WHO IS SURS?ThegovernorandGeneralAssemblyfoundedtheUniversityRetirementSystemin1941asanadministratorofben-efitsforemployeesoftheUniversityofIllinois.Inthefollowingyears,theSystemgrewtoincludeotheruniversities,collegesandaffiliatedagenciesthroughoutthestate.In1963,theSystemadopteditscurrentname,StateUniversitiesRetirementSystem(SURS).SURSemploysapproximately127peopleinitsChampaignandNapervilleofficesandprovidesretirement,survivor,disabilityanddeathbenefitstomorethan232,000membersthroughouttheworld.
MEMBERSHIPSURSservesadiversegroupofemployeeswithoccupationsrangingfromprofessorsandteacherstoclerical,buildingserviceworkersandgroundskeepers.
SURS Members do not Participate In Social SecurityUnlikemanyotherpublicpensionsystems,SURSisthesolesourceofretirementincomeforitsparticipants.Thestate/employerdoesnotcontributetoSocialSecurityontheemployee’sbehalf,andthereisnocoordinatedbenefitforSURS-coveredemploymentfromSocialSecurityuponretirement.Inaddition,retireeswhomayqualifyforSocialSecuritybenefitsfromother,non-SURScoveredemployment,maybeaffectedbytheWindfallEliminationProvisionortheGovernmentPensionOffset,resultinginanoffsetoftheirSocialSecuritybenefit.
Benefits PaidSURSdefinedbenefitplanbenefitpaymentsforfiscalyear2017were$2.38billion.Theaveragemonthlyretire-mentannuitywas$3,349.40asofMarch1,2018.
BOARD OF TRUSTEESTheSURSBoardofTrustees iscomprisedof11members: fourappointedby thegovernor, fourcontributingmemberselectedbythecontributingmembersofSURS,twoannuitantselectedbytheannuitantsofSURSandthechairoftheIllinoisBoardofHigherEducation.SURSwillholdaboardelectionApril2throughMay1,2018,tofilltheexpiringtermsoftwoactive-membertrusteepositions.Oneannuitantcandidate,currentTrusteeJohnEngstrom,completedthenecessarypetitionstobe eligiblefortheopenannuitant-trusteeposition.SURSwillnotconductanelectionforthatseat.TrusteeEngstromwillcontinueservingontheboard.

SURS RETIREMENT PLANSTheStateUniversitiesRetirementSystemofIllinois(SURS)providesretirement,disability,deathandsurvivorbenefitstoeligibleSURSparticipantsandannuitants.SURSmembersmustchooseoneofthreeretirementop-tions:theTraditionalBenefitPackage,thePortableBenefitPackage,ortheSelf-ManagedPlan(SMP).Thechoiceispermanentandcannotbechanged.Informationissenttoallnewmembers,alongwithanelectionform,tohelpthemmaketheirchoice.Ifanewmemberfailstochoosewithinsixmonths,theywillbepermanentlyenrolledintheTraditionalBenefitPackage.
Defined Benefit PlansTheSURSTraditionalBenefitPackageisthehistoricalSURSdefinedbenefitretirementplan.Until1998,itwastheonlySURSplanavailable.Itprovideslifetimeretirementbenefitsandprovidesforasurvivorbenefitatnoadditionalcost.However,theseparationrefundfeatureisnotgenerous.TheSURSPortableBenefitPackageisalsoadefinedbenefitretirementplanthathasmuchincommonwiththeTraditionalBenefitPackage.ItprovidesamoregenerousseparationrefundifyouleavetheSystem.However,theprovisionsforsurvivorbenefitsrequireareductiontotheretirementanddeathbenefits.
Defined Contribution PlanTheSURSSelf-ManagedPlan(SMP)isadefinedcontributionplanthatestablishesanaccountinyournameintowhichyourcontributionsandtheemployer(stateofIllinois)contributionsareplaced.Youdecidehowyourac-countbalancewillbeinvested,selectingfromavarietyofmutualfundsandvariableannuities.
