the period until the current contract
period is valid. Under no circumstances, the agency can charge advance
utilization fees for a period beyond the duration of the current contract
period. Any amount unauthorized collected by the agency shall have to
be re-paid by the agency to the users/members from whom the same has
been collected. Actual collection of fee will rest with SAI.
20) THAT on the completion of the period of contract, or on prior
determination thereof, the agency shall peacefully remove its materials, if
any, from the stadium premises. If the agency does not remove materials
within a fortnight of the service of notice upon him, SAI shall remove the
same at the cost of the agency from its security deposit, where after the
materials shall stand forfeited to SAI.
21) THAT the agency shall not claim any amount on account of loss of profit or
damages for earlier determination of the contract.
22) THAT the agency shall be responsible to take all the necessary
steps/precaution to prevent any mishap/accident/loss of life in the stadium
premises. In case any mishap/ accident/loss of life occur owing to any
reason during the subsistence of the contract, it shall be the sole
responsibility of the agency and the SAI shall not be responsible for the
same in any manner whatsoever.
23) THAT any misrepresentation or suppression of any other material facts or
charging of fee more than as conveyed to SAI shall render the contract
liable for cancellation.
24) THAT the agency would be responsible to ensure that the provisions as laid
down in the minimum wages act and any other Act or Rule, as may be in
force from time to time, are strictly and properly adhered to and SAI will
not be responsible for any such violation on the part of the agency. The SAI
shall have no concern, liability or responsibility regarding any dispute
between the agency and its employees, as also in respect of payment of
wages, allowances or other charges of any nature whatsoever. The
personnel employed by the agency shall in no case be treated as
employees of SAI for any purpose whatsoever.
25) THAT the security deposit and Bank Guarantee tendered by the agency
shall be released on furnishing a certificate from the Competent Authority
that up to date dues/wages of the staff/labor, so engaged by the agency,
have been cleared and no dispute/claim is pending on the said account in
any court of law/forum. Further the agency shall have to submit a
clearance certificate from SAI or any other officer so authorized by SAI, that
no amount is outstanding against him on any account whatsoever before
releasing of security deposit. No interest shall be payable on the amount
of security deposit and Bank Guarantee.
26) THAT the decision of SAI with regard to interpretation of the terms and
conditions shall be final and binding and shall not be called in question in
any proceeding before any court or forum.
27) THAT all or any of the powers and rights exercisable by SAI in respect of
contract shall be exercisable by the SAI and the agency shall not have any
objection whatsoever in respect thereof.
28) THAT the SAI shall not be responsible for the safety of men or any other
material or articles belonging to the agency and also shall not be liable for
any damage or injury to the property of the agency lying at any time in or
upon or around the said premises.
29) THAT on expiry of the period of contract or on earlier determination or
revocation of the contract, any belongings of the agency found on the
premises shall be liable to be sold through public auction, unless claimed
within a fortnight of the expiry of the period of contract or determination
or revocation of the contract as the case may be. The SAI shall be entitled
to appropriate out of the proceeds of such sale, the amount due to the SAI
from the agency and also, after deducting cost of administration and
auction/sale of those belongings and the balance, if any, shall be paid to
the agency or its legal heirs, representative, etc., as the case may be.
30) THAT the premises shall be open at any time for inspection by the
representative and the authorized staff of the licensor and also for
execution of any repairs, additions and alterations at the site, checking
water and sanitary conditions, or for renovation which may be found
necessary from time to time by the SAI.
31) THAT all or any of the power vested in the SAI under these present in
respect of the grant, determination, revocation, cancellation or restoration
of this contract or recovery of any dues in respect thereof or connected
therewith shall also be exercised by SAI and the agency shall have no
objection whatsoever in this regard.
32) Intending agency should not have been debarred in the past from
tendering in the Sports Authority of India. This would apply to individuals
as well as agencies. Individuals who were operating such debarred
agencies cannot also apply in the name of a new agency. If, such instance
comes to the notice of the management subsequently, the contract would
be immediately terminated due to concealment of facts by the agency and
the agency would be debarred from further tendering in the SAI apart from
forfeiture of the security deposit. Any individual who has been debarred is
not permitted to take part in any negotiations or represent any agency
even if he holds a power of attorney on the agency’s behalf. Any agency
engaging debarred persons is also liable to debarring.
33) THAT in case of breach of any of the conditions as referred to above, or in
case any charges, taxes, levies, or any other amount is not paid, the SAI
shall have the right to terminate, cancel and revoke the contract and cause
the material of the agency to be removed from the Complex without any
compensation whatsoever, besides recovery of the loss caused to the SAI.
The decision of the SAI shall be final and binding and shall not be
questioned in any forum or court of law.
34) THAT any breach of the terms and conditions of the agreement by the
agency shall render the contract liable to cancellation. The decision of SAI
in this regard shall be final and binding and shall not be called in question
before any Court or Forum.
