Discussion of proposed floodwall servitudes

on Port of New Orleans property

1) Almonaster to France Road Terminal (France Road

Floodwall)

2) Jourdan Rd. eastward to Elaine St. (Citrus Back Levee)

� Port has enjoyed decades of great working relationships with Orleans Levee District, USACE, and recently Southeast Flood Protection Authority

� Port owns much of the property under and adjacent to floodwalls and levees in the New Orleans area

� Previous agreements between agencies were general, but worked well until Hurricane Katrina

� Post-Katrina, USACE requested emergency access to Port property to improve the levees in the France Road area� Result: Undocumented locations of floodwall and levee areas� Inconsistent servitude widths have been established over time ,

ranging from 30’ – 62’ from the toe of levee, encumbering Port of New Orleans property from potential development/use

� Becomes a challenge for maintenance responsiblity

� In an effort to induce further maritime economic development, the Port’s Board has considered sales or transfers of its land.

� Lack of recorded, documented floodwall and levee servitudes is delaying some projects, as:o floodwalls and levees, and their servitude boundaries,

must be clarified for: � Surveys

� Appraisals

� Purchaser’s title insurance

� Uses allowed within servitude

� Maintenance responsibilities

� Access

� Previous/Existing improvements allowed/disallowed

� Create servitude document to memorialize

and protect rights of: ▪ Orleans Levee District

▪ Southeast Flood Protection Authority East

▪ United States Army Corps of Engineers

▪ Port of New Orleans

▪ New Orleans Public Belt Railroad

� Consistent 15’ floodwall servitude (from toe of levee)

throughout area

� Establishes rights for Port of New Orleans and New

Orleans Public Belt Railroad in the area

� Acknowledges existence of current site conditions and

improvements

� Access rights & Maintenance obligations

Almonaster to France Road Terminal “France Road Floodwall”

� Survey and Servitude document – both complete, pending final legal signoff

� Board approval from SLFPAE may be necessary to memorialize the servitude agreement

� Once approved by SLFPAE, will be taken to Board of Commissioners of the Port of New Orleans for consideration and approval

� SLFPAE and Port sign servitude document

Citrus Back Levee (Jourdan Rd. to Elaine St.)� Current ROW line is inconsistent, varying

from around 30’ to 215’� High demand for additional developable land

in area for rail track, industrial improvements, etc.

� Would result in less maintenance responsibility for OLD

� Drawings showing existing vs. proposed levee ROW – 16.95 acres difference

Citrus Back Levee (Jourdan Rd. to Elaine St.)

� Survey and Servitude document – need to be developed

� Board approval from SLFPAE may be necessary to memorialize the servitude agreement

� Once approved by SLFPAE, will be taken to Board of Commissioners of the Port of New Orleans for consideration and approval

� SLFPAE and PONO sign servitude document