Public Act 96-889Gov.QuinnsignedSenateBill1946(PublicAct96-889)intolawonApril14,2010.TheresultingchangestotheIllinoisPensionCodemodifySURSbenefitsforemployeeshiredonorafterJan.1,2011.MembershiredonorafterJan.1,2011,areconsideredTierIImembers.MembershiredbeforeJan.1,2011,areTierImembers.SeethecomparisonchartonPage5fordetails.
Public Act 98-599Gov.QuinnsignedSenateBill1(PublicAct98-599)intolawonDec.5,2013.TheresultingchangestotheIl-linoisPensionCodemodifySURSbenefitsforTierImembers,effectiveJune1,2014.OnMay14,2014,CircuitJudgeJohnBelzgrantedatemporaryrestrainingorderandapreliminaryinjunctionstoppingtheimplementationofPA98-599.Inaccordancewiththeorder,SURScontinuedtoadministercontribu-tionsandbenefitsasthelawexistedpriortoamendmentbyPA98-599untilotherwiseorderedbythecourt.OnNov.21,2014,JudgeBelzenteredafinaldeclaratoryjudgmentthat“PublicAct98-0599isunconstitutionalandvoidinitsentirety.”Thecourtalsoorderedthatthepreliminaryinjunctionpreventingstatedefendants(in-cludingSURS)fromimplementingtheActsinceMay14,2014,becomepermanent.TheIllinoisAttorneyGeneralappealedthecircuitcourt’srulingandonMarch11,2015,defendedthelawbeforetheIllinoisSupremeCourt.OnMay8,2015,theIllinoisSupremeCourtruledPA98-599unconstitutional.
Public Act 100-23TheIllinoisGeneralAssemblyonJuly6,2017,successfullyvotedtooverrideGov.Rauner’svetoandpassedSB42(PublicAct100-23)thatmandatesSURS,SERSandTRStocreateanoptionalhybridretirementplanthatwhenimplementedwillbeavailabletocurrentTierIImembersandfuturenewhires.ThenewplanwillnotaffectbenefitsofTierImembers,retireesorSMPmembers.SB42containstwochangesthattakeeffectinFiscalYear2018:
• Itrequiresemployerstopaytheemployernormalcostontheportionofanemployee’searningsthatisinexcessofthegovernor’ssalary($177,500inFY2018).
• Itrequiresthecostorsavingsofanychangeinactuarialassumptionsmadesincethe2012valuationtobe“smoothed”(orimplementedinequalannualinstallments)overafive-yearperiodfromwhenthechangefirstapplied.
SB42requiresthecreationofanoptionalhybridplan,whichwillbecomeeffectiveonafuturedatedeterminedby

theSURSBoardofTrustees.Theoptionalhybridplancontainscomponentsofadefinedbenefitplanandade-finedcontributionplan. Individualswhofirstbecomeparticipants on or after the implementation date willhavetheoptionofchoosingbetweentheTraditionalde-finedbenefitplan,thePortabledefinedbenefitplan,theSelf-ManagedPlanortheoptionalhybridplan.CurrentTierIIparticipantswillhavetheoptiontoirrevocablyelecttoparticipateintheoptionalhybridplaninsteadofaTierIIplan.Underthedefinedbenefitportionoftheoptionalhybridplan:
• ThepensionableearningslimitistheSocialSe-curityWageBase.
• The final average salary is the average salaryduringthelast10yearsofservice
• Retirementcanbeginnoearlierthanage67with10yearsofservicecredit.
• Retirementannuitiesarecalculatedbymultiply-ing1.25percentbyeachyearof servicecreditandthefinalaveragesalary
• Automatic annual increases are applied begin-ningoneyearafterretirementandarecalculatedat½ofthepercentageincreaseintheConsumerPriceIndex-W.