35) The agency shall not place any other equipment in the stadium over and
above those provided by the SAI. In case some other equipment is placed
by the agency, the same will be attached / confiscated by the complex.
Besides this, the contract shall be terminated and security deposit forfeited
absolutely. However, if any need arises in this regard, the request may be
given to the administrator in writing.
36) The maintenance of equipment, flooring and the premises within the
Stadium premises during their coaching period will be the responsibility of
the agency.
37) The AMC of the equipment/FOP/Sports Infrastructure will be the
responsibility of SAI. However, the agency would immediately inform the
Administrator of the complex if any equipment is non functional and
requires repair, so that the matter can be taken up by the Administrator
with the AMC provider.
38) In case machines/equipment get damaged due to vandalism, rough use,
etc., the responsibility would be that of the agency who will get them
repaired/replaced at his own cost from the original supplier only, failing
which the bank guarantee shall be got encashed by the SAI to meet the
cost of damage to the equipment.
39) That the premises shall be open to inspection by the representatives and
the authorized staff of the SAI and also to execute any structural repair,
additions or alterations at the site, check water and sanitary conditions or
undertake renovations which may be found necessary from time to time by
the SAI and for the purpose connected therewith and for the compliance of
term and conditions of any works relating to repair/additions/alterations or
other damages that may be caused during the course of installation of any
fittings, fixture, etc. In case of major renovation, the premises shall remain
closed and if need be the contract may be terminated and fresh proposals
will be invited.
40) No unauthorized person will be permitted to use the facility of the
Stadium. In such cases, the matter will be reported to the Complex
Administrator who in turn will refer the Disciplinary Committee of the
Complex to take suitable action against the said person.
41) The Sports Complex shall remain closed for a day once during the week.
Monday can be treated as ‘off-day’. However, the day fixed by the Complex
Administration for this purpose shall be final and binding and the same
shall be strictly followed by the agency. The Complex shall also remain
closed on holidays of National importance such as 26th January, 15th August
and 2nd October, or as may be declared closed by the Central/State
Government.
42) The facility would be available for use at free of cost to National Campers,
Elite Sportspersons (Rajiv Gandhi Khel Ratna awardee, Arjuna awardee,
Dronacharya awardee and for any other persons/officials referred by
Director General, SAI)
43) The agency will provide the facilities of the Stadium to the SAI for any
purpose as and when required during Major Sports events(National and
International Competitions) etc.
44) Shortcoming in contractor’s performance:
If SAI/Authorized person on behalf of SAI found any shortcoming in
performance of the agency or in maintaining contractual obligations, it
shall render the contractor/agency liable to any or all of the following
sanctions;
a) Imposition of penalties,
b) Forfeiture of its performance security,
c) Termination of Contract for default
45) Termination for default:
Without prejudice to any other contractual rights and remedies available to
it, SAI, New Delhi by a written notice of default sent to the contractor,
terminate the contract whole or in part, if the contractor fails to perform
any or all of the services or fails to perform any other obligation(s) of the
contract.
46) Termination for convenience
The SAI New Delhi reserves the right to terminate the contract, in whole or
in part for its (SAI New Delhi’s) convenience, by serving a written notice on
the Contractor at any time during the period of the contract. The notice
shall specify that the termination is for the convenience of the SAI, New
Delhi. The notice shall also indicate inter-alia, the extent to which the
Contractor’s performance under the contract is terminated, and the date
with effect from which such termination will become effective. The
contractor will not be entitled to claim any compensation against such
termination. However, while terminating the contract, if any payment is
due to the contractor for services already performed in terms of contract,
the same would be paid to it as per the contract terms.
47) Resolution of disputes
48.1 If dispute or difference of any kind shall arise between the SAI New Delhi and the agency in connection with or relating to the contract, the parties shall make every effort to resolve the same amicably by mutual consultations.
48.2 If the parties fail to resolve their dispute or difference by such mutual consultations, within twenty-one days of its occurrence, then, either the SAI New Delhi or the agency may give notice to the other of its intention to commence arbitration, as hereinafter provided. The applicable arbitration procedure will be as per the Arbitration and conciliation Act, 1996. In the case of a dispute or difference arising between the SAI and agency relating to any matter arising out or connected with the contract, such dispute or difference shall be referred to the Sole Arbitration, and Arbitrator appointed by the Director General, Sports Authority of India, New Delhi. The award of the Arbitrator will be final and binding on the parties to the Contract.
48.3 Venue of Arbitration: The venue of arbitration shall be the place from
where the Contract has been issued, i.e., New Delhi.
49) Jurisdiction
The courts at New Delhi hall have the exclusive jurisdiction to try all
disputes, if any, arising out of this contract between the parties.
50) Applicable Law
The contract shall be governed by and interpreted in accordance with the
laws of India for the time being in force.