Employeescontributethelesserof6.2percentofpayorthetotalnormalcosttothedefinedbenefitportionoftheoptionalhybridplanandaminimumof4percentofpaytothedefinedcontributionportionoftheoptionalhy-bridplan.Employerscontributebetween2-6percentofpayforeachemployeewithatleastoneyearofservicewith theemployer to thedefinedcontributionportionoftheoptionalhybridplan.Employersalsocontributetheemployernormalcostforeachemployeewhopar-ticipatesintheoptionalhybridplanorwhoparticipatesinTier II insteadof theoptionalhybridplan,plusanamounttoamortizetheunfundedactuarialaccruedli-abilityattributabletothedefinedbenefitsofsuchem-ployees.Forfiscalyearsthroughfiscalyear2020,thestatemakesadditionalcontributionstoSURSequalto2percentofthetotalpayrollofeachemployeewhopar-ticipatesintheoptionalhybridplanorwhoparticipatesinTierIIinsteadofintheoptionalhybridplan;theem-ployerpaysthiscostbeginninginfiscalyear2021.

House Bill 6021 – Election to Restore Survivors Insurance Benefits
Public Act 99-0682Sponsors–Rep.SamYinglingandSen.DanielBissHB6021allowseligibleSURSretireestorestoretheirsurvivorsinsurancebenefitsbymakingaone-time,irrevo-cableelectiontorepaytheirsurvivorsrefundoradditionalannuity,alongwithinterestcompoundedattheactuari-allyassumedrateofreturn(7.25percent),toSURS.ThecompoundedinterestappliesfromthedateofissuanceoftherefundtotheSURSretiree,orthedateofissuanceofeachadditionalannuitypaymenttotheSURSretiree,untilthedateofrepaymenttoSURS.FullrepaymentmustbemadetoSURSbytheearlierof:24monthsafterthedateoftheelectionorthedateoftheretiree’sdeath.Eligibleretireeshaveoneyear,beginningDecember29,2016,toirrevocablyelecttorestoretheirsurvivorsinsurancebenefits.UnderHB6021,aneligibleSURSretireemustmeetthefollowingrequirements:
• HeorsheretiredbeforeJune1,2011,andreceivedarefundoradditionalannuityequaltotheamountofhisorhersurvivorsinsurancecontributions;and
• Heorsheisapartytoa:(1)civilunionorlegalrelationshipthatisrecognizedasacivilunionormarriageonorafterJune1,2011;(2)marriageonorafterFeb.26,2014;or(3)marriage,civilunion,orotherlegalrelationshipthatwasnotrecognizedinIllinoisasacivilunionormarriageuntilJune1,2011,amarriageuntilFeb.26,2014,orboth.
HB6021becameeffectiveJuly19,2016,withtheelectionperiodbeingDec.29,2016,throughDec.28,2017.
House Bill 6030 – Deceased Annuitant Identification Process
Public Act 99-0683Sponsors–Rep.DebConroyandSen.ThomasCullertonHB6030requireseachpensionfundandretirementsystemundertheIllinoisPensionCode,exceptfordownstatepoliceandfirefighterspensionfunds,todevelopandimplement,byJune30,2017,aprocesstoidentifydeceasedannuitants. Specifically,HB6030requiresthepensionfundorretirementsystemtocheckfordeceasedannuitantsatleastoncepermonthandtousecommonmethodstoidentifydeceasedpersons,including:
• Theuseofathirdpartyentitythatspecializesinidentifyingdeceasedpersons;• TheuseofdataprovidedbytheSocialSecurityAdministration;• TheuseofdataprovidedbytheIllinoisDepartmentofPublicHealth’sOfficeofVitalRecords;or• Theuseofanyothermethodcommonlyusedbyotherstatestoidentifydeceasedpersons.

HB6030alsoamendstheVitalRecordsActtorequireanyinformationcontainedinthestatevitalrecordstobemadeavailable,atnocost,toanypensionfundorretirementsystemundertheIllinoisPensionCodeforadmin-istrativepurposes.HB6030becameeffectiveJuly9,2016,withtheprocesstoidentifydeceasedannuitantsrequiredbyJune30,2017.
Senate Bill 2156 – SURS Participation, Basic Compensation, and Earnings Limitations
Public Act 99-0897Sponsors–Sen.BillCunninghamandRep.KellyM.BurkeSB2156makesthefollowingchangesforemployees:
• It excludes individualswhobegin employmentwith the followingemployersonor after Jan. 1, 2017,fromparticipationunderSURS:certainassociationsofcommunitycollegeboards,theAssociationofIl-linoisMiddle-GradeSchools,theIllinoisAssociationofSchoolAdministrators,theIllinoisAssociationforSupervisionandCurriculumDevelopment,theIllinoisPrincipalsAssociation,theIllinoisAssociationofSchoolBusinessOfficials,theIllinoisSpecialOlympicsandanyentitynotdefinedasanyemployer.ItalsorequirestheSURSBoardofTrusteestopromulgaterulestodeterminewhetherapersonisanemployeecoveredunderSURSandgivestheboardfinaldeterminationastowhetherapersonisanemployeecoveredunderSURS.
• Itexcludesamountsforbonuses,housingallowances,vehicleallowances,socialclubduesandathleticclubduesfromthecalculationofpensionsforemployeeswhofirstbecomeparticipantsofSURSonandafterJan.1,2017.
• Itprovidesthatifaparticipant,beneficiary,orannuitantfailstoprovideanyinformationnecessaryforthecalculation,payment,orfinalizationofaretirement,survivors,disability,ordeathbenefitwithin90daysoftheSystem’srequestforsuchinformation,thentheSystemmayceaseprocessingthebenefitandmaynotpayanyadditionalbenefitpaymentuntiltherequestedinformationisprovided.
SB2156makesthefollowingchangesforemployers:• ItrequiresanemployertorespondtoarequestfromSURSforanyinformationnecessaryfortheproper
administrationoftheSystem(includingemploymentcontracts)within90calendardaysandtorespondtoarequestpursuanttoanemployerauditconductedbytheSystemwithin60calendardays.
SB2156alsomakes thefollowingchangesrelated tofurloughsandvoluntarypayreductionsexperiencedbypublichighereducationemployees:
• ItallowsaSURSparticipanttoestablishserviceandearningscreditforperiodsoffurlough,beginningonorafterJuly1,2015,andendingonorbeforeJune30,2017.Theparticipantmustpaytherequiredem-ployeeandemployercontributions,inadditiontocompoundedinterestattheactuariallyassumedrateofreturn(7.25percent),toestablishtheserviceandearningscredit.Thecompoundedinterestappliesfromthedateoffurloughuntilthedateofpayment.ApplicationtotheSystemmustbemadebeforeDec.31,2018.

• ItrequiresSURStoincludeearningsthatwouldhavebeenpaidtoaparticipanthadheorshenottakenaperiodoffurloughoravoluntarypayreductioninlieuoffurloughbeginningonorafterJuly1,2015,andendingonorbeforeJune30,2017forthepurposesofdeterminingwhethertheemployermustpaythepres-entvalueofearningsincreasesabove6%duringthefinalrateofearningsperiodtoSURS.
• Finally,SB2156codifiesthedefaultinvestmentfundundertheSelf-ManagedPlan.SB2156becameeffectiveJan.1,2017.

CONSEQUENCES OF UNDERFUNDING
HistoricalunderfundingofthefivestateretirementsystemshaspositionedIllinoisasoneoftheworstinthenationinpensionfunding.AsofJune30,2017,unfundedliabilitiesforthefivestateretirementsystemstotaledmorethan$129billionandthesystemswere39.8percentfundedbasedonamarketvalueofassets.SURSunfundedactuarialliabilitiestotaled$23.3billion,andSURSwas44.4percentfundedbasedonanactuarialvalueofassets.
Pensionfundinghasasignificant impactonthefiscalstabilityof thestate.Continualfundingof thesystems’certifiedcontributionsensuresstableincreasesincontributionsfromyeartoyear.
Failuretoappropriateanyyear’scertifiedcontributionincreasesthesystems’unfundedliabilitiesandincreaseslong-termcoststothestate.Bondratingagenciescontinuallyhighlightthesystems’unfundedliabilitiesasreasonfordowngrades in the state’sbond rating.Lowerbond ratings significantly impact the state’s cost of issuingpotentialdebt.
